The rise of managerialism within healthcare systems has been noted globally. This paper uses the findings of a scoping study to investigate the management of poor performance among nurses and midwives in the United Kingdom within this context. The management of poor performance among clinicians in the NHS has been seen as a significant policy problem. There has been a profound shift in the distribution of power between professional and managerial groups in many health systems globally. We examined literature published (...) between 2000 and 10 to explore aspects of poor performance and its management. We used Web of Science, CINAHL, MEDLINE, British Nursing Index, HMIC, Cochrane Library and PubMed. Empirical data are limited but indicate that nurses and midwives are the clinical groups most likely to be suspended and that poor performance is often represented as an individual deficit. A focus on the individual as a source of trouble can serve as a distraction from more complex systematic problems. (shrink)

Over a period of 10 years following the fall of the Berlin Wall in 1989, the author conducted interviews with 18 women on four separate occasions to determine their response to unification. The fourth set of interviews, which took place during the spring of 1999, revealed that the women had adopted one of three different ways of adapting to unification. In the first and largest group were women who were more engaged, active and upbeat about their new lives. A second, (...) smaller group consisted of women who were frustrated, discouraged and bitter and had turned inward. Women in the third group were involved in their new lives but exhausted by their efforts to maintain their involvement. The most significant factor in defining these women's different experiences appears to have been the ability to maintain a sense of community. These biographies show that women who successfully adapted to unification held onto the community they had enjoyed in the GDR or else created it anew, while those who were discouraged and bitter had lost connection with the wider community. Evolutionary Transitions in Individuality have been responsible for the major transitions in levels of selection and individuality in natural history, such as the origins of prokaryotic and eukaryotic cells, multicellular organisms, and eusocial insects. The integrated hierarchical organization of life thereby emerged as groups of individuals repeatedly evolved into new and more complex kinds of individuals. The Social Protocell Hypothesis proposes that the integrated hierarchical organization of human culture can also be understood as the outcome of an ETI—one that produced (...) a “cultural organism” from a substrate of socially learned traditions that were contained in growing and dividing social communities. The SPH predicts that a threshold degree of evolutionary individuality would have been achieved by 2.0–2.5 Mya, followed by an increasing degree of evolutionary individuality as the ETI unfolded. We here assess the SPH by applying a battery of criteria—developed to assess evolutionary individuality in biological units—to cultural units across the evolutionary history of Homo. We find an increasing agreement with these criteria, which buttresses the claim that an ETI occurred in the cultural realm. (shrink)

Battle lines have been drawn over involuntary treatment. On one side, there are those who oppose involuntary psychiatric treatments under any condition. Activists who take up this cause often don't acknowledge that psychiatric symptoms can render people dangerous to themselves or others. They also don't allow for the idea that the civil rights of an individual may be at odds with the heartbreak of a caring family. On the other side are groups pushing for increased use of involuntary treatment. These (...) proponents are quick to point out that people with psychiatric illnesses often don't recognize that they are ill, which (from their perspective) makes the discussion of civil rights moot. They may gloss over the sometimes dangerous side effects of psychiatric medications, and they often don't admit that patients, even after their symptoms have abated, are sometimes unhappy that treatment was inflicted upon them. In Committed, psychiatrists Dinah Miller and Annette Hanson offer a thought-provoking and engaging account of the controversy surrounding involuntary psychiatric care in the United States. They bring the issue to life with first-hand accounts from patients, clinicians, advocates, and opponents. Looking at practices such as seclusion and restraint, involuntary medication, and involuntary electroconvulsive therapy--all within the context of civil rights-- Miller and Hanson illuminate the personal consequences of this controversial practice through voices of people who have been helped by the treatment they had as well as those who have been traumatized by it. The authors explore the question of whether involuntary treatment has a role in preventing violence, suicide, and mass murder. They delve into the controversial use of court-ordered outpatient treatment at its best and at its worst. Finally, they examine innovative solutions--mental health court, crisis intervention training, and pretrial diversion--that are intended to expand access to care while diverting people who have serious mental illness out of the cycle of repeated hospitalization and incarceration. This is the conundrum that gives rise to the issue of tax avoidance: Although governments always seem to lack sufficient funds to support the needs of society, tax codes are often written that offer “a way out” of paying taxes for some but not all constituents. The ways out are referred to as loopholes that allow taxpayers to avoid taxes. This paper first defines the basic terms of tax avoidance and tax evasion and then offers an ethical review of the (...) morality of aggressive tax avoidance. Aggressive tax avoidance is then addressed in relationship a corporate entity’s tone at the top. The conclusion is drawn that use of the letter of the law to avoid payment of taxes sorely needed by governments for the good faith provision of public goods and services is ethically unacceptable. Several suggestions for change are provided, including a new financial statement disclosure and the possibility of a published corporate ethics report. (shrink)

