Kit Fine and Gideon Rosen propose to define constitutive essence in terms of ground-theoretic notions and some form of consequential essence. But we think that the Fine–Rosen proposal is a mistake. On the Fine–Rosen proposal, constitutive essence ends up including properties that, on the central notion of essence, are necessary but not essential. This is because consequential essence is closed under logical consequence, and the ability of logical consequence to add properties to an object’s consequential essence outstrips the ability of (...) ground-theoretic notions, as used in the Fine–Rosen proposal, to take those properties out. The necessary-but-not-essential properties that, on the Fine–Rosen proposal, end up in constitutive essence include the sorts of necessary-but-not-essential properties that, others have noted, end up in consequential essence. Hartry Field’s epistemological challenge to the mathematical platonist is often cast as an improvement on Paul Benacerraf’s original epistemological challenge. I disagree. While Field’s challenge is more difficult for the platonist to address than Benacerraf’s, I argue that this is because Field’s version is a special case of what I call the ‘sociological challenge’. The sociological challenge applies equally to platonists and fictionalists, and addressing it requires a serious examination of mathematical practice. I argue that the non-sociological part of Field’s (...) challenge amounts to a minor reformulation of Benacerraf’s original challenge. So, I contend, Field’s challenge is not an improvement on Benacerraf’s. What is new to Field’s challenge is as much a problem for the fictionalist as it is for the platonist. (shrink)

In “Mathematical Truth,” Paul Benacerraf raises an epistemic challenge for mathematical platonists. In this paper, I examine the assumptions that motivate Benacerraf’s original challenge, and use them to construct a new causal challenge for the epistemology of mathematics. This new challenge, which I call ‘Gödel’s Gap’, appeals to intuitive insights into mathematical knowledge. Though it is a causal challenge, it does not rely on any obviously objectionable constraints on knowledge. As a result, it is more compelling than the original challenge. (...) It is also more general; the challenge applies equally to platonistic and non-platonistic accounts of mathematical truth. The standard argument for the existence of distinctively mathematical objects like numbers has two main premises: some mathematical claims are true, and the truth of those claims requires the existence of distinctively mathematical objects. Most nominalists deny. Those who deny typically reject Quine’s criterion of ontological commitment. I target a different assumption in a standard type of semantic argument for. Benacerraf’s semantic argument, for example, relies on the claim that two sentences, one about numbers and the other about cities, have (...) the same grammatical form. He makes this claim on the grounds that the two sentences are superficially similar. I argue that these grounds are not sufficient. Other sentences with the same superficial form appear to have different grammatical forms. I offer two plausible interpretations of Benacerraf’s number sentence that make use of plural quantification. These interpretations appear not to incur ontological commitments to distinctively mathematical objects, even assuming Quine’s criterion. Such interpretations open a new, plural strategy for the mathematical nominalist. (shrink)

Wright claims that his and Hale’s abstractionist neologicist project is primarily epistemological in aim. Its epistemological aims include establishing the possibility of a priori mathematical knowledge, and establishing the possibility of reference to abstract mathematical objects. But, as Wright acknowledges, there is a question of how neologicist epistemology applies to actual, ordinary mathematical beliefs. I take up this question, focusing on arithmetic. Following a suggestion of Hale and Wright, I consider the possibility that the neologicist account provides an idealised reconstruction (...) of how people acquire cognition of numbers or arithmetical knowledge. I conclude that it is unlikely that this account can be used to reconstruct even idealised answers to pressing questions about our actual epistemology. (shrink)

Unmet legal needs contribute to housing, income, and food insecurity, along with other conditions that harm health and drive health inequity. Addressing health injustice requires new tools for the next generations of lawyers, doctors, and other healthcare professionals. An interprofessional group of co-authors argue that law and medical schools and other university partners should develop and cultivate Academic Medical-Legal Partnerships (A-MLPs), which are uniquely positioned to leverage service, education, and research resources, to advance health justice.

Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. Public, private, non-profit and for-profit nursing education enterprises in the U.S. are competing with one another in a newly complex and volatile educational landscape, placing academic leaders into situations fraught with moral, ethical and legal compromise with few precedents for guidance. This case study provides a richly contextualized narrative exploration of ethical and legal challenges to one leader’s moral courage, a fictionalized exploration drawn from multiple sources over time, to form a composite that is nonetheless firmly rooted in the complexity (...) and competitiveness characteristic of nursing education today. This book attempts to reframe abortion rights by focusing not on a woman's right to choose abortion, but rather on a woman's right to consent to pregnancy. Drawing on legal, medical, and philosophical definitions of pregnancy, it disaggregates the consent to sexual intercourse from the consent to pregnancy and argues that men and women have equal right to bodily integrity, which is defined as the freedom from nonconsensual bodily intrusion. This article examines Mary Wollstonecraft's public reception in American newspapers from 1800 to 1869. Wollstonecraft was portrayed to the American public as a philosopher of women's rights, a new model of femininity, and a pioneer of women's political activism. Although these iconic uses of Wollstonecraft were regularly negative, they grew more positive as the women's rights movement gained steam alongside the abolition movement.

Inspired by the report, Reimagining our Futures Together. A New Social Contract for Education, which warns that humanity and planet Earth are under threat, but acknowledges that education has the power to bring about profound change, this article makes the case for giving careful consideration both to Paul Ricœur’s reflections on humanity and human capacities, and to his comments on “true education” and the educational value of poetic thought. To get a sense of where scientific-technological civilization is headed, it draws (...) on the work of Allen Buchanan and Dominique Janicaud. It then examines Ricœur’s account of the essential characteristics of education and his thoughts on the roles of families and teachers. It argues that Ricœur’s proposal for the cultivation of an “ethical consciousness” offers greater protection for humanity in an uncertain future than Janicaud and Buchanan’s proposals for “ethical vigilance” and rules-based protective measures. ABSTRACTFeminists have long criticized Rousseau for his patriarchal political theory. But when his lesser-known writings on women from the 1740s are taken into account, including a nearly 900-page manuscript critiquing Montesquieu from a feminist perspective, we see how the early Rousseau robustly converged in feminist ideas with his employer Madame Louise Dupin, before he gradually diverged from this egalitarian school of thought over the course of the 1750s. I add to the evidence of the early Rousseau’s egalitarian response to ‘the (...) woman question’ by showing his philosophical convergence with the feminist arguments of the anonymous ‘Critique of the Spirit of the Laws’ as well as Madame Dupin’s ‘Ouvrage sur les femmes’ – manuscripts largely in his secretarial hand. Through this triangulation of understudied texts, we find that the early Rousseau was not a patriarchal apologist, but rather a feminist secretary and a secretary to a feminist. (shrink)

