En 1656, après avoir échappé au poignard d'un fanatique, il fut excommunié par le conseil des rabbins (...) pour hérésie. Devenu polisseur de verres optiques, Spinoza mena dès lors une vie simple et retirée, tout en restant attentif aux événements de l'époque, entouré d'un petit groupe d'amis sûrs. Spinoza fut le premier à proposer une exégèse rationaliste de la Bible, qui l'amena à formuler la distinction entre le croire et le savoir : Dieu n'est pas extérieur au monde, mais immanent à la nature, il est la Nature. Il réfuta également toute supériorité de l'âme sur le corps et substitua ainsi une éthique à la morale : il n'y a pas de Bien ni de Mal, mais du bon et du mauvais. Du Court traité à l'Éthique, en passant par le Traité théologicopolitique, Jean Préposiet a choisi de donner une vue panoramique du projet philosophique de Spinoza. This chapter applies the modified philosophy of Alasdair MacIntyre to mental health law, and in particular to the mental health tribunal. The natural law approach of Thomas Aquinas is used to assist in this. It is argued that, for law to be just in pre-modern terms, it requires that it be assessed as rational together with the care it supports as a single entity. As such, according to a modified version of the Thomistic Aristotelian ethics of MacIntyre, justice would (...) require reconciliation of both doctor and patient narratives regarding care, possibly at the tribunal. It is suggested that psychiatric intensive care, in particular, could benefit from this approach. The approach might be seen as an additional protection to human rights-based considerations. It is also argued that the tribunal can be seen differently, according to the tradition of enquiry. (shrink)

Self-ownership is a central concept not only in Anglo-American liberal/libertarian discourse but also in Marxism. This article investigates what it means to say that a person has fundamental entitlement to full property in himself. It looks at possible moments when pre-modern concepts of the self became modern ones, examining Locke’s Second Treatise and his Essay Concerning Human Understanding. The aim is to focus on continuities and discontinuities in the transition from pre-modern to modern concepts and practices (...) of identity and agency and the role that attitudes to property played within this transition. It also seeks to alert historians to the pitfalls of accepting contemporary conceptions of moral and civic agency found in normative political theory when they study pre-modern contexts and the people who lived their lives within them. It also attempts to expose certain modern limits on our understanding of society and people’s obligations to one another by rejecting the laws of the oikos as currently applied to the political domain. This article examines the, hitherto comparatively unexplored, reception of Greek embryology by medieval Muslim jurists. The article elaborates on the views attributed to Hippocrates (d. ca. 375 BC), which received attention from both Muslim physicians, such as Avicenna (d. 1037), and their Jewish peers living in the Muslim world including Ibn Jumayʽ (d. ca. 1198) and Moses Maimonides (d. 1204). The religio-ethical implications of these Graeco-Islamic-Jewish embryological views were fathomed out by the two medieval Muslim jurists Shihāb al-Dīn al-Qarāfī (d. (...) 1285) and Ibn al-Qayyim (d. 1350). By putting these medieval religio-ethical discussions into the limelight, the article aims to argue for a two-pronged thesis. Firstly, pre-modern medical ethics did exist in the Islamic tradition and available evidence shows that this field had a multidisciplinary character where the Islamic scriptures and the Graeco-Islamic-Jewish medical legacy were highly intertwined. This information problematizes the postulate claiming that medieval Muslim jurists were hostile to the so-called ‘ancient sciences’. Secondly, these medieval religio-ethical discussions remain playing a significant role in shaping the nascent field of contemporary Islamic bioethics. However, examining the exact character and scope of this role still requires further academic ventures. (shrink)

That the perplexed responses of liberals seem to be characterized by a fetishization of the Iranian Other, reducing them to an empty screen onto which the liberal ideological subject may project their fantasy, prevents the Left from acknowledging that Iranian ideology functions as an over-identification with many of the excesses which (...) liberal ideology is so used to criticizing. The present work seeks to traverse this fantasy space, explicating the way Iran is considered to the object-cause of liberal desire and the consequences this conception has for the Left’s capacity to coherently respond to the present situation as it unfolds. Iran seems incapable of entering into the sphere of modernity, as any multiculturalist will be sure to emphasize, and yet, as any conservative will claim, in light of Iran’s control over such a huge percent of the world’s oil supply, as well as their refusal to engage in secular politics and attempts to develop nuclear technology, Iran threatens to disintegrate modernity itself. Both of these alternatives should be rejected as falling prey to the same fantastic projection to be avoided. (shrink)

