This article examines the complaint that arbitrary algorithmic decisions wrong those whom they affect. It makes three contributions. First, it provides an analysis of what arbitrariness means in this context. Second, it argues that arbitrariness is not of moral concern except when special circumstances apply. However, when the same algorithm or different algorithms based on the same data are used in multiple contexts, a person may be arbitrarily excluded from a broad range of opportunities. This article argues that the fact that an action will compound a prior injustice counts as a reason against doing the action. I call this reason The Anti-Compounding Injustice principle or aci. Compounding injustice and the aci principle are likely to be relevant when analyzing the moral issues raised by “big data” and its combination with the computational power of machine learning and artificial intelligence. Past injustice can infect the data used in algorithmic decisions in two distinct ways. Sometimes prior (...) injustice undermines the accuracy of the data itself. In these contexts, improving accuracy will also help to avoid compounding injustice. Other times, past injustice produces real-world differences among people with regard to skills, health, wealth, and other traits that employers, lenders, and others seek to measure. When decisions are based on accurate data that itself results from prior injustice, these decisions can also compound injustice. This second dynamic has received less attention than the first but is especially important because improving the accuracy of data will not mitigate this unfairness. (shrink)

Willful blindness is not an appropriate substitute for knowledge in crimes that require a mens rea of knowledge because an actor who contrives his own ignorance is only sometimes as culpable as a knowing actor. This paper begins with the assumption that the classic willfully blind actor—the drug courier—is culpable. If so, any plausible account of willful blindness must provide criteria that find this actor culpable. This paper then offers two limiting cases: a criminal defense lawyer defending a client he (...) suspects of perjury and a pain doctor who suspects his patient may be lying about her pain. The paper argues that each of these actors is justified in cultivating ignorance about his client’s or patient’s truthfulness. If this is right, then a good theory of willful blindness must distinguish these cases. The article argues that neither Husak & Callender’s motivation-based account of willful blindness nor the recklessness account is able to do so. The paper proposes the following alternative: contrived ignorance constitutes culpable blindness when the decision to remain blind or to cultivate blindness is not itself justified. This Justification approach meshes with our intuitions about willfully blind drug couriers as well as willfully blind lawyers and doctors. (shrink)

Bribery is an agreement to exchange something of value for an official act. According to the dominant view, bribery is wrong because this agreement violates the professional or positional duties of the official. This chapter argues that this duty-based account is flawed. Instead, the author argues that the key features of bribery, as compared to other sorts of exchanges, reside in the fact that goods or services of different types are exchanged.

The essays in this volume apply philosophical analysis to address three kinds of questions: What are the implications of genetic science for our understanding of nature? What might it influence in our conception of human nature? What challenges does genetic science pose for specific issues of private conduct or public policy?

In summary, Hellman’s book is well worth reading. It is powerful, well-written, and interesting and explains much of the prominent case law on discrimination. Her theory, however, is false because her explanation of wrongful discrimination fails to track a wrong-making feature. Her theory does not focus on a right-infringement in or unfair treatment of the person whom is discriminated against. It also does not focus on an incorrect attitude in the person who discriminates. These intuitively seem to exhaust the reasons (...) that make an act wrong because it wrongs someone. Her account of wrongful discrimination fails to identify the correct wrong-making feature. The present work is a systematic study of five frameworks or perspectives articulating mathematical structuralism, whose core idea is that mathematics is concerned primarily with interrelations in abstraction from the nature of objects. The first two, set-theoretic and category-theoretic, arose within mathematics itself. After exposing a number of problems, the book considers three further perspectives formulated by logicians and philosophers of mathematics: sui generis, treating structures as abstract universals, modal, eliminating structures as objects in favor of freely entertained logical possibilities, (...) and finally, modal-set-theoretic, a sort of synthesis of the set-theoretic and modal perspectives. How and why, historian of science Lily Kay asks, did the ‘biological problem of DNA-based protein synthesis’ come to be represented ‘as an information code and a writing technology?’ What sort of metaphor was ‘code’ for these bio-geneticists? One whose run-away expansion, Derrida noted in Of Grammatology (1967), urgently required philosophical justification. Yet, 60 years later, there is still fundamental disagreement about its meaning and epistemic status. If the metaphor lacks ontological purchase, what accounts for its effectiveness? If, on the (...) other hand, scriptural metaphors get at the common root of culture and biology, what do we now mean by ‘code’? In this article, I trace several influential accounts of the metaphor’s effectiveness—making explicit the opposing notions of ‘code’ that animate them—and argue that each is too limited. Greater attention to the metaphoricity of ‘code’ yields a more philosophically productive and critical account of the metaphor of code. (shrink)

