Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In turn, (...) Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Originating in the Sophistic pedagogy of Protagoras and reflecting the sceptical practice of the New Academy, Quintilian's rhetorical pedagogy places a special emphasis on the juxtaposition of multiple, competing claims. This inherently dialogical approach to argumentation is referred to here as controversia and is on full display in Quintilian's own argumentative practice. More important to this paper, however, is the role of controversia as an organizing principle for Quintilian's rhetorical curriculum. In particular, Quintilian introduces the protocols of controversia through a (...) series of progressively more complex exercises in imitation, role-playing, and declamation (now referred to as situational games). All of these exercises are open for adaptation by contemporary teachers who would promote a dialogical approach to argument, i.e. argument with its methods of inquiry, invention, and judgment based on direct interaction with opposing parties. These decisions, as well as legislation addressing the same issues, have prompted a torrent of law journal articles analyzing every aspect of end-of-life law. In recent years, moreover, a number of law review articles, many published in this journal, have also specifically addressed legal issues raised by palliative (...) care. Much less is known in the United States, however, as to how other countries address these issues. Reflection on the experience and analysis of other nations may give Americans a better understanding of their own experience, as well as suggest improvements to their present way of dealing with the difficult problems in this area.This article offers a conceptual and comparative analysis of major legal issues relating to end-of-life treatment and to the treatment of pain in a number of countries. In particular, it focuses on the law of Australia, Canada, the United Kingdom, Poland, France, the Netherlands, Germany, and Japan. (shrink)

Es entstehen jedoch zwei Probleme durch eine Interpretation dieser Art. Erstens, warum wendet der frühe Leibniz die prästabilierte Harmonie auf alle Interaktionen zwischen Substanzen an und nicht nur auf die zwischen Geist und Körper? Zweitens, warum wendet der frühe Leibniz die prästabilierte Harmonie auf die Beziehung zwischen Geist (...) und Körper an, obwohl seine Ontologie nicht cartesianisch ist und also keine prästabilierte Harmonie zu rechtfertigen scheint? Ich behaupte, daß die Antwort auf die erste Frage in dem, was ich Leibniz' 'metaphysischen Fundamentalismus' nenne zu finden ist, und die Antwort auf die zweite Frage in Leibniz' Bemühung, die 'moralische Identität' der rationalen Seele zu erhalten. The Eudaimonistic Interlude It comes as a surprise. Two-thirds of the way through De Magistro, amid a torturous and at times obscure discussion of the nature of language, Augustine pauses to provide Adeodatus, his son and interlocutor, with what seems (...) a rather odd digression:...with so many detours, it's difficult to say at this point where you and I are trying to get to! Maybe you think we're playing around and diverting the mind from serious matters by some little puzzles that seem childish, or that we're pursuing some result that is only small or modest....Though we do perhaps play around, this should itself not be regarded as childish. Nor are we thinking about small and modest goods. Yet if I were to say that there is a happy and everlasting life, and I want us to be led there under the guidance of God (namely by Truth Himself) by stages that are suitable to our weak steps, I'm afraid I might seem laughable for having set out on such a long journey by considering signs rather than the things themselves that are signified. So then, you'll pardon me if I play around with you at first—not for the sake of playing around, but to exercise the mind's strength and sharpness, with which we're [End Page 467] able not only to withstand but also to love the heat and light of that region where the happy life is. 2One is left wondering—if one pauses long enough to wonder at all—what exactly the preceding tightly woven and technical discussion of signification has to do with the "heat" (calor) and the "light" (lux) of the "region" (regio) where the "happy life" (beata vita) is to be found. Indeed, even the passage itself acknowledges the ostensible obliqueness of the connection without doing very much to highlight its nature.It is not surprising that readers of De Magistro often overlook this eudaimonistic interlude in favor of the more prominent and arresting difficulties with which the text confronts us. There is, after all, the somewhat awkward view of language which underlies the entire discussion, and there is also what seems to be the abrupt and jarring reversal of positions that occurs near the very end of the text. Perhaps most notorious of all, there is the famous theory of "divine illumination" with which the dialogue concludes. It is worth noting, however, that as odd and as digressive as this eudaimonistic interlude may strike the present-day reader, it does not seem to strike Adeodatus as at all odd, nor does it seem out of keeping with the eudaimonistic emphasis that is such a prominent feature of Augustine's other works from roughly the same period. 