Bu çalışma hicrî birinci asrın ikinci yarısında Basra’da hadis ve fıkıh sahasındaki ilmî hareketliliği konu edinir. İlgili dönemde, orada yaşayan sahâbenin en meşhuru ve Hz. Peygamber’le en uzun süre birlikteliğe sahip olması hasebiyle, Enes b. Mâlik’in Basra’daki etkisi özel olarak ele alınır. Bu amaçla Enes b. Mâlik’le ilgili birçok rivayet tahlil edilir ve onun hem Basra’da hem de diğer şehirlerde yaşayan sahâbe ve tâbiûnla arasındaki ilmî ilişkileri üzerinde durulur. Çalışma mezkûr zaman diliminde Basra’da hadis faaliyetlerinin fazla, fıkıh faaliyetlerinin ise (...) az olduğunun tezahürlerini gösterir. Enes’in öğrencileri üzerindeki etkisi; öğrencilerinin fakih mi yoksa muhaddis mi olduğu araştırılır. Enes’in tabiûnla ilişkileri, kendisine yapılan rihleler, başka şehirlerde yaşayan fakih tabiûnun ondan rivayeti, İbn Ebî Şeybe’nin Musannef’i çerçevesinde onun fıkhî şahsiyeti ve başka meseleler incelenir. Böylece onun fıkhî melekesinin İbn Abbas ve İbn Ömer’le aynı derecede olmadığı ve benzer şekilde Basra’nın sahabenin fakihlerinden tabiûnun fakihlerine nakledilen “amel-i mütevâres”e önem veren Medine ve Kufe gibi bir fıkıh şehri olmadığı sonucuna ulaşılır. Basra, müksirûndan olan sahabî Enes b. Malik sayesinde hadislerin rivayetine, yayılmasına ve onlarla amel edilmesine önem verilen bir şehirdi. Ancak bu hadislerin yayılması aynı dönemde Mekke’de İbn Abbas’ın faaliyetleri ile kıyaslanabilecek bir fıkhî faaliyeti de beraberinde getirmedi. Dolayısıyla Basra sahabe döneminde fıkıh ilmî açısından geri kalırken hadis sahasında hareketliydi. Bu nedenle ona fıkıh ve “amel-i mütevâres” değil rivayet şehri denilmesini hak etmektedir. Bu araştırma hicri birinci asrın ilk yarısında varlık gösteren Basra’nın, fıkhıyla meşhur bazı sahâbîlere ev sahipliği yapmasına rağmen hadis ve fıkıh ilimlerinde, aynı dönemde öne çıkan Kûfe’den geri kalmasının muhtemel sebeplerine odaklanmaktadır. Söz konusu sahâbe arasında öne çıkanlar, Basra’da on iki sene ikamet etmiş olan Ebû Musa el-Eş’arî ve dört sene bulunan İbn Abbas’tır. Mezkûr iki sahâbenin fıkhî müktesabatlarının yanında çok sayıda hadis rivayetine sahip olduğu da bilinmektedir. Ancak buna rağmen her ikisinin de İbn Mes‘ûd’un, Kûfe’de yaptığı etkiyi gösterdikleri (...) söylenemez. Araştırmada, Basra’da meskûn bulunan sahâbeyle ilgili rivayetlerin tahlil ve değerlendirmesine dayalı bir yöntem takip edilmiş olup, özellikle sahâbe ile tâbiînin ilmî ilişkilerine yoğunlaşılmıştır. Bununla beraber coğrafya ve kuruluş bakımından benzerlik gösteren Kûfe şehrindeki sahâbenin ilmî etkisi ve tâbiîn neslinin faaliyetleri bakımından bir takım karşılaştırmalarda bulunulmaktadır. Makalenin, konu hakkında öngördüğü birinci ihtimal, söz konusu sahâbîlerin ordugâh şehrinde yaşamanın gereği olarak fetihlerle meşgul olmalarıdır. Bu sonuç ilk olarak Ebû Musa el-Eş’arî’nin sireti üzerine yapılan incelemelerde ortaya çıkmıştır. Söz konusu ilmî gecikmeye sebep olan ikinci ihtimalin ise bahsi geçen sahâbenin ilimlerini yaymak adına aktif davranmamaları olduğu söylenebilir. Bu durumda sahâbenin ilmî kişiliklerinin önemli bir rol oynadığı düşünülmektedir. Diğer bir ihtimal, Basra’daki tâbiîn neslinin, sahâbeden ilim alma hususunda sarfettikleri çabanın, Kûfelilere kıyasla daha az olmasıdır. Bahsi geçen durumda Basra’nın bedevî kabile yapısının önemli bir etkili olduğu düşünülmektedir. Konuyla ilgili zikredilebilecek son ihtimal ise ilmî yapının teşekkül etmeye başladığı süreçte vuku bulan fitne ve karışıklıklardır. Nitekim bir müddet valilik görevini yürüten İbn Abbas’ın, bu süre zarfında ilim ve eğitim faaliyetleriyle ilgilenemediği görülür. Özetle araştırmanın ulaştığı en önemli sonuç; Basra’nın hicri birinci asrın ilk yarısında, İbn Mes’ûd tarafından kurulan Kûfe’ye kıyasla hadis ve fıkıh ilimlerinde gelişmiş bir şehir olmadığıdır. Son yıllarda İslam hukukunun kökeni ve gelişimi üzerine önemli çalışmalar yapılmaktadır. Bununla birlikte, hicrî birinci yüzyıl ile ilgili temel kaynakların olmayışı veya eksikliği dolayısıyla, bu dönemde rivayet edilen bilgilerin doğruluğu hakkında bazı şüpheler dile getirilmiştir. Bu nedenle, Risâletü’l-Ferâ’iḍ olarak adlandırılan yeni ve güvenilir eseri incelemenin önemli bir boşluğu dolduracağı kanaatindeyiz. Bu eserin, ilk olarak Zeyd b. Sâbit tarafından kaleme alındığı ve daha sonra hem birinci hem de ikinci yüzyıllarda yaşayan Ebu’z-Zinâd tarafından tefsir edildiği kabul edilir. Bu çalışmada, Muvaṭṭa’ (...) ile Risâletü’l-Ferâiḍ’ arasındaki otuz beşe yakın paragraftaki benzerlikten hareketle Risâlatü’l-Ferâiḍ’in, Muvaṭṭa’ın yazımı sürecinde bir kaynak olarak hizmet ettiği ve ayrıca Medine ehlinin ameli hakkında önemli bilgiler içerdiği tespit edilecektir. Son olarak, bu risalenin analizi ile temel hadis koleksiyonlarının sadece şifâhî rivâyetlere değil, bununla beraber yazılı belgelere de dayandığına dair iddianın daha isabetli olduğu ortaya çıkacaktır. Bu makalede İhlas Sûresi’nin faziletiyle ilgili olarak nakledilen Muâviye b. Muâviye rivâyeti ele alınmıştır. Söz konusu rivâyette İhlâs Sûresini sürekli okuduğu için yüksek derecelere erişen ve cenazesine Cebrâil’le birlikte 70 bin