In American philosophy at the end of the nineteenth century there was small interest in Empiricism and almost no interest in Realism.

Does thought have distinctive experiential features? Is there, in addition to sensory phenomenology, a kind of cognitive phenomenology--phenomenology of a cognitive or conceptual character? Leading philosophers of mind debate whether conscious thought has cognitive phenomenology and whether it is part of conscious perception and conscious emotion.

This article offers arefutation of the corrective justiceinterpretation of tort law – the view that itis essentially a system of corrective justice. It introduces a distinction between primary andsecondary tort duties and claims that tort lawis best understood as the union of its primaryand secondary duties. It then advances twoindependent criticisms of the correctivejustice interpretation. The article firstargues that primary tort duties have nothingfundamentally to do with corrective justice andthat, if one understands what is meant by``primary tort duties,'' one is (...) compelledto regard this fact as a decisive objection tothe corrective justice interpretation. Second,it argues that, whatever relation thereis between secondary tort duties and correctivejustice, that relation also holds betweencorrective justice and secondary duties ofother legal branches. In sum, the concept ofcorrective justice is neither capable ofunifying tort law nor of demarcating it fromother legal branches.The article also offers a general alternativeinterpretation of tort law. Rather thanbeing essentially corrective, tort law isessentially protective. Under this picture, iftort law has a most important point, it is theprotection of legal subjects and valuablesocial interests from harm. This is theoverarching ambition that unifies primary andsecondary tort duties. It does not, however,demarcate tort law from other legal branches. (shrink)

Even the most ardent defenders of a legal right to freedom of the press are likely to regard this right as having limitations; but how precisely the right should be limited is a matter of considerable disagreement. This issue is at least partly moral in character: it concerns the moral acceptability of laws which regulate or protect the activities of members of the press. I propose here to address this moral issue, and to do so within the broader framework of (...) considering whether establishing a legal right to freedom of the press—regardless of how it might be limited—is justifiable on moral grounds. In pursuing this investigation, I will devote special attention to familiar claims about the relation between press rights on the one hand, and “the people's right to know” on the other. (shrink)

It seems to me that, with an exception to be discussed presently, Hursthouse accomplishes the critical task which she sets for herself. She is particularly successful in pointing out how very complex the abortion issue is, and how the person view and utilitarianism overlook its complexities. Hursthouse notes that Thomson's position does not suffer from this latter shortcoming, but she also argues clearly and convincingly that the position should be rejected on other grounds—grounds pertaining primarily to various things Thomson says (...) about rights. Notwithstanding its many virtues, however, Hursthouse's critical discussion does strike me as problematic in a noteworthy respect. (shrink)

Arguments aimed at undermining certain accounts of the grounds of political obligations—no matter how successful they may be—fall far short of demonstrating that there are no such obligations. Doubts about the efficacy of these arguments in this latter regard seem even more justified when it is recognized that parallel lines of reasoning can be developed in the area of filial obligations , which arguments provide rather less than conclusive reasons for denying that there are filial obligations .Furthermore, we have good (...) reason to believe that there are political obligations if patriotism is a virtue, and also that patriotism is indeed a virtue. We therefore have a basis on which to affirm the existence of political obligations—a basis whose soundness is independent of the acceptability of particular accounts of the grounds of political obligation. Hence, even if standard accounts of the grounds of political obligations are problematic in certain respects, we should not regard this consideration as capable by itself of establishing that there are no such obligations. I recently read through the most recent 24 issues of Environmental Health Perspectives—the National Institutes of Health journal of, among other issues, scientific research into how environmental contaminants impact animal and human health. It is a catalog of horrors from a public health perspective. Fish and frogs with their sex scrambled; deformed frogs with altered hormone levels in their blood; a nearly threefold increase in birth defects among Minnesota farm children exposed to pesticides; 2,4-D exposure reducing hormone levels in men; (...) insignificant levels of four environmental chemicals adding up to a significant dose; a third study reconfirming a 50% sperm decline in U.S. men, 1934–1996; phthalates elevated in the blood of Puerto Rican girls developing breasts before they are 8; some 6,000 chemicals declared candidates for study as hormone disrupters ; children living near incinerators having delayed sexual development; hypospadias linked to organochlorine levels in the blood of mink, otter, and polar bears; and “No living organism may be considered DDT-free.” Nothing definitive, but it all suggests that things are tending in a direction that is perfectly awful. Freedom, Philosophy, and Faith: The Transformational Role of Freedom in the Thought of St. Augustine and St. Thomas Aquinas highlights the essential role freedom plays in the Catholic intellectual tradition. Montague Brown argues that that freedom, taken in its most essential form as understood by the Judeo-Christian tradition, has been transformative in all aspects of human thought, from metaphysics to politics.

What is given to us in conscious experience? The Given is an attempt to answer this question and in this way contribute to a general theory of mental content. The content of conscious experience is understood to be absolutely everything that is given to one, experientially, in the having of an experience. Michelle Montague focuses on the analysis of conscious perception, conscious emotion, and conscious thought, and deploys three fundamental notions in addition to the fundamental notion of content: the (...) notions of intentionality, phenomenology, and consciousness. She argues that all experience essentially involves all four things, and that the key to an adequate general theory of what is given in experience lies in giving a correct specification of the nature of these four things and the relations between them. The intellectual climate in which Aquinas matured was one of conflict. On the one hand, he inherited a philosophical tradition from the Greeks which held that "nothing comes from nothing." On the other, a strong theological tradition held that, since the world was created from nothing, it tends toward nothing and will, in fact, finally return to nothing. ;Aquinas counters that both traditions are mistaken in considering all making as change. Besides the making that is of this particular thing, besides (...) even the universal cause or causes of all generation, there is a more radical making which is of the totality of being. This doctrine we find implicit in the Five Ways, essentially established in the doctrine of essence and existence, and openly explicit in Aquinas's discussions of creation itself. ;That the universe is necessary in itself is no less firmly held by Aquinas. There are two kinds of being that are incorruptible: those whose form completely dominates their matter, and those whose form exists without matter. In addition, the universe of material things itself cannot be corrupted since it has no substratum which could underlie the change. Only by misconceiving the act of creation as change does it make sense to speak of a tendency or possibility to corruption in the created universe. ;The upshot of the marriage of these two positions is that the universe is at once absolutely necessary in itself and totally dependent for its existence on God. Rather than proving to be antagonists, these two positions are actually mutually supportive. Studying the natural world for its own sake reveals the power and perfection of its Creator. Since the world depends on a cause unexplained by the order within it, there is no limit to its ultimate intelligibility, nor, therefore, to the scientific quest. Endless awe at the Creator of such a universe, and an endless field of enquiry--these are the results of Aquinas's option for both and rather than either a created world or the integral, permanent world which science investigates.
