When Johann and Daniel Bernoulli founded fluid dynamics they encountered several problems. To go beyond the vision of Newtonian particles, a new set of images was needed in order to deal with the spatial extensibility and lack of form of fluids. I point to evidence that analogy was an essential abductive strategy in the creation of this imagery. But its heuristic behavior is complex: analogy can provide an initial model or proto-model that establishes the starting point of a theoretical process, (...) but it can play other roles as well. The historical genesis analyzed here shows that the participation of analogy in physicists’ creativity is not so restricted and that its richness opens up the field for very different roles and strategies in model-based discovery processes. Analogies can crop up intermittently in the evolution of a theory; and they can cooperate with images, extreme case reasoning and thought experiments, and even activate these processes at origin. Although it may seem that the contributions of analogy are generative in the sense of helping to discover new aspects of reality, we must stress the evaluative function that sometimes is performed by analogical reasoning in order to gain confidence. The study of the Bernoulli’s genesis of the foundations of fluid dynamics generates interesting hypotheses about the multiple roles that analogy can play in scientific model-based reasoning. Some viewpoints on the foundations of mathematics and its philosophy are more connected to scientific practice and its heuristics, mainly with the construction of physical theories and the search for the best explanations of physical phenomena by means of abduction or the solution of problems by the analytical method. Some researchers have introduced the importance of human cultural activities into the cognitive aspects of the mental processes of scientists, proposing an embodied approach in the bridge between mathematics and reality. Fluid (...) mechanics is an interesting area in this sense due to its position if the network of mathematics. By means of an historical example on vortex motion by Helmholtz, we show that the intuitive idea of eddy contains cognitive properties of a mental schema and that it gives many heuristic options for an embodied mathematical explanation about vortex dynamics. Self-awareness represents the capacity of becoming the object of one’s own attention. In this state one actively identifies, processes, and stores information about the self. This paper surveys the self-awareness literature by emphasizing definition issues, measurement techniques, effects and functions of self-attention, and antecedents of self-awareness. Key self-related concepts (e.g., minimal, reflective consciousness) are distinguished from the central notion of self-awareness. Reviewed measures include questionnaires, implicit tasks, and self-recognition. Main effects and functions of self-attention consist in selfevaluation, escape from the (...) self, amplification of one's subjective experience, increased self-knowledge, self-regulation, and inferences about others' mental states (Theory-of-Mind). A neurocognitive and socioecological model of self-awareness is described in which the role of face-to-face interactions, reflected appraisals, mirrors, media, inner speech, imagery, autobiographical knowledge, and neurological structures is underlined. Quite a few recent models are rapidly introducing new concepts describing different levels of consciousness. This situation is getting confusing because some theorists formulate their models without making reference to existing views, redundantly adding complexity to an already difficult problem. In this paper, I present and compare nine neurocognitive models to highlight points of convergence and divergence. Two aspects of consciousness seem especially important: perception of self in time and complexity of self-representations. To this I add frequency of self-focus, amount (...) of self-related information, and accuracy of self-knowledge. Overall, I conclude that many novel concepts (e.g., reflective, primary, core, extended, recursive, and minimal consciousness) are useful in helping us distinguish between delicate variations in consciousness and in clarifying theoretical issues that have been intensely debated in the scientific literature—e.g., consciousness in relation to mirror self-recognition and language. Inner speech is postulated to play a key-role in this model, as it establishes important connections between many of its ele- ments. This paper first reviews past and current references to a link between self-awareness and inner speech. It then presents an analysis of the nature of the relation between these two concepts. It is (...) suggested that inner speech can inter- nally reproduce and expand social and physical (ecological) sources of self- awareness. Inner speech can also create a psychological distance between the self and mental events it experiences (thus facilitating self-observation) it can act as a problem-solving device where the self represents the problem and self-information the solution, and can label aspects of one’s inner life that would otherwise be difficult to objectively perceive. Alain Badiou is arguably the most significant philosopher in Europe today. Badiou’s seminars, given annually on major conceptual and historical topics, constitute an enormously important part of