The theme of this issue of Ethical Perspectives is the French tradition in liberal thought, and the unique contribution that this tradition can make to debates in contemporary liberalism. It is inspired by a colloquium held at the Katholieke Universiteit Leuven in December of 2008 entitled “In Search of a Lost Liberalism: Constant, Tocqueville, and the singularity of French Liberalism.” This colloquium was held in conjunction with the retirement of Leuven professor and former Dean of the Institute of Philosophy, André (...) Van de Putte, who found much inspiration in this tradition. A revised version of his valedictory lecture from the conference serves as the final contribution to this issue. Much contemporary liberal political philosophy is currently done in conversation with a line of liberal thinkers starting with John Locke, running through Immanuel Kant and John Stuart Mill, and culminating in the work of John Rawls and his followers. The reasons for the enormous appeal of this philosophical tradition are, among other things, the combination of the central role of the intuitively appealing value of individual liberty with a strong rationalistic, universalistic, and normative character. The thread running through most of these liberal theories is a commitment to what the French liberal Benjamin Constant referred to as “the liberty of the moderns,” that is, liberty in a negative sense, as a lack of interference in one’s activity from others and from government. This focus has expanded over time to include a richer body of civil, political, social, economic and cultural rights, for instance, in the work of liberal thinkers who have tried to integrate the insights of communitarian thought and discourse ethics in their work. However, the emphasis on individual liberty in the negative sense continues to be the normative and theoretical touchstone and default position for many contemporary liberal theories. The limitation of the canon of liberal thought to the aforementioned authors and themes deprives the contemporary debate of a rich source of ideas: the French liberal tradition. Montesquieu, considered to be the father of this tradition, provides a good example of how it can enrich current debates in liberal theory. Montesquieu’s work evinces a keen eye for the dynamics of power relations and the limitations of the power of the better rational argument. His insight that power can sometimes only be checked by an equal and opposing power, so that a system of separation and balance of powers is necessary in order to preserve liberty, is reflected in the foundations of most modern democracies. Montesquieu also argues that contingent environmental, historical, social and economic conditions play a dramatic role in determining what kind of government is appropriate for a particular society. On his view, ignoring these facts when framing a government can inadvertently end in despotism. Montesquieu’s observations challenge us to reexamine some of contemporary liberalism’s universalist and rationalist claims. Benjamin Constant is most famous for his distinction between two kinds of liberty: the liberty of the ancients and the liberty of the moderns. The ancient form of liberty manifested itself in the active political participation of citizens in the ancient republic. While this form of government and decision-making was suitable for small, homogeneous city-states, Constant argues that it is impracticable for large modern nation-states. Hence, the concept of modern liberty shifts to an emphasis on the rule of law and the non-interference of the state in private matters. This form of liberty is familiar to us from contemporary liberalism – and Constant cherishes this form of freedom as much as any liberal does today. However, his position is complex: he also argues that the liberty of the ancients should not be neglected. Active political participation is needed to ensure that the government is executing its duty of preserving the modern form of liberty by publicly pointing out violations. The contemporary relevance of Constant’s work is clear when we consider the alleged “democratic deficit” that plagues the EU and international institutions such as the UN, the IMF, and the World Bank. Not only does this democratic deficit threaten the modern form of liberty by placing decision-making processes out of sight of the people, it also threatens citizens’ sense of self-respect derived from self-governance. Constant’s argument for the necessity of combining the liberty of the ancients with that of the moderns provides a fruitful resource for confronting these contemporary issues. Tocqueville’s work on liberalism benefits from his opportunity to observe a society founded on liberal democratic principles – the United States of America – in action. In his Democracy in America, he examines the social consequences, both intended and unintended, of building a society on ‘the equality of conditions’, as he defines ‘democracy’. Tocqueville sees a tension between the democratic value of equality and the aristocratic value of the rule of the best. He observes that democratic societies do not necessarily choose the best leaders and instead promote mediocrity instead of virtue, talent, and excellence. Democracy also confronts citizens with the threat of ‘soft despotism’, where a government that preserves the outer signs of the liberty of the moderns nevertheless controls the behavior of its citizens in minute detail through a