This article deals with the question of which kinds of deceptions vitiate consent to sexual relations. More specifically, it addresses the question of which characteristics of the perpetrator (e.g. their identity, wealth, or marital status), of their relations with the victim (e.g. marriage, long-term intentions), or of the sexual act itself (e.g. protected) vitiate consent when deception is involved. In this proposal, we offer our view on how this question should be answered: the criminalisation of deceptive sex should be cautiously (...) extended to include deception regarding any characteristic of the deceiver or the relationship on which the deceived’s consent was conditional, where the deceiver was aware of this conditionality. To support our proposal, we examine the different definitions of “deceptive sex” and diverse legal approaches taken to its criminalisation in the United Kingdom, Germany, and Israel, and discuss their respective merits and shortcomings. Surprisingly, different jurisdictions take strikingly different stances on these matters. This diversity ranges from the narrow definition of traditional English law (and its more opaque contemporary version in England, Canada, and Israel) to the minimalist approach of the German system. To counter the risk of over-criminalisation inherent in our proposal, we also propose using an offence lighter than rape and criminalising only those deceivers who actively lied and whose actual knowledge of the victim’s hypothetical refusal can be proven beyond reasonable doubt. Overall, while our proposal would cautiously extend the criminalisation of deceptive sex to some types of cases that are currently not criminalised, it would also significantly limit the criminalisation of deceptive sex by enhancing the requirements regarding both the accused’s actus reus and their mens rea. Stereotypes are false or misleading generalizations about groups, generally widely shared in a society, and held in a manner resistant, but not totally, to counterevidence. Stereotypes shape the stereotyper’s perception of stereotyped groups, seeing the stereotypic characteristics when they are not present, and generally homogenizing the group. The association between the group and the given characteristic involved in a stereotype often involves a cognitive investment weaker than that of belief. The cognitive distortions involved in stereotyping lead to various forms of (...) moral distortion, to which moral philosophers have paid insufficient attention. Some of these are common to all stereotypes—failing to see members of the stereotyped groups as individuals, moral distancing, failing to see subgroup diversity within the group. Other moral distortions vary with the stereotype. Some attribute a much more damaging or stigmatizing characteristic (e.g. being violent) than others (e.g. being good at basketball). But the characteristic in question must also be viewed in its wider historical and social context to appreciate its overall negative and positive dimensions. (shrink)

The arguments in favor of the Principle of Indifference fail to explain its fruitfulness in science. Using the recent metaphysical concept of Grounding, I devise an explanation that can justify a weak version of the principle and discuss an instance of its application in Quantum mechanics.

Leibniz uses the concept of probability in both epistemic and non-epistemic contexts, as do many of his contemporaries. Some commentators have claimed that this dual-use is inexact or confused. In this paper, I describe Leibniz’s understanding of the concept of probability and discuss its dual usage in his work. Then, building on Leibniz’s creation theory, in conjunction with Russell’s interpretation of the Principle of Sufficient Reason, I endeavor to justify this dual usage and to show that this justification is also (...) valuable for the contemporary discussion of the concept of probability. When Maggie Hall died on March 3, 1999, CQ lost a valued friend and irreplaceable editorial consultant. Maggie, with her musician's gift for the sound of the written word, left her mark on every issue of the journal; and, with gratitude, this volume is dedicated to her memory. We asked Henrik Blum, Emeritus Professor in the School of Public Health, University of California, Berkeley, who worked with her over many years, to share some of his memories of Maggie.

In principle, all patients deserve to receive optimal medical treatment equally. However, in situations in which there is scarcity of time or resources, medical treatment must be prioritized based on a triage. The conventional guidelines of medical triage mandate that treatment should be provided based solely on medical necessity regardless of any non-medical value-oriented considerations (“worst-first”). This study empirically examined the influence of value-oriented considerations on medical triage decision–making. Participants were asked to prioritize medical treatment relating to four case scenarios (...) of an emergency situation resulting from a car collision. The cases differ by situational characteristics pertaining to the at-fault driver, which were related to culpability attribution. In three case scenarios most participants gave priority to the most severely injured individual, unless the less severely injured individual was their brother. Nevertheless, in the aftermath of a vehicle-ramming terror attack most participants prioritized the less severely injured individual (“victim-first”). Our findings indicate that when caregivers are presented with concrete highly conflictual triage situations their choices may be based on value-oriented considerations related to contextual characteristics of the emergency situation. Philosophical and practical ramifications of our findings are discussed. (shrink)

