BackgroundMental health professionals (MHP) working in court-mandated treatment settings face ethical dilemmas due to their dual role in assuring their patient’s well-being while guaranteeing the security of the population. Clear practical guidelines to support these MHPs’ decision-making are lacking, amongst others, due to the ethical conflicts within this field. This qualitative interview study contributes to the much-needed empirical research on how MHPs resolve these ethical conflicts in daily clinical practice. Methods31 MHPs working in court-mandated treatment settings were interviewed. The interviews (...) were semi-structured and our in-depth analysis followed the thematic analysis approach.ResultsWe first outline how mental health professionals perceive their dual loyalty conflict and how they describe their affiliations with the medical and the justice system. Our findings indicate that this positioning was influenced by situational factors, drawing the MHPs at times closer to the caring or controlling poles. Second, our results illustrate how participating MHPs solve their dual loyalty conflict. Participants considered central to motivate the patient, to see the benefits of treatment and its goals. Further, transparent communication with patients and representatives of the justice system was highlighted as key to develop a trustful relationship with the patient and to manage the influences from the different players involved. ConclusionsEven though individual positioning and opinions towards dealing with the influences of the justice system varied, the results of our research show that, in spite of varying positions, the underlying practice is not very different across participating MHPs. Several techniques that allow developing a high-quality therapeutic alliance with the patient are key elements of general psychotherapy. Transparency appears as the crucial factor when communicating with the patient and with representatives of the justice system. More specifically, patients need to be informed since the beginning of therapy about the limits of medical confidentiality. It is also recommended to develop guidelines that define the level of detailed information that should be disclosed when communicating with the authorities of the justice system. (shrink)

While writing this thesis, there were many things I wanted to get right. I wanted to get the data right. I wanted to get my analysis of the data right. I certainly wanted to get all my citations right, which can get pretty tricky when one is trying to finish a chapter at 2am. But if an error did creep in somewhere in the body of the thesis, that is not a disaster. Sooner or later, I will get a chance (...) to correct it in a future publication. However, this part of the thesis, which sits right at the beginning but was among the last to be written, is different. I only have one opportunity to express, in print, how thankful I am to the people whose assistance was so important to me over the past years. Which is unfortunate, since if I were to truly elaborate all I am thankful for, these acknowledgements would be the lengthiest chapter of the thesis. Bare plurals (dogs) behave in ways that quantified plurals (some dogs) do not. For instance, while the sentence John owns dogs implies that John owns more than one dog, its negation John does not own dogs does not mean “John does not own more than one dog”, but rather “John does not own a dog”. A second puzzling behavior is known as the dependent plural reading; when in the scope of another plural, the ‘more than one’ meaning of the plural (...) is not distributed over, but the existential force of the plural is. For example, My friends attend good schools requires that each of my friends attend one good school, not more, while at the same time being inappropriate if all my friends attend the same school. This paper shows that both these phenomena, and others, arise from the same cause. Namely, the plural noun itself does not assert ‘more than one’, but rather the plural denotes a predicate that is number neutral (unspecified for cardinality). The ‘more than one’ meaning arises as an scalar implicature, relying on the scalar relationship between the bare plural and its singular alternative, and calculated in a sub-sentential domain; namely, before existential closure of the event variable. Finally, implications of this analysis will be discussed for the analysis of the quantified noun phrases that interact with bare plurals, such as indefinite numeral DPs (three boys), and singular universals (every boy). Our knowledge about the world is often expressed by generic sentences, yet their meanings are far from clear. This book provides answers to central problems concerning generics: what do they mean? Which factors affect their interpretation? How can one reason with generics? Cohen proposes that the meanings of generics are probability judgments, and shows how this view accounts for many of their puzzling properties, including lawlikeness. Generics are evaluated with respect to alternatives. Cohen argues that alternatives are induced by the (...) kind as well as by the predicated property, and thus provides a uniform account of the varied interpretations of generics. He studies the formal properties of alternatives and provides a compositional account of their derivation by focus and presupposition. This paper is an examination of some modelling problems regarding imperfect recall within the model of extensive games. It is argued that, if the assumption of perfect recall is violated, care must be taken in interpreting the main elements of the model. Interpretations that are inconsequential under perfect recall have important implications in the analysis of games with imperfect recall.