Although wisdom might be considered a quaint concept in a post-industrialised, instrumental and secular world, it deserves serious consideration. This is done primarily from a philosophical perspective and is intended to encourage the reintroduction of wisdom into educational and developmental programmes, especially for managers and leaders. Mindful of the potential naïvete of transplanting systems of thinking from one epoch to another, we nonetheless examine the relevance of pre-modern thought to the post-modern condition. This is done by radically reinterpreting (...) classical Greek texts as Pierre Hadot has done to derive a meaning of "philosophy" and the place of wisdom in the ancient world. The concepts of wisdom, virtue and enacted ethics derived from this re-interpretation are then applied to an ethnographic case study involving a senior executive. This study suggests that a Stoical "wisdom of the moment" philosophy may characterize contemporary leadership practice. (shrink)

Responding to the work of previous critics of psychiatry, who have associated its undue dominance with both a modern scientific paradigm and political factors, I put forward a theoretical challenge based on MacIntyre`s work on Aquinas and Aristotle, but adding the museum and assembly as conceptual thinking tools. -/- MacIntyre`s work on practices, tradition-constituted enquiry, Marxist ideology and Kuhn are all used in putting forward a pre-modern view of knowledge. The feminist philosophy of Luce Irigaray widens the project (...) to include psychotherapy. Judges were never bound by law to convict a defendant unless they considered him guilty. Yet, they could be prohibited by law from convicting a person they consider guilty due to the absence of legally prescribed or the presence of legally prohibited evidence.Evaluation of Evidence addresses the question: should the law restrict the freedom of judges in assessing the probative value of evidence in the criminal process? Tracing the treatment of evidence from pre-modern to modern times, Mirjan Damaška (...) argues that there has always been some understanding about rules regarding the use and treatment of evidence, and these rules should not be looked askance as a departure from ideal arrangements. In a time when science and technology have the ability to contribute to factual inquiry, there needs to be acceptance of rules that expand or corroborate evidence produced by our native sensory apparatus. The paper asserts that the post-modern rejection of “modern” theoretical accounts including ethical-theoretical accounts as unacceptable meta-narratives would concur with an Aristotelian critique of contemporary ethical theories. Hence and Aristotelian critique will be similar to a post-modern critique. The paper sketches an account of what post-modernism in philosophy is and shows its similarity to Aristoteleanism in rejecting “modern” approaches in a significant way since an Aristotelian approach uses different criteria for what counts as ethical knowledge. The (...) paper suggests that if one follows the lead of Aristotle outlined in Book One Chapter Three of the Nichomachean Ethics applied ethics can be seen as similar to what Aristotle called “Rhetoric,” for in the Rhetoric Aristotle shows how one should engage in discourse about issues of the just and the good. The final section addresses the problem of how an Aristotelian approach can avoid the relativism of post-modernism. (shrink)

