La réflexion philosophique, dont l'ouverture à l'univers dans lequel nous nous découvrons - avec une acuité proportionnelle à un étonnement renouvelé - n'a pas de limites, n'en est que plus tributaire des sciences et des techniques, des arts et de multiples activités qui régissent plus ou moins fructueusement notre expérience. Or, au sein des sciences humaines, privilégiées pour éclairer une condition que nous ne saurions cesser d'interpréter, peu d'oeuvres du dernier siècle auront enrichi en le précisant notre être-au-monde, comme la (...) théorie linguistique de Gustave Guillaume, assez solitaire, et les recherches multiformes de Jean Piaget - où la psychologie de l'enfant a souvent occulté la visée épistémologique et son enracinement biologique (cf Biologie et connaissance, 1967) et ses prolongements pédagogiques, voire éthiques. Le Cinquantenaire et le Trentenaire de leur disparition appelaient un hommage d'autant plus impératif qu'ils sont restés marginaux ou ignorés dans les milieux philosophiques, malgré la centralité de leurs élucidations. Leur commune orientation génétique et structurale n'ayant suscité aucun échange, pendant la contemporanéité de publications d'un tiers de siècle (1923-1960), mesurer leur complémentarité s'impose d'autant plus. S'ils peuvent aider à repenser la condition humaine, c'est qu'ils auront contribué à dissiper le "mystère de la pensée". L'un cherchant à habiliter les caractères systématique et cinétique des langues, irremplaçables moyens de penser ; l'autre dans un vis-à-vis cognitif et opératoire de Freud, en relavant sur les plans épistémologique et logique, notamment, l'élan révolutionnaire de la seconde modernité, autour de l'évolutionnisme. Mais les thèmes majeurs du constructivisme, du schème et de la symbolisation - et plus largement du temps et du langage - auront sans doute aidé à spécifier les mutations autorisées par la révolution critique. Entre l'Instant du je parle et un décentrement exigible pratiquement (éthique) comme théoriquement (épistémique), c'est bien la condition humaine dans son ensemble qui est concernée. Si repenser cette Condition s'impose en permanence, il importe de ne pas manquer des oeuvres qui, par-delà toute mode, proposent à notre expérience des fondations résistant à d'inéluctables vicissitudes. This paper provides an economic justification for the exemption from liability for omissions in torts and for the exceptions to this exemption. It interprets the differential treatment of acts and omissions under tort law as a proxy for a more fundamental distinction between harms caused by multiple injurers, where each one can single-handedly prevent the harm, and harms caused by a single injurer. Since the overall cost to which a group of injurers is exposed is constant, attributing liability to many (...) injurers reduces the part each has to pay and, consequently, reduces each one’s incentives to take precautions. Broad exemption from liability for omissions is a way of carving a simple, practical rule to distinguish between the typical cases in which an agent can be easily selected and provided with sufficient incentives and cases in which there is a serious problem of dilution of liability. The exceptions to the rule exempting from liability for omissions are explained in terms of efficiency. The imposition of liability for omissions depends on the ability to identify a salient agent, i.e., to single out one or few liable agents and differentiate their role from that of others. Tort law designs three types of "salience rules." It either creates salience directly, or it can exploit salience created "naturally," or it can induce injurers to create salience voluntarily. In these pages we seek to integrate two claims. First, we argue that, taken to their logical conclusions, the considerations that support a strict form of protection for tangible property rights do not call for a similar form of protection when applied to the case of copyright. More dramatically, these considerations demand, on pain of glaring inconsistency, a substantially weaker protection for copyright. In pursuing this claim, we show that the form of protecting property rights is, to an important extent, (...) a feature of certain normal, though contingent, facts about the human world. Second, the normative question concerning the selection of a desirable protection for creative works is most naturally pursued from a tort law perspective, in part because the normative structure of copyright law simply is that of tort law. Au coeur du parcours philosophique d'André Jacob, qui enseigna la philosophie du langage et l'éthique à l'université de Paris X de 1966 à 1990 et a dirigé l'Encyclopédie philosophique universelle aux P.U.F. entre 1980 et 1998, ce volume s'ouvre avec le texte inaugural (prononcé au Congrès mondial de Philosophie à Brighton en 1988) "De la théorisation de la condition humaine" qui l'a toujours retenu : "Une Anthropo-logique : comprendre ou expliquer l'homme?" ; suivi de six autres conférences, appelant à être (...) relayées par une éthique renouvelée correspondant à la seconde partie de l'ouvrage. Une axio-genèse y apporte sa signifiante au "devenir Sujet" du corps, dans un versant d'altérité. On croisera le parcours singulier "de la langue au mal" dans le débat avec Robert Lafont, initiateur d'une praxématique linguistique à Montpellier, comme dans la Postface d'Hervé Barreau. A côté de conférences à l'UNESCO (1991), à Houston (1993) ou à Tokyo (1997), dont "Temps et liberté" (2000) pourrait annoncer l'éthicité ; tandis que "Langue et pouvoir" (2009) éclairera plus directement la figuration anthropo-logique, impensable dans les philosophies de la conscience traditionnelles. Europa presents, to the modern reader, the foreign political thought of four major German conservatives from the crucial period between the Second Reich and the Second World War. The texts chosen reveal the spiritual and cultural motives, of German conservatives at the turn of the century, that inspired expansionist policies and the consistent opposition to the Jewish financial rule. The lack of German translations of these important texts so far has clearly been a disadvantage to the modern historian in his (...) assessment of the philosophical significance of the Conservative, as well as of the National Socialist, foreign political ideology. The complexities of Henry More's eclectic Neoplatonism and his recklessly energetic poetic style have hitherto deterred scholars from undertaking a complete study of his long philosophical poem, A Platonick Song of the Soul . The aim of my dissertation is to study the Platonick Song in its entirety. I attempt to unravel the different strands of thought that it is woven of and reveal the consistency of thought and architectonic scheme of the work. ;The major themes of the Platonick Song (...) are the immateriality of the soul, its immortality, and its unfailing consciousness. I begin my study with an appraisal of More's work as an answer to Lucretius's De Rerum Natura, which had proclaimed the corporeality and mortality of the soul. The first poem of the Platonick Soul, "Psychozoia" is studied as an allegorical prelude to the work, and the Plotinian and Chaldean origins of More's systems are examined. The five poems after "Psychozoia" are divided into three sections dealing with the immortality of the soul , the macrocosmic manifestation of the soul and the alert soul "Antipsychophannychia," "The Praeexistency of the Soul" and "Antimonopsychia"). In the course of these three chapters, I have occasion to demonstrate More's reliance on the arguments of Ficino and Galileo. In the final chapter of my study, I reveal the importance of the Platonick Song for an understanding of the metaphysics, psychology and ethics of More's mature philosophy. In addition, I analyze the ways in which More's concepts of spirit, matter, space and the Deity resembled and differed from those of his Cambridge friend, Isaac Newton. (shrink)

