This paper proposes an innovative approach to achieving real-time polymorphic behavior detection, and its direct application to blockchain-focused smart-contracts. We devise a method based on a non-deterministic finite state machine to perform approximate pattern-matching, using a look-ahead mechanism implemented through a concept similar to that of a sliding window, and using threshold-based similarity checking at every state in the automaton. We introduce and formalize our approach, discuss the challenges we faced and then test it in a real-world environment. Professional integrity is a fundamental principle of the International Ethics Standards Board for Accountants Code of Ethics. This does not apply directly to members of a particular professional body, but rather member organizations from around the globe are required to adopt a code no less stringent than the principles in the IESBA Code. Hence, all professional accountants are required to possess integrity as a core ethical principle. In the USA, certified public accountants must, in addition, also adhere to the principle (...) of client advocacy in relation to their tax clients. Despite extensive prior literature on accounting ethics, firm culture, and ethical codes, no prior research has tested whether the communication of an Integrity ethical standard actually affects practitioners’ actual judgments and decisions. In this study, we use brief interventions to determine whether a prime of two ethical professional standards affects tax practitioners’ recommendations to their clients. One implication for professionalism in tax practice is our finding that a brief intervention of professional standards can directly impact on practitioners’ judgments. Most notably, a joint presentation of Advocacy and Integrity leads to contrasting results that depend on the order of the intervention. In sum, when the Integrity standard was presented before the Advocacy standard, tax practitioners were significantly less likely to choose a tax-favorable outcome. That is, the order of professional ethical standard intervention significantly affects tax practitioners’ judgments. (shrink)

The academic databases such as Scopus or Web of Science are commonly used to measure performance of universities, departments, and even single researchers. However, to what extent such databases can represent real outcomes of aforementioned units especially in the field of art and humanities where local languages and cultural phenomena play an important role is not clear. This article focuses on understanding how research in this field, as seen through the case of aesthetics in non-English speaking countries, Finland in particular, (...) is represented through major academic databases. This question is tackled by applying a data mining approach. First, we identify major academic databases, and afterwards test what is the proportion of Finnish aesthetics presented in those databases. Our approach allows us to critically look into representation of local art or humanities related research in general academic databases, and understand to what extent we can trust those sources in representing real pictures of the field. Results strengthen the well-known fact that most common academic databases draw a rather poor picture. In more particular this article shows that there are certain factors that influence analysis of the field: spread data, multilingual content, non-standard categorization, variability of venues, different publishing patterns, and unsuitable impact metrics. However, our results propose that alternative databases can be formed from university or meta-data databases. We also provide further directions for designing of such databases. (shrink)