meleğin saflar halinde katıldığı Muâviye b. Muâviye’den bahsedilmektedir. Muâviye vefat ettiği sırada Tebük Gazvesi’nde bulunan Hz. Peygamber’e Cibrîl bizzat gelerek onun vefatını haber vermiştir. Cibrîl ayrıca Resûlullah’ın Muâviye’nin cenaze katılması için dağları tepeleri aralayarak yeryüzünü dürmüştür. İhlâs Sûresi’nin faziletiyle ilgili olağanüstü hallerden bahseden Muâviye b. Muâviye rivâyeti Enes b. Mâlik (...) ve Ebû Ümâme’den merfû, Hasan-ı Basrî ve Saîd b. Müseyyeb’den mürsel olmak üzere toplam dört kişiden nakledilmiştir. Çalışmamızda, hadisler hakkında sıhhat hükmü verebilmek için öncelikle isnaddaki râvîlerin cerh-ta‘dil durumları tespit edilmiştir. Muâviye b. Muâviye hadisinin isnad analizi, rivâyetin ulaşılabilen bütün tarikleri üzerinden yapılarak her bir tarik ayrı ayrı değerlendirmeye tabi tutulmuştur. Sözkonusu rivâyetlerin metin analizi ise rivâyetlerdeki lafız ve muhteva farklılıkları üzerinden yapılmıştır. Metin analizi, rivâyetlerin önce kendi içinde daha sonra diğer hadislerle mukayesesi şeklinde yapılmıştır. Rivâyetler arası karşılaştırmalar yapılırken önce kendi içlerinde ortak bir kompozisyon oluşturulmuş daha sonra diğer rivâyetleri birbirleriyle karşılaştırma yöntemine başvurulmuştur. İsnad ve metin analizinin sonunda Muâviye b. Muâviye rivâyetinin kaynak değeri tespit edilmiştir. (shrink)

In the history of İslāmic thought, Māturīdī is a famous scholar both in the field of kalām and tafsir. Being approved by Māturīdī, the distinction of tafsir and ta’wīl, which makes possible to take the comments made about the verses into sistematic framework, is quite important. There is an important information both about content of the distinction approved by Māturīdī and the main reasons that necessiated this distinction in the introduction of Samarqandī’s Sharh at Ta’wīlāt. From this information, it is (...) understood that the distinction of tafsir and ta’wīl had dated back to older time than Māturīdī and previous scholars dealed with the problem that necessiated this distinction and Māturīdī inherited this distinction from his predecessors. Information in the Sharh at Ta’wīlāt reveals that according to Māturīdī the companions had made interpretation (ta’wīl) in addition to tafsir and the explanations made by certain evidences is tafsir too. Therefore this information gives us the opportunity flexing the acceptance of the idea “tafsir, is dedicated to the companions, ta'wīl is dedicated to fuqaha (jurists)” and asserting that companions and scholars made both tafsir and ta’wīl. In this paper, we will research whether the distinction tafsir and ta’wīl regarded by Māturīdī completely belonged to his or not and content of the distinction and its reasons. We will also analyze this distinction according to examples in the Ta’wîlāt. Summary: An important distinction is made between the concepts of tafsir and ta’wīl in the short preface of Māturīdī's tafsir, and this distinction is particularly prominent in contemporary tafsir studies. Because from the point of view of the value they carry, the explanations for these differences and concepts express the legitimacy of the following mufassirūn (writers of a commentary on the Qur’an) to be able to perform tafsir, as well as the value of the explanations found in tafsir literature in terms of certainty. In Ta'wīlāt, tafsir is described as the precise determination of what is intended. Determination of what is exactly intended in verse/wording is bound to certainly know the conditions under which it was revealed. Because they are the first to be addressed directly and they witnessed the context, the tafsir is only for the companions (ṣaḥābah pl. aṣḥāb). On the other hand, ta’wīl is not a definite determination of what is intended, but rather it is explained as putting the possibilities forward. In this case, ta’wīl is dedicated to the scholars after the companions. When we look at the other tafsir sources that include his views, it can be understood that this brief information in the preface of the tafsir which survived to our day is partially incomplete. Samarqandī's Sharhu’t-ta'wīlāt is the most important of these sources. According to the information here, Māturīdī states that some scholars distinguish tafsir and ta’wīl from each other. In these distinctions, tafsir is either described in relation to a definitive statement or in relation to being familiar with the conditions of revelation, while ta’wīl is described as extracting meanings from the verses and making possible meanings without claiming certainty. These explanations show that the distinction between tafsir and ta’wīl in Ta'wīlāt's preface was mainly based on the period before Māturīdī. These statements, which Māturīdī transmitted from some scholars in the beginning of Sharhu’t-ta'wīlāt, were then transmitted by Omar al-Nasafī, Mahāyimī and Molla Husrev. In some sources, it was also transmitted that similar explanations were made by scholars such as an-Nadr b. Shumayl, al-Hussein b. Fadl al-Bacelī and Ibn Durayd before Māturīdī.Some explanations of Māturīdī in Ta'wīlāt enables the theory of tafsir-ta’wīl to