his work. They served as laboratories for his thought and public illuminations of his complex ideas yet remain little known. In this book a noted physiologist and neuroscientist introduces the concept of simplexity, the set of solutions living organisms find that enable them to deal with information and situations, while taking into account past experiences and anticipating future ones. Such solutions are new ways of addressing problems so that actions may be taken more quickly, more elegantly, and more efficiently. In a sense, the history of living organisms may be summed up by their remarkable ability to find solutions that avoid (...) the world's complexity by imposing on it their own rules and functions. Evolution has resolved the problem of complexity not by simplifying but by finding solutions whose processes--though they can sometimes be complex--allow us to act in the midst of complexity and of uncertainty. Nature can inspire us by making us realize that simplification is never simple and requires instead that we choose, refuse, connect, and imagine, in order to act in the best possible manner. In this groundbreaking work, French legal scholar Alain Supiot examines the relationship of society to legal discourse. He argues that the law is how justice is implmented in secular society, but it is not simply a technique to be manipulated at will: it is also an expression of the core beliefs of the West. We must recognize its universalizing, dogmatic nature and become receptive to other interpretations from non-Western cultures to help us avoid the clash of civilizations. In Homo (...) Juridicus, Supiot deconstructs the illusion of a world that has become flat and undifferentiated, regulated only by supposed "laws" of science and the economy, and peopled by contract-makers driven only by the calculation of their individual interests. Such a liberal perspective is nothing but the flipside of the notion of the withering away of law and the state, promoted this time not under the banner of the struggle between classes, but rather in the name of the free competition between sovereign individuals. Supiot's exploration of the development of the legal subject-the individual as formed through a dense web of contracts and laws-is set to become a classic work of social theory. (shrink)

Dans toutes les langues occidentales, le mot " temps " recouvre deux notions différentes : le temps, collectif, de l'horloge, et celui, individuel, de l'âme. Husserl, Bergson et Heidegger ont cerné le temps individuel mais ne sont pas allés au bout des conséquences de leur introspection. Einstein, en relativisant le temps de l'horloge, n'en a pas développé les implications philosophiques. Cette étude propose d'explorer cette nouvelle approche dans laquelle le temps n'est plus " a priori ", mais est généré par (...) le " phénomène ", au sens large du terme. On bascule alors dans un monde nouveau où l'inexistence du temps " habituel " entraîne des modifications considérables dans la philosophie, la théologie et... la vie quotidienne. C'est au cours de ses explorations dans les solitudes désertiques de l'Alaska que l'auteur a eu l'idée de cette nouvelle approche du temps. (shrink)

Les comportements dans l’entreprise : dilemmes sociaux et climats éthiques.

L'ethique des affaires semble prise dans une tension entre deux ambitions: d'une part, la recherche d'un cadre normatif sur-mesure, adapte aux specificites de la vie des affaires et respectueux de principes ethiques fondamentaux; d'autre part la formulation d'une nouvelle maniere de penser le role de l'entreprise dans la societe qui, tout en restant coherente avec le liberalisme economique, depasserait l'hypothese sous-jacente d'individualisme et reconcilierait la morale des affaires et la morale ordinaire. Dans certaines de ses versions, comme celle defendue dans (...) l'un des textes commentes (Edward Freeman et alii), la theorie des parties prenantes pretend faire la synthese de ces ambitions. Si elle se heurte a des resistances theoriques et pratiques, comme celle, classique, exposee par Milton Friedman dans le premier texte, elle renforce le poids des considerations politiques dans l'ethique des affaires et contribue a rapprocher cette branche de l'ethique appliquee de l'ethique economique et sociale. Comme les autres branches de l'ethique appliquee, l'ethique des affaires (business ethics) suscite de nombreuses questions epistemologiques et pratiques. Les premieres ont trait notamment aux rapports qu'entretiennent ses dimensions normative et empirique. Les secondes concernent surtout sa supposee incapacite a apporter un reel progres moral dans les pratiques des acteurs et dans le fonctionnement du systeme economique. Cette inefficacite est souvent mise sur le compte d'une allegeance inconditionnelle de la discipline au liberalisme. L'ethique des affaires s'est constituee sur ce fond (...) de scepticisme, et elle s'est efforcee d'y repondre de facon imaginative et constructive. C'est ainsi que certaines de ses theories ont une ambition considerable. Car si elles etaient effectivement mises en pratique, elles conduiraient a un changement radical du systeme economique actuel. Les textes qui composent cet ouvrage temoignent non seulement de la richesse des contributions de l'ethique des affaires sur ces deux types de questions, mais aussi de sa pretention a modifier profondement les pratiques de la vie economique. If