In the following, I show that where Williams restricts LEG to generating only minimal political protections, seeking (...) to isolate his account of political legitimacy from a range of liberal principles, this is neither internal to, nor necessarily demanded by, the specifically political account of LEG. This two-part study analyzed some of the ethical choices made by founding entrepreneurs during the creation and development of their ventures in order to identify the areas in which founding entrepreneurs must make decisions related to ethics or social responsibility during venture creation and development. Content analysis was used to identify decisions with ethical components and/or implications from in-depth interviews with 10 successful business founders. The research for part one of the study was guided by the following research question: In (...) what areas must entrepreneurs make decisions with ethical and/or social responsibility implications during new venture creation and development? The authors identified four distinct categories of decisions where ethical or social responsibility components exist: (1) individual entrepreneurial values-related decisions, (2) organizational culture/employee well-being decisions, (3) customer satisfaction and quality decisions, and (4) external accountability decisions. In the second part of the study, the decisions identified in part one were analyzed using a framework derived from prior research in ethics. This framework was developed from the work of Kant (1964) who theorized about human morals and Rawls (1971) who developed theories about justice. Part two of the study was guided by the following research questions: Do entrepreneurs have values and ethics similar to those held by society in general? If they don’t, how do their values and ethics differ? The comparison revealed that the ethics and/or values that the entrepreneurs either explicitly or implicitly acknowledged were in fact similar to those of society in general. (shrink)

There is growing recognition that good ethics can have a positive economic impact on the performance of firms. Many statistics support the premise that ethics, values, integrity and responsibility are required in the modern workplace. For consumer groups and society at large, research has shown that good ethics is good business. This study defines and traces the emergence and evolution within the business literature of the concepts of values, business ethics and corporate social responsibility to illustrate the increased emphasis that (...) has been placed on these issues over time. Two organizations that have successfully dealt with these issues were analyzed to identify the links among values, ethics, and corporate social responsibility as they are incorporated into the culture and management of a firm. Using samples from the U.S. and Puerto Rico, we examine cross-cultural differences in cultural value dimensions, and relate these to act and rule utilitarian orientations, and ethical decision making of business professionals. Although these places share the same legal environment, culturally they are distinct. In addition to tests of between-group differences, a model in which utilitarian orientation mediates the influence of cultural values on ethical decisions was evaluated at the individual level of analysis. Results indicated national culture differences on three (...) cultural values, but no between-group differences on utilitarian orientations and ethical decisions. Significant indirect effects were found; act utilitarian orientation mediated the effects of two values activity orientation and universalism on ethical decision making. A corresponding study of Information Technology (IT) professionals’ ethics has led to the conclusion that good ethics in the development and uses of information technology correspond to the basic business principle that good ethics is good business. Ergo, good business ethics practiced by IT professionals is good IT ethics and vice versa. IT professionals are professionals in businesses; (...) a difficulty presented to these professionals, however, is the number and diversity of codes of ethics to which they may be held. Considering the existence of several formalized codes of ethics prepared by various IT professionals’ associations, a more harmonized approach seems more reasonable. This paper attempts to present a review of the purpose of codes of ethics, the persons who should be covered by such codes and to organize codes of ethics for business in general and IT professionals in particular and to make the argument that, once again, good ethics is good business practice, regardless of the profession or occupation concerned. While women are most likely to teach young students in classroom settings, men are most likely to teach older