Ispoljavanje dobra u Hegelovim Osnovnim crtama filozofije prava nije postizanje srece ili malogradjanskog komfora, nego hrabro i odlucno, gotovo slucajno i spolja posmatrano neosnovano ispoljavanje partikularne volje. Ovakav pojam dobra je upravo suprotan pojmu dobra u smislu dobara i uzivanja koji sprecava stvaranje subjektivnosti kod onih koji su neprepoznati od datog drustvenog sistema, urusavajuci mogucnost partikularnog delanja kod ovih, i time ih podrzavajuci u mentalitetu rulje, to jest mase. Nadomestavanje nedostatka slobode komforom je pre karakteristika faze apstraktnog prava, koju faza (...) moralnosti tezi da prevazidje. U fazi apstraktnog prava, zbog slepog postovanja suvog legaliteta, ono sto je pravo u sebi i za sebe ne moze nikako biti ispoljeno u pravom smislu reci jer je izjednaceno sa ugovornom pravdom, cija je prava osnova nista drugo do pravo jaceg. Esta investigación explora la influencia de la filosofía de Arthur Schopenhauer sobre la composición musical de Tristán e Isolda, un drama musical del compositor Richard Wagner. Se toman como punto de partida los textos del compositor en donde afirma haber conocido la obra filosófica de Schopenhauer y asegura que esta fue de gran importancia en su vida y en su labor (...) artística. Resumen: Espacio y tiempo son conceptos inseparables. La relación que los une es tan estrecha que el espacio puede considerarse la otra cara del tiempo, y viceversa. La unidad y a la vez alteridad espacio-temporal representa un problema fundamental tanto para la ciencia, especialmente la física, como para la filosofía y el arte. Aunque puede haber puntos de encuentro entre las concepciones de las diferentes áreas, se observan diferencias fundamentales en la manera de entender ambos conceptos y la relación (...) entre ellos. El espacio y tiempo de la física clásica y el espacio lógico de Wittgenstein, ligado al presupuesto de la simultaneidad, son presuposiciones teóricas necesarias para establecer leyes físicas o bien para lograr representaciones exactas. Frente a la noción científica y transcendental está la concepción ontológica de Heidegger y la artística de Chillida. Renunciando al ideal de la exactitud, de lo medible y comprobable, el filósofo y el escultor entienden la mutua pertenencia de espacio y tiempo como algo que tiene una importancia fundamental para la vida humana y que representa un reto que hay que buscar.: Space and time are inseparable concepts. The relationship that joins them is so close that one can understand space as the opposite side of time, and vice versa. Unity and otherness of space and time constitute a fundamental problem for science, especially physics, as well as for philosophy and art. Although there may be connecting lines between the conceptions those different fields hold on space and time, one observes fundamental differences in the way they understand these two concepts and the relation between them. The conception of space and time in classical physics, as well as in Wittgenstein’s notion of logical space connected with the principle of simultaneity, represent necessary theoretical premises in order to establish physical laws and precise representations. Opposite to the scientific and transcendental concepts, we find Heidegger’s ontological and Chillida’s artistic conceptions. Giving up the ideal of precision, of measurement and verification, the philosopher and the sculptor understand the mutual belonging of space and time as something that has a fundamental importance in human life, and that constitutes a challenge that one can only search for. Las órdenes militares dispusieron desde su fundación de mano de obra esclava en sus tierras, pero la institución que mejor sirve para estudiar la esclavitud en los siglos XII y XIII en los reinos de León y Castilla son los hospitales para la redención de cautivos de la Orden de Santiago. Estas instituciones disponían de espacio para alojar a los cautivos mientras se negociaban rescates con los poderes islámicos, y atendían a la redistribución de aquellos musulmanes que, por no (...) class='Hi'>haber sido redimidos, pasaban a ser esclavos de la propia orden o a ser vendidos en los mercados de los reinos cristianos. Los escasos documentos de la sección de Órdenes Militares del Archivo Histórico Nacional dedicados a esclavos ayudan a comprender el funcionamiento del tráfico, trabajo y liberación de este colectivo. La Europa de libertad, seguridad y justicia que pretende garantizarse para la ciudadanía, en principio, no iría dirigida a los millones de personas que residen legalmente en la UE sin ostentar la nacionalidad de ningún Estado miembro, y de ningún modo pensada para quienes se encuentran en situación irregular. A estas personas que forman parte de la población real de los Estados no se les califica de ciudadanos, ni se les otorgan derechos de ciudadanía. Por consiguiente, muestran la situación de (...) servidumbre que existe en el interior de los Estados europeos. Pero no sólo los nacionales de terceros Estados encuentran limitado el ejercicio de los derechos humanos. También la ciudadanía europea, como resultado de los necesarios ajustes institucionales y estructurales que demanda el modelo económico global, está viendo incrementarse los riesgos y la incertidumbres, debido a los cambios en el mercado de trabajo, en el sistema educativo y en el modelo de Estado. Todas estas reestructuraciones están gestando un nuevo orden social. En este nuevo modelo de sociedad, el control y la seguridad parecen haber usurpado el protagonismo hasta ahora detentado por la justicia social. La finalidad de esta investigación ha sido precisamente mostrar el doble impacto que el nuevo modelo económico y la sociedad del conocimiento y la información tienen en la ciudadanía y en quienes están fuera o en los límites de ella. Una comparación que permite sostener que en estos ajustes sólo ganan las mercancías y las instituciones, no las personas. (shrink)