The article analyses legal preconditions for personal identification in physical and electronic space (hereinafter – cyberspace). Analysis of legal governing of identification in physical space is followed by the analysis of the same in cyberspace. Compulsory elements of identification in physical space and compulsory and non-compulsory elements of identification in cyberspace are provided which leads to conclusions about problem aspects concerning personal identification in cyberspace and related legal governing. This scientific article consists of four main chapters. The first chapter „Identity (...) and Personal Identification“ looks into identity, its content and elements alongside with personal identification. The second chapter „Personal Identification in Physical Space“ scrutinizes legal preconditions of identification in physical space in Lithuania. The third chapter „Personal Identification in Cyberspace“ looks into elements of legally regulated and non-regulated personal identification in cyberspace and discusses identity of a person in cyberspace. The fourth chapter „Electronic Identity of a Person and Legal Regulation“ analyzes and systematizes elements of electronic identity of the person and presumes their reliability and mandatory legal governing. In such cases courts shall apply analogy of law, customs and general principals of law. Last but not least, the courts must address international legal practice as regards the domain name disputes, i.e. take into account the famous ICANN Uniform Domain Name Dispute Resolution Policy adopted in 1999 and mostly applied by the panels of WIPO Arbitration and Mediation Centre while (...) dealing with disputes on generic top level domain names <.com>, <.net>, <.org>, also analyse the practice of ADR cases of Czech Arbitration Court which has the jurisdiction over <.eu> domain name disputes. This article deals with the case-law of Lithuanian courts in <.lt> domain name disputes and analysis the trends of Lithuanian internet law as regards the protection of the owners of intellectual property in Lithuania. The Convention on Cybercrime (the Convention) adopted in the framework of the Council of Europe is the main international legislative tool in the fight against cybercrime. It is the first international treaty on crimes committed via the Internet and other computer networks, dealing particularly with infringements of copyright, computer-related fraud, child pornography and violations of network security. Lithuania is among its signatory states, therefore, the provisions of the Convention have become binding on its legislator, obliging it to take all necessary (...) measures to harmonize national legal acts with the framework set out therein. The Criminal Code of the Republic of Lithuania (the CC) in force is the legal act establishing liability for criminal offences known as computer crimes and Internet crimes. Although the legislator of Lithuania had been combating cybercrimes since as early as 1994 by means of the amendments to the Soviet era Criminal Code of 1961, a significant effort was required to transpose the requirements of the Convention into the Lithuanian law, starting from the year 2007. The end result was not always as expected, leaving several serious gaps in the field of criminalization, which are thoroughly addressed in the article. In particular, this article deals with the topic of computer-related crimes and the legal approaches related to substantive criminal law of the Republic of Lithuania. In this paper we examine some passages of a logical treatise by Christian August Crusius. It seems that Crusius anticipated what might be called the circle of deduction, first discussed by Lewis Carroll. The question now emerges: why was it possible for Crusius to have deeper logical insights than his contemporaries, given that he was not a brilliant logician? The answer here proposed traces these insights back to his very peculiar philosophical premisses, which have been important for Kant's development in (...) his early career. (shrink)

The linguistic theory of the logical A Priori: is it obsolete In holistic interpretations, the logical truths are considered as continuous with empirical science: they are revisable, a posteriori, though very near to the centre of our web of belief. In this paper, we consider the merits and demerits of this approach, and we propose that it is necessary to revaluate holistic philosophies of logic. Some arguments are put forward which point in favour of the logical empiricists’ theory of logical (...) truth. We argue (following Hartry Field) that the concept of “correlation between logical facts and logical beliefs” (which is at the heart of the holistic theory) is inconsistent. Finally, we concentrate on the principle of contradiction and argue (following Manley Thompson) that this principle is fundamental for meaning, truth, and thinking. Diese Studie versucht, die Grundlinien der kantischen Mathematiktheorie zu entwickeln. Es zeigt sich, dass das Problem des "epistemischen Bezugs" zu mathematischen Gegenständen im Mittelpunkt steht. Kant entwickelt hierzu zwei Strategien: unter der Voraussetzung, dass mathematische Erkenntnis "Erkenntnis in concreto", also anschaulich ist, zeigt er 1762, dass diese sich von der empirischen in der Methode der Begriffsbildung unterscheidet. Dies führt auf einen "schwachen" Aprioritätsbegriff. 1770 entwickelt Kant eine anspruchsvollere Theorie: er zeigt, dass die Anschaulichkeit und Apriorität mathematischer Erkenntnis uns nötigen, ein (...) entsprechendes ontologisches Substrat zu fordern, dass er mit Raum und Zeit identifiziert. Diese Strategie wird hier als unbefriedigend kritisiert, und es wird vorgeschlagen, die "schwächere" Konzeption von 1762 stärker zu akzentuieren: mathematische Begriffe können sich auf empirische Anschauungen beziehen; der Bezug auf reine Anschauungen ist dagegen explanatorisch überflüssig. In this study we consider Kant's numerous attempts at finding a secure path to metaphysical truth via mathematical arguments. In 1756, he thinks that in natural philosophy we cannot do without metaphysical speculation, although he admits that there is no way to explain natural phenomena without the aid of experience and geometry. Kant's ideas in this matter have been mainly shaped by the influence of Euler, who proposed that the evident principles of mechanics ought to be taken as starting point (...) for metaphysical considerations. In a similar vein, after 1762 Kant looks for a metaphysical theory of space and time by taking mathematical arguments and observations as starting point for a genuinely presuppositive argument. Along these lines, Kant's so-called "Argument from Geometry" becomes more intelligible, although this paper ends with some sceptical remarks, questioning the existence of evident truths independent of any previous accepted set of metaphysical presuppositions. Niccolo Machiavelli’s teachings have never gone out of fashion; no doubt because power remains a central aspect of modern political and corporate life. The writings of this 16th century thinker seem as relevant today as they were a half millennium ago. Given the immutable nature of human beings, this is hardly surprising. What is surprising is the regular stream of monographs published in the last third of the 20th century, and reaching a crescendo in the last decade, that argue for (...) Machiavelli’s relevance to modern management and corporate leadership. This essay will examine the structure, assumptions and conclusions of these manuals. After reviewing the manuals, this essay concludes that certain of these assumptions upon which these manuals are based are not transferable from a 16th century principality to a 21st century corporation. Not surprisingly, the teachings of these manuals concerning morality and the corporation are either inconsistent with the actual teachings of Machiavelli, or fail to acknowledge the teachings of Machiavelli most relevant to the modern corporate world. By refering to the examples of different cultural traditions, Arūnas Sverdiolas in his study Constitution and Preservation described the mechanisms that are involved in the creation of culture – constitution and preservation. The goal of this article is to show how these mechanisms operated in the reality of the Grand Duchy of Lithuania. The article analyzes the roles that the Lithuanian political society gave to legislation, upbringing, historical narratives, heroic and occasional poetry while constituting and preserving itself.