system of detailed rules ostensibly aimed at their welfare. This paternalism is an even more insidious threat to liberal values than the hard variety of despotism, since it is so difficult to detect and done in the name of liberal values themselves. Taking Tocqueville’s observations seriously would add complexity to attempts to theorize about the modern social-democratic welfare state. The contributions to this issue supplement and critique mainstream liberal thought and its relation to contemporary issues through a serious engagement with the French liberal tradition. Annelien De Dijn’s contribution discusses Bertrand de Jouvenel, a lesser-known 20th Century representative of the French political tradition she terms ‘aristocratic liberalism’. This tradition has its roots in the work of Montesquieu, and emphasizes the importance of intermediary bodies, most importantly the aristocracy, in providing a check to the top-down power of despotic state authorities and the bottom-up power of revolutionary leveling tendencies, both of which threaten liberty. De Dijn situates Jouvenel in this tradition, but then indicates an important difference between his thought and that of his predecessors: his most significant work, On Power, is not only on French history, but on European history. Pointing to the enthusiastic reception of this work in the Anglophone world, she suggests that the rise of totalitarianism in Europe gave the anti-totalitarian features of aristocratic liberalism a broader appeal. Valentino Lumowa’s paper concerns Constant’s classic text, The Liberty of the Ancients Compared with that of the Moderns. Lumowa argues that in order to understand Constant’s piece, we must be aware that its two parts were written under different historical circumstances and decipher the argumentative thrust inherent in the text. Following Stephen Holmes, he argues that to understand the shift Constant made in the second part of the text, we should read it within the context of the increasing influence of the ultra-Royalists in the legislature during the Bourbon Restoration. However, in contrast to Holmes, he contends that the spirit of both civic and individual freedom, which enlivens representative system, is the backbone of the text in its unity. Demin Duan’s essay investigates an apparent ambivalence between liberal and imperialist tendencies in the work of Alexis de Tocqueville, which has already drawn some attention from Tocquevillian scholars. These interpretations of Tocqueville and his writings on empire generally agree that Tocqueville stands in a recognized tradition of liberalism, which is characterized by respect for human rights, individual freedom and a sense of universal humanism. On this standard view, Tocqueville’s support of imperialism represents nothing but an unfortunate breach of his own otherwise consistent liberal thinking. Duan’s article questions this standard position. By questioning the assumption of Tocqueville’s liberalism in the first place, he tries to gauge the influence of both the old republican tradition and the new liberal perspective on his thinking. In conclusion, he argues that Tocqueville’s overall thought, especially his notion of freedom, is very much informed by an old republican tradition. His support of French imperialism could be better understood from this perspective rather than be rendered simply as a deviation from liberal norms. Pawel Marczewski’s contribution is an attempt to show that Tocqueville’s conception of liberty transcends the divisions between negative and positive aspects of freedom. He begins by juxtaposing this conception with the opposition drawn by Constant between liberty of the ancients and liberty of the moderns. While Tocqueville and Constant shared a concern for the preservation of individual rights, Tocqueville was much more reluctant to accept the modern loss of the communal dimension of liberty. He did not accept the view that jouissances privées, private pleasures, are the main compensation that the modern world has to offer for the lost ancient treasure of political participation. The essay then looks into the relevance of Tocqueville’s standpoint for current debates between liberal defenders of negative freedom and republican advocates of freedom as non-domination. Participants on both sides of the debate seem to be so devoted to showing that their particular approach provides the best guarantees against actual and possible threats to liberty that they overlook the fact that their definitions of freedom remain significantly similar. By arguing that ‘to be free is to be guided by one’s own will’, contemporary republicans, as well as their liberal counterparts, move along the lines drawn by Constant towards private pleasures. By questioning the inevitability of this turn, Tocqueville provides us with a valuable contribution to these discussions in contemporary political philosophy. Finally, André Van de Putte’s contribution, an adaptation of his emeritus speech that closed the conference on French Liberalism, appeals to Tocqueville in order to draw attention to the importance of intermediary, dialogical bodies in mitigating the implicit despotic tendencies of the democratic drive to equality. In Tocqueville’s view, the transition from the feudal corporate inequality to democratic individual equality was not a clean break. Rather, this transition is a continual process of democratization that is driven by a desire for equality, or egalité des