Considering the importance of research in the development of nursing, we examine the ethical principles governing nurses' investigative activity, as well as the different codes regulating biomedical investigation with human beings, amongst which are the Nuremberg Code, the Declaration of Human Rights, and the Declaration of Helsinki. From the perspective of the central points of the article reference is made to different codes proposed by international nursing associations, as well as reviewing the Deontological Code of Spanish Nursing. The ethical principles (...) a nurse has to bear in mind in research are analysed, with respect to patients, society and the profession. Innovation is strongly associated with survival and growth of all kind of organizations in a global competitive economy. Moreover, nowadays companies are increasingly questioned on how they deliver innovative solutions to deep-seated problems, such as poverty. Our research aims to understand how Economy of Communion companies respond to this challenge by applying the logic of gratuitousness and giving. This paper examines the altruistic behaviour of EoC leaders and the connection with organizational innovation, necessary for firm’s survival in the long-term. We (...) analyse these connections through a qualitative descriptive case study of three Spanish EoC companies. The findings reveal altruistic behaviours of leaders seeking the Common Good. Innovation derives from the desire to help others, such as employees and customers. Moreover, the findings reveal that a culture of dialogue among employees, managers and the whole organisation enhances risk-taking and, therefore, innovation The paper contributes to our understanding of how EoC companies are able to reconcile innovation with the ideal of altruism, distinctive of the Economy of Communion. We believe that this study opens up a wide range of future research opportunities on the antecedents of an innovative organizational culture. (shrink)

This article puts forward solutions to some of the ethical and legal dilemmas posed in the current discussion on how to program crash algorithms in autonomous or self-driving cars. The first part of the paper defines the scope of the problem in the criminal legal field, and the next section gives a critical analysis of the proposal to always prioritise the interest of the occupant of the vehicle in situations with conflict of interests. The principle of minimizing social damage as (...) a model for configuring self-driving cars is examined in the third section. Despite its apparent plausibility, within the framework of a liberal legal system that recognises humans as free agents who have rights and responsibilities, maximizing the function of social utility does not justify harmful interference into a person’s legal sphere. Therefore, in the fourth part, the author argues the need to program the crash algorithms of autonomous cars based on a deontological understanding of the system of justifications in criminal law. The solution to the dilemma lies in a prior analysis of the legal positions of all agents involved in the conflict, from a perspective of the principles of autonomy and solidarity as the core of the system of justifications. En primer lugar, expondremos el trasfondo común que comparten las propuestas multiculturalistas y las intercultralistas, esto es, el particular énfasis que ponen en la necesidad de reconocimiento para la conformación de la personalidad y en las patologías que se derivan de la falta de reconocimiento. En segundo lugar, veremos algunos de los problemas que suscitan los planteamientos multiculturalistas: minorías dentro de las minorías, esencialismo y ausencia de cohesión social. En este punto también expondremos algunas de las propuestas del interculturalismo para (...) superar estos obstáculos. Por último, propondremos la noción de patriotismo constitucional como fórmula para la cohesión social, puesto que éste, al requerir una adhesión de tipo cívico, puede ser abrazado desde cualquier forma de vida particular, además de contemplar el importante papel de la sociedad civil a la hora de dar forma a sus principios a través del Derecho.In the first place, we will deal with the common background that multiculturalism and interclturalism share: the emphasis that they put in the necesity of recognition in the conformation of the personality and in the pathologies derived from the absence of recognition. In the second place, we will explore some of the problems that multiculturalism entails: minorities within minorities, essentialism and lack of social cohesion. At this point, we will explain some of the solutions that interculturalism has proposed for these problems. To conclude, we will propose the notion of constitutional patriotism as a means for achieving social cohesion. Constitutional patriotism demands some sort of civic engagement, so it can be supported from every particular cultural form of life. Así mismo, una vez justificada la importancia (...) de la utilidad de la Economía Social los poderes públicos deben reforzar y potenciar esas utilidades mediante el fomento de políticas publicas que ayuden a potenciar estas características. Los objetivos que nos marcamos son explicar en qué consiste esta función económica, describir los diferentes métodos de fomento de las políticas públicas y explicar qué está haciendo la Unión Europea al respecto del fomento de las políticas públicas de fomento de la Economía Social. La metodología ha sido acudir a las distintas fuentes primarias y secundarias que refleja la bibliografía utilizada, varios trabajos en los que nos hemos basado comportan análisis empíricos de bases de datos. Los principales resultados son que a nivel español y a nivel europeo se está empezando a tener en cuenta que la Economía Social es un sector estratégico frente a la crisis y el paro. Y las conclusiones más relevantes son que debemos continuar en la senda de la investigación de cómo las políticas públicas son un instrumento de fomento esencial de la Economía Social.The purpose or object of this article is to highlight the importance of the social economy and its level role as economic engine has the following advantages: more equally distributes income and wealth, contributes to endogenous economic development, increases the autonomy of the territories, corrects imbalances in the labor market, offer social welfare services, economic stability helps and makes sustainable economic development. Also, once justified the importance of the utility of the Social Economy, governments should strengthen and boost those profits by encouraging public policies that help drive these features. The goals we set are: explain what this economic function, describe the different methods of promoting public policies that use these and explain what the eu is doing in terms of stimulating the Social Economy. The methodology has been to go to various primary and secondary sources, as reflected in the literature used, and especially consider several jobs that we have relied, and which involve empirical analysis databases. The main results both nationally and at European level show that the administrations are beginning to consider that the social economy is a strategic sector to the crisis and unemployment. Therefore, the most important conclusion is that from the academic must continue investigating how public policy can act as an instrument driver of Social Economy. (shrink)

