I will take a famous paragraph from J S. Mill as a starting point for defending the idea that moral philosophy has to take charge definitively of those who have been less fortunate in the natural lottery. This means that we must to take seriously the possibility of increasing the capacity for the well-being of nonhuman animals. The aim of the text is to show the relevance of the current ethical debate on enhancement also in the context of reflection on (...) our obligations towards sensitive non-human animals. (shrink)

En el artículo se lleva a cabo un análisis de las bases en las que descansa el paradigma ético tradicional. La pretensión es mostrar que la propuesta humanista falla en su pretensión de justificar que la responsabilidad moral de los agentes morales se dirige a todos y sólo a los seres humanos. En la parte final se apuesta por una propuesta alternativa más plausible.

Deberíamos usar las nuevas técnicas biomédicas para mejorar a los individuos? Si sabemos que la naturaleza humana contiene también características que podemos considerar no deseables entonces parece que no habría nada en sí mismo erróneo a la hora de alterarla. Algunos autores interesados en este tema hacen referencia a los daños que ello podría ocasionar a otros. Pero entonces, ¿la mejora moral podría funcionar como un contraejemplo a la idea de que la mejora biomédica es siempre moralmente impermisible? Puede que (...) lejos de estar ante algo meramente permisible, la mejora de nuestro carácter moral sea algo a lo que debamos aspirar. ¿Sería entonces obligatorio seleccionar los embriones con un nivel más alto de moralidad? La comunicación que presentamos pretende mostrar las consecuencias que el sistema implementado por el sindicato agrícola Unió de Pagesos en Cataluña -por el que se realiza el reclutamiento, importación y suministro de mano de obra extranjera para el campo catalán- produce: un sujeto limitado en el justo goce de sus libertades y el legítimo ejercicio de sus derechos. La política migratoria la responsable del surgimiento de un sistema tal, cuyo germen está en la relación simbiótica Estado/Sindicato, cuyos intereses -la entrega (...) just in time de la mano de obra y el control social del extranjero- se armonizan en su puesta en práctica. En los alojamientos, infraestructura del sistema, se procura la docilización de los individuos necesaria a su continuo suministro a través de variados dispositivos, entre ellos, normativas de alojamiento, supervisión constante y regímenes de visita. Para o campo da Ciência da Informação (CI), é de grande relevância a discussão sobre o fluxo informacional, que é um objeto focal das pesquisas desenvolvidas nessa área. Por esse motivo, não são estudados apenas os meios e os conceitos, mas as relações que eles têm entre si e as suas mediações, sempre levando em consideração os processos que envolvem sua comunicação, usabilidade e acessibilidade pelo tecido social. Também, observam-se as distintas visões que envolvem a mediação tida na Ciência da (...) Informação e os diversos ramos do conhecimento, tais como a Comunicação, a Psicologia e a Ciência do Direito. Diante disso, este trabalho trata-se de uma revisão bibliográfica que visa conceituar a mediação da informação em áreas distintas e analisar a importância dessa atividade em cada segmento. Quanto aos aspectos metodológicos, esta pesquisa é de natureza aplicada, enquadrando-se nos objetivos exploratório e descritivo. (shrink)

Tienen razón Francisco Lara y Olga Campos en afirmar en la introducción de su libro que “un mérito importante de este libro es que, de manera muy divulgativa, pretende dar respuestas filosóficas al debate sobre nuestra relación con los animales al aplicar ideas bási- cas a cuestiones prácticas como si debemos ser o no vegetarianos, si hay que experimentar con animales o hasta qué punto son justifica- bles las corridas de toros” (p. 15). Y efectivamente, de una manera (...) muy clara, el libro no sólo pretende, sino que en efecto da respuestas a cuestiones centrales sobre nuestra relación con los animales, en particular a la cuestión acerca de cuál es su estatus o su valor moral y, por ende, sobre si tenemos obligaciones morales hacia ellos. Su tesis es que los animales sí tienen un estatus moral independiente de los intereses humanos, que tienen derechos y que es nuestra obligación moral respetarlos. Parte de ese respeto consiste en no tratarlos como meros instrumentos o recursos al servicio de los inte- reses de los humanos. (shrink)