En este artículo, emergente de pensadores (...) ambientales latinoamericanos y pensadores-otros que han sospechado radicalmente del edificio de la ética ambiental emergente de la conferencia del Club de Roma o del Informe Burndtland, intentamos desplegar lo ético, como ethos con e larga, que en griego significa casa, y desde este lugar de enunciación, intentamos salirnos del sujeto y del objeto en la variación ética ambiental eurocentrista, y proponer con las voces de la tierra sur, abya yala, diseños del ethos, ligado óntica-relacionalmente con el cuerpo-tierra. Diseñamos, inspirados en Husserl, Heidegger, Deleuze, Guattari, Ángel-Maya, Enrique Leff, Noguera, Echeverri, pensadores-otros y voces de montañas, animales, ríos, y plantas, la vida, territorios de libertad entendida ésta como expansión de los cuerpos en la naturaleza y de paz integral y completa, entendiendo que no puede haber paz, si no amamos ni respetamos la tierra que somos. Este libro no es solo una ética para chicas, es también una llamada a los chicos para que se atrevan a transgredir de verdad: para que dejen de ponerse en el lugar de sus deseos y se pongan en el lugar de las demás. La filosofía y, con ella, la ética puede ayudarnos a comprender las enormes contradicciones a las que tienen que enfrentarse las mujeres en un mundo patriarcal al que los filósofos, aun sin haber estado a la altura, sí aportaron una manera de pensar crítica que nos ha llevado a ser conscientes de las desigualdades y a cuestionar el sistema. Ética para Celia nos invita a mirar de frente la realidad, el hecho de que nuestra vida se ha levantado sobre una doble verdad, con normas morales y fines vitales distintos para mujeres y hombres. Esta doble verdad se ha ido transformando, pero no ha desaparecido. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

How does this complicate the task of phylogenetic inference, and how might it inform and shape the conceptual foundations of phylogenetics? The repair of chromosomal double‐strand breaks (DSBs) by homologous recombination is essential to maintain genome integrity. The key step in DSB repair is the RecA/Rad51‐mediated process to match sequences at the broken end to homologous donor sequences that can be used as a template to repair the lesion. Here, in reviewing research about DSB repair, I consider the many factors that appear to play important roles in the successful search for homology by several homologous recombination mechanisms.