students in all settings, but most particularly in wind/percussion ensembles.1 Despite gender-affirmative employment practices, men constitute a large majority among band directors at all levels.2 At the (...) postsecondary level in the U.S., women constitute less than 10%.3 In all cases and all levels, the vast majority of band directors are white. Occupational segregation inhibits the development of individuals' careers as well as the development of the profession as individuals choose or are hired for positions based on their gender and/or race rather than their abilities.In terms of women university band directors, researchers have investigated employment trends,4 personal and occupational characteristics,5 occupational role models, and professional identity.6 Their findings generally have supported the hypotheses that historical precedent, traditional socialization, discrimination, segregation, and lack of role models contribute to their persistently low percentage as band directors. Longitudinal studies7 demonstrate that the percentage of women band directors has not increased significantly, and may be actually [End Page 147] declining after thirty years of enforcing affirmative action laws, which would suggest that these interventions have not provided the basis for enacting change in the profession. Further, change does not seem possible if members of the profession do not understand what causes the situation to persist. For example, while the College Band Directors National Association has supported the Linda A. Hartley and Deborah A. Sheldon study,8 their concern seems to be in only identifying the extent of the situation with the intention of increasing the number of women and non-white individuals who are band directors within the profession as it currently is constructed. This empirical approach is inadequate because it addresses neither the values held by members of the profession, nor its structure, which as previous research indicates, is poorly understood and must change to make possible meaningful increases in the number of women and non-white people.The profession of conducting university bands exists within the profession of music education in general, which, of course, exists within the profession of music. Clearly, one cannot be adequately understood without placing it in the context of the others. What is needed, then, are richer, more substantive, and meaningful understandings of the professions in general and of specific questions within them in particular, as they may provide the basis on which change can be possible. In addition to addressing the issue of persistent occupational gender and racial segregation, questions that may be addressed include positionalities9 of bands in the music education profession, the relationship of performance/conducting to the music profession, and the role of the musician in society in general. In order to accomplish this, I propose an analytical method that is both postmodern and feminist, and in which the philosophical figuration of the nomad, as explicated by Rosi Braidotti,10 is central.Postmodern/Feminist AnalysisDescribed variously as a "philosophical perspective,"11 a "sensibility,"12 and a historical moment,13 postmodernism resists definition. It may be understood as a way of perceiving the world that accepts and even embraces contradictions and uncertainties while rejecting commonly accepted cultural beliefs and practices, including humanist understandings of identity, representation, and the subject. This is a "postmodernism of resistance"14 that interrogates cultural practices, focusing on what is unexpected, marginalized, and silenced, opening spaces for change. In contrast, analysis based on modernism is constrained by binary oppositions that inscribe the positionalities of social groups. These oppositions are exemplified by Subject/Other (for example, male/female, reason/emotion) and consist of asymmetrical power relations in which the former is privileged over the latter, and the latter is defined in terms of not-the former. As resident physicians practicing Internal Medicine in hospitals within the USA, we are confronted on a daily basis with patients who wish to leave the hospital floor to smoke a cigarette. While many physicians argue that hospitals should do everything in their power to prevent patients from smoking, we argue that a more comprehensive and nuanced approach is needed. In part 1 of this perspective piece, we outline the various forms of smoking bans in hospital settings, applauding the development of (...) indoor smoking bans while questioning the move towards stricter, campus-wide smoking bans. In part 2, we turn to traditional biomedical ethics to guide our approach to the hospitalised patient who smokes. This approach, which is informed by our backgrounds in harm reduction and medical anthropology, takes into account the lived realities of patients and acknowledges the complicated sociohistorical contexts of tobacco use. Purpose The purpose of this paper is to review current practice in sharing and mining medical data revealing benefits, costs and ethical issues. Based on stakeholder perspectives and values, the authors create an ethical code to regulate the sharing and mining of medical information. Design/methodology/approach The framework is based on a review of academic, practitioner and legal research. Findings Owing to the inability of current safeguards to protect consumers from risks related to the disclosure of medical information, the authors develop (...) a framework for ethical sharing and mining of medical