conditions. This dissolution of distinctions of estate, class and status has the unintended consequence of concentrating the diffuse power of these entities into a centralized state, which is responsible for ensuring the equality of all under the law. This process leaves increasingly isolated and atomized individuals to face the power of a monolithic state in defense of their freedom, and moves toward a soft, paternalistic despotism. Constant’s freedom of the moderns is not sufficient to protect individuals from this centralized power. Democracy also requires the political freedom of the ancients. Van de Putte argues for a system in which atomized individuals organize themselves into intermediary bodies that, in a Montesquieuian balance of powers, can enter into dialogue with each other and the state on more equitable terms. Van de Putte’s contribution closes with a plea for a conception of democracy as a regime of dialogue. (shrink)

Tocqueville’s imperialism has recently attracted much attention in Tocqueville studies. The challenge is to reconcile his imperialism to his liberalism. Is Tocqueville merely a classical liberal thinker who based his liberal theory on human rights and universal humanism? If so, then his support for imperialism would inevitably seem irrational and awkward. The present contribution questions this approach and argues that Tocqueville is more influenced by a republican tradition of freedom, on account of which he grants a positive value to both (...) the state as a political community and to its power as a necessary instrument in the protection of freedom. On these grounds we may explain his sense of empire from the perspective of his liberal theory, while simultaneously adjusting our understanding of his liberalism. (shrink)

During the nineteenth century, German philosophy developed from a type of general knowledge to an academic discipline at the university. Changes across disciplines to the philosophy of science and psychological surveys created new challenges for the place and purpose of philosophy in the educational system. The content of logic courses for secondary schools (Gymnasiums) was centred on the dissociation of nature and the scale of logic. In this paper, I will examine a number of projects for teaching philosophy at the (...) secondary school level from new humanism to reduce philosophical to philological concerns about different projects offered by Niethammer, Hegel and Herbart. Then, I will focus on the most successful – Adolf Trendelenburg’s Elements of Aristotle’s Logic (1st edition of 1836). This work is a compilation of the logical texts of Aristotle, and for as long as sixty years, it was an official textbook in Prussian secondary schools. The aim of the paper is to show how the rethinking of Aristotle’s heritage affected the theoretical and ideological expectations of propaedeutic courses and transformed the image of logic as a philosophical discipline. The issue of (in)compatibility between Confucianism and modern democracy, particularly in China, has attracted much debate over the decade. This article singles out the particular notion of Minben ??, which is at the center of the argument for a ?Confucian democracy?, and argues that it is fundamentally different from modern democracy. However, this does not mean that Confucianism could not be connected with modern democracy. The important question is: what exactly does it mean to ?connect? Confucianism to the modern society? (...) This book rewrites the story of classical Chinese philosophy, which has always been considered the single most creative and vibrant chapter in the history of Chinese philosophy. Works attributed to Confucius, Mozi, Mencius, Laozi, Zhuangzi, Xunzi, Han Feizi and many others represent the very origins of moral and political thinking in China. As testimony to their enduring stature, in recent decades many Chinese intellectuals, and even leading politicians, have turned to those classics, especially Confucian texts, for alternative or complementary sources (...) of moral authority and political legitimacy. Therefore, philosophical inquiries into core normative values embedded in those classical texts are crucial to the ongoing scholarly discussion about China as China turns more culturally inward. It can also contribute to the spirited contemporary debate about the nature of philosophical reasoning, especially in the non-Western traditions. -/- This book offers a new narrative and interpretative framework about the origins of moral-political philosophy that tracks how the three normative values, humaneness, justice, and personal freedom, were formulated, reformulated, and contested by early Chinese philosophers in their effort to negotiate the relationship among three distinct domains, the personal, the familial, and the political. Such efforts took place as those thinkers were reimagining a new moral-political order, debating its guiding norms, and exploring possible sources within the context of an evolving understanding of Heaven and its relationship with the humans. Tao Jiang argues that the competing visions in that debate can be characterized as a contestation between partialist humaneness and impartialist justice as the guiding norm for the newly imagined moral-political order, with the Confucians, the Mohists, the Laoists, and the so-called fajia thinkers being the major participants, constituting the mainstream philosophical project during this period. Thinkers lined