The Prophet, whom Allah sent the whole universe and humanity as mercy, produced not only many judicial rules and practices regarding the relations of a person with Allah and other people in Islam but also uttered sentences about the explanation of holy book, Qur’an, and about how this book can be put into practice. The issue whether and how much these sentences of the prophet (hadith) and acts of the prophet (Sunnah) are binding have been discussed by both hadith methodologists (...) and fiqh methodologists; accordingly, a great many studies were produced. In hadith methodology, the discussions about Sunnah of the Prophet had their reflections in the studies of fiqh methodology; and especially Hanafi jurists propounded considerations about this issue. Hussein b. Ali al-Saymerî (d. 436/1045) one of these jurists, is the student of Muhammad b. Mûsa al-Khwârizmî (d. 403/1012), who is the student of Abû Bakr al-Jassâs (d. 370/980), who is an authority in Hanafi methodology. al-Saymerî, who adopted the method of al-Jassâs in fiqh methodology, systematically categorized several fundamental issues which were discussed and were related to fiqh methodology during his time; and he defended the views of Hanafi scholars about these issues primarily against Shâfiʿîs and several fiqh and kalam schools. While presenting the views and evidences of Hanafis, al-Saymerî initially applied for the views of founder imams of Hanafi sect such as Abû Hanîfa, Abû Yusuf and Muhammad al-Shaybânî; following these scholars, he greatly benefited from Hanafi scholars from Iraq region, such as Abu’l-Hasan al-Karkhî (d. 340/952) and his student, Abu Bakr al-Râzî al-Jassâs. When the relevant parts of his study is analysed, it is seen that the effect of al-Jassâs is especially noticeable. In this article, we will study the binding issue of the Sunnah of the Prophet within the context of al-Saymerî’s study, which has extant and is called Mesâilu’l-hilâf fi usûli’l-fiqh. We consider that the different attitude of al-Saymerî about the Sunnah of the Prophet from the other methodologists and hadith scholars and the underlying reasons of these differences are worth to be investigated and emphasized. Recent advances in brain imaging methods as well as increased sophistication in neuroscientific modeling of the brain’s reward systems have facilitated the study of neural mechanisms associated with addiction such as processes associated with motivation, decision-making, pleasure seeking, and inhibitory control. These scientific activities have increased optimism that the neurological underpinnings of addiction will be delineated, and that pharmaceuticals that target and change these mechanisms will by themselves facilitate early intervention and even full recovery. In this paper, we argue that (...) it is misguided to construe addiction as just or primarily a brain chemistry problem, which can be adequately treated by pharmaceutical interventions alone. All democratic constitutions feature "the people" as their author and ultimate source of legitimacy. They claim to embody the political form that citizens are in some sense supposed to have given themselves. But in what sense, exactly? When does a constitution really or genuinely speak for the people? Such questions are especially pertinent to our present condition, where the voice of "the people" turns out to be irrevocably fragmented, and people themselves want to speak and be heard in their own (...) voices. _Founding Acts_ explores the relationship between constitutional claims of popular sovereignty and the practice of constitution-making in our pluralistic age. Serdar Tekin argues that the process of making a constitution, or its pedigree, is as morally and politically significant as its content. Consequently, democratic constitution-making is not only about making a democratic constitution but also about making it, as much as possible, democratically. Tekin develops two overarching arguments in support of this claim. First, citizen participation in the process of constitution-making is essential to the democratic legitimacy of a new constitution. The question “What is the relationship between the self and mental disorder?” is especially important for mental health professionals interested in understanding and treating patients, as most mental disorders are intimately tied to self‐related concerns, such as loss of self‐esteem and self‐control, or diminished agency and autonomy. Philosophy, along with the cognitive and behavioral sciences, offers a wealth of conceptual and empirical resources to answer this question, as the concepts of the self and psychopathology have occupied a central place in (...) these fields since their inception. Interestingly, and unfortunately, however, scientific psychiatry, in its approach to mental disorder as primarily a cluster of signs and symptoms has been slow in acknowledging the advances in conceptualizing and investigating mental disorders in relation to the self. The article addresses this problem and offers solutions for better cross‐fertilization between empirical and philosophical inquiry into the self and psychiatric research on mental disorders. The first part evaluates what empirically informed philosophical inquiry and philosophically informed empirical inquiry offer to the examination of the relationship between the self and mental disorders. The second part argues that scientific psychiatry has missed opportunities to find effective treatments for mental disorders because of its insularity from debates in naturalistic philosophy and cognitive and behavioral sciences. Psychiatry has much to gain from the conceptual, scientific, and clinical resourcefulness of philosophy's collaboration with the cognitive and behavioral sciences. (shrink)