be understood at a wider level. When the examples are examined, it is observed that Māturīdī exhibited two types of attitude against the tafsir of the companions. He states that one of these is that if the transmission is true, what is intended is exactly what is stated in the narrated. The second is that he sometimes does not accept these explanations and suggests additional opinions. The reason he refuses is that sometimes he does not find the transmission reliable, and sometimes he thinks that companions performed ta'wīl. If this is the case, the dedication of ta’wīl to those coming later should not be absolutized. Because the companions can perform both tafsir and ta’wīl. The examples in Ta'wīlāt clearly reveal what areas tafsir, which is defined as a definite statement, covers. According to this, first, tafsir is related to the field of “invisible” about the past and the future. Secondly, its meaning and practice is only about the information of the “statement” about the issues that can be revealed by the Prophet (pbuh). In the third aspect, it is related to “revelation” information reporting the context in which the verses descended. In the beginning of Sharhu’t-ta'wīlāt, Māturīdī says that the explanations made based on the definitive evidences such as mutawātir (repetition; narration reported by large number reporters) and ijmā (consensus) also fall under the category of tafsir. However, it is also necessary to add intellectual evidence to these evidences. Because intellectual evidence is also important in the epistemology of Māturīdī. In fact, the truthfulness of nass (text) is primarily based on intellectual evidence. First, the issues of theology are proven by certain intellectual evidence, and then, on the basis of this, the meanings expressed by the nass acquire the value of certainty and truthfulness. With the definitive acceptance of reason in theology, what some nass express confirm each other and are used as evidence in the process of interpretation. Therefore, since some of the intellectual evidence, ijmā and mutawātir news provide definitive information, explanations based on them are also seen as tafsir. Considering the fact that the above-mentioned evidence was also used by those coming after the companions, it can be concluded that tafsir can be performed by not only the companions but also those coming after them. In this case, it should be accepted that tafsir is not performed only by the companions, and that the succeeding mufassirūn can also perform tafsir as well as ta’wīl. When we look at the examples based on these evidence, there are two different situations in Ta'wīlāt. The first is that Māturīdī sometimes has views on evidence based on mutawātir and ijmā and sometimes suggests different opinions from the assumptions that he said there was ijmā in particular. Because these evidences are certain, it is understandable that he remains bound to them. However, as a possible reason for his opposition to ijmā, it can be said that he thinks only the following generations enter the scope of ijmā. Because, according to Samarqandī, Māturīdī's objection to such information does not seem possible, since ijmā of the companions in a matter is accepted. Although he sometimes said that there was ijmā, the reason why no such ijmā was mentioned in other tafsir sources and sometimes, it may be considered that he did not respect other views in the face of ijmā as a reason for including different views or it may be thought that he was unaware of the different views that were transmitted. The second remarkable situation is that according to Māturīdī, intellectual evidence, in particular, can reveal only the “knowledge of existence” of the issues related to theology. Māturīdī thinks that their nature cannot be certainly known, and that the explanations made regarding their nature are only ta’wīl. For this reason, he firmly rejects the interpretation of the khabarī attributes about Allah in accordance with the idea of tashbīh and tajsīm (anthropomorphism). (shrink)

Hicrî birinci yüzyılın sonu ile ikinci yüzyılın ortalarında yaşamış bulunan Ca‘fer-i Sâdık ve Ebû Hanîfe, akran iki âlimdir. Kûfe’de yetişen ve Ehl-i sünnet mezheplerinden birinin imamı olan Ebû Hanîfe’nin, Medine’de yetişen ve İsnâaşeriyye’nin altıncı imamı kabul edilen Ca‘fer ile bir araya geldiği ve onun talebesi olduğu hem sünnî hem Şiî kaynaklarda rivayet edilmektedir. Mukaddem kaynaklarda Ebû Hanîfe’nin Ca‘fer-i Sâdık’ın öğrencisi olduğu yönündeki ifadelerin, muahhar kaynaklarda abartılı bir şekilde yorumlandığı görülmüştür. Bu çalışmada Ebû Hanîfe ile Ca‘fer-i Sâdık arasındaki hoca-talebe ilişkisi (...) netleştirilmeye çalışılmıştır. Bu sebeple öncelikle kısaca her iki imamın hayatı ele alınarak onların ilmî birikimi tespit edilmiştir. Akabinde Ebû Hanîfe ile Ca‘fer’in ne zaman ve ne kadar süre birlikte oldukları, Ebû Hanîfe’nin Ehl-i beyt’e yönelik tutumunun Ca‘fer’den ilim almasında ne gibi bir etkisinin bulunduğu ve çeşitli ilim dallarında Ebû Hanîfe- Ca‘fer ilişkisi tespit edilmeye çalışılmıştır. On the outside wall and in the vestibule of the ‘House of