3 Indeed, our passage, although easily swept aside and passed over, can do much to provide a unifying strand which ties our difficulties together; it is, indeed, a helpful prism through which we can view those difficulties in a new light. [End Page 468] 2. Some Initial Darkness And the difficulties are indeed quite real. To begin with, there is the awkward view of language that underlies the entire discussion. "Words" (verba) are "signs" (signa) (DM 2.3), and there is a fundamental distinction between a "sign" and "signifiables" (significabilia) which are signified by signs (DM 4.8). Language, on this account, is fundamentally instrumental (see, e.g., DM 9.25), for each word is a means by which one attempts to draw attention to that which the word, qua sign, somehow signifies. As Wittgenstein says in his famous gloss on Confessions I.8, In this picture of language we find the roots of the following idea, E.g. Every word has a meaning. The nosological status of the putative clinical entity of compensation neurosis and the relationship of chronic pain complaints to compensation are explored. It is concluded that, using the traditional criteria of diagnostic validity, there is no support for the view that a specific type of psychiatric disorder related to compensation or litigation can be demonstrated. Although it has been generally considered that chronic pain complaints reflect an underlying disease state, recent evidence has shown that in the medico-legal setting the nature (...) of the compensation system and the level of available benefits have a marked influence on both the rate of chronic pain complaints and the duration of pain related work incapacity. The author tells us that this book was originally intended to be part of a larger work, with the provisional title God and Infinity, but that he opted instead for a separate and independent treatment of the notion of infinity in philosophy and related areas. The original purpose is very well-hidden, showing itself clearly only in the Preface and a few other places. The book begins with a chapter describing some known alleged difficulties having to do with the infinitely large (...) and infinitely small . This is followed by a chapter on some basic mathematical notions and facts, including sketchy references to Zermelo-Fraenkel set theory , ordinal and cardinal numbers, Cantor's diagonal method, some special set-theoretic statements , analysis, non-standard analysis, model theory, internal set theory , Conway numbers, and the ‘finite mathematics’ of Mycielski and Lavine. Of course, readers will obtain very little solid information about these matters, but at least they will be introduced to some of the terminology. Chapter 3 returns to the problems and conundrums introduced in Chapter 1 and tries to resolve them or show that they are illusory. In some cases, the trouble arose because an infinite sequence of experiments was imagined which would be physically impossible . The author of this article maintains that there is a progression in plato's "phaedo" from argument and myth to action. In the dialogue, socrates is portrayed as a believer in immortality. How is that belief conveyed to skeptics like simmias? it is argued here that plato deliberately employs a variety of methods because men are not convinced by rational argument. Plato's depiction of socrates' own death is itself the final demonstration.

This dissertation is a detailed exploration of Augustine's discussion of the origin of the human soul in the De Genesi ad Litteram. The two central problems addressed are: Why does Augustine abruptly and without explanation abandon his two-phase view of creation and reduce his three hypotheses of the soul's origin to two?, and Why, in spite of what seems to be a preponderance of evidence in favor of the traducianist hypothesis, does Augustine resist it? It is argued that the solution (...) to both of these puzzles is to be found in Augustine's unstated yet persistent commitment to an unmediated account of the soul's origin. It is further argued that if one is sufficiently attentive to the details of Augustine's discussion, it can be seen that Augustine in fact mounts a concerted effort to argue in favor of the creationist hypothesis while simultaneously attempting to block the traducianist hypothesis.