This paper explores how the diagnosis of mental disorder may affect the diagnosed subject’s self-concept by supplying an account that emphasizes the influence of autobiographical and social narratives on self-understanding. It focuses primarily on the diagnoses made according to the criteria provided by the Diagnostic Statistical Manual of Mental Disorders (DSM), and suggests that the DSM diagnosis may function as a source of narrative that affects the subject’s self-concept. Engaging in this analysis by appealing to autobiographies and memoirs written by (...) people diagnosed with mental disorder, the paper concludes that a DSM diagnosis is a double-edged sword for self- concept. On the one hand, it sets the subject’s experience in an established classificatory system which can facilitate self-understanding by providing insight into subject’s condition and guiding her personal growth, as well as treatment and recovery. In this sense, the DSM diagnosis may have positive repercussions on self-development. On the other hand, however, given the DSM’s symptom-based approach and its adoption of the Biomedical Disease model, a diagnosis may force the subject to make sense of her condition divorced from other elements in her life that may be affecting her mental- health. It may lead her frame her experience only as an irreversible imbalance. This form of self-understanding may set limits on the subject’s hopes of recovery and may create impediments to her flourishing. (shrink)

In this paper, the scientific realism/anti-realism debate, which is one of the most popular topics in the metaphysics of science, will be examined in supporting the realistic wing. In this respect, the discussion will be conducted by keeping the subjects of ‘existence of an external mind-independent world’ and ‘unobservable entities’ at the center of this paper. In the context of understanding the world, ‘Science’ activity is not the sum of the research carried out only by considering empirical data; on the (...) contrary, it will be claimed that it is an endeavor that pursues unknown but interesting things (such as protons, photons, or viruses) and tries to give meaning to the world. Thus, against the empirical rigid attitude of anti-realism –bearing in mind the views of logical positivists; it will be illustrated that scientific realism is an understanding based on metaphysics and has a philosophical basis. In this paper, I aim to explore Lewis’s best system analysis and how it can accommodate laws with exceptions. The Best System Account has been introduced to provide an alternative view for both minimalist and counterfactual theories of regularities. Simple regularity theory faces problems in which there is some generalization that seems to be a law or some regularities that are established accidentally. It tries to exclude the accidental generalization from the account. However, the best system analysis can solve the (...) problem of how to distinguish between laws and accidents. (shrink)

Al-Qāḍī Ḥusayn al-Marwarrūdhī is one of the important representatives of Khurāsān Shāfi‘ī School. Al-Ta‘līḳa is his famous work, which is one of the first commentaries of al-Muzanī’s Mukḫtaṣar. One of the important features of this work is the introduction to some of the subjects of ijtihād (process of juristic legal reasoning), taqlīd (acting upon the word of another without asking for specific proof), ijmā‘ (consensus of jurists) and view’s of the companions of the Prophet. The first systematic, complete and detailed (...) works of uṣūl al-fiqh (Islamic legal theory) that belonged to the Khurāsān Shāfi‘ī School have reached to the present day belong to the second half of the V./XI. century. Making research on the studies which were done about uṣūl al-fiqh and formed the basis of this period is essential to follow the development of uṣūl al-fiqh of the Khurāsān Shāfi‘ī School. Transfer of the uṣūl al-fiqh in al-Qāḍī Ḥusayn al-Marwarrūdhī’s al-Ta‘līḳa make it possible to determine the literatüre, which was formed in Khurāsān region in the period from the death of Shāfi‘ī to the first half of the V./XI. century until the first half of the Khurāsān region, which allows the determination of the uṣūl al-fiqh. In this study, on the basis of ijmā‘, al-Qāḍî Ḥusayn al-Marwarrūdhī’s method in al-Ta‘līḳa will be examined.Summary: Al-Qāḍī Ḥusayn al-Marwarrūdhī is considered to be one of the most important representatives of the Khurāsān Shāfi‘ī School. In addition to receiving fiqh education from al-Qaffāl al-Marwazī, who is accepted as the founder of the Khurāsān Shāfi‘ī School in Shāfiʿī fiqh circles. Al-Qāḍī Ḥusayn, one of the most distinguished students of al-Qaffāl al-Marwazī, has become one of the important bearers of the fiqh heritage of Khurāsān Shāfi‘ī School. The fact that the epithet “el-kāḍî” is used in the works of Khurāsān Shāfi‘ī School to absolutely refer to al-Qāḍî Ḥusayn, is another issue that shows his being authority on fiqh. Al-Qāḍī Ḥusayn al-Marwarrūdhī has accomplished many works in the field of fiqh. The most famous and most important work of al-Qāḍī Ḥusayn is the al-Ta‘lîḳa, written according to the Mukḫtaṣar arrangement style of al-Muzanī. He is often cited as the author of the well-known work al-Ta‘lîḳa in the sect. Al-Ta‘lîḳa, commonly cited in fiqh studies to refer to the views of al-Qāḍī Ḥusayn, is one of the first commentary on Mukḫtaṣar by Muzanī. With these characteristics, al-Ta‘lîḳa is one of the outstanding manuscripts for exploring the fiqh legacy of the Khurāsān Shāfi‘ī School. Another important feature of this text is that uṣūl al-fiqh issues such as ijtihād, taqlīd, ijmā‘ and view’s of the companions of the Prophet (qawl al-ṣaḥābah) have been covered in the introduction of the work. Al-Qāḍī Ḥusayn discusses the issues of evidentiality and types of ijmā‘ and ijmā‘ of ṣaḥābah in the chapter on ijmā‘ in al-Ta‘lîḳa. Al-Qāḍī Ḥusayn also handles the debates on view’s of the companions of the Prophet in the section on ijmā‘ of ṣaḥābah. It is also seen that the proofs proposed for evidentiality of ijmā since Shāfiʿī’s period became more versatile and differed. The fact that the arguments al-Qāḍī Ḥusayn cites in the chapter of the evidences of ijmā‘ were also mentioned by his contemporary, al-Māwardī, an Iraqi Shāfiʿī jurist, points out the accumulation of knowledge in terms of proofs of ijmā. Al-Qāḍī Ḥusayn makes two related distinctions that are fundamentally related to the types of ijmā. The first is the division between ijmā supporters, those who argue for knowability of ijmā, and their opponents. According to this, ijmā is divided into two parts as ‘āmm (general public) ijmā‘ and khāṣṣ (scholars) ijmā‘. Opposition to ‘āmm ijmā‘, such as fardhs (obligations) in prayer, rawātib sunnah (the practice that the Prophet regularly performed) and feast prayer requires kufr (blasphemy). Al-Qāḍî Ḥusayn, who considers issues such as ‘awl (a sharing method in Islamic inheritance law), mut‘a marriage (a type of temporary marriage) and riba’l-faḍl (interest in exchange or sale transactions) which are seen as controversial ijmā‘ issues in literature, as khāṣṣ ijmā‘ and evaluates opposition to this type of ijmā‘ as fisq (impiety). The second division al-Qāḍī Ḥusayn makes is between ijmā‘ based on the text and apparent comparison, and the ijmā‘ based on hidden comparison. Al-Qāḍī Ḥusayn thinks that the opposition to ijmā‘ that is based on ijtihād or the text in terms of sanad (chain of narrators), requires blasphemy. In a sense, this is to accept ijmā‘ as a provision on an equal basis and to reduce the distinctions of ijmā‘ to literary level. Al-Qāḍī Ḥusayn also discusses evidentiality of qawl al-ṣaḥābah in connection with the issues of ijmā‘. Al-Qāḍī Ḥusayn opposes the thesis that ijmā‘ is only limited to companions’ era and argues that it can be realized in any century after the Prophet. Al-Qāḍī Ḥusayn, who discusses ṣaḥābah’s ijmā‘ under two categories: the views of ṣaḥābah that have gained prevalence among other ṣaḥābahs and those that have not gained prevalence among other companions, argues for evidentiality of qawl al-ṣaḥābah, which have gained prevalence and known not to be opposed. He provides significant information on ijmā‘ discussion in Shāfi‘ī fiqh methods with regard to the evidentiality of this type of qawl al-ṣaḥābah, which is referred ijmā‘ al-suqūtī (consensus based on lack of opposition-silence). The knowledge al-Qāḍī Ḥusayn cites with regard to the evidentiality of qawl al-ṣaḥābah which have not gained prevalence among other ṣaḥābahs differs from Māwardī, one of his contemporary, and his predecessors. The fact that he cites Shāfi‘ī’s previous and latest views with regard to the state of such qawl al-ṣaḥābah in the face of qiyās (legal analogy) enables him to make comparison using uṣūl material available in his era. Al-Qāḍī Ḥusayn, who mentions debatable issues among ṣaḥābah, makes controversial narrations. While al-Qāḍī Ḥusayn reports that there is not any conflict on the argument that it is legitimate to express a third view with regard to issues on which ṣaḥābah is divided in two groups and fall into conflict, his contemporary al-Māwardī and other Shāfi‘ī jurists report that it is not legitimate to propose a third view on such an issue as there is ijmā‘ on these issues. The ijtihâd issues are among important problems of uṣûl al-fiqh (Islamic legal theory). Given al-beyân el-ijtihâd in the meaning of interpreting naṣṣ (text) and al-qiyâs el-jtihâd in the meaning of reaching a verdict of a new issue which is not determined by naṣṣ, it is possible to say that mujtahid (a jurist) is actively in the ijtihâd activity. Thus, the ijtihâd issues has been discussed in uṣûl al-fiqh since early period. The fact that Shâfi‘î refers to ijtihâd issues in his (...) works which have arrived the present day shows that there is a rich accumulation of knowledge about ijtihâd discussions in early period. After Shâfi‘î, the issues were discussed by scholars of Islamic legal theory. Among the Shâfi‘î (uṣûl al-fiqh) works which have arrived the present day, the first work that deals with ijtihâd issues in an ordered, systematic and detailed way is the work of al-Mâwerdî’s el-Ḥâvi’l-Kebîr. In this study, al-Mâwerdî discusses many issues in uṣûl al-fiqh, especially the definition of ijtihâd, its types, the relation between ijtihad and qıyâs, the qualities of mujtahid, iṣâbet (right) and ḫaṭâ’ (fault) in ijtihâd and the provision of ijtihâd. The debates on the ijtihâd issues in Shâfi‘î uṣûl al-fiqh before al-Mâverdî are important our subject. al-Mâwerdî’s view of uṣûl has a close relationship with the accumulation of uṣûl developed prior to him. al-Mâwerdî mentions the views of many scholars who have contributed the accumulation of the sect in the ijtihad issues, especially Shâfi‘î. He refers to the views of scholars from sects other than Shâfi‘î in the issues he discussed. From this point of view, it is certain that to determine the ijtihâd issues in al-Mâwerdî’s el-Ḥâvi’l-Kebîr will also help us to determine the framework and course of debates on ijtihâd in the classical period. ABSTRACT This article discusses the Celtic myths, figures, and central themes of Tomm Moore’s animated movie Song of the Sea, from a transmodern feminist perspective. While the movie offers a vivid portrayal of the dichotomy between the tranquil Irish countryside and the turbulent city of Dublin, its main theme revolves around a rural family’s lament for the loss of the mother who is a modern-day personification of the Celtic selkie. This curious female figure embodies contradictory characteristics: she is semi-human and (...) at the same time a mother and a wife who, in struggling with her in-between state, leaves her family and returns to her mythical roots. By focusing on several of the Celtic mythical figures and central themes of maternal loss, motherhood, gender relations, and family reconciliation, I attempt to show that the movie’s transmodern echoes and concerns suggest that alternative family formations and changed gender roles are possible in Irish society and in the world more generally. In this study, the term of ‘blessing’, which is a basic Qurʾānic concept, is analyzed. In this regard, the study focuses on the definition of ‘blessing’, its different meanings in the various contexts, synonyms and antonyms and its leading individuals to the dimensions of faith, worship and morality. These subject matters are studied by taking into consideration of the meanings of ‘blessing’ in the Qurʾān and commentators’ explanations about the word. The expression of the ‘blessing’ in the Qurʾān indicates that (...) the word has an extensive and constructive meaning. The fact that having an extensive meaning demonstrates that the points the word encompasses can be determined to some extent. It is exemplified in the Qurʾān what can be regarded as ‘blessing’. Furthermore, the commentators determine various meanings to the word by considering the contexts