Authentic leadership has become increasingly important in the literature, attracting the attention of many scholars in the last decade. This study adopted an employee-centered perspective to guide its examination of the relationship between authentic leadership and individual performance and investigation of the sequential mediation of employees’ affective commitment and individual creativity. An analysis was conducted of data collected from 214 employees working in different business sectors. The results reveal a statistically significant positive relationship between authentic leadership and employees’ workplace performance, (...) which are both directly connected and indirectly linked through the two proposed psychosocial mechanisms. The findings thus indicate that authentic leadership reinforces workers’ emotional connection with their organizations, thereby increasing their individual creativity and, subsequently, promoting better on-the-job performance. This study presents new and significant results since, on the one hand, it relied on a sequential mediation analysis of variables and, on the other hand, integrated the four main constructs into a single model. The proposed model displays the chain of effects between authentic leadership, affective commitment, individual creativity, and employee workplace performance. Although touch frequently occurs in psychotherapy with children, there is little written on the ethical considerations of therapeutic touch. Because physical contact does occur, therapists must consider if, how, and when it is used, for both their clients' safety and their own. In this review, I further develop the issues suggested by Aquino and Lee (2000) in the use of nurturing touch in therapy by considering many types of touch that occur in psychotherapy with children; the possible positive role of (...) touch; clients' perception of touch in therapy; considerations related to the therapist, the child's safety, and any history of abuse in the child's and family's background; and other practical considerations. Physician-assisted suicide is a novel idea having affinities with both suicide and euthanasia. It has affinities with suicide because it involves a self-inflicted death, and it has affinities with euthanasia because the physician is instrumental in the death. It is, however, not exactly either, making it the subject of an exciting debate.

Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. In this essay I present some of my thoughts on the issue of boundaries in the professional relationship between service users and social workers. As a graduate student of social work, I had an opportunity to discuss ethical dilemmas in an international perspective in one of my courses. A guest professor, who provided international perspectives, was Prof. Kim Strom from UNC at Chapel Hill in North Carolina, USA. The lectures offered a fresh perspective that raised many questions about thick and (...) thin boundaries in social work – especially when approaching social work by following prevailing guidelines for social work in Slovenia requiring us to co-create solutions through dialogue with service users, keeping in mind that service users are actually the ones who are the experts from experience. In this way, the working relationship seeks to foster a sense of partnership between social workers and service users. In this essay I would like to challenge the idea of rigid boundaries in social work and explore the possibility of fluid boundaries, keeping in mind that boundaries should reflect their main purpose, which I believe is to protect human dignity. The purpose of this article is to investigate human spatiality and perception in general, with the experience of adventure sports as its background. These activities highlight especially our strong relationship with the world when we consider the specific way in which the environment participates in the development of human potential. We first analyse the notions of risk and instability as important elements in adventure sports. Then we explore the notion of experience and spatiality, considering the way in which we establish (...) our relationship with the world. The theoretical background is found in the phenomenology of Merleau-Ponty and Bachelard’s phenomenology of imagination to investigate perspectives of space among adventurers. We hold that more than a different range of corporeal techniques, adventure sports can teach us a way of interrogating and looking at the world. They require a peculiar sensibility that allows our body to experience the environment in favour of a corporeal wisdom. Alternative sports indicate the possibility that we have to build up different ways of inhabiting the world and comprehending it. (shrink)

Lack of vaccine confidence can contribute to drops in vaccination coverage and subsequent outbreaks of diseases like measles and polio. Low trust in vaccines is attributed to a combination of factors, including lack of understanding, vaccine scares, flawed policies, social media and mistrust of vaccine manufacturers, scientists and decision-makers. The COVID-19 crisis has laid bare societies’ vulnerability to new pathogens and the critical role of vaccines in containing this and future pandemics. It has also put science at the forefront of (...) the response, with several governments relying on academics to help shape policy and communicate with the public. Against this backdrop, protecting public trust in scientists and scientific output is arguably more important than ever. Yet, conflicts of interest in biomedical research remain ubiquitous and harmful, and measures to curb them have had limited success. There is also evidence of bias in industry-sponsored vaccine studies and academics are voicing concerns about the risks of working in a CoI prevalent research area. Here, we set out to challenge established thinking with regard to vaccine confidence, by shifting the gaze from a deficit in public understanding towards probity in research relationships and suggesting an alternative and perhaps complementary strategy for addressing vaccine mistrust. We argue that a concerted effort needs to be made to revisit the norms that undergird contemporary vaccine research, coupled with a willingness of all stakeholders to reimagine those relationships with an emphasis on demonstrating trustworthiness and probity. Aggregating snippets from the semantic memories of many individuals may not yield a good map of an individual’s semantic memory. The authors analyze the structure of semantic networks that they sampled from individuals through a new snowball sampling paradigm during approximately 6 weeks of 1-hr daily sessions. The semantic networks of individuals have a small-world structure with short distances between words and high clustering. The distribution of links follows a power law truncated by an exponential cutoff, meaning that most words (...) are poorly connected and a minority of words has a high, although bounded, number of connections. Existing aggregate networks mirror the individual link distributions, and so they are not scale-free, as has been previously assumed; still, there are properties of individual structure that the aggregate networks do not reflect. A simulation of the new sampling process suggests that it can uncover the true structure of an individual’s semantic memory. (shrink)