up differently along the justice-humaneness spectrum with earlier ones maintaining some continuity between the two normative values (or at least trying to accommodate both to some extent) while later ones leaning more toward their exclusivity in the political/public domain. Zhuangzi and the Zhuangists were the outliers of the mainstream moral-political debate who rejected the very parameter of humaneness versus justice in that discourse. They were a lone voice advocating personal freedom, but the Zhuangist expressions of freedom were self-restricted to the margins of the political world and the interiority of one's heartmind. Such a take can shed new light on how the Zhuangist approach to personal freedom would profoundly impact the development of this idea in pre-modern Chinese political and intellectual history. The study is based on validating and exploring the effects of a mega project plan on infrastructure development and Sustainable Project Management. The CPEC has great importance to infrastructure development and economy-boosting. The current study's primary aim is to deal with environmental protection, economic boost up, international relations influencing to the Project's success. The paper also addressed project management as a moderator between environmental protection, economic boost up, international relations, and the CPEC project's success. The primary data has been gathered (...) by using questionnaires, and PLS-SEM has been employed for the analysis. The results revealed that environmental protection, economy boost up, and international relations have a positive association with the success of CPEC. The outcomes also exposed that project management moderating among the nexus of economy boosts up the international relations and success of CPEC. The present study results guided how Pakistan and China make the CPEC project stronger with the efficient implementation of practices required for protecting the environment, with the economic growth and boost up, and good strong relations with foreign countries. This study was an attempt to validate the different factors to check their association with each other in a new environment, resulting in a leading edge for the success of mega projects that influence project management. In 19th century Germany, the number of publications in the history of philosophy increased dramatically. According to Ulrich Schneider’s calculations, from 1810 through 1899, 148 original textbooks by 114 authors were published in German. The aim of this article is to analyse how the documented in these publications canonic vision of 19th century German philosophy evolved. An analysis of 66 treatises published from 1802 through 1918 allows dividing 19th century philosophers into groups based on the frequency of their names across (...) the tables of contents, describing the changes in the leading group composition and in the share of attention received by a given philosopher over time. The paper presents thus a formal analysis of how historical reputations of philosophers were made, how they stabilised, or faded. The authors claim that the current understanding of the history of 19th century philosophy differs significantly from the one recorded in the German textbooks of the era. (shrink)

Human vision supports social perception by efficiently detecting agents and extracting rich information about their actions, goals, and intentions. Here, we explore the cognitive architecture of perceived animacy by constructing Bayesian models that integrate domain‐specific hypotheses of social agency with domain‐general cognitive constraints on sensory, memory, and attentional processing. Our model posits that perceived animacy combines a bottom–up, feature‐based, parallel search for goal‐directed movements with a top–down selection process for intent inference. The interaction of these architecturally distinct processes makes perceived (...) animacy fast, flexible, and yet cognitively efficient. In the context of chasing, in which a predator (the “wolf”) pursues a prey (the “sheep”), our model addresses the computational challenge of identifying target agents among varying numbers of distractor objects, despite a quadratic increase in the number of possible interactions as more objects appear in a scene. By comparing modeling results with human psychophysics in several studies, we show that the effectiveness and efficiency of human perceived animacy can be explained by a Bayesian ideal observer model with realistic cognitive constraints. These results provide an understanding of perceived animacy at the algorithmic level—how it is achieved by cognitive mechanisms such as attention and working memory, and how it can be integrated with higher‐level reasoning about social agency. The number of articles published in open access journals has increased dramatically in recent years. Simultaneously, the quality of publications in these journals has been called into question. Few studies have explored the retraction rate from OAJs. The purpose of the current study was to determine the reasons for retractions of articles from OAJs in biomedical research. The Medline database was searched through PubMed to identify retracted publications in OAJs. The journals were identified by the Directory of Open Access Journals. (...) Data were extracted from each retracted article, including the time from publication to retraction, causes, journal impact factor, and country of origin. Trends in the characteristics related to retraction were determined. Data from 621 retracted studies were included in the analysis. The number and rate of retractions have increased since 2010. The most common reasons for retraction are errors, plagiarism, duplicate publication, fraud/suspected fraud and invalid peer review. The number of retracted articles from OAJs has been steadily increasing. Misconduct was the primary reason for retraction. The majority of retracted articles were from journals with low impact factors and authored by researchers from China, India, Iran, and the USA. (shrink)