Generics are sentences such as Birds fly, which express generalizations. They are prevalent in speech, and as far as is known, no human language lacks generics. Yet, it is very far from clear what they mean. After all, not all birds fly—penguins don’t! -/- There are two general views about the meaning of generics in the literature, and each view encompasses many specific theories. According to the inductivist view, a generic states that a sufficient number of individuals satisfy a certain (...) property—in the example above, it says that sufficiently many birds fly. This view faces the complicated problem of spelling out exactly how many is “sufficiently many” in a way that correctly captures the intuitive truth conditions of generics. -/- An alternative, the rules and regulations view, despairs from this project and proposes instead that generics directly express rules in the world. Rules are taken to be abstract objects, which are not related to the properties of specific individuals. This view faces the difficult problem of explaining how people come to know of such rules when judging the truth of falsity of generics, and accounting for the strong intuition that a sentence such as Birds fly talks about birds, not abstract objects. -/- What seems to be beyond dispute is that generics, even if they do not express rules, are lawlike: they state non-accidental generalizations. Many scholars have taken this fact to indicate that generics are parametric on possible worlds: they refer to worlds other than the actual world. This, again, raises the problem of how people come to know about what happens in these other worlds. However, a rigorous application of standard tests for intensionality shows that generics are not, in fact, parametric on possible worlds, but only on time. This unusual property may explain much of the mystery surrounding generics. -/- Another mysterious property of generics is that although there is no language without them, there is no linguistic construction that is devoted to the expression of genericity. Rather, generics can be expressed in a variety of ways, each of which can also express nongenerics. Yet, each manifestation of generics differs subtly (or sometimes not so subtly) in its meaning from the others. -/- Even when these and other puzzles of genericity are solved, one mystery would remain: Why are generics, which are so easy to produce and understand in conversation, so difficult to analyze? Both traditional accounts of hope and some of their recent critics analyze hope exclusively in terms of attitudes that a hoper bears towards a hoped-for prospect, such as desire and probability assignment. I argue that all of these accounts misidentify cases of despair as cases of hope, and so misconstrue the nature of hope. I show that a more satisfactory view is arrived at by noticing that in addition to the aforementioned attitudes, hope involves a characteristic attitude towards an external (...) factor, on whose operation the hoper takes the prospect's realization to depend causally. The roots of the ideal of authenticity in modern Western thought are numerous and complex. In this article, I explore their development in relation to Rousseau’s paradoxical conclusion that complete satisfaction is an aspiration that not only cannot be fulfilled but whose actual realization will make a person miserable. I argue that there is an unresolved tension between the notion of humans as creatures who by nature strive to eliminate suffering to achieve static serenity and the idea that their natural (...) goal in society is to constantly change and enrich themselves. The purpose of this article is not to construct another pessimistic interpretation according to which our most profound desire – happiness – cannot be achieved, but rather, by understanding natural inequality as a historical phenomenon, to shed light on Rousseau’s idea that happiness should be rejected because it contradicts the new foundation of morality: the realization of people’s uniqueness. Generics and frequency statements are puzzling phenomena: they are lawlike, yet contingent. They may be true even in the absence of any supporting instances, and extending the size of their domain does not change their truth conditions. Generics and frequency statements are parametric on time, but not on possible worlds; they cannot be applied to temporary generalizations, and yet are contingent. These constructions require a regular distribution of events along the time axis. Truth judgments of generics vary considerably across speakers, (...) whereas truth judgments of frequency statements are much more uniform. A generic may be false even if the vast majority of individuals in its domain satisfy the predicated property, whereas a frequency statement using, e.g., usually would be true. This paper argues that all these seemingly unrelated puzzles have a single underlying cause: generics and frequency statements express probability judgments, and these, in turn, are interpreted as statements of hypothetical relative frequency. It is widely agreed that generics tolerate exceptions. It turns out, however, that exceptions are tolerated only so long as they do not violate homogeneity: when the exceptions are not concentrated in a salient “chunk” of the domain of the generic. The criterion for salience of a chunk is cognitive: it is dependent on the way in which the domain is mentally represented. Findings of psychological experiments about the ways in which different domains are represented, and the actors affecting such (...) representations, account for judgments of generic sentences, facts which cannot be explained by linguistics alone. The reason for the homogeneity requirement itself is, in turn, also dependent on cognitive considerations. Generics express default rules, and psychological findings have shown that, the more homogeneous the domain, the easier it is for subjects to infer rules about it. Thus, cognitive results form a crucial part of a comprehensive account of the meaning of a linguistic expression. (shrink)

