If the global economy seems unfair, how should we understand what a fair global economy would be? What ideas of fairness, if any, apply, and what significance do they have for policy and law? Working within the social contract tradition, this book argues that fairness is best seen as a kind of equity in practice.

This discussion responds to important questions raised about my theory of fairness in the global economy by Christian Barry, Charles Beitz, A.J. Julius and Kristi Olson. I further elaborate how moral argument can be ‘internal’ to a social practice, how my proposed principles of fairness depend on international practice, how I can admit several relevant conceptions of ‘harm’ and why my account does not depend on a problematic conception of societal ‘endowments’.

Public discourse is often caustic and conflict-filled. This trend seems to be particularly evident when the content of such discourse is around moral issues (broadly defined) and when the discourse occurs on social media. Several explanatory mechanisms for such conflict have been explored in recent psychological and social-science literatures. The present work sought to examine a potentially novel explanatory mechanism defined in philosophical literature: Moral Grandstanding. According to philosophical accounts, Moral Grandstanding is the use of moral talk to seek social (...) status. For the present work, we conducted six studies, using two undergraduate samples (Study 1, N = 361; Study 2, N = 356); a sample matched to U.S. norms for age, gender, race, income, Census region (Study 3, N = 1,063); a YouGov sample matched to U.S. demographic norms (Study 4, N = 2,000); and a brief, one-month longitudinal study of Mechanical Turk workers in the U.S. (Study 5, Baseline N = 499, follow-up n = 296), and a large, one-week YouGov sample matched to U.S. demographic norms (Baseline N = 2,519, follow-up n = 1,776). Across studies, we found initial support for the validity of Moral Grandstanding as a construct. Specifically, moral grandstanding motivation was associated with status-seeking personality traits, as well as greater political and moral conflict in daily life. (shrink)

The present work posits that social motives, particularly status seeking in the form of moral grandstanding, are likely at least partially to blame for elevated levels of affective polarization and ideological extremism in the U.S. In Study 1, results from both undergraduates (N = 981; Mean age = 19.4; SD = 2.1; 69.7% women) and a cross-section of U.S. adults matched to 2010 census norms (N = 1,063; Mean age = 48.20, SD = 16.38; 49.8% women) indicated that prestige-motived grandstanding (...) was consistently and robustly related to more extreme ideological views on a variety of issues. In Study 2, results from a weighted, nationally-representative cross-section of U.S. adults (N = 2,519; Mean age = 47.5, SD = 17.8; 51.4% women) found that prestige motivated grandstanding was reliably related to both ideological extremism and affective polarization. Familiar questions about whether or how far to impose risks of harm for social benefit present a fundamental dilemma for contractualist moral theories. If contractualism allows objections by considering actual outcomes, it becomes difficult to justify the risks created by most public policy, leaving contractualism at odds with moral commonsense in much the way utilitarianism is. But if contractualism instead takes a fully form by considering only expected outcomes, it becomes unclear how it recommends something other than aggregative cost-benefit decision-making. (...) Focusing on T.M. Scanlon's version, this paper develops this basic choice of interpretation and recommends the ex ante version. A theory of fairness in international trade should answer at least three questions. What, at the basic level, are we to assess as fair or unfair in the trade context? What sort of fairness issue does this basic subject of assessment raise? And, what moral principles must be fulfilled if trade is to be fair in the relevant sense? This discussion presents answers to these questions that derive from a “constructivist” methodology inspired by John Rawls and the social contract tradition.

This paper suggests that “systemic risk” has a distinctive kind of moral significance. Two intuitive data points need to be explained. The first is that the systematic imposition of risk can be wrongful or unjust in and of itself, even if harm never ensues. The second is that, even so, there may be no one in particular to blame. We can explain both ideas in terms of what I call responsibilities of “Collective Due Care.” Collective Due Care arguably precludes purely (...) aggregative cost-benefit decision-making and requires one kind of “precautionary” attitude in public choice. Philosophers commonly wonder what a constructivist theory as applied to practical reasons might look like. For the methods or procedures of reasoning familiar from moral constructivism do not clearly apply generally, to all practical reasons. The paper argues that procedural specification is not necessary, so long as our aims are not first‐order but explanatory. We can seek to explain how there could be facts of the matter about reasons for action without saying what reasons we have. Explanatory constructivism must assume (...) constructive “norms of practical reasoning” which yield particular truths without assuming them. But philosophers often mistakenly assume that only “formal” norms of reasoning could fulfill this role. The paper describes a further possibility: norms of reasoning can be “situation‐specific” and yet retain truth‐independent authority. Though we might doubt whether such norms can be independently defended, we should not doubt the possibility or coherence of constructivism about practical reasons. (shrink)