Recent technical developments in the logic of nominalism make it possible to improve and extend significantly the approach to mathematics developed in Mathematics without Numbers. After reviewing the intuitive ideas behind structuralism in general, the modal-structuralist approach as potentially class-free is contrasted broadly with other leading approaches. The machinery of nominalistic ordered pairing (Burgess-Hazen-Lewis) and plural quantification (Boolos) can then be utilized to extend the core systems of modal-structural arithmetic and analysis respectively to full, classical, polyadic third- and fourthorder number (...) theory. The mathenatics of many structures of central importance in functional analysis, measure theory, and topology can be recovered within essentially these frameworks. (shrink)

Deborah Schiffrin looks at two important tasks of language--presenting 'who' we are talking about (the referent) and 'what happened' to them (their actions and attributes) in a narrative--and explores how this presentation alters in relation to emergent forms and meanings. Drawing on examples from both face-to-face talk and public discourse, she analyzes a variety of repairs, reformulations of referents, and retellings of narratives, ranging from word-level repairs within a single turn-at-talk, to life story narratives told years apart.

After some metatheoretic preliminaries on questions of justification and rational reconstruction, we lay out some key desiderata for foundational frameworks for mathematics, some of which reflect recent discussions of pluralism and structuralism. Next we draw out some implications (pro and con) bearing on set theory and category and topos therory. Finally, we sketch a variant of a modal-structural core system, incorporating elements of predicativism and the systems of reverse mathematics, and consider how it fares with respect to the desiderata highlighted (...) earlier. O êxodo rural brasileiro compreendeu um processo de grande magnitude desde o seu início, onde, em comparativo, poucos países experimentaram fluxo migratório tão intenso, tendo em vista a quantidade absoluta da população atingida. Uma das características encontradas nos movimentos migratórios brasileiros se estabelece na diferenciação por sexo. Estudos apontam que as mulheres migram mais do que os homens, além do fluxo migratório se caracterizar cada vez mais pela saída de jovens do campo. Nesse sentido, o presente artigo se propõe a (...) analisar a categoria rural, abordando a situação das mulheres migrantes no contexto do Norte de Minas. Para tanto, utilizará do levantamento bibliográfico na construção de uma revisão acerca das práticas migratórias do campo realizadas por jovens, de modo a entender e problematizar a questão do gênero no processo migratório. Como resultado parcial tem-se que as mulheres continuam migrando, sendo tal deslocamento realizado com propósitos variados e, muitas vezes, devido à ausência de políticas públicas regionais, que resultam em pouca perspectiva de valorização do campo/gênero. Sendo assim, o processo migratório, principalmente no que diz respeito à questão de gênero, não se encerra nas discussões apresentadas, sendo necessários estudos que acompanhem as distintas dimensões que o migrar implica. Philosophical aesthetics emerges out of eighteenth-century discussions of taste that paid scant attention to the experience of tasting and ingesting food. Sarah Worth diagnoses this historical oversight and offers an unexpected remedy. She argues that we should start our analysis of aesthetic taste over again, this time beginning with the pleasures of the tongue and mouth, and work out from there to consider the kinds of experience, knowledge, and appreciation that belong to eating and savoring. As she argues, our ability (...) to make gustatory discriminations and to determine what tastes good and why is not as different from our aesthetic judgments as philosophers and other aesthetic theorists might have led us to believe. In this engaging and readable book, Worth persuasively argues that food and its many tastes deserve serious philosophical consideration.Worth explores a number of puzzles that arise when we try to make sense of the concept of taste. She disentangles the metaphorical sense of taste understood as a reasoned judgment expressing aesthetic preferences from the literal sense of taste which involves our sensory experiences when food is in our mouths. She discusses good and bad taste, food and pleasure, authentic and inauthentic food, “food porn”—those impossibly glamourized images of food that we find in advertising and magazines and cookbooks and social media—and the role of recipes in the practice of cooking. She places our everyday experiences of food in the context of wider relationships and activities including cultivation, harvesting, processing, shipping, and purchasing, as well as the preparation and cooking meals for family and friends. The book is punctuated by many of the usual philosophical suspects (Plato and Aristotle, Hume and Kant, Bullough and Sibley) as well as critical and feminist theorists, food sociologists, and a number of famous chefs including Fannie Farmer, Julie Child, and Nigella Lawson. If Worth endorses a particular metaphilosophy of food, it would be that of the Slow Food movement, which is the subject of Chapter Three. (shrink)