data, security, transparency, respect, accountability, community and quality, which espouses security, transparency, respect, accountability, community and quality as the basic tenets of ethical data sharing and mining practice. Research limitations/implications The STRACQ framework is an original, previously unpublished contribution that will require modification over time based on discussion and debate within and among the academy, medical community and public policymakers. Social implications The framework for sharing borrows from the Fair Credit Reporting Act, allowing the collection and dissemination of identified medical data but placing strict limitations on use. Following this framework, benefits of shared and mined medical data are freely available with appropriate safeguards for consumer privacy. Originality/value Mandates for adoption of electronic health-care records require an understanding of medical data mining. This paper presents a review of data mining techniques and reasons for engaging in the practice of identifying benefits, costs and ethical issues. Culture is the most difficult thing about an organization to change in a lasting way. Our paper is predicated upon the idea that better ethics leadership through change is the foundation to more successful implementation of change. Ethical culture will enable the firm to initiate the change process from a stronger position: the obstacles to change such as mistrust, fear of uncertainty, failure of communication and empowerment will be easier to overcome in an atmosphere pursuing the ethically correct approach, combining (...) ethical leadership with an ethical corporate culture. Our idea goes one step beyond the virtuous change circle by incorporating a series of check points a leader can reference to stay on a course of change management based in good ethical principle that will lead to effective change. Our model incorporates the concept of values into the management of change; this allows for a more comprehensive approach to change management by the utilization of well-known change management principles used in conjunction with basic principles of ethics. We argue that the change leader can depend on this more comprehensive approach for a better assurance of ethical and therefore more effective change. Our idea also would be effective regardless of the type of change confronting the organization and/or the leaders of the firm. Our point is that, while change is by its nature hard and there is an inclination to resist change, with ethical change management, the firm has a better chance of success. (shrink)

For one thing, he was clearly no great mathematician himself. His sympathetic biographer Nicholas Nancel related that Ramus would spend the mornings being coached in mathematics by a team of experts he had assembled, and in the afternoon would lecture on the very (...) same subjects.1 But there can be no doubt that Ramus held mathematics in particular esteem and even played a crucial role in linking philosophical discourse to mathematics and in promoting the use of quadrivial reasoning in the study of the natural world.2The origins for his enthusiasm for mathematics are to be found in his account of the nature of the arts and critique of the curriculum of the universities. From his earliest career, Ramus was a logician and remained one in all his works, whether writing on mathematics or Virgil, and he conceived [End Page 63] of all the arts, especially mathematics, as unchanging structures of necessarily true propositions—not prima facie a position which lends itself to notions of historical change and development.3 His career as a historian of mathematics, I will argue, was directed by problems that arose in his theoretical understanding of mathematics as he began to immerse himself in the sciences of the ancient world.Ramus and the Reform of DialecticRamus set out his fundamental logical positions in his very first printed work, the Dialecticae institutiones (Education in Dialectic) of 1543, a contribution to the ongoing humanist attack on scholastic logic, in which Ramus rehearsed many of the commonplace criticisms of the university dialectic. Humanists complained that logic no longer concerned itself with real human reasoning; instead, it had become a discipline studied for its own sake, using its own incomprehensible jargon, and was of no practical interest. The new humanist dialectics of Lorenzo Valla and Rudolph Agricola attempted to teach the kind of practical reasoning useful for composing a speech or letter, and they borrowed extensively from rhetorical works of Cicero and Quintilian to develop a highly rhetoricized logic. Questions about the formal validity of arguments were of little interest; what mattered was whether the arguments were persuasive.4In his Dialecticae institutiones, Ramus took this humanist reformulation of dialectic a step further. Dialectic—or, in fact, any art or science—consisted of nature, doctrine, and exercise. The natural workings of the mind formed the most significant element. Doctrine was nothing more than a record of natural reasoning; in importance it paled next to nature and practice.5 The logic of the universities bore no resemblance to the true, natural dialectic, as he argued at length in the companion volume to the Institutiones, the innocuously titled but exuberantly offensive Aristotelicae animadversiones [End Page 64] (Observations on Aristotle).6 The question, then, remained: how can we gain access to this "natural reasoning"?Ramus's answer was surprising. He asks us to find a group of men—not