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Eight papers are discussed: two concern the management and use of documents available on the World Wide Web, (...) and six apply machine learning techniques to a variety of legal applications. This is a part of an in-depth study of a set of the manuscripts related to the Jayadrathayāmala. Taking JY.3.9 as a test-chapter, a comparative paleography analysis of the 11 manuscripts was made within READ software framework. The workflow within READ minimized the effort to make a few important discoveries (manuscripts containing more than one script, identification of the manuscripts potentially written by the same person) as well as to create an overview of the shift from Nāgarī to Newārī and, (...) finally, to Devanāgarī scripts within the history of manuscript transmission of a single chapter. Exploratory statistical analysis in R of the syllable frequency in each manuscript, based on the paleography analysis export from READ, helped to establish that there are potentially two lines of manuscript transmission of the JY.3.9. Agostino d’Ippona è stato un punto di riferimento costante nella produzione filosofica arendtiana, a partire dalla dissertazione di dottorato del 1928, intitolata Il concetto d’amore in Agostino, fino alle ultime pagine scritte prima di morire, e dedicate alla trattazione della volontà. Il segno più evidente di questo rapporto è costituito da una frase del De civitate Dei, « initium ut esset creatus est homo, ante quem nullus fuit» sulla quale Hannah Arendt fonda il proprio concetto di libertà, intesa come la (...) capacità dell’uomo di “essere” un nuovo inizio. Drawing from extensive, eye-opening first-person accounts, No Refuge puts a spotlight on the millions of refugees worldwide who have to leave home but find nowhere to resettle. This book is a philosophical analysis of the ethical treatment of refugees and stateless people, a group of people who, though extremely important politically, have been greatly under theorized philosophically. The limited philosophical discussion of refugees by philosophers focuses narrowly on the question of whether or not we, as members of Western states, have moral obligations to admit refugees into our countries. This book reframes this debate and shows why it is important to think ethically about people who will never (...) be resettled and who live for prolonged periods outside of all political communities. Parekh shows why philosophers ought to be concerned with ethical norms that will help stateless people mitigate the harms of statelessness even while they remain formally excluded from states. The pharmaceutical industry plays an increasingly dominant role in healthcare, raising concerns about “conflicts of interest” on the part of the medical professionals who interact with the industry. However, there is considerable disagreement over the extent to which COI is a problem and how it should be managed. Participants in debates about COI have become entrenched in their views, which is both unproductive and deeply confusing for the majority of medical professionals trying to work in an increasingly commercialized environment. We (...) used a modified meta-narrative review method to analyse debates about COI in the academic and grey literature. We found two Discourse Models: The Critical Discourse Model sees COI in health and biomedicine as a major problem that both can and should be addressed, while the Defensive Discourse Model argues that current efforts to control COIs are at best unnecessary and at worst harmful. Each model is underpinned by profoundly differing views about how society should be organized—in particular whether market forces should be encouraged or curtailed—and how the dangers associated with market forces should be managed. In order to make any headway, academics and policymakers must recognize that these debates are underpinned by profoundly differing worldviews. (shrink)

En este trabajo se analizan las reflexiones de Ernst Jünger sobre la idea de progreso para, después, ofrecer una hipótesis acerca de las bases metafísicas de este concepto. Para ello, se presenta una lectura de los textos fundamentales de Jünger en torno a esta cuestión, publicados durante la época de entreguerras, en los que el progreso aparece vinculado al desarrollo de la técnica y del nihilismo. Después, se propone una genealogía de la idea de progreso para descubrir sus cimientos filosóficos (...) desde una perspectiva crítica. In its broadest sense, globalization refers to the economic, social, cultural, and political processes of integration that result from the expansion of transnational economic production, migration, communications, and technologies. This article outlines the ways in which predominantly Western feminist philosophers have articulated and addressed the challenges associated with its economic and political dimensions.

The paper analyses and evaluates the linguistic policy of the Court of Justice of the European Union against the background of other multilingual courts and in the light of theories of legal interpretation. Multilingualism has a direct impact upon legal interpretation at the Court, displacing traditional approaches with a hermeneutic paradigm. It also creates challenges to the acceptance of the Court’s case-law in the Member States, which seem to have been adequately tackled by the Court’s idiosyncratic translation policy.

Are inequalities of income created by the free market just? In this book Serena Olsaretti examines two main arguments that justify those inequalities: the first claims that they are just because they are deserved, and the second claims that they are just because they are what free individuals are entitled to. Both these arguments purport to show, in different ways, that giving responsible individuals their due requires that free market inequalities in incomes be allowed. Olsaretti argues, however, that neither (...) argument is successful, and shows that when we examine closely the principle of desert and the notions of liberty and choice invoked by defenders of the free market, it appears that a conception of justice that would accommodate these notions, far from supporting free market inequalities, calls for their elimination. Her book will be of interest to a wide range of readers in political philosophy, political theory and normative economics. (shrink)

This paper is an exploration of the role of conscience in the justification of human rights. I argue that in both the western tradition of natural rights and the non-western traditions, human rights are justified, in part, because of their appeal to conscience, and not simply because they issue from a divine source or are based on reason. In contrast, contemporary justifications of human rights primarily look for an objective foundation or simply assert the pragmatic importance of human rights as (...) their justification. While there are distinct advantages to this way of arguing, there are also problems, which I will discuss. As an alternative, I outline Arendt's understanding of conscience as the ability to be with and think with one's self as a secular alternative to both a non-secular version of conscience, and the denial of conscience implicit in contemporary theories. Her view of political judgment helps us to understand how conscience can be understood as subjective but not arbitrary. This paper brings Arendt's insights on conscience and judgment to bear on contemporary discourses of human rights. (shrink)

Contemporary egalitarian theories of justice constrain the demands of equality by responsibility, and do not view as unjust inequalities that are traceable to individuals' choices. This paper argues that, in order to make non-arbitrary determinate judgements of responsibility, any theory of justice needs a principle of stakes , that is, an account of what consequences choices should have. The paper also argues that the principles of stakes seemingly presupposed by egalitarians are implausible, and that adopting alternative principles of stakes amounts (...) to fleshing out the demands of responsibility rather than imposing limits on them. Serena Olsaretti brings together new essays by leading moral and political philosophers examining the relation between desert and justice; they also illuminate the nature of distributive justice, and the relationship between desert and other values, such as equality and responsibility.