in which the word is used. It is understood that the aim of using the word in the Qurʾān is to lead the individuals to the dimensions of the faith, worship and morality. It is possible for people to be grateful to God by making this aim more visible in their lives. -/- SUMMARY The word blessing mentioned in the Qurʾān has a general meaning. This type of words contains more than one subject inside them. The fact that the blessing contains more than one subject may be seen in the Qurʾānic attributions of it as well as seen in its dictionary and term meaning. Also, the way of explaining a part of subjects, which are in its content, points out this aspect. Thus, in the Qurʾān, the new ones are being added in another place to things referred as blessing in one place. Also, sometimes the blessings with entirely different contents are included. For example, the blessing of God upon Muslims is His support on a battle. In another place rendering them as brothers is a blessing. This is also an example that blessing was partially explained in the Qurʾān. The explanation of the word is sometimes in the same context and sometimes in different contexts. For example, in the verse 47 of the Surah al-Baqara, the blessing given to Jews in the time of Moses is mentioned. Starting from the next verse, between the verses 49-61, these blessings are aligned. Moreover, the blessing that was given to prophets, martyrs and righteous (siddiq) can be an example for the explanation of blessing in the different verses of the Qurʾān. These people who have been given blessing are mentioned side by side in the verse 69 of al-Nisā’. However, it is not explained that what the blessing given to them is. Each blessing mentioned is explained in different places in the Qurʾān. While some part of blessing is determined by the Qurʾān itself, the other part is attempted to be determined by commentators. Given that the explanations in the Qurʾān and commentaries, the subjects that affected by blessing can be divided into two as tangible and intangible blessings. The resources offered for humans to maintain their lives, emancipation a slave, the wind that helps the ship to move forward and Muhammad himself as a prophet are the tangible ones. Faith, miracle, mercy, reward, retrieving safety, the place where all kind of resources and ease, peace and happiness exist (Heaven) can be commentated as intangible blessings. The subjects included in the concept of blessing in the Qurʾān are changing according to the context. The blessing from God upon believers is “the faith granted by God on the earth” in one place, and “the Heaven bestowed in the afterlife” in another place. When determining the close and opposite meanings of the word, it should not be ignored this aspect of the blessing. In other words, it changes according to the context. For example, if the content of blessing is “the resource presented to human beings”, the close meaning of it in the Qurʾān is “compassion”, the opposite meaning of it is “harm”. However, if the thing that fell within blessing is “reward”, the close meaning will be “good deed”, opposite meaning will be “torment”. The blessing changes according to the addressed person as well. It is the all kind of resource that God presents to humans if the human kind is in question. If it is for a believer, it means moral support and every kind of reward as well as the resources offered. However, if it is relevant to a prophet, the prior meaning is prophethood as well as the meanings above. The expression of blessing in the Qurʾān helps us to have more opinion about it. For example, blessing has a positive meaning according to the Qurʾān. The word’s positive aspect is emphasized by comparing things that cannot be blessing to negative person types. The perception of blessing of Pharaoh and a hypocrite that is expressed in the Qurʾān can be evaluated in this content. According to the Qurʾān, the blessing they qualify is not in the context of blessing. Another aspect that draws attention in the expression of blessing in the Qurʾān is the relationship between the blessing giver and receiver. This relationship between God and servants takes place both in the earth and the afterlife. First, God has presented blessing to humans by considering that he/she is worth creating. Human beings show ingratitude or gratitude for being created and all other blessings. Here, the blessing is a test tool for humans. God responds according to the behaviors of human beings in test. He gives this response either only in the afterlife or both in the afterlife and the earth. If the humans respond the blessing with gratitude, God puts him/her to the heaven full of blessings in the afterlife. The blessing here is the result of the test on the earth. So the purpose of expression of blessing in the Qurʾān is to direct the humans to exhibit the behavior with that God is pleased, gain His contentment, deserve His heaven full of blessings. This is the reason that prophets remind the blessings of God to humans while they invite them to religion. Prophets invite people to believe, worship and be moral toward God as a response to these blessings. -/- Even though the content of blessing changes according to addressed person and time, the principle of the relationship between God and His servants does not change. Blessing and gratitude or blasphemy shall continue to exist as long as mankind exists. Here, the principle of “Every blessing’s gratitude is its own type” can be remembered. This principle recommends that giving thanks to God by tongue only for blessings will not be enough. Because of that, how should be grateful for different blessings should be exemplified. These definitions containing examples help us to understand better the purpose of expression of blessing in the Qurʾān. For example, the gratitude for humans’ own equipment can be through remembering always Him who gave that equipment, obey and worship Him constantly. Gratitude for children and good fortune happens by directing them towards God’s sake. As for the gratitude for the blessing of the universe, that contains signs of the existence of God, can be through recognizing his/her Creator and maintaining its existing order. If human beings break this order, he/she