This paper studies the notion of virtuality in the Bohr-Kramers-Slater theory of 1924. We situate the virtual entities of BKS within the tradition of the correspondence principle and the radiation theory of the Bohr model. We show how, in this context, virtual oscillators emerged as classical substitute radiators and were used to describe the otherwise elusive quantum transitions. They played an effective role in the quantum theory of radiation while remaining categorically distinct and ontologically separated from the quantum world of (...) the Bohr model. The notion of virtuality thus differs markedly from its counterpart in quantum mechanics or QFT. (shrink)

This book demonstrates that ancient Christian Gnosticism was an ancient form of cultural criticism in a mythological garb. It establishes that, much like modern forms of critical theory, ancient Gnosticism was set on deconstructing mainstream discourses and cultural premises. Strains of critical theory dealt with include the Frankfurt School, queer theory, and poststructural philosophy. The book documents how in both ancient Gnosticism and modern critical theories issues that used to serve as premises for discussion or as concepts relegated to the (...) realms of the “natural” and the “given” in their respective historical contexts, are transformed into objects of contention. The main aim of this book is to salvage the historical category of Gnosticism from its present scholarly disavowal, if only because Gnosticism, when read as a cultural, and not only a religious phenomenon, presents us an ancient form of culture criticism which would be hard to parallel until (post) modernity. While Hans Jonas remarked many years ago that “something in Gnosticism knocks at the door of our Being and of our twentieth-century Being in particular,” by the 21st century global world this something has already entered and lives with us. We can thus still benefit from another perspective, even if it comes from Mediterranean people who lived almost 2,000 years ago. (shrink)