Bridging the gap between the world of science and the realm of the spiritual, B. Alan Wallace introduces a natural theory of human consciousness that has its roots in contemporary physics and Buddhism. Wallace's "special theory of ontological relativity" suggests that mental phenomena are _conditioned_ by the brain, but do not _emerge_ from it. Rather, the entire natural world of mind and matter, subjects and objects, arises from a unitary dimension of reality that is more fundamental than these dualities, as (...) proposed by Wolfgang Pauli and Carl Jung. To test his hypothesis, Wallace employs the Buddhist meditative practice of _samatha_, refining one's attention and metacognition, to create a kind of telescope to examine the space of the mind. Drawing on the work of the physicist John Wheeler, he then proposes a more general theory in which the participatory nature of reality is envisioned as a self-excited circuit. In comparing these ideas to the Buddhist theory known as the Middle Way philosophy, Wallace explores further aspects of his "general theory of ontological relativity," which can be investigated by means of _vipasyana_, or insight, meditation. Wallace then focuses on the theme of symmetry in reference to quantum cosmology and the "problem of frozen time," relating these issues to the theory and practices of the Great Perfection school of Tibetan Buddhism. He concludes with a discussion of the general theme of complementarity as it relates to science and religion. The theories of relativity and quantum mechanics were major achievements in the physical sciences, and the theory of evolution has had an equally deep impact on the life sciences. However, rigorous scientific methods do not yet exist to observe mental phenomena, and naturalism has its limits for shedding light on the workings of the mind. A pioneer of modern consciousness research, Wallace offers a practical and revolutionary method for exploring the mind that combines the keenest insights of contemporary physicists and philosophers with the time-honored meditative traditions of Buddhism. Noël Carroll denies and Robert Stecker affirms that it is a necessary condition of aesthetic experience that it should be valued for its own sake. I make use of their controversy to argue for the psychological impossibility of discharging very common practices of art evaluation and analysis without undergoing an aesthetic experience valued for its own sake. By way of supporting my thesis and also making progress in Stecker and Carroll’s dispute about aesthetic experience, I analyse their methodological assumptions and (...) develop further our understanding of negative, indifferent and unexpected aesthetic experiences. In this article I argue that a high capacity for courage, in the sense of the strength of character that enables one to face distress, angst or psychological pain, is required of Hume’s ideal critics just as the other well-known five characteristics are. I also explore the implications of my proposal for several aspects of Hume’s aesthetics, including the one brought into relief by Shelley’s interpretation of Hume along the lines of distinguishing between the perceptual and affective stages in aesthetic (...) appreciation. Recently, the mechanistic framework of active inference has been put forward as a principled foundation to develop an overarching theory of consciousness which would help address conceptual disparities in the field (Wiese 2018 ; Hohwy and Seth 2020 ). For that promise to bear out, we argue that current proposals resting on the active inference scheme need refinement to become a process theory of consciousness. One way of improving a theory in mechanistic terms is to use formalisms such as computational (...) models that implement, attune and validate the conceptual notions put forward. Here, we examine how computational modelling approaches have been used to refine the theoretical proposals linking active inference and consciousness, with a focus on the extent and success to which they have been developed to accommodate different facets of consciousness and experimental paradigms, as well as how simulations and empirical data have been used to test and improve these computational models. While current attempts using this approach have shown promising results, we argue they remain preliminary in nature. To refine their predictive and structural validity, testing those models against empirical data is needed i.e., new and unobserved neural data. A remaining challenge for active inference to become a theory of consciousness is to generalize the model to accommodate the broad range of consciousness explananda; and in particular to account for the phenomenological aspects of experience. Notwithstanding these gaps, this approach has proven to be a valuable avenue for theory advancement and holds great potential for future research. (shrink)