would be ungrateful because this would be an attitude against the one who created this order. Just as a servant might be ungrateful to God when he/she does not appreciate the blessing of prophet that reminds us God, exhibiting negative attitude against the universe that points out the existence of God is a kind of ungratefulness against God as well. So that, the blessing carries humans to faith and worship dimensions and also to moral dimension in terms of relationship between himself/herself and other things. The modern-day people need this Qurʾānic perspective. A human being should review his/her relationship between himself/herself, God, other people and the nature, then he/she should try to reach the Qurʾānic dimension by being grateful properly for blessings that he/she has. Bilindiği üzere onun kaleme aldığı Te’vîlâtü’l-Kur’an, dirayet ağırlıklıdır. Ancak eserdeki dirayet içerikli yorumları rivayetten yoksun değildir. Zira tefsirinde az da olsa Hz. Peygambere isnad edilen rivayetlere, bolca sahabe ve tabiine ait rivayetlere rastlanır. Sahabe nesli içerisinde tefsirde ilk sırada yer alan İbn Abbas, Te’vîlâtü’l-Kur’an’da da rivayet sayısı bakımından ilk sırayı korumaktadır. Tespitimize göre bu eserde İbn Abbas’a ait 579 rivayet vardır. Bu sayıyla (...) İbn Abbas Te’vîlâtü’l-Kur’an’da sahabe arasında ilk sırada yer almaktadır. Bu eserde İbn Abbas’ın önemi aslında rivayet bakımından ilk sırada yer almasıyla ilgili değildir. Mâtürîdî’ye göre genelde sahabenin, özelde İbn Abbas’ın tefsirde ayrı bir önemi vardır. Zira o, tefsiri sahabeye özgü bir alan olarak görmektedir. Bilindiği üzere Mâtürîdî, tefsir te’vil ayrımı yapmakta, tefsirin sahabeye te’vilin ise alimlere ait olduğunu söylemektedir. Onun bu yaklaşımı çalışmada Te’vîlâtü’l-Kur’an’daki İbn Abbas’a ait 579 rivayet üzerinden incelenmektedir. Çalışma iki kısımdan oluşmaktadır. İlk kısımda Mâtürîdî tefsirindeki İbn Abbas rivayetleri biçim ve içerik açısından tanıtılmaktadır. Rivayetlerin uzun veya kısa oluşu, ayet içerip içermemesi, İbn Abbas’ın senedde her zaman sözün sahibi değil, Hz. Peygamberin sözünü aktaran biri olarak yer alması ona ait rivayetlerin biçimsel yönü olarak görülebilir. Rivayetlerin Te’vîlâtü’l-Kur’an’daki görünümü de bu bağlamda ele alınabilir. Bu hususta önce Mâtürîdî’nin İbn Abbas rivayetleri için hem te’vil hem tefsir ifadesini kullandığını belirtmeliyiz. O tefsirinin genelinde sadece sözü söyleyenin ismini zikrederek senedin geriye kalan kısmını hazfettiği için tefsirinde senedin yer alış biçimi üzerinde durma imkânı yoktur. Rivayetin metin kısmını ise Mâtürîdî bazen olduğu gibi alıntılamakta bazen özetlemekte bazen de başkasına ait sözü zikrettikten sonra İbn Abbas’a ait sözün, aktardığı söze benzediğini söylemekle yetinmektedir. Te’vîlâtü’l-Kur’an’da İbn Abbas’a ait rivayetlerin içeriğine gelince rivayetler, hurûf-ı mukattaa, sebeb-i nüzul, kıraat, nesh gibi Kur’an ilimleri, kelime açıklamaları, ayet yorumları şeklinde sınıflandırılabilir. O ayetin bazen bir kesitini bazen bütününü yorumlamakta, yorumlarını nüzul dönemi veya sonrası olaylar ile ilişkilendirebilmektedir. Çalışmanın ilk kısmı bu çerçevededir. İkinci kısımda ise Mâtürîdî’nin İbn Abbas rivayetlerini ayeti yorumlamada kullanışı ele alınmaktadır. Te’vîlâtü’l-Kur’an’a bu açıdan bakıldığında Mâtürîdî’nin farklı tavırlar sergilediği rahatlıkla görülebilir. Zira o, bir âyetin yorumu için İbn Abbas’ın görüşünü bazen benimsemekte, kendi görüşüne dayanak etmekte, bazen başka rivayet zikretmeksizin onun rivayetiyle yetinmekte, bazen onun rivayetini diğer rivayetler içerisine almakta ancak bunlara ilişkin bir değerlendirme yapmamaktadır. Bunun yanı sıra o bazen İbn Abbas tefsirini tercih etmemekte hatta eleştirmektedir. Mâtürîdî’nin İbn Abbas’ın yaptığı yorumu gereksiz gördüğü yerler de bulunmaktadır. (shrink)

Aristotle (b. 322 BC) was the first philosopher in the history of thought to examine all modes and types of belief acquisition such as knowledge, supposition, error and indirectly imagination. In his _Prior Analytics_, which he wrote primarily to clarify his theory of demonstration, Aristotle examined in detail the syllogism, which he saw as the most important form of reasoning, and his analysis was subject to interpretation by different traditions of thought for centuries. Aristotle’s _Prior Analytics_ was translated into Arabic (...) in the classical period and later interpreted by many Islamic logicians. This article aims to show how Aristotle’s definition of the syllogism in the _Prior Analytics_ was taken up and interpreted in the Peripatetic Islamic logical tradition. These interpretations of the definition of the syllogism will provide us with an idea about the unique features of the commentaries on the _Prior Analytics_ in the Islamic world. Here, introductory information about the translation of the _Prior Analytics_ into Arabic and its commentators in Arabic will be given, Aristotle’s definition of the syllogism and its versions in Peripatetic Islamic logicians will be indicated, and the interpretation of the basic terms in the definition by Peripatetic Islamic logicians will be revealed. The purpose of this chapter is to describe what we see as several important new directions for philosophy of medicine. This recent work (i) takes existing discussions in important and promising new directions, (ii) identifies areas that have not received sufficient and deserved attention to date, and/or (iii) brings together philosophy of medicine with other areas of philosophy (including bioethics, philosophy of psychiatry, and social epistemology). To this end, the next part focuses on what we call the “epistemological turn” in (...) recent work in the philosophy of medicine; the third part addresses new developments in medical research that raise interesting questions for philosophy of medicine; the fourth part is a discussion of philosophical issues within the practice of diagnosis; the fifth part focuses on the recent developments in psychiatric classification and scientific and ethical issues therein, and the final part focuses on the objectivity of medical research. In this study, we aimed to investigate how prospective science teachers, who participated in a series of explicit-reflective activities for NOS teaching, understood "science in a social and cultural context" in the context of a biographical documentary film. We adopted a phenomenological approach. The data were analyzed descriptively by considering the aspects of nature of science and the levels of understanding as defined in Dilthey's hermeneutic approach. In this way, we determined participants’ levels of hermeneutic understanding regarding the nature of (...) science. The findings show that the participants regarded science within the framework of aspects of the consensus view blended with somewhat authentic interpretations and at a basic level of understanding from the point of view of hermeneutics. This finding highlights the importance of integrating the hermeneutic approach into the teaching process in understanding science. (shrink)