Publius Paquius Proculus’ in Pompeii (building I.7.1) three graffiti containing the name Cucuta can be found. The first simply readsCucuta(CIL4.8065 [outside wall]). The second tells us that Cucuta was an attendant of the Emperor Nero (CIL4.8066 [outside wall]):Cu(cuta) | Cucuta Ner(onis).From the third we learn that Cucuta was a financial secretary (a rationibus) of Nero (CIL4.8075 [vestibule]):Cucuta ab ra[t]ioni[b]us | Neronis Augusti. While the meaning and significance of these (...) graffiti may seem apparent—that one of Nero's attendants scratched his name on the wall and vestibule pillar as he waited for the emperor to return from a meeting—the closeness betweenCucuta(an otherwise unattested name) andcicuta(hemlock) raises a key question: should we readCucutaasCicutaand therefore understand the third graffito in particular as a joke about Nero's rumoured fondness for killing family, friends and his senatorial enemies with poison? In other words, is it Poison, and not a person, that keeps Nero's finances in order? And, if so, can theCucutagraffiti give us an alternative insight into the plethora of wall inscriptions found outside building I.7.1 greeting Publius Paquius Proculus and recommending him for office? Bu makalede, müşriklerle sosyal ilişkinin mahiyetine dair Müslüman düşünce geleneğinde ortaya konulan literatür genel hatlarıyla ele alınmaktadır. Söz konusu literatür, “müşrikler bu yıldan sonra Mescid-i Harâm’a yaklaşmasınlar” (Tevbe 9/28) ayeti temelinde şekillenmiştir. Bu bağlamda âlimler şirkin mahiyeti, Mescid-i Harâm bölgesinin sınırları ile bu bölgeye yaklaşmamayı ifade eden fiilin içeriği ve özellikle de ayetteki uyarının Hac ibadeti ile sınırlı/kayıtlı olup olmadığı gibi hususları tartışma konusu yapmışlardır. Bu ayet çerçevesinde ortaya konulan literatürde iki görüşün ön plana çıktığı görülmektedir. Bunlardan ilki, Mescid-i Harâm (...) ifadesiyle kastedilen mananın tüm mescitleri kapsayacağı düşüncesinden hareketle “yaklaşmama” yasağın sınırlarını genişletirken diğer görüş, maslahatçı bir yaklaşımla söz konusu bölgenin Kâbe ve çevresiyle sınırlı olduğu iddiasına dayanmaktadır. Bu bağlamda ilk görüşte, harem bölgesine müşriklerin hiçbir surette giremeyeceği savunulurken ikinci görüşte, müşriklerin cahiliye döneminde yaptıkları tarzda hac ve umre ibadeti yapmak amacıyla söz konusu bölgeye giremeyecekleri ancak ticaret, seyahat vb. farklı maksatlarla gelebilecekleri vurgulamaktadır. Makalede konu H. VII. yüzyıla kadar kaleme alınan rivayet, dirayet, ahkâm ve Şiî tefsirler temelinde irdelenmiştir. Bu bağlamda Mukātil b. Süleymân, İmâm Şâfiî, Cassâs, Ebû Bekir İbnü’l-Arabî ve Kurtubî’nin kaleme aldığı ahkâm tefsirleri; Taberî, İbn Ebî Hâtim, Ebû İshak es-Sa‘lebî ve İbn Kesîr’in yazdığı rivayet tefsirleri; Mâtürîdî, Zemahşerî, Fahreddin er-Râzî, Beyzâvî ve Ebu’l- Berakât en-Nesefî’nin dirayet tefsirleri ile Şiî müfessirler Kummî, Ayyâşî, Ebû Ca‘fer et-Tûsîve Tabersî’nin tefsirleri incelenmiştir. Konunun bahsi geçen tefsirler temelinde ele alınmasındaki amaç ayetin anlaşılmasına bağlı olarak ortaya konulan fıkhî hükümleri ve gerekçelerini tespit ederek mukayese yapmaktır. Zira Tevbe suresi 28. ayetin anlaşılmasında, dini anlama tarzları bakımından Ashâbu’l-Hadis ve Ashâbu’r-Rey olarak nitelenen âlimlerin görüşlerinin belirleyici olduğu görülmektedir. Konu bağlamında Şiî tefsirlerin incelenmesindeki amaç ise söz konusu literatürde Tevbe suresi 28. ayetin ele alınmasına ilişkin bakış açısının Ashabu’l Hâdis’e mi Ashabu’r-Rey’e mi yakın olduğunu tespite yöneliktir. İncelenen tefsirlerde ilk görüşün İmâm Mâlik ve İmam Şâfiî’ye ait olduğu belirtilirken ikinci görüş Ebû Hanîfe’ye nispet edilmiştir. İmâm Mâlik ve İmam Şâfiî’ye ait olan görüş genel kabul görürken Ebû Hanîfe ve Mâtürîdî’nin benimsediği, Hanefî-Mâtürîdî âlimler tarafından kabul gören ikinci görüş, tarihsel süreçte şaz olarak nitelendirilmiş ve dikkate alınmamıştır. Makalede, H.7. yüzyıl’a kadar yazılan rivayet, dirayet, ahkâm ve Şiî tefsirleri özelinde bu görüşlerin temel mantığı, ortaya çıkış süreçleri ve bu çerçevede üretilen fıkhî hükümler analitik bir bakış açısıyla irdelenmeye çalışılmıştır. Makalede sonuç olarak Ashabu’l-Hadis’e mensup âlimlerden İmâm Mâlik ve İmâm Şâfiî’nin konuyu sadece müşrikleri değil tüm gayr-i müslimleri içerecek şekilde ele aldıkları ve bu gruplarla kurulacak sosyal, ekonomik ve siyasi ilişkinin mahiyeti hakkında fıhkî hükümler koydukları görülmektedir. Bu hükümlerle, Müslüman düşünce geleneğinde gayr-i Müslimlerin özellikle sosyo-kültürel açıdan ötekileştirilmeleri meşrulaştırılmıştır. Bu bakış açısı Müslümanların birlikte yaşama kültürüne katkı sağlamalarını engellediği gibi insana saygıyı temel alan Kur’an’ın bakış açısı ile de çelişmektedir. Bu bağlamda Ashabu’r-Rey’in önemli temsilcilerinden biri olan Ebu Hanîfe’nin yasaklama emrini cahiliye döneminde yapılan hac fiili ile sınırlaması konuya ilişkin bakış açısında ciddi farklılıklara imkân tanımaktadır. Ebû Hanîfe’nin bu anlama biçimi, gayr-ı Müslimlere ilişkin olumsuz bir uygulamaya imkân vermediği gibi takipçisi Mâtürîdî tarafından geliştirilerek ahlakî bir boyutta ela alınmıştır. Süreç içerisinde söz konusu anlama biçimi, aynı düşünce geleneğine mensup olan Cassâs ve Ebû’l-Berekât en-Nesefî tarafından devam ettirilerek geliştirilmiştir. (shrink)