A Brief History of Moscovia is regarded as a minor, slightly odd composition within the Milton canon. Mostly completed before his total blindness in 1652, it stands in an awkward relationship to his other works, being largely composed of extracts from previous writers. This essay considers Milton's selection of factual content as well as his subtle deviations, at times, from his sources? wording. Milton takes us on a journey beginning with exterior landscapes and moves to graphic anthropological details, in the (...) final chapters shifting from geography to history. All these elements gradually accrue moral emphases, producing not a neutral account but an ethical critique in terms familiar from other Miltonic works, with some patriotic bias. Using R. D. Bedford's superb essay as the starting point, it explores Milton's language at the juncture of statement and evocation. Approaching nearer to the Far Eastern frontier with Cathay, one enters a mysterious realm. Here, the exotic and oriental fire Milton's descriptive imagination. In this combination of knowledge-based detail, moral energy and imaginative and poetic suggestion, Moscovia is in some ways a typically Miltonic work. (shrink)

This article proposes to analyse the way in which the body is addressed in the philosophical works of Judith Butler. The constructionism that characterizes her initial articles has been widely spread in the contemporary debates about sex and gender diversity, since in those articles she links the body to a discursive ontology that denounces the contingent and unnecessary welding between body -which is considered as the substantial and natural basis of gender and sexuality- and subjective identities. Such an epistemological turn, (...) however, entails the problem of the dissolution of the material body as a strong foundation for various political claims. From this point on, some argumentative lines will be drawn parting from different segments of the author’s thought. These lines tend to present a complex notion of the body, clung to the idea of vulnerability. El presente artículo se propone analizar el modo en que la obra filosófica de Judith Butler aborda el cuerpo. El construccionismo social que caracteriza sus textos iniciales ha cobrado gran difusión en los debates contemporáneos sobre la diversidad sexo-genérica, pues allí la autora vincula al cuerpo a una ontología discursiva que denuncia la soldadura contingente y no necesaria entre cuerpo -pretendida base sustancial y natural del género y la sexualidad- y las identidades subjetivas. Tal giro epistemológico, sin embargo, genera el problema de la disolución del cuerpo material como fundamento sólido para reclamos políticos diversos. A partir de aquí se extraen líneas argumentativas de diferentes segmentos del pensamiento de la autora tendientes a presentar una noción compleja de cuerpo anclada en la idea de vulnerabilidad. ABSTRACTThis article argues that received accounts of the concept of human dignity face more difficulties than has been appreciated, when explaining the connection between human dignity and the duty of respect that dignity is supposed to generate. It also argues that a novel, relational, account has the adequate structure to explain such connection.

While opinions on the semantic analysis of generics vary widely, most scholars agree that generics have a quasi-universal flavor. However, there are cases where generics receive what appears to be an existentialinterpretation. For example, B's response is true, even though only theplatypus and the echidna lay eggs: (1) A: Birds lay eggs. B: Mammals lay eggs too. In this paper I propose a uniform account of the semantics of generics,which accounts for their quasi-existential readings as well as for their more (...) familiar quasi-universal ones. Generics are focus-sensitiveoperators: their domain is restricted by a set of alternatives, which may be provided by focus. I claim that, unlike otherfocus-sensitive operators, generics may, but do not have to, associate with focus. When alternatives are introduced, either by focus or by other means, generics get their usual quasi-universal readings. But when no alternatives are introduced, quasi-existential readings result.I argue that generics, unlike adverbs of quantification, do not introduce tripartite structures directly, but are initially interpreted as cases ofdirect kind predication. Only when this interpretation fails to make sense, the phonologically null generic quantifier is derived, and tripartite structures result. This two-level interpretation has the effect that while adverbs of quantification require focus to determine which elements go to the restrictor and which to the nuclear scope, and hence must associate with focus, generics do not, and hence may fail to associate with focus, resulting in quasi-existential readings. This paper defends a rigorous reading of Hume’s critiques of arguments for the existence of God and of the belief in God against interpretations that endorse Humean theism, deism, and fideism. The latter include Donald Livingston’s theist reading, J. C. A. Gaskin’s “attenuated deism” reading, and Edward Kanterian’s “humble fideism” reading. I also examine whether Hume’s rejections of a positive theology commit him to agnosticism or atheism. My innovative challenge to such conclusions maintains that, while elements of both agnosticism and (...) atheism are found in Hume, these denote, respectively, a methodology and an incidental implication of his philosophy. But neither sufficiently captures his constructive vision for a society, individual psychology, and system of knowledge guided by naturalist principles and aims. For this, an alternate conception is needed that describes Hume’s philosophy of religion beyond mere atheism. (shrink)