scholars, but completely uneducated vineyard workers. Question them about the coming year: the fertility of the soil, the quality and quantity of the crop. "And then," he writes "from their minds as from a mirror an image of nature will be reflected."7 In the reasoned replies of these uneducated men, says Ramus, we discover every part of logic needed for any purpose, whether everyday discourse or composition of poetry: the invention of arguments, the assessment of their truth and their proper and orderly presentation. Other humanists had praised man's natural logical faculties, elevating them over artificial technique, but Ramus was the first to look beyond the walls of the university and the writings of the ancients to find natural dialectic at work.If even the uneducated have some possession of the arts, then the arts taught at the university should do no more than clear away the misleading junk in the mind, and allow its natural clarity to shine through.8 Logic should be easy to learn—not because this is a pedagogic ideal, but from the very nature of the art. The purpose of this article is to explore the law related to identity theft, to review corresponding rights, and responsibilities of stakeholders involved in identity theft and to formulate a system of best practices businesses could engage in to prevent or reduce identity theft threats. Utilizing two ethical frameworks based on deontological approaches, the authors conclude that there should be a well-defined management scheme to prevent identity theft, which is easy to comprehend and comply with for all stakeholders. They are correct that punctuated equilibria apply to sexually reproducing organisms and that morphological evolutionary change is regarded as largely (if not exclusively) correlated with speciation events. However, they err in suggesting that we attribute stasis strictly to "developmental constraints," which represent only one of a set of possible mechanisms that we have suggested for the causes of stasis. Others include habitat tracking and the internal structure of species themselves [for example, (2)].

This book is more than a cross-examination of Socrates: it is a carefully wrought indictment. Beversluis, unlike Socrates' historical adversaries Anytus and (...) Meletus, brings philosophically serious charges against Socrates by offering a rigorous defense of the interlocutors in Plato's early dialogues, the so-called Socratic dialogues. In so doing, he charts new territory in the vast area of recent analytic scholarship on Plato.According to traditional readings, Socrates deploys his elenchus to defeat his interlocutors, leaving them "either to retreat in anger or to submit to his power." Allegedly, Plato, guided by his Socratic intellectualism, draws them as distinctive, complex characters, though intellectually and thus ethically flawed. Beversluis argues against this standard view, providing sympathetic reassessment of Socrates' interlocutors. Although some previous scholars have defended some of the interlocutors, Beversluis widens the scope of the argument, leveling a scathing attack on Socratic intellectualism and its correlative method of moral education.He deals not only with Socrates' interlocutors and their logical defeats, but also with the idea of an interlocutor, and in so doing casts light on the philosophical dialogue as a genre. This emerges in the first and perhaps most original chapter, entitled "The Socratic Interlocutor," which may be of value to readers interested in philosophical writing or the philosophy of literature more generally. Here he illuminates Plato's use of the interlocutor, in part, by contrasting it with that of other philosophers who wrote in dialogue form, such as Augustine, Anselm, Hume, and Berkeley. The Socratic interlocutors are not, he says, "embodiments of error." Socrates, unlike the protagonists drawn by these other authors, does not subject them to his scrutiny in order to make them accept his beliefs, but rather to reject theirs. Beversluis claims that Plato's portrayal expresses his Socratic belief in the good life as one of bewilderment and uncertainty, a view, Beversluis rightly says, Plato will come to repudiate in his middle dialogues. Beversluis is clearly aware of the disparity between the [End Page 166] discomfort Socrates visits on his interlocutors and that which he is willing to endure himself.While many interpreters forgive Socrates' lapses of logic, Beversluis is unsparing. There is no reason, he thinks, to judge Socrates' arguments by any other criterion than their logical merits, and he therefore rejects the idea that Socrates' most fallacious arguments are valuable for psychological illumination. He also rejects Vlastos's view that only those of Socrates' arguments that are offered "seriously" should be criticized seriously. If they appear to be logical arguments, Beversluis contends, they must be assessed on their logical merits, not their rhetorical or therapeutic virtues. Some might find this approach rather arid until they see that Beversluis is warning the reader not to be dazzled by Socrates as the interlocutors are.It is widely believed that the aim of Socratic elenchus is to uncover the structure of a person's beliefs and to show that it is either internally inconsistent or at best unreflectively constructed. Beversluis's account, however, portrays Socrates as a Svengali who makes people assent to claims they would not otherwise accept. Beversluis challenges the notion of sincere assent, both as an interpretative guide to the early dialogues and as an epistemic concept.
