This paper explores the impact of the Human Rights Act 1998 on decision making in adult social care in England and Wales. It focuses on a review of the Act by the government in June 2006 and subsequent new guidance on implementation addressed to policy makers, managers and practitioners. The meaning of ?rights? in contemporary legal and social theory is considered and the potential of human rights law to improve the experiences of service users is evaluated in the light of (...) recent research findings and proposed policy changes. In 2012, chief nursing officers (CNO) in England published a policy on compassion in response to serious criticisms of patients’ care. Because their objective is fundamentally to shape nursing, this study argues, following Popper, that the policy should be analysed. An appraisal tool, developed from Popper, Gadamer, Jauss and Thiselton, is the framework for this analysis. The CNO policy document identified six values and behaviours, termed ‘6Cs’, required by all nurses, midwives and care staff. The document contains no data, references (...) or acknowledgements, but is similar to the 6Cs defined by the Canadian nursing nun, Sister M. Simone Roach, in her theory of caring published 30 years earlier. Roach considered caring and the components of it, including compassion, to be moral virtues, an inner motivation to care. This study suggests that without explicit reference to Roach's ideas, and her underlying theoretical base, the CNO requirement has the effect of turning virtues into commodities and a form of external control, described by Ritzer as a McDonaldized dehumanization. This study, which has international relevance beyond England and the UK, suggests that the CNO revise their policy by acknowledging Roach's 6Cs and openly discuss the implications of her work for their policy. This paper combines a review of existing literature in the field of business ethics education and a case study relating to the integration of ethics into an undergraduate degree. Prior to any discussion relating to the integration of ethics into the business curriculum, we need to be cognisant of, and prepared for, the arguments raised by sceptics in both the business and academic environments, in regard to the teaching of ethics. Having laid this foundation, the paper moves to practical questions (...) such as who should teach ethics, and when and how can ethics be taught. The paper presents alternative models for the teaching of ethics in the curriculum of undergraduate and postgraduate business programmes. An integrative model is elaborated on in more detail with a case example describing the six-stage process undertaken in the move from a single entry course to an integrated approach. The case study details not only the planning and initial implementation of ethical education in the context of an undergraduate business degree programme, but also the means by which a change in the way that ethics is taught was achieved in a business faculty in a tertiary institution. It is commonly accepted – not only in the philosophical literature but also in daily life – that ignorance is a failure of some sort. As a result, a desideratum of any ontological account of ignorance is that it must be able to explain why there is something wrong with being ignorant of a true proposition. This article shows two things. First, two influential accounts of ignorance – the Knowledge Account and the True Belief Account – do not satisfy this (...) requirement. They fail to provide a satisfying normative account of the badness of ignorance. Second, this article suggests an alternative explanation of what makes ignorance a bad cognitive state. In a nutshell, ignorance is bad because it is the manifestation of a vice, namely, of what Cassam calls “epistemic insouciance”. (shrink)

In recent years, there has been a growing anti-feminist, conservative movement across many parts of the world known as the anti-gender movement. This movement has been especially strong in Central Eastern Europe, where anti-gender actors have framed ‘gender’ as a static, foreign concept imported from ‘the West’ and destructive to ‘traditional’ societies. Utilising a postcolonial feminist approach, I examine the concept of ‘gender’ in Czechia, drawing attention to the role played by Czech academics, activists and policymakers in negotiating the use (...) of the term ‘gender’. This article traces the history of the term from the 1990s when ‘gender’ was first introduced to a Czech academic audience, through public seminars and lectures hosted by the Prague Gender Studies Centre, to the present-day inclusion of gender mainstreaming discourse in Czech policy documents. I reveal that ‘gender’ is not a timeless, clearly defined, fixed term wholly imported from ‘the West’ but rather a concept with a variable and complicated history. Thus, this crucial term, first developed in Anglo-academia, is not uncontested or uncritically accepted, contrary to the claims made by anti-gender actors. The findings presented in this article hold implications critical to transnational feminist dialogue and activism during the current period of growing global anti-feminist sentiment. (shrink)