The frequency of discriminatory language in job advertisements placed by U. S. multinational corporations operating in Mexico was compared with that of Mexican companies using content analysis. A sample of 300 ads placed by companies from each culture was analyzed and coded by two groups of coders to calculate the frequency of discriminatory language in the job ads with respect to age, gender, physical appearance and marital status. Results of a chi square analysis revealed that U. S. multinationals firms in (...) Mexico utilize discriminatory language in job ads less frequently in the categories of age, gender and marital status. This result suggests that the legal and cultural framework of the country of origin of U. S. enterprises in Mexico may be influencing their actual recruitment practice in Mexico, and in turn, help them in setting a positive example of non-discrimination in recruitment among their Mexican counterparts. The publication in 1869 of Mill’s Subjection of Women gave rise to philosophical and political responses beyond Western Europe on the relationship between Westernization and women’s rights in developing, colonial, and post-colonial countries. Through the first comparative study of the Subjection of Women alongside the forewords to six of its earliest non–Western European editions, we explore how this book provoked local intellectuals in Russia, Chile, and India to engage its liberal utilitarian, imperial, Orientalist, and feminist ideas. By showing how Mill’s (...) Western European biases and instrumental reasoning establish problematic rhetorical models for women’s rights arguments, we are able to explore the ethical dimensions of women’s rights issues in the context of cultural and political imperialism. Most importantly, this reception history illustrates how cross-cultural and culturally sensitive dialogue on women’s rights can push us beyond Western bias and imperialism in advocating for the end of women’s subjection around the globe. This article explores the epistemological and strategic issues facing feminists embarking upon narrative explorations into women's experiences. It considers the implications for feminist epistemology of acknowledging women's participation in dominant ideologies about their social role. Focusing upon questions of women's agency, it asks how this `conforming knowledge' might complicate postmodernist feminist notions of resisting and reconstructing law's categorisation of `Woman'. It also represents an attempt to clarify, in advance of my own analysis of women's agency in abortion decision-making, why postmodern (...) feminists might talk to women – the `subjects' of law's constructive power. He’s a visual artist and a political activist for the American Indian Movement. (...) Pirogenetico pirogenetico (2009) was recently installed at the Centre Pompidou as part of their “New Presentation of the Contemporary Collections.” His work is replete with wild ideas shaped by a sage, unpretentious impulse and an automatic responsibility to history, particularly his own Cherokee history. Confident from instability, and free from pedagogical language, he strings form and words together that sharply pierce the atmosphere of ideology. Durham doesn’t follow a line and he doesn’t depend on the scaffold of language, but the work makes a remarkable point. Pirogenetico, pirogenetico is a collection of three obsidian rocks, cut and then cast as a double in German silver. Each threesome sits on its own low metal table, forming a diptych. The cut of the original follows the shattering nature of obsidian, which Durham undercuts and monumentalizes in the double. The derivative double and its mannered original: they are nearly too beautiful but still can’t deny the violence. If Durham’s irony, his edge, is obscured by the volume of his forms, it’s reactivated in a video on the adjacent wall where the obsidian cuts through a heart organ. Durham’s syntax is spare. He knows that language isn’t big enough to tell the story, reminding us, as Lacan stated, “I always speak the truth. Not the whole truth... because saying it all is impossible: words fail.”(2) In place of language Durham uses an alternative accuracy that compounds history with the present, a mashup of material things, a collision of aesthetics that shakes down conventional wisdom, replacing it with searing poetry. The authors ground their reflections on gender and the complex realities of the second Palestinian intifada against Israeli occupation in the political processes unleashed by the signing of the Israeli–Palestinian rule, noting that the profound inequalities between Israel and Palestine during the interim period produced inequalities among Palestinians. The apartheid logic of the Oslo period – made explicit in Israel's policies of separation, seige and confinement of the Palestinian population during the intifada and before it – is shown to shape (...) the forms, sites and levels of resistance which are highly restricted by gender and age. In addition, the authors argue that the Palestinian Authority and leadership have solved the contradictions and crisis of Palestinian nationalism in this period through a form of rule that the authors term ‘authoritarian populism’, that tends to disallow democractic politics and participation. The seeming absence of women and civil society from the highly unequal and violent confrontations is contrasted with the first Palestinian intifada (1987–91), that occurred in a context of more than a decade of democratic activism and the growth of mass-based organizations, including the Palestinian women's movement. ABSTRACT In the style of Swift and Wollstonecraft, I contribute to the growing pandemic literature on Hobbes by writing a feminist satire of the Leviathan for the age of the novel coronavirus. Hobbes's conceptions of the state of nature and the body politic are eerily relevant to the present political crises, especially in the United States. In a personal narrative that is both arch and absolutely serious, I reveal how a woman-empowering vision of a healthy global body politic can be (...) teased out of Hobbes's political thought and used to combat the fatalistic view of humanity's inevitable descent into a chaotic state of nature during times of crisis such as the Covid-19 pandemic. This article takes up Paul Ricœur’s suggestion that he learned more about the idea of justice by positioning himself on the juridical plane than he had by moving directly to a consideration of political theory. It contends that Ricœur’s very interesting but largely neglected text, “The Just between the Legal and the Good,” illustrates the value of doing philosophical work at a level where there is an imperative to make a judgement and following on from that to distribute, in the (...) fairest way possible, the goods that are at the heart of the dispute. The article also offers a detailed commentary on Ricœur’s text, noting the unusual form of critique that it brings to bear on Rawls’s principles of justice. It contends that Ricœur’s very interesting but largely neglected text, “The Just between the Legal and the Good,” illustrates the value of doing philosophical work at a level where there is an imperative to make a judgement and following on from that to distribute, in the (...) fairest way possible, the goods that are at the heart of the dispute. The article also offers a detailed commentary on Ricœur’s text, noting the unusual form of critique that it brings to bear on Rawls’s principles of justice. It also discusses Ricœur’s proposals for entrenching those principles in a concrete judicial practice. (shrink)