This article covers the critical edition, translation and analysis of the epistle on creed, al- Muʿtamad min al-muʿtaqad, written by the famous Hanafī jurist ʿAlāʾ al-dīn Abū Bakr b. Masʿūd al-Kāsānī. In his work, which can be evaluated in the literature of creed, al-Kāsānī explains the basics of Hanafī-Māturīdī belief in a brief and concise manner without any discussion. This study consists of three main parts: examination, critical edition and translation. In the examination part of the study, the life of (...) the author is handled with various aspects, and at the same time information is given about the relation of the work to the author, its position in the literature, its method and content as well as its manuscripts. Then, based on the six manuscript copies of the work which are available in various manuscript libraries, the critical edition and the translation of the work is given. It is aimed that this work, which is discussed in Turkish for the first time in an academic article, will contribute to the studies on Hanafī-Māturīdī creed literature to some extent. (shrink)

Although the Mukhtasar Siyasat al-Hurub has attained iconic status in the Islamic military canon, it has never received a full-length analysis. Almost all extant references, moreover, focus on its technical aspects rather than its political subtext. That subtext has a twofold purpose. First, to valorize reason by emphasizing the centrality of deliberation in jihad. Second, to ensure that such valorization nevertheless does not lose sight of (a) the uncertainties of war, which militate against replacing faith in supernatural forces with an (...) equally unwarranted faith in science; or (b) the existence of evil in the world, which precludes any hope of perpetual peace. As such, the Mukhtasar articulates a distinctive Islamic approach that diverges both from a more optimistic Western tradition extending from early Christianity to the Enlightenment, and from an alternative-- but currently resurgent-- Islamic outlook on the proper scope and conduct of jihad. Ved å videreføre H. Grimen og A. Molanders anvendelse av S.E. Toulmins modell for praktisk resonnering i en klinisk kontekst redegjør jeg for legeskjønnets multidimensjonale, epistemiske struktur. Gjennomgangen viser hvordan skjønnsanvendelse i legerollen kan analyseres i henhold til en fagteknisk, en distributiv og en relasjonell dimensjon. Mot denne bakgrunnen diskuterer jeg så (...) spenninger som oppstår i skjæringspunktet mellom strukturering og kultivering av skjønnets ulike dimensjoner. Diskusjonen tydeliggjør at den medisinske profesjonen ikke kan betraktes som en selvtilstrekkelig premissleverandør når det gjelder å sikre adekvat kultivering av medlemmenes skjønnsutøvelse i en klinisk kontekst. By developing H. Grimen and A. Molander's application of S.E. Toulmin's model for practical reasoning in a clinical context, the multi-dimensional epistemic structure of the physician's judgment in terms of technical, distributive, and relational judgment is accounted for. Against this backdrop, tensions emerging in the intersection between delimitation and cultivation of professional judgment in its various dimensions are discussed. The discussion clarifies that the medical profession is not a self-sufficient provider when it comes to ensuring an adequate cultivation of its members' judgment in a clinical context. It is argued that by emphasising and implementing the relevant external contributions to the profession's ongoing self-regulation, the public's justified trust in the medical profession can be strengthened. Erken dönemlerden itibaren fıkhî meseleler üzerindeki tartışmalar, bir yönteme bağlı kalınarak icra edilmiştir. Tartışmalarda belirli soru ve cevap türlerine başvurulmuş, soruların tertibine özen gösterilmiştir. Bu sayede taraflar kendi görüşlerinin doğruluğunu, karşıt görüşün yanlışlığını çelişkiye düşmeden ortaya koymaya çalışmıştır. Bu çalışmada ilk olarak cedelden ve cedelin fıkha tatbikinden bahsedilmiş, sonrasında münâzaracı kimlikleriyle meşhur olan Hanefî fakihi Kudûrî ile Şâfiî fakihi Ebu’t-Tayyib et-Taberî arasında geçtiği rivayet edilen talâka dair bir münâzara inceleme konusu edilmiştir. Bu münâzarada, muhâlea ile boşanılan kadına, kadının iddeti esnasında (...) tekrardan ricî talâk yapılabileceğini savunan Kudûrî ile bu durumda talâkın geçersiz olacağını söyleyen Taberî’nin karşılıklı istidlal ve itirazları yer almaktadır. Bu tartışmanın temelini Kudûrî’nin muhâlea yapılan kadını ricî talâkla boşanan kadına kıyas etmesi oluşturmaktadır. Taberî bu kıyasın illetine yönelik mutâlebe, itirâz ve muâraza türü sorulara başvurmuş, Kudûrî ise kendi illetinin sıhhatini savunmaya çalışmıştır. Yer yer tartışma kurallarına atıfların yapılması yönüyle de önemli olan bu münâzara incelenirken, cedelin fıkha tatbikine dair kısımda zikredilen bilgilerin pratikte nasıl uygulandığına işaret edilmiştir. İslâm coğrafyasının