Psychotherapy is a well-established, efficacious, and fully accepted treatment for mental disorders and psychological problems. Psychotherapy is an interpersonal practice engaging patient values, interests, and personal meanings at every step. Thereby, psychotherapy abounds with moral issues. In psychotherapy ethics, numerous moral issues converge, including self-determination or autonomy, decision-making capacity and freedom of choice, coercion and constraint, medical paternalism, boundaries between health and illness, insight into illness and the need for therapy, dignity, under- and overtreatment, and much more. The Oxford Handbook (...) of Psychotherapy Ethics covers the whole range of ethical issues in the heterogenous field of psychotherapy, closing a commonly perceived gap between ethical sensitivity, technical language, and knowledge among psychotherapists. The primary audience is psychotherapists in clinical practice. Furthermore, the Oxford Handbook of Psychotherapy Ethics addresses the whole range of professionals providing mental health services beyond psychology and medicine including counselors, social workers, nurses, or ministers. The Oxford Handbook of Psychotherapy Ethics is not only intended for a clinical audience but also for a philosophical/ethical audience. The goal of the is to explicitly link the two disciplines by fostering a productive dialogue between them, enriching both the psychotherapeutic encounter and the ethical analysis and sensitivity within and outside the clinic. The aim of this study is to obtain information about the awareness of social studies teacher candidates about the refugee problem in Turkey. In this regard, a group of teacher candidates are asked their opinion on the subject of refugees in Turkey and as to how they perceive the problem. Interview method is used in the study for data collection. The obtained data is subjected to content analysis via Nvivo 8 software package. As a result of the study, it is (...) observed that the participants residing in provinces with high refugee population have a more negative attitude towards refugees, whereas the ones in areas with no refugee population have a more positive attitude towards them. Advances in applications of artificial intelligence and the use of data analytics technology in biomedicine are creating optimism, as many believe these technologies will fill the need-availability gap by increasing resources for mental health care. One resource considered especially promising is smartphone psychotherapy chatbots, i.e., artificially intelligent bots that offer cognitive behavior therapy to their users with the aim of helping them improve their mental health. While a number of studies have highlighted the positive outcomes of using smartphone psychotherapy chatbots (...) to handle various anxiety related problems no conclusive data illustrate their effectiveness or warrant their use in mental illness diagnosis and treatment settings. Yet smartphone psychotherapy is highly endorsed by experts in the field of mental health research. In this paper, I focus on the specific features of smartphone psychotherapy chatbots intended for the diagnosis and treatment of mental illness and criticize three popular promises; i.e., they enable early diagnosis and intervention through digital phenotyping; they defy the stigma of mental illness diagnosis and treatment; they offer increased access to mental health treatment globally. Going against the popular enthusiasm, I argue smartphone psychotherapy chatbots have epistemic and ethical limitations in the diagnosis and treatment of illnesses. In light of these, I encourage researchers, clinicians, policy makers, patients, and caregivers to pause before jumping on the artificial intelligence bandwagon to seek solutions for mental illness on the grounds of these three promises. This paper challenges the exclusion of patients from epistemic practices in psychiatry by examining the creation and revision processes of the Diagnostic and Statistical Manual of Mental Disorders (DSM), a document produced by the American Psychiatric Association that identifies the properties of mental disorders and thereby guides research, diagnosis, treatment, and various administrative tasks. It argues there are epistemic—rather than exclusively social/political—reasons for including patients in the DSM revision process. Mental disorder is an urgent and growing public health problem.1 Scientific investigation of this problem has the pragmatic goals of identifying the causes of mental disorders and developing strategies to effectively treat them. Philosophers of psychiatry have participated in the inquiry into the empirical examination of mental disorders, predominantly by debating whether psychopathology is a legitimate target of scientific inquiry and, if so, how mental disorders should be explained, predicted, and intervened on. Various traditions in mental health care, such as phenomenological, and existential and cognitive-behavioral psychotherapy, implicitly or explicitly acknowledge that a disruption of the self, or the person, or the agent is among the common denominators of different mental disorders. They often emphasize the importance of understanding patients as reasonsresponsive, in their full mental health relevant complexity, if their mental disorder is to be treated successfully. The centrality of the concept of the self is not mirrored in the mainstream