La repugnancia es una emoción que pone de manifiesto la especificidad de los seres humanos como seres naturales y seres culturales. Es por ello que la repugnancia constituye un objeto de estudio privilegiado para la Neuroética. En el siguiente artículo trataremos de mostrar que la repugnancia no es una mera reacción fisiológica, sino que la evolución biológica y cultural ha hecho de ella una emoción enormemente compleja dotada de un gran contenido cognitivo. Veremos qué papel ha jugado el recurso retórico (...) a la repugnancia en distintos procesos de deshumanización y crueldad a lo largo de la historia. Por último, examinaremos cómo funciona la empatía en la agencia moral y analizaremos qué relación tiene este mecanismo psicológico con la repugnancia. (shrink)

Este trabajo analiza los elementos centrales de la concepción platónica del saber moral en el diálogo Critón. En primer lugar, se examina la caracterización del saber moral que Sócrates se atribuye a sí mismo en la Apología, con el objetivo de ofrecer un marco conceptual de referencia en el que situar el saber moral socrático tal y como es presentado en el Critón. El siguiente epígrafe está dedicado al estudio de los principios prácticos introducidos por Sócrates en su respuesta a (...) la propuesta de fuga planteada por su amigo Critón y que habrán de guiar la deliberación sobre si tal acción debe acometerse o no. Dicha deliberación es el objeto de análisis en el cuarto epígrafe. Finalmente, en el quinto y último epígrafe se analizan algunos aspectos disposicionales en los que incide la representación dramática de Sócrates y Critón y que resultan esenciales en la caracterización del saber moral en el Critón. Objetivamos elaborar um balanço sobre lógica das perguntas científicas na produção do conhecimento stricto sensu. Tomamos como fontes 100 dissertações e 32 teses escritas por docentes que trabalham em cursos de Educação Física no Estado da Bahia – 1982 a 2018, abordando enquanto objeto a lógica instituída pelas perguntas científicas na referida produção. Trata-se de uma pesquisa documental, tendo como método o materialismo histórico e dialético. Os resultados apontam que 48% das produções têm suas perguntas de investigação construída a partir (...) da lógica formal; 28% apresenta uma lógica dialética na elaboração das perguntas científicas; e 24% não apresentam problema de investigação. The so-called ‘hidden curriculum’ is often presented as a counterproductive element in education, and many scholars argue that it should be eliminated, by being made explicit, in education in general and specifically in higher education. The problem of the HC has not been solved by the transition from a teacher-centered education to a student-centered educational model that takes the student’s experience as the starting point of learning. In this article we turn to several philosophers of education to propose that HC (...) can be made explicit in HE when the teacher recognizes and lives his/her teaching as a personal issue, not merely a technical one; and that the students’ experience of the learning process is not merely individual but emerges through their interpersonal relationship with the teacher. We suggest ways in which this interpersonal relationship can be strengthened despite current challenges in HE. (shrink)

ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. The necessity defense is barely accepted in contemporary Western case law. The courts, relying on the opinion held by the majority of legal scholars, have reduced its margin of application to practically zero, since in the framework of contemporary welfare states, there is almost always a “legal alternative.” The needy person who acts on their own behalf, regardless of whether they save an interest higher than the one they injure, does not show due deference to democratic legal solutions and procedural (...) channels. This article aims to contest this abrogative interpretation of the necessity defense and to outline the limits of its legitimate scope. Even in welfare states, there are actions in a necessity scenario that neither question the legal decisions of the democratically elected legislature nor make a mockery of established procedural channels. This research aims to monitor the current situation of confinement in Spanish society motivated by COVID-19 crisis. For this, a study of its socio-family, psychological and educational impact is conducted. The sample (N= 165 families, 89.1% nuclear families with children living in the same household and 20.5% with a relative in a risk group) comes from the Aragonese region (Spain). The instruments used are: Beck-II Depression Inventory (BDI-II); Baron-Cohen and Wheelwright’s Empathy Quotient (EQ) with its cognitive empathy subscale, as well (...) as an ad-hoc questionnaire, reviewed by a panel of experts, to learn about socio-personal, family and housing conditions, use of technology, involvement in school tasks and household, and working condition. The multiple regression analysis results show that the anxiety derived from the current situation is explained in 23.1% (p< 0.001) by the variables: gender (t = -2.31,p= 0.022), level of Internet consumption (t = 2.139,p= 0.034), increase of family conflicts (t = 2.980,p= 0.003) and help with school tasks (t = 2.980,p= 0.040). On the other hand, cognitive empathy is explained in 24.6% (p< 0.001) by the variables: gender (t = -4.690,p< 0.001) and mother’s hours of teleworking (t = 2.101,p= 0.037). All this leads us to conclusions related to preventive systems of social, psychological, and educational aspects to better serve families. These conclusions can be also be transferred to the future with an inclusive care to family settings from those three parameters. (shrink)

Faced with the inaction of liberal democracies to effectively tackle global warming, many climate activists engage in forms of protests that involve committing minor criminal offences. They seek to shape official decisions on climate policies by resorting to civil disobedience. Some of these activists, rather than accepting punishment, have successfully claimed to be acting in a justified manner by invoking the necessity defence. The aim of this article is to show that, within the framework of representative democracies guided by the (...) rule of law, the climate necessity defence must be rejected, since such protests do not meet the ‘non-legal alternatives’ requirement. This does not mean, however, that protesters should be punished as common offenders. Their acceptance of responsibility and political motivation should be taken into account as a mitigating factor at sentencing. (shrink)

Para ello, primero enmarcaré la discusión dentro de la interpretación heideggeriana del naturalismo y su manera de entender la relación entre filosofía y ciencia. Luego, analizaré su interpretación de la embriología y la ecología mediante la cual Heidegger esboza aportes originales a la filosofía de la biología, especialmente en torno al problema de la identidad del organismo biológico. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. Gilead et al. claim such diversity requires a multi-process theory, and thus is out of reach for PP, which postulates a universal canonical computation. We contend this argument and instead propose that PP fails to account for the experiential level of representations.

El aumento en la producción y consumo de frutas y hortalizas mínimamente procesadas de los últimos años ha con­tribuido a incrementar las toxiinfecciones alimentarias asociadas al consumo de productos vegetales frescos. Esto es debido a que los tratamientos desinfectantes llevados a cabo actualmente por industria de IV gama son insuficientes para garantizar la seguridad microbiológica de los productos finales, y además estos no reciben ningún tratamiento capaz de eliminar todos los patógenos antes de su consumo. Por lo tanto, es necesario (...) utilizar estrategias al­ternativas para reducir los microorganismos patógenos y alteran­tes en frutas y hortalizas. La bioconservación, mediante el uso de microorganismos o sus metabolitos, es una alternativa que, en combinación con las prácticas habituales, puede reducir o prevenir el crecimiento de patógenos en productos mínimamente procesa­dos, mejorando su calidad microbiológica. En este artículo se pre­sentan los resultados más relevantes sobre la bioconservación de frutas y hortalizas mínimamente procesadas. (shrink)

This paper intends to identify the functions of the French particle “comme” (“like” in opposition to “as”) and “comme si” (“as if”) in the work of French contemporary philosopher Jean-Luc Marion, especially in L’idole et la distance (American translation: The Idol and Distance), Dieu sans l’être (American translation: God without Being), Étant donné (American translation: Being given) and De surcroît (American translation: In excess). The author of this paper focuses on the relation between phenomenology and theology in order to demonstrate (...) its complexity by an analysis of linguistic phenomenology. At the end of this analysis, the “saturated phenomenon”, as proposed by Jean-Luc Marion, becomes an important notion to understand the boundaries of both disciplines, phenomenology and theology.