possible, please submit your abstract in both English and French.When writing an assignment, most students start by searching for information online, which they integrate in their writing and conclude by producing a bibliography for the sources used. They use their informational, writing and referencing skills to do this as well as refer to their plagiarism knowledge to make sure their text is exempt from plagiarism. In this paper, we examined which skills and knowledge students feel the (...) need to further develop in university to prevent plagiarism in their assignments. Professors were also questioned as to their perceptions of their students’ skills development during their pre-university studies. Questionnaires were administered in six Quebec Universities to students (n = 1170) and professors (n = 279). Results show that students feel the need for more training while professors expect students to have already mastered the skills and knowledge to prevent plagiarism. Recommendations are made on how to implement better training for students through a program approach.Lors de la rédaction d’un devoir, la plupart des étudiants universitaires commencent par chercher des informations en ligne, qu’ils intègrent dans leur rédaction et terminent en produisant une bibliographie des sources utilisées. Ils utilisent leurs compétences informationnelles, rédactionnelles, et de référencement documentaire et se réfèrent à leurs connaissances en matière de plagiat pour s’assurer que leur texte en soit exempt. Dans cet article, nous avons examiné les compétences et les connaissances que les étudiants ressentent le besoin de développer davantage à l’université pour prévenir le plagiat dans leurs travaux. Les professeurs ont également été interrogés sur leur perception du développement des compétences de leurs étudiants durant leurs études pré-universitaires. Des questionnaires ont été administrés dans six universités québécoises à des étudiants (n = 1170) et à des professeurs (n = 279). Les résultats montrent que les étudiants ressentent le besoin d’une formation plus poussée alors que les professeurs s’attendent à ce que les étudiants maîtrisent déjà les compétences et les connaissances nécessaires pour prévenir le plagiat. In her 2006 book ‘‘My Stroke of Insight” Dr. Jill Bolte Taylor relates her experience of suffering from a left hemispheric stroke caused by a congenital arteriovenous malformation which led to a loss of inner speech. Her phenomenological account strongly suggests that this impairment produced a global self-awareness deficit as well as more specific dysfunctions related to corporeal awareness, sense of individuality, retrieval of autobiographical memories, and self-conscious emotions. Little is known with regard to the precise cognitive tools the self uses in acquiring and processing information about itself. In this article, we underline the possibility that inner speech might just represent one such cognitive process. Duval and Wicklund’s theory of self-awareness and the selfconsciousness, and self-knowledge body of work that was inspired by it are reviewed, and the suggestion is put forward that inner speech parallels the state of self-awareness, is more frequently used among highly self-conscious persons, and (...) represents an effective, if not indispensable, tool involved in the formation of the self-concept. The possibility is also raised that the extent to which one uses inner speech could partially explain individual differences in self-consciousness and self-knowledge. A selective review of the private and inner speech literature is presented, and some possible ways of testing the hypothesis by using pre-existing techniques are proposed in the hope of stimulating empirical investigations. It is widely acknowledged that human rights law and international criminal law share core normative features. Yet, the literature has not yet reconstructed this underlying basis in a systematic way. In this contribution, I lay down the basis of such an account. I first identify a similar tension between a “moral” and a “political” approach to the normative foundations of those norms and to the legitimate role of international courts and tribunals adjudicating those norms. With a view to bring the (...) debate forward, I then turn to the practices of HRL and international criminal law to examine which of those approaches best illuminates some salient aspects of the adjudication of ICs. Finally, I argue that the political approach best explains the practice. While each preserves a distinct role, HRL and ICL both establish the basic conditions for the primary subject of international law, namely the state, to legitimately govern its own subjects constructed as free and equal moral agents. Legal scholars and theorists have recently drawn a more sustained attention to the link between international human rights law (hereafter IHRL) and international criminal law (hereafter ICL). This concerns both positive and more normative accounts of the link. Whether positive or normative, the predominant approach to constructing the link is substantive. This overlap is normatively justified in similar terms by reference to a subset of moral human rights. In this paper, I offer an alternative to the substantive approach. After identifying (...) two flaws in the substantive approach (the problem of threshold and the problem of ethical neutrality), I defend what I call a structural account by focusing on duty‐holders. I start by reconstructing two structural characteristics common to IHRL and ICL qua international legal regimes: who has the authority to address violations of IHRL and ICL, and who can be liable for those violations. I then infer that public authority (functionally construed) constitutes the common structural core of IHRL and ICL. I rely on the extraterritorial application of IHRL and on the collective dimension of ICL violations to further support the argument. I finally offer an argument explaining the normative point of those structural features. I hold that IHRL and ICL (their adjudicative and liability regimes) are both necessary (but clearly not sufficient) to render this exercise of public authority legitimate to its subjects. (shrink)