scientific approaches (...) in psychiatry however; the self has rarely been considered as the object of scientific research, the empirical investigation of which might yield successful explanations of and interventions in mental disorders. Thus, even though self-related phenomena are clinically relevant in so far as they give important information about a mental disorder to the clinician and help the development of effective interventions, they are not considered among the scientifically relevant properties of mental disorders. Leaving the self-related phenomena out of the scientific research on mental disorders can be attributed to the presupposition that the self is not empirically tractable and its use will hinder psychiatry’s goal to be scientific. In this paper, taking issue with this, I argue the self is empirically tractable, and its use as a target of research will not hinder psychiatry’s scientific commitments. (shrink)

This paper explores the factors that contribute to the degree of a mood disorder patient’s self- insight, defined here as her understanding of the particular contingencies of her life that are responsive to her personal identity, interpersonal relationships, illness symptoms, and the relationship between these three necessary components of her lived experience. I consider three factors: (i) the Diagnostic Statistical Manual of Mental Disorders (DSM), (ii) the DSM culture, and (iii) the cognitive architecture of the self. I argue that the (...) symptom-based descriptions of mood disorders which eliminate the subjective features of the patient’s illness experience, in conjunction with the features of the DSM-culture and the cognitive biases that guide the patient, contribute to the impoverishment of her self-insight. The resulting impoverished self-insight would prevent her from developing resourceful responses to her interpersonal problems. In analyzing how these factors combine to influence the patient’s self-insight, I distinguish the therapeutic impact of receiving a psychiatric diagnosis, which facilitates patient’s clinical treatment, from its reflective impact, how the diagnosis informs the patient’s reflection on who she is, how her mental disorder is expressed, and how her interpersonal relationships proceed. I substantiate my argument by considering a patient’s memoir of psychopathology. (shrink)

his article develops a set of recommendations for the psychiatric and medical community in the treatment of mental disorders in response to the recently published fifth edition of the Diagnostic and Statistical Manual of Mental Disorders, that is, DSM-5. We focus primarily on the limitations of the DSM-5 in its individuation of Complicated Grief, which can be diagnosed as Major Depression under its new criteria, and Post-Traumatic Stress Disorder (PTSD). We argue that the hyponarrativity of the descriptions of these disorders (...) in the DSM-5, defined as the abstraction of the illness categories from the particular life contingencies and personal identity of the patient (e.g., age, race, gender, socio-economic status), constrains the DSM-5's usefulness in the development of psychotherapeutic approaches in the treatment of mental disorders. While the DSM-5 is useful in some scientific and administrative contexts, the DSM's hyponarrativity is problematic, we argue, given that the DSMs are designed to be useful guides for not only scientific research, but also for the education of medical practitioners and for treatment development. our goal therefore is to offer suggestions for mental health practitioners in using the DSM-5, so that they can avoid or eliminate the problems that may stem from the limitations of hyponarrativity. When such problems are eliminated, we believe that effective psychotherapeutic strategies can be developed, which would be successful in repairing the very relationships that are strained in mental disorder: the patient's relationship to herself, her physical environment, and her social environment. The scientific investigation of mental disorders is an invigorating area of inquiry for philosophers of mind and science who are interested in exploring the nature of typical and atypical cognition as well as the overarching scientific project of ‘carving nature at its joints’. It is also important for philosophers of medicine and bioethicists who are concerned with concepts of disease and with the development of effective and ethical treatments of mental disorders and the just distribution of mental health services. For some, narratives created by a subject about herself shape her self-constitution (Flanagan 1991; Fivush 1994). For others, they help the subject to participate in social cognition (Hutto 2008). Educators who start a philosophy of medicine or medical ethics class with a philosophical discussion on the definition of basic concepts in medicine, such as health and disease, might relate to this anecdotal account. Students initially find the topic engaging because of the ubiquity of the concept of disease regulating not only their direct encounter with health-related contexts, for example, when veterans returning to school receive accommodations after being diagnosed with Post Traumatic Stress Disorder, but also their social world, say, (...) when they get in an argument with their classmates about whether vaccines cause or prevent diseases, or when they join the campus gym to improve their health. Yet their enthusiasm wanes when they read the seminal naturalist and normative accounts of disease. This happens not because such conceptual work does not have any philosophical sophistication and value but because the discussion seldom makes direct contact with the common uses of the disease concept in the medical, social, moral and institutional contexts in which the students are heavily embedded. As the authors of ‘Rethinking ‘Disease’: A Fresh Diagnosis and a New Philosophical Treatment’ argue, the notion of disease central to the naturalist and normativist positions is conceptually insulated from its applications in various institutional settings in healthcare and also from its personal, social and economic contexts. This insularity largely stems from the fact that traditional conceptual analysis in philosophy