This article puts forward solutions to some of the ethical and legal dilemmas posed in the current discussion on how to program crash algorithms in autonomous or self-driving cars. The first part of the paper defines the scope of the problem in the criminal legal field, and the next section gives a critical analysis of the proposal to always prioritise the interest of the occupant of the vehicle in situations with conflict of interests. The principle of minimizing social damage as (...) a model for configuring self-driving cars is examined in the third section. Despite its apparent plausibility, within the framework of a liberal legal system that recognises humans as free agents who have rights and responsibilities, maximizing the function of social utility does not justify harmful interference into a person’s legal sphere. Therefore, in the fourth part, the author argues the need to program the crash algorithms of autonomous cars based on a deontological understanding of the system of justifications in criminal law. The solution to the dilemma lies in a prior analysis of the legal positions of all agents involved in the conflict, from a perspective of the principles of autonomy and solidarity as the core of the system of justifications. Montague and Kaplan began a revolution in semantics, which promised to explain how a univocal expression could make distinct truth-conditional contributions in its various occurrences. The idea was to treat context as a parameter at which a sentence is semantically evaluated. But the revolution has stalled. One salient problem comes from recurring demonstratives: "He is tall and he is not tall". For the sentence to be true at a context, each occurrence of the demonstrative must make a different truth-conditional contribution. (...) But this difference cannot be accounted for by standard parameter sensitivity. Semanticists, consoled by the thought that this ambiguity would ultimately be needed anyhow to explain anaphora, have been too content to posit massive ambiguities in demonstrative pronouns. This article aims to revived the parameter revolution by showing how to treat demonstrative pronouns as univocal while providing an account of anaphora that doesn't end up re-introducing the ambiguity. In this paper I will critically assess a very popular interpretation of Heidegger’s early thought, according to which meaning (Bedeutung) is conceived as ontologically dependent on human existence (Dasein). In order to criticize this subjectivist understanding of meaning, I will offer an interpretation of Heidegger’s analysis of signs in Being and Time (§17). This will reveal two main things: first, that the ubiquity of sign-phenomena is founded on the universality of the structure known as reference (Verweisung); second, that Heidegger’s idea (...) of reference offers a non-substantialist understanding of meaning and its relation to the world. In the language of second-order logic, first- and second-order variables are distinguished syntactically and cannot be grammatically substituted. According to a prominent argument for the deployment of these languages, these substitution failures are necessary to block the derivation of paradoxes that result from attempts to generalize over predicate interpretations. I first examine previous approaches which interpret second-order sentences using expressions of natural language and argue that these approaches undermine these syntactic restrictions. I then examine Williamson’s primitivist approach according to which (...) second-order sentences are not offered readings in a previously understood language. I argue that the syntactic restrictions alone do not block the derivation of the paradox, unless they are backed by a principled reason that the language cannot be expanded to allow the grammatical substitution of first- and second- order variables. I argue that there is neither a syntactic nor a semantic principle that prohibits such an expansion. (shrink)

Those of us who take skepticism seriously typically have two relevant beliefs: (a) it’s plausible (even if false) that in order to know that I have hands I have to be able to epistemically neutralize, to some significant degree, some skeptical hypotheses, such as the brain-in-a-vat (BIV) one; and (b) it’s also plausible (even if false) that I can’t so neutralize those hypotheses. There is no reason for us to also think (c) that the BIV hypothesis, for instance, is plausible (...) or probably true. In order to take skepticism seriously it’s sufficient to hold (a) and (b); one need not hold (c). Indeed, philosophers who accept (a) and (b) never endorse (c). Show me a philosopher who suspects that he is a brain in a vat and I’ll show you someone who is deranged! That’s one thing that bothers undergraduates in philosophy. They object: why on earth do some philosophers take the BIV hypothesis to pose any threat at all to our beliefs given that those very same philosophers think that there’s no real chance that the BIV hypothesis is true? Sure, the BIV hypothesis is formally inconsistent with my belief that I have hands, so if the former is true then my belief is false. But so what? Why should that bare inconsistency matter so much? Is this strange attitude amongst philosophers the result of some logic fetish infecting the philosophical community? It is sometimes said that the skeptical hypotheses are not only inconsistent with our beliefs but are explanatory of our experiences, which is supposed to make them more of a threat. But students aren’t fooled: although the skeptical hypotheses may attempt to explain why our experience is as it is, it’s the kind of attempt appropriate for science fiction movies that are all special effects and virtually no plot. No one with any sense of reality will take the evil demon hypothesis to be even tenuously explanatory. (shrink)