Distributive justice has come to the fore in political philosophy: how should we arrange our social and economic institutions so as to distribute benefits and burdens fairly? Thirty-two leading figures from philosophy and political theory present specially written critical assessments of the key issues in this flourishing area of research.

Although epidemiology as a scientific study of disease in populations claimed an independent disciplinary status already in the mid–nineteenth century, its history in the twentieth century can be seen as a continuous and often contentious attempt to define the field’s social and intellectual boundaries vis-à-vis a variety of neighboring scientific fields and public health practices. In a period dominated by laboratory biomedical sciences, epidemiologists repeatedly tried to spell out how their discipline met the requirements of scientificity despite its focus on (...) disease as a collective phenomenon and its reliance on nonlaboratory methods. This article asks about the relationship between the changing institutional and intellectual contexts of British epidemiological practice and the epidemiologists’attempts to define both science in general and epidemiology in particular. An examination of the epidemiologists’boundary-making endeavors is also used to reflect on the circumstances in which scientists engage in the discourse of disciplinary demarcations. (shrink)

Confronted with an unprecedented scale of human-induced environmental crisis, there is a need for new modes of theorizing that would abandon human exceptionalism and anthropocentrism and instead focus on developing environmentally ethical projects suitable for our times. In this paper, we offer an anti-anthropocentric project of an ethos for living in the Anthropocene. We develop it through revisiting the notion of sustainability in order to problematize the linear vision of human-centric futurity and the uniform ‘we’ of humanity upon which it (...) relies. We ground our analyses in posthumanism and material feminism, using works by posthumanist and material feminist thinkers such as Stacy Alaimo, Rosi Braidotti, Donna Haraway and Jane Bennett, among others. In dialogue with them, we offer the concept of posthuman sustainability that decenters the human, re-positions it in its ecosystem and, while remaining attentive to difference, fosters the thriving of all instances of life. The compensatory desert argument is an argument that purports to justify inequalities in (some) incomes generated by a free labour market. It holds, first, that the principle of compensation is a principle of desert; second, that a distribution justified by a principle of desert is just; and third, that (some) rewards people reap on a free labour market are compensation for costs they incur. It concludes that therefore, a distribution of (some) rewards generated by a free labour market is just. (...) In this chapter I criticise the first two premises of this argument. I argue that the principle of compensation is not a principle of desert (sections 3 and 4), and that a distribution of deserved compensatory payments may be unjust (sections 5 and 6). Before developing my critique of the compensatory desert argument, I start by illustrating further that argument in the version of it which has been defended by Julian Lamont (section 1), and to dispel two objections that have been moved against the view that compensation is a principle of desert. Liberal-Democratic changes in the Russian Society have brought a number of acute problems threatening national security and leading to converting Russia into a peripheral socio-cultural system («national self-identification crisis»). Scientific research shows that the main indicator of the said crisis is not only the critical economic differentiation of people into the «poor» and «rich» Russia (with the different ways of life, needs, mentality) but also spiritual degradation, spread of aggressive – depressive syndrome (growth of hatred, feeling of injustice, loss of (...) meaning of the life, anger, melancholy, hopelessness, loneliness etc.). Twothirds of the citizens (74.9%) interviewed in 2006 think that their social status does not correspond to their personal achievements in education and professional abilities. One of the main reasons of their distrust towards the government bodies is insufficient professional and cultural level, absence of unity of a word and business. It is worth mentioning that books and articles of scientists and ideologists who resist Western liberalism are freely published, but you can hardly see these people close to the President. Russians are openly and secretly under pressure of ideas propagandizing negative past which undermine national self-identification, national pride for the great history of their country. The original sphere of influence of Russian language and Russian culture is shortening under the press of mass-culture. Meanwhile, 67% of Russians expressed their negative attitude towards massive Western cultural expansion. The Futureof Russia is in safeguarding national intellectual and spiritual values, Science, education and in supporting the person of work and creativity. (shrink)

The traditional point of view on analyticity implies that truth in virtue only of meaning entails a priori acceptability and vice versa. The argument for this claim is based on the idea that meaning as it concerns truth and meaning as it concerns competence are one and the same thing. In this paper I argue that the extensions of these notions do not coincide. I hold that truth in virtue of meaning— truth for semantic reasons—doesn't imply a priori acceptability, and (...) that a priori reflection based only on knowledge of meaning—in the sense of competence—doesn't necessitate true conclusions.The main consequence of this view concerns conceptual analysis, as it presupposes we have a privileged—incorrigible in the face of empirical evidence—access to non-trivial truths about the world on the basis of mere a priori reflection founded on meaning. If, as I argue, such access is not incorrigible the project of conceptual analysis loses its special epistemological status. (shrink)