genişlemesi neticesinde Arap olmayan toplulukların İslâm dini ile tanışmaları beraberinde bir takım problemleri de getirmiştir. Bu problemler arasında, Kur’ân’ın yanlış anlaşılma endişesi en başı çekmektedir. Arapçaya hâkim olmamaktan kaynaklanan dil hatalarının âyetlere kadar sirayet ettiğini gösteren birçok rivayetin varlığı da bunu teyit etmektedir. Bundan dolayı hicrî birinci yüzyılın ikinci yarısından itibaren dil ile ilgili faaliyetler aralıksız bir şekilde devam etmiştir. Bu faaliyetler arasında, Kur’ân’ın üslûbunu, âyetlerde yer alan kelimelerin delâleti ve sesletimini, cümlelerin iç bütünlüğü ile filolojik tahlillerini (...) ele alan çalışmalar bulunmaktadır. Bu çalışmalar, Arap gramerinin oluşturulması ve bazı gramer ekollerinin ortaya çıkmasıyla birlikte genellikle “Ma‘âni’l-Ḳur’ân” ve “İ‘râbü’l-Ḳur’ân” başlıkları kullanılarak daha sistemli bir şekilde hicri dördüncü yüzyılın sonlarına kadar devam etmiştir. “Ma‘âni’l-Ḳur’ân” başlığını kullanarak eser yazan âlimler arasında gramer ilmiyle birlikte tefsir alanında da önemli bir konuma sahip olan Yahyâ b. Ziyâd el-Ferrâ da bulunmaktadır. Sözü edilen eserde Ferrâ’nın, lügavî tahlilleri esnasında özellikle sözcüklerin siygası ve çok anlamlılığı doğrultusunda dil-kültür ilişkisine örnek olabilecek birçok bireysel değerlendirmesine rastlanılmaktadır. Onun bazı ayetler etrafında sergilenen çeşitli görüşlere yer verdikten sonra Arap toplumu nezdinde bir yönüyle de bile olsa kabul gören semantik tahlillere ayrıca yer vermesi, müfessirlerin, çoğu zaman anlaşılması güç ayetlerle birlikte murad edilenin dışında bir yorumun önlenmesi için dönemin kültüründen yararlanmaları gerektiği şeklinde de değerlendirilebilir. Bu bakımdan Kur’ân-ı Kerîm’in insanlığa sunduğu mesajların en doğru şekilde anlaşılabilmesi adına bazı âyetlerin tefsiri ve değerlendirmesi yapılırken başvurulacak ilmî merci ve disiplinlerin geniş tutulması önem arz etmektedir. Binâenaleyh makalede Ferrâ’nın kendisine özgü tahlilleriyle beraber, görüşlerine yer verdiği başka âlimlerin analizlerinden sadece dil-kültür ilişkisine örnek olabilecek tespitler üzerinde durularak kültür ve dil etkileşiminin âyet yorumundaki rolüne işaret edilecektir. Ahmed b. Hanbel, vefatıyla neticelenen hastalığı esnasında oğlu Abdullah’tan, şu hadisin el-Müsned’inden çıkartılmasını istemiştir: “Allah Rasûlü ‘Ümmetimi Kureyş’ten şu grup helâk edecek’ buyurunca oradakiler ‘(bu durumda) bize neyi emredersin?’ diye sordular. O da ‘İnsanlar onlardan uzak durup ayrılsalar!’ cevabını verdi”. Ahmed b. Hanbel bu hadisin, diğer rivayetlerle çeliştiğini düşünmektedir. Oğlu Abdullah’a göre bu hadisin çeliştiği rivayetler, Hz. Peygamber’in idarecilere itaat etmeyi ve onlardan kaynaklanan yanlışlara karşı sabırlı olmayı emrettiği haberlerdir. Ahmed b. Hanbel’in tavrı ve bunun sebebi esasen açık ve net (...) gibi görünmektedir. Buna rağmen daha sonra gelen ilim adamları, onun bu tavrı ile ilgili farklı değerlendirmeler yapmışlardır. Bu değerlendirmelerden birine göre İmam’ın tavrı, kendi açıklamasında da dikkat çektiği üzere hadisin şaz olması yani halkın idarecilerle ilişkilerini düzenleyen diğer rivayetlerle çelişmesidir. Bu bakış açısı, İmam’ın açıklamasıyla uyum içinde olmasına ilaveten aynı hadisin Buharî ve Müslim gibi meşhur muhaddisler tarafından nakledilmesi açısından da önemlidir. Zira bu yorumun ulaştığı sonuca göre Buharî ve Müslim’in sadece sahih olan hadisler ihtiva ettikleri iddiasıyla takdim ettiği el-Câmi‘u’s-sahîh isimli eserlerinde, bu şarta uymayan rivayetler de bulunabilmektedir. Bununla birlikte söz konusu hadisin hem sened hem de metni üzerinde yapılan incelemeler şaz iddiasının doğru olamayacağını göstermektedir. Nitekim hadisi nakleden dört ravinin tamamı, içinde Ahmed b. Hanbel’in de bulunduğu münekkitler tarafından güvenilir bulunmuştur. Nitekim İmam, el-Müsned’inde bu ravilerin çok miktarda hadisine yer vermektedir. Hadisin metin açısından da şaz olmadığını söylemek mümkündür. Zira metnin birinci cümlesi olan “Ümmetimin helâki Kureyş’in elinden olacak” şeklindeki tespiti, farklı onlarca hadiste görebilmek mümkündür. Bu hadislerden pek çoğu el-Müsned’de bizzat Ahmed b. Hanbel tarafından da nakledilmiştir. Şaz addedilen kısmın “İnsanlar onlardan uzak dursalar” şeklindeki ikinci cümle olması da pek muhtemel görünmemektedir. Zira zalim idarecilere karşı bundan çok daha şiddetli tepkileri emreden hadislerden onlarcası yine bizzat Ahmed b. Hanbel tarafından nakledilmiş durumdadır. Ahmed b. Hanbel’in, bu hadisi kitabından çıkarmak istemesinin sebebi bağlamında ortaya atılan ikinci iddiaya göre İmam, dönemin yönetimiyle iyi geçinmek amacıyla böyle bir talepte bulunmuştur. Zira bu dönemde Abbasî iktidarı, hadisçileri büyük bir sıkıntıya sokan Mihne sürecine son vermiş, ulemaya karşı yumuşama politikası gütmeye başlamıştır. Ahmed b. Hanbel de yönetimin bu uzlaşma arzusuna olumlu cevap vermiş ve bu çerçevede idareciye karşı sergilenecek sert tutuma işaret eden hadisleri kitabından çıkarmak istemiştir. Fakat bu iddia da yaşadığı dönemde iktidara karşı takındığı tavır sayesinde toplum önderi haline gelmiş Ahmed b. Hanbel gibi bir şahsiyetle