assumes a lot more than it can show, including the assumption that concepts, such as disease, have necessary and sufficient conditions that exist independently of the world as we encounter it and are accessed through our intuitions. Post-classical period witnessed intense debates on aspects of the Avicennan theory of science. Among them one set of discussions concerned the issue of subject matter (mabāhith al-mawdūʿ) in a science. They were raised by Ṣadr al-Sharīʿa (d. 747/1346) in the introduction of his al-Tawḍīh, a commentary on his legal theory text al-Tanqīḥ. Therein, he raised three questions: (1) whether the subject matter of a science can be multiple, (2) what restricting subject matter of a science means, and (3) whether one (...) thing can be the subject matter of multiple sciences. Taftāzānī (d. 792/1390), a proponent of the Avicennan theory, objected to Ṣadr al-Sharīʿa’s positions in his al-Talwīḥ, the most well-known supercommentary on al-Tawḍīh. The paper analyzes this debate on the issue of subject matter in sciences, and thus sheds light on the reception of an important aspect of the Avicennan theory of science in the postclassical period. In “Mad Narratives: Self-Constitutions Through the Diagnostic Looking Glass,” by using narrative approaches to the self, I explore how the diagnosis of mental disorder shapes personal identities and influences flourishing. My particular focus is the diagnosis grounded on the criteria provided by the Diagnostic Statistical Manual of Mental Disorders (DSM). I develop two connected accounts pertaining to the self and mental disorder. I use the memoirs and personal stories written by the subjects with a DSM diagnosis as illustrations to bolster (...) my claims. First, expanding on the narrative approaches to the self, I explain how narratives about a subject shape her self-constitution. I elucidate how this process is generated by drawing on research in developmental psychology, cognitive science, and social psychology. Next, using this account as a springboard, I argue that the DSM diagnosis of mental disorder serves as a source of narrative, entering into the patients’ autobiographical and social narratives. This plays an important role in the diagnosed subjects’ self-understanding, self-constitution and flourishing. In this vein, how mental disorders are classified is not only a theoretical question about accurately taxonomizing the various experiences related to mental distress but also an ethical question about which ways of talking about mental disorders will allow subjects to respond effectively to their psychological distress, to flourish and to live autonomous and fulfilling lives. Finally, I suggest that the DSM-based narratives wield a double-edged sword when it comes to the subject’s flourishing: On the one hand, there are problems with some DSM-based narratives that stem from the DSM diagnostic schema and the culture of DSM diagnoses. These problems render these DSM-based narratives unbeneficial for flourishing as they constrain the range of adoptive social, cognitive and emotional responses the subjects can give to their mental disorders. On the other hand, there are grounds to believe that some DSM-based narratives help subjects to flourish. For instance, they provide certainty to subjects' otherwise puzzling symptoms and help them reach out to others with similar experiences. Understanding how the DSM-based narratives can both benefit and harm will help us address problems with psychiatric diagnoses and the dissemination of knowledge about mental disorders in popular culture. The project aims to convince both philosophers and psychiatrists that no plausible theory of the self can be developed without attending to the topic of mental disorder and that no theory of mental disorder can be complete without devising the tools provided by the philosophical approaches to the self as well as developmental and social psychology. It also calls for methodological alterations in mental health ethics research, arguing that a careful scrutiny of mental disorder memoirs can advance the ethical underpinnings to the practice of psychiatry. Authors in this special issue address the theoretical disagreements that are manifest in the clinical and scientific goals of psychiatry and explore the possibility of reconciling the claim that research on psychopathology needs to be scientific with the claim that it needs to address the needs of patients in the clinic. Downsizing is a process whereby human relations management emerges as a critical skill in its effective management. This paperis about perceptions of employees of a small-sized Turkish firm who survived successive downsizing decisions. It was found that downsizing affected the organizational justice-related perceptions of survivors. The questionnaire used to explore organizational justice-related perceptions involved three dimensions and was developed by Saunders and Thornhill (1999). Procedural, interactional and distributive justice-related perceptions of survivors were influenced by the way management handled the process. (...) Summary Leading scholars offer perspectives from the philosophy of science on the crisis in psychiatric research that exploded after the publication of DSM-5. -/- Psychiatry and mental health research is in crisis, with tensions between psychiatry's clinical and research aims and controversies over diagnosis, treatment, and scientific constructs for studying mental disorders. At the center of these controversies is the Diagnostic and Statistical Manual of Mental Disorders (DSM), which—especially after the publication of DSM-5—many have found seriously flawed as a guide (...) for research. This book addresses the crisis and the associated “extraordinary science” (Thomas Kuhn's term for scientific research during a state of crisis) from the perspective of philosophy of science. The goal is to help reconcile the competing claims of science and phenomenology within psychiatry and to offer new insights for the philosophy of science. -/- The contributors discuss the epistemological origins of the current crisis, the nature of evidence in psychiatric research, and the National Institute for Mental Health's Research Domain Criteria project.