I offer a feminist critique of deep ecology as presented in the seminal papers of Naess and Devall. I outline the fundamental premises involved and analyze their internal coherence. Not only are there problems on logical grounds, but the tacit methodological approach of the two papers are inconsistent with the deep ecologists’ own substantive comments. I discuss these shortcomings in terms of a broader feminist critique of patriarchal culture and point out some practical and theoretical contributions which eco-feminism can make (...) to a genuinely deep ecology problematic. Character education is an increasingly discussed topic drawing upon virtue ethics as a moral theory. Scholars have predominantly understood educating character as a process that entails the formation of certain distinct character traits or functions through practice and habituation. However, these approaches present some problems. This paper explores the educational implications of various accounts focusing on the relationship between phronesis and other virtues. In particular, our focus will be on those that Miller (2023) has classified as Standard Model and Eliminativist (...) Model of practical wisdom. Starting from these accounts, we will outline three specific problems that the latter models appear to generate at a theoretical level in character education. Finally, we will address the task of demonstrating why the monist account of moral virtue recently proposed by the Aretai group—which conceives being virtuous in possessing phronesis understood as ethical expertise—might offer a refined response to these challenges. In addition, we will illustrate three educational pathways that can emerge from the same model. (shrink)

This article focuses on human dignity as a moral idea and, in particular, on a single but fundamental question: what conception of human dignity, if any, can generate an egalitarian duty to respect all persons? After surveying two mainstream and two alternative conceptions, the article suggests that explaining how human dignity generates an egalitarian duty of respect may be more difficult than has been appreciated.

In spite of the burgeoning philosophical literature on human dignity, Stephen Darwall's second-personal account of the dignity of persons has not received the attention it deserves. This article investigates Darwall's account and argues that it faces a dilemma, for it succumbs either to a problem of antecedence or to the wrong kind of reasons problem. But this need not mean one should reject a second-personal account. Instead, I argue that an alternative second-personal conception, one I will call relational, promises to (...) solve the dilemma by avoiding both the problem of antecedence and the wrong kind of reasons problem. More generally, distinguishing these two second-personal conceptions of the dignity of persons is important to enrich the available philosophical accounts of human dignity. (shrink)

In this paper I explore elements from Kant’s philosophy of right to develop a relational account of the wrong of poverty. Poverty is a relational wrong because it involves relations of problematic dependence, inequality, and humiliation. Such relations infringe the rights to freedom and equality of the poor. And the called-for response is one of public recognition and protection of the rights of the poor. This position means we must radically reconceptualize our individual duties to the poor: not _private beneficence_, (...) but _private remedies for public failures_. (shrink)

This article draws from Adriana Cavarero’s considerations on the role of the body in diverse contemporary modalities of violence. We propose a conceptual path along some ideas from Jacques Lacan, Judith Butler and Kaja Silverman in order to state, on the one hand, an onto-epistemological turn that understands the body as the effect of social norms and, on the other, an ethical and political reflection about the levels of violent exposure that suffer those bodies that are excluded from the cultural (...) frames that make a life livable. The concave mirror—as a possibility for other alternative ways of representing the body—is postulated as an alternative to the hegemonic ways in which the representation operates in the configuration of the body as a totality and unity: those that theory links to the flat mirror. Cognitive penetration of perception, broadly understood, is the influence that the cognitive system has on a perceptual system. The paper shows a form of cognitive penetration in the visual system which I call ‘architectural’. Architectural cognitive penetration is the process whereby the behaviour or the structure of the perceptual system is influenced by the cognitive system, which consequently may have an impact on the content of the perceptual experience. I scrutinize a study in perceptual learning that provides empirical evidence that (...) cognitive influences in the visual system produce neural reorganization in the primary visual cortex. Claiming rights against one another is a perfectly familiar phenomenon. We express the elementary thought you cannot do that to me in a variety of ways. And yet, in spite of the perfect familiarity of this phenomenon, the two standard philosophical theories of rights face notorious difficulties in accounting for it. My aim in this paper is to introduce a distinctive, second-personal account of rights. I will call this the independence theory of rights, the view that rights are specifications of (...) a basic right to independence against another. And I will argue that by taking as basic the second-personal thought you cannot do that to me the independence theory best illuminates the basic phenomenon of having rights against one another. How should we think about apparent conflicts of moral rights? I defend a non-balancing and holistic specification model: non-balancing because moral rights have absolute deontic stringency regardless of any balance of independent values; holistic because the content of moral rights is limited only by that of other moral rights. Holistic Specification, as I call the model, offers a principled, non-consequentialist explanation of exceptions to moral rights. The two standard interpretations of Kant’s view of the relationship between external freedom and public law make one of the terms a means for the production of the other: either public law is justified as a means to external freedom, or external freedom is justified as a means for producing a system of public law. This article defends an alternative, constitutive interpretation: public law is justified because it is partly constitutive of external freedom.