Political constructivism is associated with John Rawls more than any other contemporary philosopher. This chapter suggests that Rawls's political constructivism is better understood as a general method of justification which runs throughout his work as a whole, including his early work and A Theory of Justice. The chapter develops the general characterization of Rawls's political constructivism. Its main elements are taken in turn and developed with special attention to the two places where Rawls discusses the topic in depth – his (...) Dewey Lectures on Kantian Constructivism in Moral Theory and its substantially revised version called “Political Constructivism” (PL, Lecture III). The main elements include social role, sources, interpretive basis, representation and conclusion. Rawls endorsed a Kantian metaethical constructivism in part because it offered a way of more deeply characterizing how his previous political constructivism could be a live and distinct possibility. The paper suggests that the state is subject to assessment according to principles of social justice because state institutions or practices exercise forms of power over which no particular person has control. This rationale for assessment of social justice equally applies to legally optional or informal social practices. But it does not apply to individual conduct. Indeed, it follows that principles of social justice cannot provide a basis for the assessment and guidance of individual choice. The paper develops this practice-based (...) conception of the subject of justice by rejoining G. A. Cohen's influential critique of Rawls’ focus on the “basic structure” of society. (shrink)

ABSTRACTThis is an account of the emancipatory struggle that faces agents who seek to change the oppressive social structures associated with neo-liberalism. We begin by ‘digging amongst the bones’ of the calls for resistance that have been declared dead or assimilated/co-opted by neoliberal theorists. This leads us to unearth, then utilize, Paulo Freire’s Pedagogy of the Oppressed, Steve Biko’s Black Consciousness and Shiv Visvanathan's ideas; which are examples of Roy Bhaskar’s transformative dialectic. We argue, using examples, that cognitive justice – (...) a concept common to each of our chosen theorists – is vital in enabling emancipatory social learning. By embracing cognitive justice, the agents gained confidence, which led to their increased ability to champion community and non-academic knowledge. It also uncovered structural tensions – attendant in neoliberalism – around privilege. By articulating these tensions, the participants were able to ‘come closer together’. Such processes, initiated by ensuring cognitive justice, are possible steps in achieving universal solidarity; which is likely to be a necessary step along the path of achieving emancipation. The practice-based method of justification requires sensitivity to social practices. This raises difficult questions: Must the practices in question be established or at least realistic? How “constructive” can we be in our interpretation of their form or aims? This paper suggests that our answers to these questions can vary with our explanatory purposes. Requirements of realism and sociological accuracy are relatively thin given purely intellectual aims of moral understanding, thicker given the aim of addressing humanity, and thicker still given the (...) aim of justifying principles as normative for us , in our current world historical situation. I suggest that we have no reason to insist on one set of animating justice concerns to the exclusion of all the others, even as normative requirements rightly take center stage. (shrink)

In matters of distributive justice, we assume that it is important how benefits and burdens are distributed among different people. But what, precisely, is important about this? In particular, what, from the point of view of justice, is ultimately at stake in what distributions come about? T. M. Scanlon has been coy about what his contractualist moral theory might imply for justice.[ii] Yet his conception of morality bears directly on this question of stakes. The significance of distribution then depends on (...) independently valuable relations of recognition. Distribution has no fundamental importance per se. This in turn has significant implications for how philosophical reasoning about justice in distribution must proceed. In recent years, many egalitarians have proceeded as though a distribution can be just by its very nature, in and of itself. The basic aim of the theory of distributive justice is to say what this intrinsically just distribution is.[iii] What is ultimately at stake in matters of distributive justice, it is suggested, is whether or not a certain intrinsically valuable distributional pattern comes about. Scanlon ’s theory implies that this cannot be right: a distribution, taken as such, cannot be owed, and so cannot be justice. Or at least this follows given the platitude about justice, due to Aristotle, that justice is, by nature, giving each his or her due.[iv] The platitude tells us that to distribute justly is simply to give to each individual what he or she is due or owed, as determined by an independent conception of what this is. According to Scanlon ’s independent conception of “what we owe to each other,” no individual can be owed a distribution across persons, as such. We are at most each owed our respective shares—only what we can reasonably ask for on our own behalf. (shrink)