This essay looks into a particular aspect of Sinological challenge to the modern project of Chinese philosophy within the Western academy through the lens of authorship, using the Zhuangzi 莊子 as a case study. It explores philosophical implications for texts whose authorship is in doubt and develops a new heuristic model of authorship and textuality, so that a more robust intellectual space for the philosophical discourse on Chinese classics can be carved out from the dominant historicist Sinological discourse. It argues (...) that philosophical and Sinological approaches to Chinese classics have divergent scholarly objectives and follow different disciplinary norms. To clarify such divergence, it proposes a heuristic model to distinguish two sets of scholarly objects operative in Sinology and philosophy respectively, namely original text versus inherited text, historical author versus textual author, and authorial intent versus textual intent. These two sets of scholarly objects are related, at times overlapping but often irreducibly distinct, with the former in the pairs belonging to Sinologists and the latter to philosophers. (shrink)

In recent years, more and more people are applying Convolutional Neural Networks to the study of sound signals. The main reason is the translational invariance of convolution in time and space. Thereby the diversity of the sound signal can be overcome. However, in terms of sound direction recognition, there are also problems such as a microphone matrix being too large, and feature selection. This paper proposes a sound direction recognition using a simulated human head with microphones at both ears. Theoretically, (...) the two microphones cannot distinguish the front and rear directions. However, we use the original data of the two channels as the input of the convolutional neural network, and the resolution effect can reach more than 0.9. For comparison, we also chose the delay feature (GCC) for sound direction recognition. Finally, we also conducted experiments that used probability distributions to identify more directions. To help academic associations in management develop, refine, and implement a code of ethics, we conducted a survey of management educators’ perception of the ethicality of 142 specific behaviors in teaching, research, and service. The results of the survey could be used to inform ethics committees of these associations regarding the level of acceptability of such conduct. The potential value of our study for the Academy of Management or similar management associations lie in our (1) systematically involving the members in (...) building support for the code of ethics, (2) assessing members’ ethical judgments on both cross-sectional and longitudinal bases so as to identify areas needing particular attention in ethical training, (3) providing an extensive list of specific examples of questionable and potentially unethical behaviors so as to make it easier to implement the code, and (4) providing a template survey document for potential use in involving more stakeholder groups in the development of codes of ethics. Husserl and Spatiality is an exploration of the phenomenology of space and embodiment, based on the work of Edmund Husserl. Little known in architecture, Husserl's phenomenology of embodied spatiality established the foundations for the works of later phenomenologists, including Maurice Merleau-Ponty's well-known phenomenology of perception. Through a detailed study of his posthumously published and unpublished manuscripts, DuFour examines the depth and scope of Husserl's phenomenology of space. The book investigates his analyses of corporeity and the 'lived body,' extending to questions (...) of intersubjective, intergenerational, and historical spatial experience, what DuFour terms the 'environmentality' of space. Combining in-depth architectural philosophical investigations of spatiality with a rich and intimate ethnography, Husserl and Spatiality speaks to themes in social and cultural anthropology from a theoretical perspective that addresses spatial practice and experience. Drawing on extensive fieldwork in Brazil, DuFour develops his analyses of Husserl's phenomenology through spatial accounts of ritual in the Afro-Brazilian religion of Candomblé. The result is a methodological innovation and unique mode of spatial description that DuFour terms a 'phenomenological ethnography of space.' The book's profoundly interdisciplinary approach makes an incisive contribution relevant to academics and students of architecture and architectural theory, anthropology and material culture, and philosophy and environmental aesthetics. The COVID-19 pandemic has had a profound psychological and behavioral impact on people around the world. Consumer purchase behaviors have thus changed greatly, and consumer services companies need to adjust their business models to adapt to this change. From the perspective of consumer psychology, this paper explores the impact of consumer purchase behavior changes over the course of the pandemic on the business model design of consumer services companies using a representative survey of 1,742 individuals. Our results show that changes (...) in consumer purchase behavior have a significant impact on the design of consumer services firms’ business models. Specifically, changes in consumers’ purchase object, motive, and timeframe are more likely to spark a novelty-centered business model design, whereas changes in purchase method tend to inspire an efficiency-centered one. Our findings provide a theoretical reference for consumer services companies in designing business models when faced with unexpected crises. (shrink)