ABSTRACT It used to be said that shame culture waned in early modernity, but there is a growing body of historiography on the vital role that recognition and the opinion of others continued to play. Honour mattered; for some it was the mark and the maker of your true self. While philosophers like Hobbes, Locke, Mandeville, Hume, Smith, and Rousseau disagreed in their evaluations of the phenomenon, they were united in thinking that the great engine of recognition whirred like furious (...) clockwork through human society. When one listens to voices from the margins of power, however, to formerly enslaved black women and men, and white women, one hears a different story – that the machine is broken. I argue that, albeit from incomparable positions, they articulate a theory of misrecognition in the face of systematic power. Sensitive to the entanglements of epistemology and naturalised inequality, they offer a politics of vision that deconstructs the punitive lenses of gender and race which render people invisible and misunderstood, and in so doing they try to write themselves into view. They offer an account of the mysterious intractability of hegemonic ways of seeing that poses a challenge to both the putatively laissez-faire economy of recognition of their enlightened contemporaries, and to the emancipatory teleology of modern recognition theorists. Peter Harrison's Gifford Lectures demonstrate that the modern concepts of “religion” and “science” do not correspond to any fixed sphere of life in the pre-modern world. Because these terms are incommensurate and ideological, they misconstrue the past. I examine the influence and affinities of Ludwig Wittgenstein's philosophy on Harrison's study in order to argue that Harrison's project approaches Wittgenstein's. Harrison's book is a therapeutic history, untying a knot in scholarly language. I encourage Harrison, however, to clarify how future (...) scholars can progress in their study of phenomena once termed “scientific” or “religious” without succumbing to these same mistakes. The essay draws on the concept of ‘asymmetric counter-concepts’ as developed by Reinhart Koselleck starting with twin-formulas such as ‘the familiar and the unfamiliar’ which are generally used to establish collective des­ignations of the self and others and which institutionalize the axiological and the epistemological. These counter-concepts can have different semantic temperatures. The focus is on the underlying meaning-production schemes which produce value-asymmetries. The essay tries to show that a process of heating up these value-asymmetries is only one side of (...) the history of such asymmetric counter-concepts from medieval to modern times. Simultaneously a cooling down can be observed in written texts from different periods; examples include the 12th century Rolandslied and the 16th century Essais of Michel de Montaigne. Full negation eliminates uncertainties and value insecurities. But the complexities and contingencies that emerge since Early Modern times then lead to losses of negatability, which in turn render gains in unfamiliarity. The modern experience of the foreign is indeterminate otherness instead of determined negation that characterized pre-modern alterity. Modern societies therefore need to mediate between validity and contingency under the circumstances of plurality. Interpretational demands and uncertainty about the relevant interpretive frames increase. Foreignness is then experienced as unfamiliarity. This presupposes intellectual attitudes like irritability, curiosity, and willingness to learn. The modern concept of ‘culture’ then is proposed as a comparative pattern where only unavoidable structural asymmetry remains. It explains cultural differences and the experience of foreignness through heterogeneity. Using this specifically modern pattern, there is no longer a legitimate value slope between one’s own position and its negation. The distinction is then between the familiar and the unfamiliar. This paper explores the reception of Gellner’s historical sociology among students of pre-modern societies and the Greco-Roman world in particular and asks how his thought is still relevant to the field. This involves discussion of recent trends in world history as well as new comparative work on ancient state and elite formation. A main contention of the paper is that Gellner’s sociological reading of Plato and his politics may be one of the most interesting modern interpretations of the (...) ancient Greek thinker on offer and one which can serve as a fruitful framework for the comparative study of complex, pre-industrial societies. Of late, historians have been realising that South Asia and Europe have more in common than a particular strand in the historiography on "the rise of the West" would have us believe. In both world regions a plurality of languages, religions, and types of belonging by birth was in premodern times matched by a plurality of legal systems and practices. This volume describes case-by-case the points where law and social diversity intersected.

In most countries where Islam is acknowledged as a, or the, source of legislation, abortion is permitted under certain conditions and at certain stages of pregnancy. This article examines some of these laws and argue that they represent a continuation of the logic that governed the views of pre-modern Muslim jurists on abortion, that is, harm aversion. However, these laws also add a ‘modernist’ twist to that logic – rather than repealing that logic altogether, modernist views on ‘rights’ and (...) the advancement of medical knowledge and technology have influenced the priorities of Muslim jurists and lawmakers as far as abortion and the issues associated with it are concerned. This influence has furthermore been possible by a conscious selection and blending of pre-modern views to serve modern concerns. In all this, however, harm aversion remains the centrifugal principle, even when the abortion discourse in Muslim countries appears couched in the modernist discourse of rights. (shrink)

According to their standardized treatment within the Indian legal tradition, ordeals are supposed to occur, under certain circumstances, when one person formally accused another of some crime in a court of law. While not disputing the general accuracy of this standardized treatment of ordeals, this article argues for the widespread practice in pre-modern India of another—hitherto unrecognized—type of ordeal that fails to fit this basic scenario, for such ordeals would occur when someone was widely believed to have committed some (...) wrongdoing, but was not forced to stand trial in a formal judicial court. In order to prove his innocence and, thereby, mitigate the damage caused by his suspected guilt, such an individual could—and sometimes did—arrange for himself to undergo an ordeal at his own expense and independently of any formal plaint. After establishing the practice of ordeals of this sort in pre-modern India, this article then examines some possible explanations for their development. (shrink)

The present article challenges the popular image of Hugo Grotius as the founder of modern moral philosophy. It establishes that he continued the dialectical search for the good life distinctive of pre-modern ethics. Key in correcting the image of Grotius as innovator—an image almost as old as his De Jure Belli ac Pacis of 1625—is the realisation that this treatise deals only of the requirements for just use of force set out in what Grotius calls ‘law in the (...) strict sense’. For Grotius, ethics—in addition to this law—also encompasses rules of love, an account of the virtues and of happiness. That Grotius adhered to such a virtue-based eudaemonism is confirmed by his De veritate religionis Christianae where he sets out his conception of Christian happiness. The conclusion discusses whether such a distinctly Christian ethics can be of interest to today's world. I argue that the limits on state jurisdiction defined in De Jure Belli ac Pacis are key in making eudaemonism compatible with a liberal state. (shrink)