In the social sciences and in everyday speech we often talk about groups as if they behaved in the same way as individuals, thinking and acting as a singular being. We say for example that "Google intends to develop an automated car", "the U.S. Government believes that Syria has used chemical weapons on its people", or that "the NRA wants to protect the rights of gun owners". We also often ascribe legal and moral responsibility to groups. But could groups literally (...) intend things? Is there such a thing as a collective mind? If so, should groups be held morally responsible? Such questions are of vital importance to our understanding of the social world. In this lively, engaging introduction Deborah Tollefsen offers a careful survey of contemporary philosophers? answers to these questions, and argues for the unorthodox view that certain groups should, indeed, be treated as agents and deserve to be held morally accountable. As one examines the tracts dealing with novae and comets in which reference is made to the nova of 1572 or the comet of 1577, it becomes quite evident that in different parts of Europe and in the Near East and at different periods of time and among men of different religious convictions different values were placed on his work. The extent of his (...) influence should be distinguished from the measure of his achievements. Moreover, his importance cannot be completely separated from that of Kepler and the horde of other writers who furnished more than a mere background for the display of Tycho's brilliance. This article investigates whether or not theories of justice from political philosophy, first, support the position that health research should contribute to justice in global health, and second, provide guidance about what is owed by international clinical research (ICR) actors to parties in low- and middle-income countries. Four theories—John Rawls's theory of justice, the rights-based cosmopolitan theories of Thomas Pogge and Henry Shue, and Jennifer Ruger's health capability paradigm—are evaluated. The article shows that three of the four theories require the (...) conduct of health research for justice in global health. The theories help identify the ends of justice to which ICR is to contribute, but they cannot tell us how to organize ICR to promote these ends. Aside from Ruger's health capability paradigm, the theories also lack an allocative principle for assigning specific duties to specific actors. This creates difficulties for establishing obligations for certain types of ICR actors. (shrink)

Community engagement to protect and empower participating individuals and communities is an ethical requirement in research. There is however limited evidence on effectiveness or relevance of some of the approaches used to improve ethical practice. We conducted a study to understand the rationale, relevance and benefits of community engagement in health research. This paper draws from this wider study and focuses on factors that shaped Community Advisory Group members’ selection processes and functions in Malawi. A qualitative research design was used; (...) two participatory workshops were conducted with CAG members to understand their roles in research. Workshop findings were triangulated with insights from ethnographic field notes, key informant interviews with stakeholders, focus group discussions with community members and document reviews. Data were coded manually and thematic content analysis was used to identify main issues. Results have shown that democratic selection of CAG members presented challenges in both urban and rural settings. We also noted that CAG members perceived their role as a form of employment which potentially led to ineffective representation of community interests. We conclude that democratic voting is not enough to ensure effective representation of community's interests of ethical relevance. CAG members’ abilities to understand research ethics, identify potential harms to community and communicate feedback to researchers is critical to optimise engagement of lay community and avoid tokenistic engagement.