My argument is that poststructuralist and postmodernist theory carries on and intensifies the main lines of a characteristically modern tradition of aesthetics whose most important point of reference is not French structuralism – as the term, ‘poststructuralism’, implies – but the tradition of 18th-century German romanticism and idealism that culminated in the work of Heidegger during the Weimar period in Germany between the world wars and afterward. What characterizes this modernist tradition of aesthetics is its valorization of language as a (...) mode of being possessed of an ‘ontological’ status. I place the term ‘ontology’ in quotes in order to highlight the distinction between ‘metaphysics’, with its Aristotelian and neo-Platonic connotations of a ‘chain of being’, and the more modern term ‘ontology’, which was coined in the 17th century and which became widely used during the 18th century by Leibnizian philosophers Christian Wolff and Alexander Baumgarten; the latter, not incidentally, also helped to establish modern usage of the term ‘aesthetics’. ‘Metaphysics’ and ‘ontology’ have their roots, respectively, in those two most major currents of our western heritage, the Graeco-Roman and Judaeo-Christian. These currents, although inextricably linked to one another in innumerable ways, have nonetheless been engaged, as Nietzsche put it, ‘in a fearful struggle on earth for thousands of years’ that has been obscured by Heidegger’s and Derrida’s accounts of the history of western philosophy. Such accounts have projected what is basically a romanticist critique of Enlightenment values and thought on to a totalizing account of the history of Western thought since Plato. My purpose in emphasizing the distinction between metaphysics and ontology is to provide a conceptual framework within which our understanding of the development of modern aesthetics, and the concept of language that informed that development, can be related to the larger philosophical issues at hand. Literary theorists in the United States, by endorsing Heidegger’s and Derrida’s self-serving accounts of their writings as assaults on the entire history of Western philosophy, and by failing to judge them critically as outgrowths of that history, have not only obscured these developments. They have also sustained the central tenet of American literary theory since the 1960s: that there is such a thing as a ‘Western philosophical tradition’ on the ‘other’ side of which, through an endless series of linguistic coinages and ‘erasures’, we may maneuver ourselves. My claim is that to the extent that there is such an other side, we are already on it, and that we fundamentally misunderstand our situation if we regard it as ‘other’ to the Western philosophical tradition. In the recent literature of environmental ethics, certain criticisms of pragmatism in general and Dewey in particular have been made, specifically, that certain features of pragmatism make it unsuitable as an environmental ethic. Eric Katz asserts that pragmatism is an inherently anthropocentric and subjective philosophy. Bob Pepperman Taylor argues that Dewey’s naturalism in particular is anthropocentric in that it concentrates on human nature. I challenge both of these views in the context of Dewey’s naturalism. The theology of Joseph Smith remains controversial and at times divisive in the broader Christian community. This paper takes Smith’s trinitarian theologyas its point of departure and seeks to accomplish four interrelated goals: (1) to provide a general defense of “social trinitarianism” from some of the major objections raised against it; (2) to express what we take to be Smith’s understanding of the Trinity; (3) to analyze the state of modern ST and (4) to argue that, as a form of (...) In this paper, I outline both a nonanthropocentric and non-subjective theory of intrinsic value which incorporates pragmatism in environmental ethics in a novel way. The theory, which I call creative actualization, is a non-hierarchical, nonsubjective theory of value which includes the value of nonhuman species and the biosphere. I argue that there are conditions to such values. These limitations include evaluations of actual improvement and reciprocity as conditions. These conditions are necessary limitations upon actions, i.e., duties. I incorporate a deontological (...) ethic thereby as an alternative to utilitarian and other ethical theories in environmental ethics. Duties are to species and to habitats, not to individuals. I conclude that the distinction between ethics and ecological ethics is no longer tenable, given a theory of obligation which is truly universal rather than speciesist. Ecological ethics is the ethics of the future, embracing a way of life, duty, and questions of ultimate worth. (shrink)