Further it attacks structuralist critiques of Yoga and comments on the state of Hindu and even, Buddhist studies today. Over the last few decades the study of Shīʿī Islam has witnessed a growing interest in specific aspects and perspectives of Shīʿī philosophers and theologians. The monograph authored by Sayeh Meisami focuses on the views of two of the most influential thinkers in Shīʿī, namely the eleventh century Ismāʿīlī thinker Ḥāmid al-Kirmānī and the Twelver mystic and thinker Ṣadr al-Dīn al-Shīrāzī, better known as Mullā Ṣadrā. Throughout the five chapters, the textual comparative analysis of their thought shows how multifaceted epistemological (...) and cosmological keys are transmitted from al-Kirmānī to Mullā Ṣadra, and ultimately become interwoven with their respective theories about the legitimacy of the Imām. Epistemology, cosmology, and political theory thus become, in the author’s analysis, the fil rouge that characterize the development of Shīʿī mystical and political philosophies up to the advent of Ayatollah Khomeini and the Islamic Republic of Iran. The aim of this article is to explore how, and to what extent, Italian thought – by its focalization on pre-modern theoretical issues and its distance from classical modern topics, such as the philosophy of conscience or the transcendence of language – can offer a different insight on contemporary social theory and critical theory, after the dissolution of the idea of totality as a foundational concept of modernity. In the last decades, a frame named ‘Italian theory’ has started (...) to circulate in international theoretical debates, often with the aim of replacing the exhausted paradigms of poststructuralism, postmodernism and deconstructionism. Indeed, ‘Italian thought’ seems to offer new insights, thinking about the ‘post-totality’ era in a different way. Much has been done on the publication of original sources in Arabic during the past 30 years, but much more remains to be done. Some of the recent multiple editions are unnecessary duplication of work and therefore waste of energy. This energy could be better spent on the publication of unpublished sources, and on studies involving the contextualization of Islamic sciences. Furthermore, historians of pre-modern science should work on the popularization of their wonderful subject. In this volume of conference papers originally presented at the University of Oklahoma, a distinguished group of scholars examines episodes in the transmission of premodern science and provides new insights into its cultural, philosophical and historical significance.

The early modern and modern cultural world in the West would be unthinkable without Petrarch and Boccaccio. Despite this fact, there is still no scholarly contribution entirely devoted to analysing their intellectual revolution. Internationally renowned scholars are invited to discuss and rethink the historical, intellectual, and literary roles of Petrarch and Boccaccio between the great model of Dante’s encyclopedia and the ideas of a double or multifaceted culture in the era of Italian Renaissance Humanism. In his lyrical poems (...) and Latin treatises, Petrarch created a cultural pattern that was both Christian and Classical, exercising immense influence on the Western World in the centuries to come. Boccaccio translated this pattern into his own vernacular narratives and erudite works, ultimately claiming as his own achievement the reconstructed unity of the Ancient Greek and Latin world in his contemporary age. The volume reconsiders Petrarch’s and Boccaccio’s heritages from different perspectives, and investigates how these heritages shaped the cultural transition between the end of the Middle Ages and the early modern era, as well as European identity. Collapse is a term that has attracted much attention in social science literature in recent years, but there remain substantial areas of disagreement about how it should be understood in historical contexts. More specifically, the use of the term collapse often merely serves to dramatize long-past events, to push human actors into the background, and to mystify the past intellectually. At the same time, since human societies are complex systems, the alternative involves grasping the challenges that a holistic analysis presents, (...) taking account of the many different levels and paces at which societies function, and developing appropriate methods that help to integrate science and history. Often neglected elements in considerations of collapse are the perceptions and beliefs of a historical society and how a given society deals with change; an important facet of this, almost entirely ignored in the discussion, is the understanding of time held by the individuals and social groups affected by change; and from this perspective ‘collapse’ depends very much on perception, including the perceptions of the modern commentator. With this in mind, this article challenges simplistic notions of ‘collapse’ in an effort to encourage a more nuanced understanding of the impact and process of both social and environmental change on past human societies.