Nobilitas is a study of the history of aristocratic philosophy from ancient Greece to the early twentieth century that aims at providing an alternative to the liberal democratic norms, which are propagated today as the only viable socio-political system for the world community. Jacob reveals that, contrary to popular belief, the social and cultural development of European civilization has, for twenty-five centuries, been based not on democratic or communist notions but, rather on aristocratic and nationalist notions. Beginning with the political (...) philosophies of Plato and Aristotle, and continuing through Renaissance and Baroque aristocratic philosophers, the German Idealists, and English and Italian nationalists, the study ends with the transformation of aristocratic philosophy in nineteenth century Germany into racist elitism. As such, the study includes a survey of the philosophical bases of racism and anti-Semitism. These topics have been systematically excluded from academic and political debate since the end of the last Great War. This study is a pioneering work in understanding and changing political ideologies. (shrink)

This edition of Houston Stewart Chamberlain's Politische Ideale reveals the historical significance of Chamberlain in German conservative political philosophy. Contrasting the vital nationalistic state with the sterile commercialism of liberal democracies, moral freedom with the unruly selfishness of democratic parties, and the decaying culture of the Anglo-Saxon peoples with the relatively pure Teutonic, Chamberlain evokes in this work the principal elements of a genuinely conservative state.

Everyone can agree that modern Westerners live in a secular age. That the process of "disenchantment" which led to this age constituted an epistemic loss, that it was not just a rejection of false beliefs but a real alteration in the way the world is experienced, has been shown by previous scholarship, notably that of Charles Taylor. This paper makes the case that this disenchantment was not only a latent possibility from the earliest interactions of Christianity with pre-Christian Roman society, (...) but developed from theological and political developments unique to Western Christendom. In so doing, it builds on the work of Taylor as well as that of Michael Allen Gillespie, who has written about the theological origins of modernity. It also provides a brief illustration of a recurrence, within the secular epistemic frame, of the same distinct features Christianity demonstrated in Rome which first made that frame possible.