The Greek word eoikos can be translated in various ways. It can be used to describe similarity, plausibility or even suitability. This book explores the philosophical exploitation of its multiple meanings by three philosophers, Xenophanes, Parmenides and Plato. It offers new interpretations of the way that each employs the term to describe the status of their philosophy, tracing the development of this philosophical use of eoikos from the fallibilism of Xenophanes through the deceptive cosmology of Parmenides to Plato's Timaeus. The (...) central premise of the book is that, in reflecting on the eoikos status of their accounts, Xenophanes, Parmenides and Plato are manipulating the contexts and connotations of the term as it has been used by their predecessors. By focusing on this continuity in the development of the philosophical use of eoikos, the book serves to enhance our understanding of the epistemology and methodology of Xenophanes, Parmenides and Plato's Timaeus. The principle of compositionality requires that the meaning of a complex expression remains the same after substitution of synonymous expressions. Alleged counterexamples to compositionality seem to force a theoretical choice: either apparent synonyms are not synonyms or synonyms do not syntactically occur where they appear to occur. Some theorists have instead looked to Frege’s doctrine of “reference shift” according to which the meaning of an expression is sensitive to its linguistic context. This doctrine is alleged to retain the relevant claims (...) about synonymy and substitution while respecting the compositionality principle. Thus, Salmon (Philos Rev 115(4):415, 2006) and Glanzberg and King (Philosophers’ Imprint 20(2):1–29, 2020) offer occurrence-based accounts of variable binding, and Pagin and Westerståhl (Linguist Philos 33(5):381–415, 2010c) argue that an occurrence-based semantics delivers a compositional account of quotation. Our thesis is this: the occurrence-based strategies resolve the apparent failures of substitutivity in the same general way as the standard expression-based semantics do. So it is a myth that a Frege-inspired occurrence-based semantics affords a genuine alternative strategy. (shrink)

If you retain your belief upon learning that a large number and percentage of your recognized epistemic superiors disagree with you, then what happens to the epistemic status of your belief? I investigate that theoretical question as well has the applied case of philosophical disagreement—especially disagreement regarding purely philosophical error theories, theories that do not have much empirical support and that reject large swaths of our most commonsensical beliefs. I argue that even if all those error theories are false, either (...) (a) the average philosopher’s true commonsensical beliefs are epistemically impoverished, or (b) a good portion of philosophy is bunk and philosophers should give up most of their error theories despite the fact that their supporting arguments are generally as good as or even better than other philosophical arguments. Aristotle’s theory of human happiness in the Nicomachean Ethics explicitly depends on the claim that contemplation (theôria) is peculiar to human beings, whether it is our function or only part of it. But there is a notorious problem: Aristotle says that divine beings also contemplate. Various solutions have been proposed, but each has difficulties. Drawing on an analysis of what divine contemplation involves according to Aristotle, I identify an assumption common to all of these proposals and argue for rejecting it. (...) The necessity defense is barely accepted in contemporary Western case law. The courts, relying on the opinion held by the majority of legal scholars, have reduced its margin of application to practically zero, since in the framework of contemporary welfare states, there is almost always a “legal alternative.” The needy person who acts on their own behalf, regardless of whether they save an interest higher than the one they injure, does not show due deference to democratic legal solutions and procedural (...) channels. This article aims to contest this abrogative interpretation of the necessity defense and to outline the limits of its legitimate scope. Even in welfare states, there are actions in a necessity scenario that neither question the legal decisions of the democratically elected legislature nor make a mockery of established procedural channels. Goodman and Lederman (2020) argue that the traditional Fregean strategy for preserving the validity of Leibniz’s Law of substitution fails when confronted with apparent counterexamples involving proper names embedded under propositional attitude verbs. We argue, on the contrary, that the Fregean strategy succeeds and that Goodman and Lederman’s argument misfires.

After a period of inactivity, interest in explanationism as a thesis about the nature of epistemic justification has been renewed. Poston and McCain have both recently offered versions of explanationist evidentialism. In this paper, we pose two objections to explanationist evidentialism. First, explanationist evidentialism fails to state a sufficient condition for justification. Second, explanationist evidentialism implies a vicious regress.