In this paper, I offer an analytical and normative framework to re-visit the question of whether state parties should derogate from the European Convention on Human Rights (ECHR) in order to combat the COVID-19 pandemic via harsh ‘lockdown’ measures. It is three-pronged. First, I show that the predominant debate on the (non-)derogation question is informed by a textual approach to adjudication, which severely limits the analytical and evaluative horizon for addressing the issue. Most importantly, it cannot address one salient fact (...) about the effects of lockdown measures, namely their highly disproportionate effects on vulnerable groups and minorities. Second, I argue that proportionality assessment should be the basis for determining whether state parties ought to derogate or not. This is because proportionality’s very purpose is in part to track the effects of state interferences on minorities and vulnerable groups by measuring the disproportionate burden imposed on them. It is also because proportionality assessment has very different requirements between limitation clauses built into the relevant Convention articles (e.g. Article 5, Articles 8–11) and the derogation clause (Article 15) under the ECHR. Surprisingly, while the emerging literature almost always mentions proportionality as an important component of the analysis, it does not investigate the extent to which each regime (derogation or limitation) better performs it, and why. Third, I draw from the philosophical literature on the ‘right to justification’ to clarify the egalitarian and justificatory function of proportionality. Unlike derogation, limitation clauses have a much higher and systematic requirement of justification, which makes the case for non-derogation clearer and stronger. (shrink)

In this commentaryI evaluate the claim made byKeenan, Nelson, OÕConnor, and Pascual-Leone (2001) that since self-recognition results from right hemispheric activity, self-awareness too is likely to be produced by the activity of the same hemisphere. This reasoning is based on the assumption that self-recognition represents a valid operationalization of self-awareness; I present two views that challenge this rationale. Keenan et al. also support their claim with published evidence relating brain activityand self-awareness; I closelyexamine their analysis of one specific review of (...) literature and conclude that it appears to be biased. Finally, recent research suggests that inner speech (which is associated with left hemispheric activity) is linked to self-awareness—an observation that further casts doubt on the existence of a right hemispheric self-awareness. A single, fairly simple proposition lies at the heart of the present contribution, viz. that the development of early-modern literature on international law should be regarded as a specific form of the early usus modernus during the second half of the sixteenth century and the first half of the seventeenth century.In Section 1 that general proposition and some of its ramifications will receive some further explanation. First, the main characteristics of usus modernus will be set out, and, subsequently, their applicability (...) to early-modern literature on international law will be outlined. In addition, the question should be raised, what purpose the characterisation of that literature as part of the more general usus modernus may serve. These considerations may inevitably appear somewhat abstract. Section 2 will therefore aim to provide a particular illustration, based on two contemporary works on the law of naval warfare, viz. A. The aim of this article is to examine the potential influence of mass-media on public’s opinions and attitudes towards economic liberalism. It shows that, without relying to the assumption that journalists pursue such a purpose, the nature of the media system leads them to give a rather negative image of how the market economy works and doesn’t give the same place to liberal thesis with respect to others. Our argument is founded on a critique of the economic model of spatial (...) competition currently used in this field, on the crucial role that norms inherent to the profession of journalist play and the characteristics of the demand which media face. L’objet de cet article est d’examiner la question de l’influence éventuelle des médias de masse sur les opinions et attitudes du public à l’égard du libéralisme économique. On y montre que, sans recourir à l’hypothèse que les journalistes poursuivent consciemment un tel objectif, la nature du système médiatique les conduit à donner une image plutôt négative du fonctionnement de l’économie de marché et à ne pas donner une place équilibrée à l’exposé des thèses libérales par rapport aux autres. L’argumentation suivie repose sur la critique du modèle économique de la concurrence spatiale habituellement utilisé à ce sujet, sur le rôle déterminant que jouent les normes propres à la profession de journaliste et les caractéristiques de la demande s’adressant aux médias. Decision making is an area of profound importance to a wide range of specialities - for psychologists, economists, lawyers, clinicians, managers, and of course philosophers. Only relatively recently, though, have we begun to really understand how decision making processes are implemented in the brain, and how they might interact with our emotions. 