Emmanuel Levinas's concept of "the face of the Other" involves an ethical mandate that is presumably transcultural or, in his terms, "precultural." His essay "Meaning and Sense" provides his most explicit defense of the idea that the face has a meaning that is not culturally relative, though it is always encountered within some particular culture. Levinas identifies his position there as a "return to Platonism." Through a careful reading of that essay, exploring Levinas's use of religious terminology and the (sometimes (...) implicit) relationships of the essay to the work of other phenomenologists and of Saussure, the author seeks to clarify (1) what Levinas retains and what he rejects in returning to Platonism "in a new way," (2) the sense in which this return constitutes an "overcoming" of relativism, and (3) the nature of the phenomenological warrant that he offers for his position. Charles Taylor’s ‘Politics of Recognition’ has given philosophical substance to the idea of ‘recognition’ and has solidified a link between recognition and multiculturalism. I argue that Taylor oversimplifies the valuational basis of recognition; fails to appreciate the difference between recognition of individuals and of groups; fails to articulate the value of individuality; fails to appreciate the difference between race and ethnoculture as dimensions of identity; and fails to appreciate equality as a recognitional value. In discussing his conceptions of history and time, however, it is the aim of this paper only to locate these within his own philosophy. [End Page 59]One of the unresolved problems in the writings of Francesco Patrizi is the difference between his earlier contributions to the humanistic canon and his late philosophical main treatise, Nova de universis Philosophia. The earlier writings conform to the usual humanist literary topics: the political program of a città felice, the treatises on honor, the poetic fury, Petrarch (1553), and then his two dialogues on history (1560) and rhetoric (1562). The two works which followed, the Discussiones peripateticae (1571) and the Poetics (1586), show a characteristic development of humanist thinking, namely, the differentiation of purely philological from essentially philosophical literature.Patrizi's Discussiones peripateticae 5 is a polemic against Aristotle, written from a Platonic viewpoint, but his own philosophy is concealed under a mass of philological material. In an attempt that seeks to be virtually definitive, he cites passages from Aristotle and the Peripatetic tradition in order to point out mistakes and contradictions. It was on this account that Giordano Bruno heaped ridicule on him, calling him "sterco di pedanti." Simply put, he tells us, Patrizi demonstrates "how like he is to an ox or an ass." One cannot say that he has understood Aristotle either well or ill, but merely that he has read him and reread him, cut him up and stitched him together, compared him with a thousand other Greek writers, friends and foes alike, and altogether gone to an immense deal of trouble, not only to no purpose whatsoever but also to our infinite disappointment. This book, based on a colloquium at the Warburg Institute, London in 1997, strives at extending the limits of (...) this period into the sixteenth and fifteenth centuries. Thus "the long-standing exclusion of the Renaissance from the standard philosophical curriculum" (xii) should come to an end by acknowledging its being an integral part of early modern philosophy and its relevance for an understanding of modern thought. The distinctive element of the Renaissance was, according to the editors, humanism, understood as the revival of ancient sources from the fourteenth century on, and its impact on the shaping of modern thought by these sources.One can identify the following types of argument offered in the twelve contributions to this book: (1) Renaissance humanists mediated classical sources into the seventeenth and following centuries either by translating Greek texts into Latin (Lohr on Aristotle commentaries) or by offering new interpretations that were to become standard (Hankins on Ficino and Galileo, and Mercer on the German Platonists). (2) Ancient modes of thought, mediated through the Renaissance, shaped modern philosophy (Stone on Aristotelian and Reformed ethics, Levi on Stoicism in Justus Lipsius, Kraye on Marcus Aurelius editions, and Osler on Gassendi and Aristotle). Thus Descartes's triumph was that of the myth of the irrelevance of history to philosophy as evident in Galileo, Locke, and even Hume. If antecedents are acknowledged, e.g., in Berkeley, then accepting that they "provide us either with an irreplaceable source of wisdom or with equally irreplaceable models for imitation, or indeed both" (167), still fails to recognize that the history of a philosophical problem is a part of that problem rather than just some general "wisdom" or a model for imitation. Of course, Milton repeats the myth of Bacon's anti-humanism, masterly refuted in this very book by Brian Vickers, and Milton believes that Valla "enthroned" "custom and example" and therefore for him "it would be difficult if not impossible to state Hempel's Raven Paradox" (169). One might wonder whether the conclusion: "All ravens are black --all non-black things are non-ravens," is the paramount of modern philosophy. But a thorough reader of Valla's logic might discover similarities to pragmatism, which are fostered by his deep criticism of language with the tools of Renaissance humanism. However, Descartes's indebtedness to Renaissance method and rhetoric is handbook knowledge today.The audience for this collection of samples are specialists either in seventeenth- or eighteenth-century philosophy, or in Renaissance thought, or even philosophers in the narrow sense of the disciplines. In this follow-up to the highly successful _Ethnography Unbound,_ Michael Burawoy and nine colleagues break the bounds of conventional sociology, to explore the mutual shaping of local struggles and global forces. In contrast to the lofty debates between radical theorists, these nine studies excavate the dynamics and histories of globalization by extending out from the concrete, everyday world. The authors were participant observers in diverse struggles over extending citizenship, medicalizing breast cancer, dumping toxic waste, privatizing nursing homes, the degradation of (...) work, the withdrawal of welfare rights, and the elaboration of body politics. From their insider vantage points, they show how groups negotiate, circumvent, challenge, and even re-create the complex global web that entangles them. Traversing continents and extending over three years, this collaborative research developed its own distinctive method of "grounded globalization" to grasp the evaporation of traditional workplaces, the dissolution of enclaved communities, and the fluidity of identities. The authors examine the experiences and ideals of African American working-class mothers through 20 intensive interviews. They focus on the women's negotiations with racialized norms of motherhood, represented in the assumptions that legal marriage and an exclusively bonded dyadic relationship with one's children are requisite to good mothering. The authors find, as did earlier phenomenological studies, that the mothers draw from distinct ideals of community-based independence to resist each of these assumptions and carve out alternative scripts based on nonmarital relationships (...) with male partners and shared care of children. Friendship, Altruism, and Morality, originally published in 1980, gives an account of "altruistic emotions" and friendship that brings out their moral value. Blum argues that moral theories centered on rationality, universal principle, obligation, and impersonality cannot capture this moral importance. This was one of the first books in contemporary moral philosophy to emphasize the moral significance of emotions, to deal with friendship as a moral phenomenon, and to challenge the rationalism of standard interpretations of Kant, although Blum’s "sentimentalism" (...) owes more to Schopenhauer than to Hume. It was a forerunner to care ethics, and feminist ethics more generally; to virtue ethics; and to subsequent influential interpretations of Kant that attempted to room for altruistic emotion and friendship, and other forms of particularism and partialism.