:Since the advent of recombinant DNA technology, expectations about the potential for altering genes and controlling our biology at the fundamental level have been sky high. These expectations have gone largely unfulfilled. But though the dream of being able to control our biology is still far off, gene editing research has made enormous strides toward potential clinical use. This paper argues that when it comes to determining permissible uses of gene editing in one important medical context—germline intervention in reproductive medicine—issues (...) about enhancement and eugenics are, for the foreseeable future, a red herring. Current translational goals for gene editing research involve a different kind of editing than would be required to achieve manipulation of complex traits such as intelligence, and there are more pressing questions that need attention if clinical use of gene editing in reproductive medicine ever becomes a possibility. A central dispute in understanding Frege’s philosophy concerns how the sense of a complex expression relates to the senses of its component expressions. According to one reading, the sense of a complex expression is a whole built from the senses of the component expressions. On this interpretation, Frege is an early proponent of structured propositions. A rival reading says that senses compose by functional application: the sense of a complex expression is the value of the function denoted by its functional (...) component for the arguments denoted by its remaining components. I argue that two non-negotiable Fregean theses entail that senses compose by functional application. One thesis is that referents compose by functional application. The other thesis is that an expression in an indirect context refers to its customary sense. (shrink)

Scientifically speaking, quantum mechanics (QM) is the most successful theory ever made. Philosophically speaking, however, it is the most controversial theory. Its basic principles seem to contravene our deepest intuitions about reality, which are reflected in the metaphysical commitments of classical mechanics (CM). The aim of this paper is twofold. First, I argue that QM implies an ontological challenge, and not merely an “ontic” one, as it has been traditionally interpreted in the analytic tradition. Faced with the inaction of liberal democracies to effectively tackle global warming, many climate activists engage in forms of protests that involve committing minor criminal offences. They seek to shape official decisions on climate policies by resorting to civil disobedience. Some of these activists, rather than accepting punishment, have successfully claimed to be acting in a justified manner by invoking the necessity defence. The aim of this article is to show that, within the framework of representative democracies guided by the (...) rule of law, the climate necessity defence must be rejected, since such protests do not meet the ‘non-legal alternatives’ requirement. This does not mean, however, that protesters should be punished as common offenders. Their acceptance of responsibility and political motivation should be taken into account as a mitigating factor at sentencing. (shrink)

The distinction between germline and somatic gene editing is fundamental to the ethics of human gene editing. Multiple conferences of scientists, ethicists, and policymakers, and multiple professional bodies, have called for moratoria on germline gene editing, and editing of human germline cells is considered to be an ethical “red line” that either never should be crossed, or should only be crossed with great caution and care. However, as research on germline gene editing has progressed, it has become clear that not (...) all germline interventions are alike, and that these differences make a significant moral difference, when it comes to ethical questions about research, regulation, clinical application, and medical justification. In this paper, I argue that, rather than lumping all germline interventions together, we should distinguish between revising, correcting, and transferring genes, and I assess the consequences of this move for the ethics of gene editing. There is a long history of using facts about disagreement to argue that many of our most precious beliefs are false in a way that can make a difference in our lives. In this essay I go over a series of such arguments, arguing that the best arguments target beliefs that meet two conditions: (i) they have been investigated and debated for a very long time by a great many very smart people who are your epistemic superiors on the matter (...) and have worked very hard under optimal circumstances to figure out if the belief is true, and (ii) as far as you know these people have not come to any significant agreement on the belief and as far as you know those who agree with you are not, as a group, in a better position to judge the belief than those who disagree with you. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Esto es debido a que los tratamientos desinfectantes llevados a cabo actualmente por industria de IV gama son insuficientes para garantizar la seguridad microbiológica de los productos finales, y además estos no reciben ningún tratamiento capaz de eliminar todos los patógenos antes de su consumo. Por lo tanto, es necesario (...) utilizar estrategias al­ternativas para reducir los microorganismos patógenos y alteran­tes en frutas y hortalizas. La bioconservación, mediante el uso de microorganismos o sus metabolitos, es una alternativa que, en combinación con las prácticas habituales, puede reducir o prevenir el crecimiento de patógenos en productos mínimamente procesa­dos, mejorando su calidad microbiológica. This book develops a comprehensive framework for ethics in the helping professions based on bioethicist Bernard Gert's theory of common morality. The prevailing model of ethics education is built upon adherence to codes of ethics applied largely through the use of decision-making trees. While a firm understanding of a professions code of ethics and all relevant laws is essential to responsible practice, this approach to teaching ethics excludes the opportunity for students to acquire a holistic, and grounded understanding of moral (...) action. The framework proposed in this text moves beyond codes of ethics, and allows students to develop a cohesive sense of ethical reasoning that both validates their moral intuition and challenges moral assumptions. The theory of a common morality uses a systematic, step-by-step approach that readers and practitioners can apply to all questions of moral action and behaviour. While there is no such thing as a single right answer to any ethical question, by following this approach practitioners can confidently eliminate the bad decisions, allowing them to feel more secure in their decision and practice. By considering the epistemology and relations among certain philosophical problems, I argue for a disjunctive thesis: either (1) it is highly probable that there are (i) several (ii) mutually independent philosophical reductios of highly commonsensical propositions that are successful—so several aspects of philosophy have succeeded at refuting common sense—or (2) there is enough hidden semantic structure in even simple sentences of natural language to make philosophers highly unreliable at spotting deductive validity in some of the simplest cases—so we are much (...) worse at logic than we think and cannot, in general, know when our own arguments are valid. We tend to think that philosophical progress, to the extent that it exists, is a good thing. I agree. Even so, it has some surprising unfortunate consequences for the rationality of philosophical belief.