A multi-method, multi-informant method was used to collect data from diverse stakeholders about school climate to inform school improvement efforts as part of the Positive Behaviour Intervention Supports framework. Teachers, administrators, school staff and students completed surveys and parents participated in focus groups to gather perspectives about school climate. Respondents identified safety as a strength at the school, staff and student results suggested interpersonal relationships as an area for improvement and staff identified parent involvement as an area for growth. Both (...) positive and negative perceptions of school climate emerged from the parent focus group. While there are limitations to the generalisability of the results, this case study provides a useful approach for schools to assess their school climate and establish goals for improvement. This article examines an omission in the study of discretionary time that bears on proposals currently being evaluated in this part of political philosophy. Specifically, this is the tendency in many jobs for work time to bleed into what is meant to be protected or discretionary time. I refer to this phenomenon as the relative proximity of labour and capital, which has become more prevalent in the labour market due to increased use of mobile communications technology. Ignored by the literature (...) is the fact that whether a job exhibits a high degree of proximity of labour and capital will influence workers' access to their discretionary time entitlements, including policies such as workplace flexibility and the four-day week. To account for this, I provide a descriptive and normative account of the proximity of labour and capital, in response to which I propose a remedial policy that provides workers with greater autonomy over how and when they take up their discretionary time entitlements. The present study aimed to understand how status-oriented individual differences such as narcissistic antagonism, narcissistic extraversion, and moral grandstanding motivations may have longitudinally predicted both behavioral and social media responses during the early stages of the COVID-19 pandemic. Via YouGov, a nationally representative sample of U.S. adults was recruited in August of 2019 (N = 2,519; Mage = 47.5, SD = 17.8; 51.4% women) and resampled in May of 2020, (N = 1,533). Results indicated that baseline levels of narcissistic antagonism (...) were associated with lower levels of social distancing and lower compliance with public health recommended behaviors. Similarly, dominance oriented moral grandstanding motivations predicted greater conflict with others over COVID-19, greater engagement in status-oriented social media behaviors about COVID-19, and lower levels of social distancing. Interoperability across data sets is a key challenge for quantitative histopathological imaging. There is a need for an ontology that can support effective merging of pathological image data with associated clinical and demographic data. To foster organized, cross-disciplinary, information-driven collaborations in the pathological imaging field, we propose to develop an ontology to represent imaging data and methods used in pathological imaging and analysis, and call it Quantitative Histopathological Imaging Ontology – QHIO. We apply QHIO to breast cancer hot-spot detection with (...) the goal of enhancing reliability of detection by promoting the sharing of data between image analysts. (shrink)

Now more than ever it is clear that the global economy needs to be assessed and governed from a moral point of view. Such moral assessment can, however, come in at least two quite different forms. Political philosophers have tended to focus on a range of issues (e.g. poverty, human rights, or general distributive justice) whose basic moral importance is “external” to and wholly independent of how the global economy is socially organized. The result has been relative neglect of a (...) quite different class of “internal” moral issues, which do in various ways depend on the complex legal and social relations that now organize the global economic scene. These include a dizzying array of politically important but poorly understood fairness concerns—concerns such as “non-discrimination,” “special and differential treatment,” “fair trade,” “fair play,” “fair competition,” “level playing fields,” “equitable growth,” “fair wages,” and “exploitation.” My aim in this discussion is to suggest a framework for understanding how several such fairness notions might be systematically connected and have an internal rather than external character. Specifically, I suggest that the content and internal nature of several such fairness notions can be explicated in terms of a more fundamental idea of “structural equity.” From the point of view of political philosophy, the issue turns on the sorts of principles that might ground moral assessment of the global economy. External principles are justified and apply quite independently of what the global economy and its social organization happens to be like. Humanitarian principles are a natural example: in asking whether or not the current global economy is set up so as to bring as many people as possible out of poverty, the assumed goal of poverty reduction can be seen as important and morally necessary quite independently of how the global economy is institutionally organized, and indeed independently of its very existence. Internal principles, by contrast, are not justified, and do not apply, independently of the global economy and its organizing institutions.. (shrink)

Does the very existence of money depend in any sense on our “recognition” of it? According to certain functionalist views, no such attitudes are necessary. This paper argues to the contrary for recognition dependence, of a minimal sort. What’s needed in a population is (1) the functional know-how of money use, (2) an ideational structure founded upon people’s thinking about what others are thinking, and (3) wide enough acceptance of a payment or settlement obligation (as expressed, e.g., when someone asks (...) a vendor “So what do I owe ya?”). This paper seeks to deflate G. A. Cohen ’s recent meta-ethical argument that fundamental principles must be “fact-insensitive.” That argument does not advance Cohen ’s dispute with Rawls and other social contract theorists. There is attenuated sense of “factinsensitivity” which they can happily grant, which Cohen never rules out on specifically metaethical grounds. While his barrage of substantive arguments may retain independent force, the argument from fact-insensitivity is largely inconsequential.