Flexibility in conceptual projection constitutes one of the most challenging issues in the embodiment and conceptual metaphor literatures. We sketch a theoretical proposal that places the burden of the explanation on attentional dynamics in interaction with mental models in working memory that are constrained to be maximally coherent. A test of this theory is provided in the context of the conceptual projection of time onto the domain of space. Participants categorized words presented at different spatial locations (back–front, left–right) as referring (...) to the past or to the future. Responses were faster when the irrelevant word location was congruent with the back–past, front–future metaphoric mapping. Moreover, when a new highly task-relevant spatial frame of reference was introduced, it changed the projection of past and future onto space in a way that was congruent with the new frame (past was now projected to left space and future to right space), as predicted by the theory. This study shows that there is substantial flexibility in conceptual projection and opens a venue to study metaphoric variation across tasks, individuals, and cultures as the result of attentional dynamics. U ovom članku raspravljamo o hipotezi proširenog jastva Andyja Clarka i Davida Chalmersa, a osobito o prigovoru prema kojemu proširenom jastvu nedostaje stabilnost i kontinuitet koji su potrebni da bismo ga smatrali identičnim kroz vrijeme. Pokušavamo pokazati da je taj prigovor neodrživ. Raspravljamo i o gledištu prema kojemu se drugi tip jastva, to jest narativno jastvo, također može shvatiti kao prošireno, i tvrdimo da stabilnost i kontinuitet toga tipa jastva također nisu ugroženi ako ga proširimo izvan granica čovjekova tijela. Stoga, (...) barem što se tiče tih tipova jastva, kada razmišljamo o problemima osobnog identiteta, nije potrebno ograničiti se na internalizirano jastvo. (shrink)

The language of ethics expertise has become particularly important in bioethics in light of efforts to establish the value of the clinical ethics consultation, to specify who is qualified to function as a clinical ethics consultant, and to characterize how one should evaluate whether or not a person is so qualified. Supporters and skeptics about the possibility of ethics expertise use the language of ethics expertise in ways that reflect competing views about what ethics expertise entails. We argue for clarity (...) in understanding the nature of expertise and ethics expertise. To be an ethics expert, we argue, is to be an expert in knowing what ought to be done. Any attempt to articulate expertise with respect to knowing what ought to be done must include an account of ethics that specifies the nature of moral truth and the means by which we access this truth or a theoretical account of ethics such that expertise in another domain is linked to knowing or being better at judging what ought to be done and the standards by which this “knowing” or “being better at judging” is determined. We conclude with a discussion of the implications of our analysis for the literature on ethics expertise in CEC. We do think that there are clear domains in which a clinical ethics consultant might be expert but we are skeptical about the possibility that this includes ethics expertise. Clinical ethics consultants should not be referred to as ethics experts. (shrink)

Citizenship is no longer an exclusive relationship. Many people today are citizens of multiple countries, whether by birth, naturalization, or even through monetary means, with schemes fast-tracking citizenship applications from foreigners making large investments in the state. Moral problems surround each of those ways of acquiring a second citizenship, while retaining one's original citizenship. Multiple citizenship can also have morally problematic consequences for the coherence of collective decisions, for the constitution of the demos, and for global inequality. The phenomenon of (...) multiple citizenship and its ramifications remains understudied, despite its magnitude and political importance. In this innovative book, Ana Tanasoca explores these issues and shows how they could be avoided by unbundling the rights that currently come with citizenship and allocating them separately. Fencing for the blind and visually impaired is an emerging sub-discipline of fencing that creates unusual conditions for meaning-making through interaction between embodied endowments and worldly affordances. With the rules of fencing slightly adjusted to the needs of the blindfolded participants – regardless of their sightedness – the discipline requires the fencers to engage in a duel by relying on other than visual cues. This article explores what an autoethnographic account of experiences of participation in fencing for the blind and (...) visually impaired brings to debates on the embodied, and specifically sensory difference. The discussion of these experiences intersects with debates on affect, affordance, and habit, with all three having important roles in related semiotic processes. Presented vignettes draw upon the author’s lived experiences of participation in fencing for the blind and visually impaired and are analyzed as part of a mixed-method autoethnographic study, accompanied by sensory methodologies, with a focus on an inquiry beyond the visual. The vignettes elucidate how we make sense of our surroundings through a complex engagement with the ecology of sensory and affective processes. In addition to exploring the role of affective and pre-conceptual aspects of our experiences, the article seeks to understand how semiosis occurs through both exposure to as well as the active pursuit of specific environmental signs available to us. The article also derives from biosemiotics to examine the complex relationship between meaning-making processes and habits. In her recent book Gillian Brock argues that states’ legitimacy depends on their being part of a just state system that protects human rights. Here I discuss some practical limitations raised by Brock’s legitimacy framework: mainly, (1) the problematic real-world implications of such an account, and (2) the epistemic challenges that judgements inspired by this account would have to face, were we to proceed solely on the basis of it.