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. I have taken the traditional problem of the seeming interdependence of identity concepts and essentialistic concepts and the attendant difficulties with circularity as a starting point in my consideration of recent attempts to provide accounts ofde re essences. Having distinguished between theories of individual and generic essences, I have shown how a linguistic device based upon a new approach to referring expressions has, perhaps, provided some advance in the understanding of individualde re essences. I have argued that, however efficacious these (...) linguistic devices may be in dealing with individual essences, they are of no help in dealing with generic essences. I considered, therefore, one of the recent attempts to use science as the arbiter ofde re essences and concluded that such attempts will not, ultimately, solve the traditional problem of circularity. That problem remains, arising in different forms to thwart different attempts to account forde re generic essences. (shrink)

Design of clinical trials for germline gene editing stretches current accepted standards for human subjects research. Among the challenges involved is a set of issues concerningintergenerational monitoring—long-term follow-up study of subjects and their descendants. Because changes made at the germline would be heritable, germline gene editing could have adverse effects on individuals’ health that can be passed on to future generations. Determining whether germline gene editing is safe and effective for clinical use thus may require intergenerational monitoring. The aim of (...) this paper is to identify and argue for the significance of a set of ethical issues raised by intergenerational monitoring in future clinical trials of germline gene editing. Though long-term, multigenerational follow-up study of this kind is not without precedent, intergenerational monitoring in this context raises unique ethical challenges, challenges that go beyond existing protocols and standards for human subjects research. These challenges will need to be addressed if clinical trials of germline gene editing are ever pursued. (shrink)

This article argues that economic crises are incompatible with the realisation of non-domination in capitalist societies. The ineradicable risk that an economic crisis will occur undermines the robust security of the conditions of non-domination for all citizens, not only those who are harmed by a crisis. I begin by demonstrating that the unemployment caused by economic crises violates the egalitarian dimensions of freedom as non-domination. The lack of employment constitutes an exclusion from the social bases of self-respect, and from a (...) practice of mutual social contribution crucial to the intersubjective affirmation of one’s status. While this argument shows that republicans must be concerned about economic crises, I suggest a more powerful argument can be grounded in the republican requirement that freedom must be robust. The systemic risk of economic crisis constitutes a threat to the conditions of free citizenship that cannot be nullified using policy mechanisms. As a result, republicans appear to be faced with the choice of revising their commitments or rejecting the possibility that republican freedom can be robustly secured in capitalist societies. In this paper I begin by suggesting that Immanuel Kant’s argument for the impermissibility of treating others with contempt seems to be subject to a paradox very similar to the well known paradox of forgiveness first described by Aurel Kolnai. Specifically, either the object of the judgment of contempt is not really contemptible, in which case the prohibition on treating him with contempt is superfluous, or else the person truly is contemptible, in which case the prohibition seems unjustifiable, reducing to (...) a mere condonation of wrongdoing. My goal in the paper is to show that this paradox is only apparent. Making use of the philosophy of phrases that Jean-François Lyotard develops in The Differend—emphasizing especially the ideas of phrase-event, presentation, situation, addressor, and addressee—I argue that the Kantian prohibition on treating others with contempt is rationally defensible, even in cases in which we believe the object of the judgment of contempt truly is contemptible.