'Emotion and Reason' presents a groundbreaking new approach to understanding decision making processes and their neural bases. The book presents a sweeping survey of the science of decision making. (...) It examines the brain mechanisms involved in making decisions, and controversially proposes that many of our perceptual actions are essentially decision making processes. Whether looking, listening, hearing, or moving, we choose to attend to certain stimuli, at the expense of others. In some psychiatric disorders the inability to respond selectively to certain stimuli can be harmful - such pathologies of decision making are additionally considered. Berthoz also considers how many decision making processes involve an internal dialogue with our other self, and how this dialogue with our "doppelganger" might be represented in the brain. He considers the important implications that a neuroscience of decision making can have for the judiciary - how we apportion blame and responsibility; for economics - with discussion of the growing field of neuroeconomics; and for theories of management. Lastly he examines decision making and creativity - if perception relies in part on decision making processes, how might this alter our view of the artistic process. This article raises the question of how we acquire self-information through self-talk, i.e., of how self-talk mediates self-awareness. It is first suggested that two social mechanisms leading to self-awareness could be reproduced by self-talk: engaging in dialogues with ourselves, in which we talk to fictive persons, would permit an internalization of others' perspectives; and addressing comments to ourselves about ourselves, as others do toward us, would allow an acquisition of self-information. Secondly, it is proposed that self-observation is possible only if (...) there exists a distance between the individual and any potentially observable self-aspect; self-talk, because it conveys self-information under a different form , would create a redundancy -- and with it, a wedge -- within the self. Plato's _Republic_ is one of the best-known and most widely-discussed texts in the history of philosophy. But how might we get to the heart of this work today, 2,500 years after its original composition? Alain Badiou breathes life into Plato's landmark text and revives its universality. Rather than producing yet another critical commentary, he has instead worked closely on the original Greek and, through spectacular changes, adapted it to our times. In this innovative reimagining of Plato's work, Badiou has (...) removed all references specific to ancient Greek society--from lengthy exchanges about moral courage in archaic poetry to political considerations mainly of interest to the aristocratic elite--and has expanded the range of cultural references. Here, philosophy is firing on all cylinders: Socrates and his companions are joined by Beckett, Pessoa, Freud, and Hegel, among others. Together these thinkers demonstrate that true philosophy endures, ready to absorb new horizons without changing its essence. Moreover, Badiou--who is also a dramatist--has transformed the Socratic dialogue into a genuine oratorial contest. In his version of the _Republic_, the interlocutors do much more than simply agree with Socrates. They argue, stand up to him, put him on the spot, and show thought in motion. D’un point de vue patrimonial, le célèbre texte des Éléments de géométrie de Clairaut, publié la première fois en 1741, est traditionnellement considéré comme le début d’une riche histoire plutôt que son aboutissement, en raison notamment du succès considérable qu’il a eu dès sa parution et de la manière dont Clairaut en a défendu le projet, en rupture apparente avec le modèle euclidien. Nous proposons ici une image un peu différente qui s’appuie sur la nature très particulière de la production (...) géométrique foisonnante dans laquelle le traité de Clairaut s’insère et doit être compris. Nous présentons tout d’abord le côté paradoxal de l’ouvrage, qui revendique non seulement une grande originalité mais aussi une non moins grande conformité au genre des « éléments » de géométrie spéculative. Nous indiquons ensuite cinq raisons majeures qui montrent que le texte était en effet largement conforme aux attendus de l’époque, y compris dans sa revendication d’accessibilité et de rupture vis-à-vis du modèle euclidien. Nous dégageons deux originalités de l’ouvrage : le fait de confondre les caractéristiques des géométries spéculatives et pratiques dans un seul et même ouvrage ; et le fait d’écrire un ouvrage de géométrie suivant un « ordre analytique », mais sans algèbre.