Investigating the theoretical and empirical relationships between transparency and trust in the context of surveillance, this volume argues that neither transparency nor trust provides a simple and self-evident path for mitigating the negative political and social consequences of state surveillance practices. Dominant in both the scholarly literature and public debate is the conviction that transparency can promote better-informed decisions, greater oversight, and restore trust damaged by the secrecy of surveillance. The contributions to this volume challenge this conventional wisdom by considering (...) how relations of trust and policies of transparency are modulated by underlying power asymmetries, socio-historical legacies, economic structures, and institutional constraints. They study trust and transparency as embedded in specific socio-political contexts to show how, under certain conditions, transparency can become a tool of social control that erodes trust, while mistrust-rather than trust-can sometimes offer the most promising approach to safeguarding rights and freedom in an age of surveillance. As we approach the end of the twentieth century, humanity is facing a crisis in definition and ways of thinking across the boundaries of identity, politics, and culture. This paper briefly addresses unusual forums and forms for expressing the anxiety surrounding change and the ability to analyze it, forms linked to the media and its intensive focus on particular “human interest” stories, but also to the uncertainty that a lack of precedent for thinking creates. One of the questions that most (...) interests me is how the malaise of society and the malaise of political change is expressed through the debates around maternity, birth, and the custody of children, how socio-political problems are made intelligible through dramatization of individual struggle involving family relations. What is compelling is the way in which certain stories followed by the media gravitate around facts that speak of what we do not know. Recent advances in reproductive technologies have put into question the belief (whether implicit or explicit) that biology, as a teleological process, can hold cultural chaos in abeyance. The doors have been opened wide as the definition and status of mother, father, and child have all been deeply questioned. Yet at the very moment when the so-called nuclear family is endangered, it is the extraordinarily powerful metaphor of the family that rings insistently in social and political discourse. There is a sense that the threat to the family signals a disintegration of order, leaving the contemporary sense of self bereft of a discourse that can represent universal order. (shrink)