Moral licensing theory suggests that observers may liberate actors to behave in morally questionable ways due to the actors’ history of moral behaviors. Drawing on this view, a scenario experiment with a 2 (high vs. low ethical)×2 (internal vs. external motivation) between-subject design (N = 455) was conducted in the current study. We examined whether prior ethical leader behaviors cause subordinates to license subsequent abusive supervision, as well as the moderating role of behavior motivation on such effects. The results showed (...) that when supervisors demonstrated prior ethical behaviors, subordinates, as victims, liberated them to act in abusive ways. Specifically, subordinates showed high levels of tolerance and low levels of condemnation towards abusive supervision and seldom experienced emotional responses to supervisors’ abusive behaviors. Moreover, subordinates tended to attribute abusive supervision, viewed as a kind of mistreatment without an immediate intent to cause harm, to characteristics of the victims and of the organization rather than of the supervisors per se. When supervisors behaved morally out of internal rather than external motivations, the aforementioned licensing effects were stronger. (shrink)

Recently at least two papers1,2have appeared that look at cancer from an evolutionary perspective. That cancer has a negative effect on fitness needs no argument. However, cancer origination is not an isolated process, but the potential for it is linked in diverse ways to other genetically determined developmental events, complicating the way selection acts on it, and through it on the evolution of development. The two papers take a totally different line. Kavanagh argues that anti‐cancer selection has led to developmental (...) constraints. Leroi et al. argue that cancer is a side‐effect of recent evolutionary changes that usually will disappear over time through anti‐cancer selection. Here we place the papers in a wider perspective, and in so doing discuss various alternative developmental links cancer may have together with their evolutionary implications. The evolutionary history of muscle development in the paired fins of teleost fish and the limbs of tetrapod vertebrates is still, to a large extent, uncertain. There has been a consensus, however, that in the vertebrate clade the ancestral mechanism of fin and limb muscle development involves the extension of epithelial tissues from the somite into the fin/limb bud. This mechanism has been documented in chondrichthyan, dipnoan, chondrostean and teleost fishes. It has also been assumed that in amniotes, in contrast, (...) individual progenitor cells of muscles migrate from the somites into the limb buds. Neyt et al.(1) now present the exciting finding that in zebrafishes this presumably derived mechanism involving individual cell migration, is present. They conclude, based on data on sharks, zebrafishes, chickens, quails and mice that the derived mechanism was present in the sarcopterygians. This conclusion, however, may be premature in the light of further data available in the literature, which show a highly mosaic distribution of this character in the vertebrate clade. Furthermore, a developmental mode exists that is intermediate between the supposed ancestral and derived modes in teleosts, reptiles and possibly amphibians.