uyuşmaz. Zira o idareci ve toplum arasındaki ilişkilerin keyfiyeti ve sıhhati konusunda gerek tavsiyeleri gerekse fiilî tatbikatı ile örnek ve simge haline gelmiştir. Hayatını Hz. Peygamber’in mirası olan hadisleri nakletmeye ve doğru anlaşılmasına hasreden böyle bir şahsiyetin, sırf iktidarla iyi geçinmek adına, sened ve metin itibariyle usûl problemi olmayan rivayetleri el-Müsned’den çıkartılması emrini vermesi çok da doğru görünmemektedir. Bu konuda yapılan üçüncü yoruma göre Ahmed b. Hanbel’in bu hadise yönelik tavrı, manasının istismara müsait olmasıdır. Nitekim İmam’ın bizzat kendisi, ehl-i bid‘attan bazılarının bu hadisi delil getirip iktidara karşı toplumda ayrımcılık yaratacak davranışlara yöneldiğini söylemiştir. Elimizde bu son yorumu güçlendiren başka veriler de vardır. Nitekim o aynı tavrı, iktidara karşı silahlı mücadeleyi emreden başka hadisler hakkında da göstermiş; bunların kitabından çıkartılmasını istemiştir. Bu tavrından anlaşıldığına göre Ahmed b. Hanbel, zalim idareciye karşı, toplumda kargaşa ve fesada sebep olacak fiilî ve silahlı mücadeleye kalkışılmasını istememektedir. Öyleyse denilebilir ki İmam’ın söz konusu hadisle ilgili tavrı, hadisin özellikle “insanların böyle idarecilerden uzak durması” yönündeki ikinci cümle ile ilgilidir. Zira İmam’ın yaşadığı dönemde Mutezile ve Haricîler gibi bazı gruplar böyle hadisleri delil getirerek toplumda tefrikaya sebebiyet vermişlerdir. Bunu bilen ve bizzat gören İmam, böyle grupların toplumsal birlik karşıtı amaçlarına alet edilebilir düşüncesiyle idarecilere karşı “uzak durmaya çalışmak” gibi basit gibi görünen tepkilere yer veren hadislerin bile kitabından çıkarılmasını istemiştir. Sonuç olarak ifade etmek gerekirse onun bu hadis hakkındaki “diğer rivayetlerle çelişiyor” şeklindeki tavrını, “Müsned’imde oluşturmaya çalıştığım ideal idareci-toplum ilişkisi ile çelişiyor” şeklinde anlamak gerekecektir. The subject of this study is the naḳīḍa (opposing) type of poetry competitions between the Meccan poet Ḍirār b. al-Khaṭṭāb (d. 12/633) and the Muslim poet Kaʿb b. Mālik (d. 50/670) from Medina during the Battle of Badr, when the Muslims and the polytheists confronted for the first time. The problem is the questioning of the approaches reflected in the naḳīḍa poems, which were used as a means of propaganda and psychological superiority by the Muslims and polytheists during the Battle (...) of Badr. Naḳīḍa poems, the subject of the study, are important for getting to know the two opposite understandings closely and forming an opinion about the naḳīḍa poems sung during the era of the Prophet Muhammad. Although there are some recent studies on naḳīḍa poems from the era of the Prophet, these studies lacked details and only mentioned general features. The interesting approaches and fine details reflected in the verses, such as Ḍirār b. al-Khaṭṭāb's claims aiming to distract attention and discredit the Muslims of Medina in the face of the unexpected defeat of the Meccan army at Badr that the Battle of Badr was a tribal war between the Meccans and the Medinans, makes this study prominent. On the other hand, Kaʿb b. Mālik's verses reflect the approaches bearing traces of the Islamic faith and draw attention to the fact that the battle was between faith and unbelief and the Muslims of Medina were proud of their support for the Messenger of Allah. Undoubtedly, Meccan immigrants participated in the Battle of Badr along with the Muslims of Medina. Even so, Kaʿb b. Mālik does not mention Muhājirs (immigrants) in his verses. This suggests that Kaʿb b. Mālik may have concentrated on responding to the allegations made by Ḍirār b. al-Khaṭṭāb. Document analysis, one of the qualitative method techniques, was used in the study. First, a literature review was conducted to better understand the subject, and the studies related to the field were briefly mentioned. Then, summary information about the concept and background of naḳīḍa is provided. Two call-and-response poems between the Jāhiliyyah period poet Imruʾ al-Qays (d. 545) and ʿAbīd b. al-Abraṣ (d. 555) are included as an example for the first phases of naḳīḍa poems. Then, brief information about the Meccan poet Ḍirār b. al-Khaṭṭāb and the Medinan poet Kaʿb b. Mālik are presented. After the background information, two naḳīḍa poems of both poets were examined and analyzed, and the differences in the Battle of Badr were pointed out. Concepts that are common in the eulogies of the Jāhiliyyah period, such as nobility, being a master warrior, and generosity, draw attention in Ḍirār b. al-Khaṭṭāb's verses. On the other hand, in his verses Ka'b b. Mālik uses terms and expressions brought by Islam such as the Messenger of Allah, there is no Lord but Allah, unbelievers, Hell, and hellfire. In the verses of both poets, there are clues about the commonly used battle orders and war equipment of the period. The opinions are summarised in the conclusion part of the study. (shrink)