Croatia is a transitional society in that it is a country emerging from a socialist command economy toward a market-based economy with ensuing structural changes of a social and political nature—some extending into the healthcare system. A legacy from our past is that, until now, Croatian healthcare institutions have had no real experience with clinical ethics support services. When clinical cases arise presenting complex ethical dilemmas in treatment options, the challenges presented to the medical team are substantial. The case described (...) below recently occurred on a ward in a university hospital in Croatia. An unexpected request from the patient’s parents created a number of issues that needed to be addressed by the medical team, which was made more difficult by the lack of clinical ethics support services. Such cases press the question currently being debated as to what type of ethics support services would be suitable for Croatia and why. (shrink)

Studies of creative industries typically contend that creative work is profoundly precarious, taking place on a freelance basis in highly competitive, individualized and contingent labour markets. Such studies depict creative workers as correspondingly self-enterprising, self-reliant, self-interested and calculative agents who valorise care-free independence. In contrast, we adopt the ‘ethics of care’ approach to explore, recognize and appreciate the communitarian, relational and moral considerations as well as interpersonal connectedness and interdependencies that underpin creative work. Drawing on in-depth interviews with creative workers (...) in a range of marginal socio-cultural contexts, we argue that creative workers cultivate and sustain a diverse array of practices of care arising from an affective concern with the well-being of others. Far from being merely individualistic and crudely competitive actors, creative workers enact practical ethical responsibilities and affectivities towards a range of human and non-human others, including families, local communities and neighbourhoods, colleagues, artistic scenes and their adjacent genres, and surrounding national and linguistic cultures. In emphasizing the fundamental and structuring role of care in contingent labour markets our approach accords with recent trends in the social sciences that ‘affirmatively’—as opposed to ‘negatively’ and ‘suspiciously’—recognize that mutuality, solidarity and affectivity are powerful drivers of action on a par with or even exceeding market-driven self-centredness. Despite its potential implications for the objectivity of scientific knowledge, the claim that “scientific instruments are perspectival” has received little critical attention. I show that this claim is best understood as highlighting the dependence of instruments on different perspectives. When closely analyzed, instead of constituting a novel epistemic challenge, this dependence can be exploited to mount novel strategies for resolving two old epistemic problems: conceptual relativism and theory-ladeness. The novel content of this article consists in articulating and developing these strategies (...) by introducing two fine-grained notions of perspectives as the key units of analysis: “broad perspectives” and “narrow perspectives.”. The theory of mental models postulates that meaning and knowledge can modulate the interpretation of conditionals. The theory's computer implementation implied that certain conditionals should be true or false without the need for evidence. Three experiments corroborated this prediction. In Experiment 1, nearly 500 participants evaluated 24 conditionals as true or false, and they justified their judgments by completing sentences of the form, It is impossible that A and ___ appropriately. In Experiment 2, participants evaluated 16 conditionals and provided their (...) own justifications, which tended to be explanations rather than logical justifications. In Experiment 3, the participants also evaluated as possible or impossible each of the four cases in the partitions of 16 conditionals: A and C, A and not-C, not-A and C, not-A and not-C. These evaluations corroborated the model theory. We consider the implications of these results for theories of reasoning based on logic, probabilistic logic, and suppositions. (shrink)