There is much in Thomas Hobbes’s political theory that contemporary political philosophy cannot readily accept—including Hobbes’s egoism, his unconditional right of self-defense, and his insistence that peace is only possible under absolute sovereign rule.[1] Nevertheless, we can and should embrace one of Hobbes’s central insights: that problems of assurance are of fundamental importance for questions of social justice, even, or especially, justice questions of global scale. In general, agents face normatively significant problems of assurance because they have imperfect knowledge about (...) the conduct of others and must therefore weigh consequent risks of action. Practically speaking, the basic human device for their resolution is for agents to form “agreements”—promises, conventions, social practices, or institutions—that reduce uncertainty and thus “assure” the parties involved. None of this necessarily bears on basic principles of morality or justice, at least not without further argument.[2] Hobbes’s dramatic assurance problem—the state of nature—makes this further step. It shows vividly how agreement-making may be not simply a useful device but a condition for the applicability of basic principles. In the absence of an agreed upon common power to assure compliance, Hobbes explains, basic principles of conduct—including considerations of justice and injustice—are simply out of place. The resulting uncertainty about what others will do in the name of self-preservation gives us sweeping liberty to defend ourselves. Contemporary political philosophy is concerned with substantive political morality and “ideal theory,” so it may seem that Hobbes’s problem of assurance—a matter of amoral selfpreservation—can simply be set aside. This is to underestimate the depth of Hobbes’s insight. As I will explain, assurance problems can take specifically moral forms, arising even among morally motivated agents, in a way which bears on the very applicability of fundamental moral principles. In central cases of normative political philosophy, justification of basic principles, even in “ideal theory,” must be tailored to the circumstances that give rise to assurance problems and the available human means for their resolution.. Wittgenstein said of Kierkegaard that he was the “single most profound philosopher of the 19th century”; but what accounts for Wittgenstein’s estimation of Kierkegaard’s work? I argue that Kierkegaard, who was a student of ancient philosophy, synthesized Socratic and Aristotelian concepts into a conception of philosophical inquiry that provided the basis for a Socratic-style engagement with what Kierkegaard calls “the present age”. This allows Kierkegaard to engage Socratically with the present age’s assumptions, but with a kind of categorial sophistication that (...) goes beyond traditional Socratic inquiry. This Kierkegaardian model, I argue, provides the template for what Wittgenstein comes to call “philosophical foundations of X”, where X is some non-philosophical enterprise, such as psychology or mathematics. But didn’t Wittgenstein’s later work constitute a fundamental break with the philosophical tradition altogether? As G. H. von Wright famously remarks, “the author of Philosophical Investigations has no ancestors in philosophy”. In fact, I argue that if a reasonable adjustment is made in the understanding of Wittgenstein’s grammatical investigation, then the Wittgensteinian grammatical investigation can be seen to have more in common with certain Socratic and Aristotelian paradigms in ancient philosophy than we might otherwise assume. At that point, we can appreciate how the work of Søren Kierkegaard represents a significant conceptual and historical transitional link between these two periods. According to Kierkegaard, it is a central Socratic idea that anyone, no matter who they are, always already operates with some philosophical understanding of the things with which they are especially occupied in life. And scientists are no exception to this rule. In fact, scientists can be expected to operate with some formal-causal and ontological-categorial understanding of their subject, as well as an understanding of how the basic domains and topics that preoccupy them fit into the larger scheme of things: however, in light of the division of labor, scientists will not necessarily be aware of the extent to which they are already committed to a distinctively philosophical understanding of things. Making this philosophical understanding explicit and scrutinizing it may in turn have an impact on the ways in which scientists go on to frame their scientific research. I suggest that in light of the above genealogy of Wittgenstein’s concept of “philosophical foundations of X”, Wittgenstein can be regarded as a descendant of this Socratic tradition of philosophy, in which philosophy is occasioned by a reflection on the philosophical foundations of non-philosophical discourse.