What kinds of evidence reliably support predictions of effectiveness for health and social care interventions? There is increasing reliance, not only for health care policy and practice but also for more general social and economic policy deliberation, on evidence that comes from studies whose basic logic is that of JS Mill's method of difference. These include randomized controlled trials, case–control studies, cohort studies, and some uses of causal Bayes nets and counterfactual-licensing models like ones commonly developed in econometrics. The topic (...) of this paper is the 'external validity' of causal conclusions from these kinds of studies. We shall argue two claims. Claim, negative: external validity is the wrong idea; claim, positive: 'capacities' are almost always the right idea, if there is a right idea to be had. If we are right about these claims, it makes big problems for policy decisions. Many advice guides for grading policy predictions give top grades to a proposed policy if it has two good Mill's-method-of difference studies that support it. But if capacities are to serve as the conduit for support from a method-of-difference study to an effectiveness prediction, much more evidence, and much different in kind, is required. We will illustrate the complexities involved with the case of multisystemic therapy, an internationally adopted intervention to try to diminish antisocial behaviour in young people. (shrink)

Survival after solid-organ transplantation has improved significantly, and many contemporary transplant recipients are of childbearing potential. There are limited data to guide decision-making surrounding pregnancy after transplantation, variations in clinical practice, and significant knowledge gaps, all of which raise significant ethical issues. Post-transplant pregnancy is associated with an increased risk of maternal and fetal complications. Shared decision-making is a central aspect of patient counselling but is complicated by significant knowledge gaps. Stakeholder interests can be in conflict; exploring these tensions can (...) help patients to evaluate their options and inform their deliberations. We argue that uniform, evidence-based recommendations for pregnancy after solid organ transplantation are needed. Conducting research, including patient-engaged studies, in this area should be priority for the transplant community. (shrink)

In this paper I argue for the use of Deleuzian theories in educational contexts. In particular, I am interested in the use of the concept of rhizomes, and the analysis of texts as rhizomes, drawing on Deleuze and Guattari's work in A Thousand Plateaus (1987). I discuss the possibilities for using rhizomatics in educational contexts through an exploration of the construction of an 'apparatus of social critique' (Buchanan, 2000). I then describe a rhizomatic understanding of the relationships between teachers and (...) policy texts, which can disrupt commonsense understandings of these relations. I provide examples from my own research (Honan, 2001) of a rhizo-textual analysis of policy texts. This rhizo-textual analysis involved an exploration of the construction of the subject position, teacher, within one policy text, as well as a mapping of two teachers' readings of this text. The paper concludes with a discussion of the implications for using Deleuzian theory in educational contexts, implications for both policy developers and educational researchers. (shrink)

Little is known about older persons’ expectancies (or anticipations) about the possible actions of home-care professionals, although such data have implications for the ethics of home care and home-care policies. From a longitudinal study of older women’s experience of home care, findings are reported concerning their expectancies of professional home-care providers. A descriptive phenomenological method was used to detail the structure of the experience and its context. Data were analyzed from a series of interviews with 13 women aged 82 to (...) 96 years. Among the five key structures of experience were ‘finding that someone has the job of helping me here’ and ‘determining where the helper’s field lies’. Two subsets within a category of expectancies were differentiated: speculations about helpers’ possible actions and expectancies about outcomes of helpers’ actions. As parameters of relational ethics, clients’ speculations and expectancies are appropriate bases for dialogue about older widows’ relationships with home-care professionals and the foci of home-care policies.