ABSTRACT This paper is concerned with the contrast in views between traditional mainstream Chinese philosophy and Western liberal individualism on the importance of the concept of individual rights in social and political thought. The contrast is striking because, whereas individual and political rights have long featured in public discourse in the West, in China, mainstream social and political thought has developed without a notion of individual rights. In search of the significance of this major difference, the paper traces ideas of (...) the self in China through Confucian ethics, and compares the Confucian conception of the self with the deontological liberal conception of the subject as a bearer of rights in the West. Having established that the Chinese way of thinking about the self and about moral agency is in stark contrast to the image of the self as a bearer of rights in the deontological conception, the paper goes on to discuss the inadequacy of the moral individualism of a rights‐based morality and argues for an alternative view of morality which places importance on the intrinsic value of collective goods and on membership in a society. This paper proposes a coevolutionary scenario on the origins of compositionality and word order regularity in human language, and illustrates it using a multi-agent, behavioral model. The model traces a `bottom-up' process of syntactic development; artificial agents, by iterating local orders among lexical items, gradually build up basic constituent word order(s) in sentences. These results show that structural features of language (e.g. syntactic categories and word orders) could have coevolved with lexical items, as a consequence of general learning mechanisms (e.g. (...) pattern extraction and sequential learning) initially not language-specific. No community fully achieves the ideal of the rule of law. Puzzles about the content of the ideal seem to make it necessarily unattainable (and, therefore, an incoherent ideal). Legal systems necessarily contain vague laws. They typically allow for change in the law, they typically provide for unreviewable official decisions, and they never regulate every aspect of the life of a community. It may seem that the ideal can never be achieved because of these features of legal practice. But I (...) ask what counts as a 'deficit' in the rule of law, and I argue that none of these features of legal practice necessarily amounts to a deficit. I conclude that communities fail to achieve the rule of law only because of official infidelity to law, and the failure of lawmakers to pursue the ideal (or their decision not to pursue it). During the recent discussions concerning the problem of the criterion of truth, some comrades have said: In real life we use a great many criteria to distinguish between true and false, such as the criterion for distinguishing between the fragrant flowers and the poison ivy [i.e., ideologically correct and incorrect], the criterion for distinguishing what is revolutionary from what is counterrevolutionary, the criterion for determining successors to manage the proletarian revolution, etc. Although these criteria are derived from practice, in themselves (...) they are not practice but things of the subjective realm. Is it possible to sinicize Marxist Philosophy? This is a prerequisite for Marxism localization. Some people answer “no”, because their main arguments are like this: so far, the Marxist Philosophy understood by Chinese is not the real Marxist Philosophy, and it is impossible for Chinese to understand Marxist Philosophy;even though Chinese have understood Marxist Philosophy, they could not sinicize Marxist Philosophy. Thus this paper shall discuss this point. Although Marxist Philosophy has originated from the Western Europe, its visual threshold involves (...) the total human history and overall situation of the world, but not just the WesternEurope. Therefore, it is not a regional theory, but an international theory. Its fundamental principles are not just the generalization of the Western Europe conditions, but the generalization of developing process of the world history. Besides, Chinese distinctiveness does not deny the universality of these fundamental principles. That Chinese Marxists adapt Marxist Philosophy to conditions in China is not to cancel the universality of these fundamental principles by Chinese distinctiveness, but to make detailed analysis on Chinese special conditions taking these fundamental principles as guide; of course it shall include absorbing and drawing upon fruits of all active and reasonable elements in Chinese traditional culture and then arriving at a new conclusion.