Arbery; 255 pp. Wilmington, Delaware: ISI Books, 2001, $24.95. Over the last decade or so, there has appeared an increasing number of books critical of the profession of literary studies. Such criticism has typically been directed (...) at literary theory and its preoccupation with the politics of race, class, and gender. To a limited extent, Glenn Arbery's Why Literature Matters: Permanence and the Politics of Reputation can be classified as belonging to such a "genre." Early in the book, for example, Arbery argues in favor of the "old-fashioned" idea, as he calls it, that literature is a "mode of knowledge" with the potential to open up transcendent modes of experience. Yet Why Literature Matters is so short on polemics and so long on incisive, sometimes brilliant readings of works ranging from the poetry and fiction of Seamus Heaney, Tom Wolfe, Toni Morrison, and Emily Dickinson to Shakespeare's Othello and Homer's Iliad, that such a characterization is insufficient at best and distorting at worst. Notwithstanding its title, this book is devoted less to advancing a polemic about "why literature matters" than to dramatizing, with performative power and grace, why most of us, politically oriented or not, are already quite sure that it does.Such performative power can be felt throughout Why Literature Matters, but [End Page 373] its presence is especially strong in the final, lengthy chapter on the Iliad, "The Sacrifice of Achilles." Bringing to bear his training as a classical scholar, Arbery contends that the Iliad is "about" a single event: the death or "sacrifice" of Achilles. Achilles, Arbery notes, was not just the greatest hero of the Iliad. He was also the greatest hero of the entire classical world: "Achilles has no rival in glory, either in the generation of heroes before him (not even Herakles), or in the ages after him. According to Plutarch, Julius Caesar wept because he had not accomplished as much as Alexander at the same age, but Alexander the Great envied Achilles."Why, then, does Arbery refer to Achilles' death as "sacrificial"? Drawing on a version of the Greek myth whose source is Pindar rather than the more commonly cited Hesiod, Arbery observes that Achilles' sacrificial death, which is not in fact narrated in the Iliad but is everywhere taken for granted, was necessitated by Zeus' successful plan to forestall a prophecy. That prophecy said that a son would be born to Zeus and the goddess Thetis, who would overthrow the Olympian god as Zeus had overthrown the Titans. Such a son, prophesized to be not the greatest of mortals but, much more, the greatest of gods, would have been--should have been, from Achilles's justly embittered standpoint--Achilles. But in fact Zeus foiled the prophecy by marrying Thetis off to a mere mortal, Peleus, thereby ensuring his own continued reign and Achilles' eventual death.It is the burden of Arbery's discussion to show not just that Achilles comes to accept and even "will" his own death, but that the meaning of such sacrificial death is embodied and given "presence" in the poetic form and language of the Iliad, including especially the descriptions of Patrocles and Hector, each of whom "inhabits the meaning of Achilles" by dying, successively, in Achilles' armor. Objective—To identify and describe the current state of clinical ethics support services in the UK.Design—A series of questionnaire surveys of key individuals in National Health Service (NHS) trusts, health authorities, health boards, local research ethics committees and health professional organisations. Interviews with chairmen/women of clinical ethics committees identified in the surveys.Setting—The UK National Health Service.Results—Responses to the questionnaires were received from all but one NHS trust and all but one health authority/board. A variety of models of clinical ethics support were (...) identified including twenty formal clinical ethics committees (CECs). A further twenty NHS trusts expressed an intention to establish a CEC within the next twelve months. Most CECs in the UK have been in existence less than five years and are still defining their role. The chairmen identified education of committee members and contact with other ethics committees as important requirements for committee development. Problems were identified around lack of support for the committee and with raising the profile of the committee within the institution. There has been little evaluation of clinical ethics support services either in the UK or in other countries with longer established services. What evaluation has occurred has focused on process rather than outcome measures.Conclusions—Clinical ethics support services are developing in the UK. A number of issues have been identified that need to be addressed if such support services are to develop effectively. (shrink)

Kline's evolutionary analysis of teaching provides welcome reframing for cross-species comparisons. However, theory based on competition cannot explain the transmission of human cultural elements that were collectively created. Humans evolved in a cultural niche andteaching-learningcoevolved to transmit culture. To study human cultural variation in teaching, we need a more articulated theory of this distinctively human engagement.

In this paper, I take a critical look at Sartorio’s book Causation and Free Will (2016). Sartorio offers a rich defence of an actual-sequence view of freedom, which pays close attention to issues in the philosophy of causation and how they relate to freedom. I argue that although this focus on causation is illuminating, Sartorio’s project nevertheless runs into some serious difficulties. Perhaps most worrying amongst them is whether the agent-based reason-sensitivity account, offered by Sartorio, is consistent with Frankfurt-style cases (...) – the very cases which are provided as the sole reason to endorse an actual-sequence view of freedom. I suggest that given that powers and causation are so intimately bound together, the debate is skewed somewhat by thinking of these as rivals. (shrink)

This paper looks at conflicts of interest in the not-for-profit sector. It examines the nature of conflicts of interest and why they are of ethical concern, and then focuses on the way not-for-profit organisations are especially prone to and vulnerable to conflict-of-interest scandals. Conflicts of interest corrode trust; and stakeholder trust (particularly from donors) is the lifeblood of most charities. We focus on some specific challenges faced by charitable organisations providing funding for scientific (usually medical) research, and examine a case (...) study involving such an organisation. One of the principal problems for charities of this kind is that they often distribute their funds within a relatively small research community (defined by the boundaries of a small region, like an American state or Spanish Autonomous region, or a small country), and it often proves difficult to find high-level researchers within the jurisdiction to adjudicate impartially the research grants. We suggest and recommend options appropriate for our case study and for many other organisations in similar situations. (shrink)