We prove that: • if there is a model of I∆₀ + ¬ exp with cofinal Σ₁-definable elements and a Σ₁ truth definition for Σ₁ sentences, then I∆₀ + ¬ exp +¬BΣ₁ is consistent, • there is a model of I∆₀ Ω₁ + ¬ exp with cofinal Σ₁-definable elements, both a Σ₂ and a ∏₂ truth definition for Σ₁ sentences, and for each n > 2, a Σ n truth definition for Σ n sentences. The latter result is obtained by (...) constructing a model with a recursive truth-preserving translation of Σ₁ sentences into boolean combinations of $\exists \sum {\begin{array}{*{20}{c}} h \\ 0 \\ \end{array} } $ sentences. We also present an old but previously unpublished proof of the consistency of I∆₀ + ¬ exp + ¬BΣ₁ under the assumption that the size parameter in Lessan's ∆₀ universal formula is optimal. We then discuss a possible reason why proving the consistency of I∆₀ + ¬ exp + ¬BΣ₁ unconditionally has turned out to be so difficult. (shrink)

The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. The human face conveys a myriad of social meanings within an overlapping array of features. Herein, we examine such features within the context of gender-emotion stereotypes. First we detail the pervasive set of gender-emotion expectations known to exist. We then review new research revealing that gender cues and emotion expression often share physical properties that represent a confound of overlapping features characteristic of low versus high facial maturity/dominance. As such, gender-related facial appearance and facial expression of emotions often share social (...) meaning and physical resemblance. Thus, stereotypic and phenotypic information conveyed by the face are intertwined—sometimes confounded, sometimes clashing. We discuss implications of this work for gender-emotion stereotypes, as well as for emotion and face processing more generally. (shrink)

We investigate conditions under which the least element of an algebraic, meet semi-distributive lattice is a (complete) meet of meet-prime elements. For example, this is true if the lattice has only countably many compact elements, or if |L| < 2ℵ0, or if L is in the variety generated by a finite meet semi-distributive lattice. We give an example of an algebraic, meet semi-distributive lattice that (...) has no meet-prime element or join-prime element. This paper presents a unique manuscript copy of a fifth/eleventh-century Maghribī commentary on al-Bāqillānī’s Kitāb al-Tamhīd. The work, entitled al-Tasdīd fī sharḥ al-Tamhīd, was written by ‘Abd al-Jalīl b. Abī Bakr al-Dībājī —also known as Ibn al-Ṣābūnī— who had studied the Kitāb al-Tamhīd with al-Bāqillānī’s disciples in Qayrawān. The present study first reviews the transmission of al-Bāqillānī’s work to the Islamic west. It then continues to present the author of the commentary, to reconstruct the work’s genesis and to describe its (...) content. The final section focuses on a sample chapter and argues that al-Dībājī follows al-Bāqillānī’s later position on a specific theory —the so-called theory ofaḥwāl— of which the Tamhīd strongly disapproved. The Tasdīd is one of the oldest texts of Maghribī Ash‘arism that has come down to us and provides valuable new insights into the school’s early history in the Islamic west. (shrink)

Cheerfulness or serenity (Heiterkeit) is one of the most important themes in Nietzsche’s philosophy. Throughout his writings, from first to last, he can be found wrestling with conceptions of cheerfulness and promoting a cheerful mode of philosophizing. Despite the importance and recurrence of the theme of cheerfulness in Nietzsche’s entire œuvre, there have been relatively few studies specifically devoted to it. An important debate on cheerfulness has recently taken place in the literature on Nietzsche between Robert Pippin and Lanier Anderson (...) and Rachel Cristy. Both sides of the debate have explored Nietzsche’s practice of cheerfulness in direct relation to Montaigne. According to Pippin, Nietzsche never succeeds in writing with the kind of cheerfulness of Montaigne. In contrast, Anderson and Cristy have contended that both Nietzsche and Montaigne conceive of cheerfulness as a complex, non-naïve spiritual state or attitude that is to be cultivated through the practice of philosophy as a way of life. According to Anderson and Cristy, this is a deep form of love of life that both Nietzsche and Montaigne practice and perhaps achieve at least in part by and through writing. In this essay, we aim to contribute to this debate by offering a threefold argument. First, we argue that Nietzsche conceives of cheerfulness not only as a psychological ideal, as a desirable state or attitude of the spirit, but also as an aesthetic ideal, as a desirable quality or style of thinking and writing (sections 1–2). Second, we argue that, in addition to Montaigne, Ralph Waldo Emerson is an equally important but neglected influence on Nietzsche’s conception and practice of cheerfulness (section 2). Third, by reconstructing Nietzsche’s self-presentation as a cheerful thinker and writer in the 1886 prefaces and in Ecce homo (1888), we conclude that it is possible to argue that starting from his middle writings Nietzsche thinks and writes cheerfully in some of his works, including a number of his most significant texts (section 3).
