: As the fifth national bioethics commission has concluded its work and a sixth is currently underway, it is time to step back and consider appropriate measures of success. This paper argues that standard measures of commissions' influence fail to fully assess their role as public forums. From the perspective of democratic theory, a critical dimension of this role is public engagement: the ability of a commission to address the concerns of the general public, to learn how average citizens resolve (...) moral issues in healthcare, and to monitor public opinion on the topics addressed in the commission. Such a public forum role is supported by the critical literature within bioethics, which has deemed some commissions successful, supported more generally by the history of bioethics as a reform discourse that has brought socially important values into the medical domain, and supported more generally still by the example of the great social issues commissions of the 1960s. : In a 2004 article, we argued that bioethics commissions should be assessed in terms of their usefulness as public forums. A 2006 article by Summer Johnson argued that our perspective was not supported by the existing literature on presidential commissions, which had not previously identified commissions as public forums and that we did not properly account for the political functions of commissions as instruments of presidential power. Johnson also argued that there was nothing sufficiently unique about bioethics commissions to (...) make the public forum perspective particularly applicable. We respond by arguing that analysis of commissions' work as public forums fits well within the literature on commissions, especially on their agenda-setting functions, and that the political functions of commissions are often compatible with their functioning as public forums. We also demonstrate how the origins and concerns of bioethics make public forum analysis particularly applicable to bioethics commissions. (shrink)

Prior reports suggest that affective effects in visual word processing cannot be fully explained by a dimensional perspective of emotions based on valence and arousal. In the current study, we focused on the contribution of approach and avoidance motivational systems that are related to different action components to the processing of emotional words. To this aim, we compared frontal alpha asymmetries and brain oscillations elicited by anger words associated with approach motivational tendencies, and fear words that may trigger either avoidance, (...) approach or no action tendencies. The participants’ task was to make decisions about approaching or distancing from the concepts represented by words. The results of cluster-based and beamforming analyses revealed increased gamma power band synchronization for fear words relative to anger words between 725 and 750 ms, with an estimated neural origin in the temporal pole. These findings were interpreted to reflect a conflict between different action tendencies underlying the representation of fear words in semantic and emotional memories, when trying to achieve task requirements. These results are in line with the predictions made by the fear-hinders-action hypothesis. Additionally, current data highlights the contribution of motivational features to the representation and processing of emotional words. (shrink)

As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Finally, we set out a three-step process by which policy-makers may navigate the ethical and legal considerations at play. (shrink)

Liver transplantation (LT) activities during the COVID-19 pandemic have been curtailed in many countries. The impact of various policies restricting LT on outcomes of potential LT candidates is unclear. We studied all patients on the nationwide LT waitlists in Hong Kong and Singapore between January 2016 and May 2020. We used continuous time Markov chains to model the effects of different scenarios and varying durations of disruption on LT candidates.

The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, (...) and futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital (...) administrators seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. The ongoing digital transformation (DT) in our world has not only brought change to secular systems but also to how things are done in the mission and ministry of the Christian faith. Although before the coronavirus disease 2019 (COVID-19) pandemic, some churches were interacting with DT, the post COVID-19 experience has shown that many more Christian organisations, especially, the African Neo-Pentecostal Churches (ANPC), have carved their niche in the digital space. With South Africa and Nigeria in view, this article investigated (...) how the ANPC interacts with DT to improve missional work and the possible implications of doing so in the last 15 years. In the process, three strategies were applied. Firstly, a literature review and some online investigations were undertaken to articulate how the ANPC have engaged with DT in the past. Secondly, as a primary source, a quantitative empirical survey was conducted through data collection from 109 Neo-Pentecostal leaders to assess the current development in the use of digital technology (DTECH) by the ANPC. Thirdly, the article applied Albert Humphrey’s Strengths, Weaknesses, Opportunities and Threats (SWOT) framework to analyse the implications of the interaction. The outcome showed that the strengths and opportunities of digital interaction such as the wider and easier reach of audience, online training, online giving, improved sound and light technology and advertisements among others are helpful in missional assignments. Nevertheless, some observed Weaknesses and Threats need attention. Most importantly, the lesson from the findings is that ‘techno church’ practices come with gains; however, interaction with DT is not sufficient for missional services.Contribution: Aligning with HTS Teologiese Studies/Theological Studies’s focus and scope, this article contributed to an interdisciplinary religious aspect of research as it brought forward the interactions of African Pentecostalism, Historical Theology and Information Technology. Against the background of intellectual and political debates in France during the 1950s and 1960s, Daniel Just examines literary narratives and works of literary criticism arguing that these texts are more politically engaged than they may initially appear. As writings by Roland Barthes, Maurice Blanchot, Albert Camus, and Marguerite Duras show, seemingly disengaged literary principles - such as blankness, minimalism, silence, and indeterminateness - can be deployed to a number of potent political and ethical ends. At the time (...) the main focus of this activism was the escalation of violence in colonial Algeria. The poetics formulated by these writers suggests that blankness, weakness, and withdrawal from action are not symptoms of impotence and political escapism in the face of historical events, but deliberate literary strategies aimed to neutralize the drive to dominate others that characterized the colonial project. Traditional human–computer interaction (HCI) allowed researchers and practitioners to share and rely on the ‘five E’s’ of usability, the principle that interactive systems should be designed to be effective, efficient, engaging, error tolerant, and easy to learn. A recent trend in HCI, however, is that academic researchers as well as practitioners are becoming increasingly interested in user experiences, i.e., understanding and designing for relationships between users and artifacts that are for instance affective, engaging, fun, playable, sociable, creative, involving, meaningful, exciting, (...) ambiguous, and curious. In this paper, it is argued that built into this shift in perspective there is a concurrent shift in accountability that is drawing attention to a number of ethical, moral, social, cultural, and political issues that have been traditionally de-emphasized in a field of research guided by usability concerns. Not surprisingly, this shift in accountability has also received scarce attention in HCI. To be able to find any answers to the question of what makes a good user experience, the field of HCI needs to develop a philosophy of technology. One building block for such a philosophy of technology in HCI is presented. Albert Borgmann argues that we need to be cautious and rethink the relationship as well as the often-assumed correspondence between what we consider useful and what we think of as good in technology. This junction—that some technologies may be both useful and good, while some technologies that are useful for some purposes might also be harmful, less good, in a broader context—is at the heart of Borgmann’s understanding of technology. Borgmann’s notion of the device paradigm is a valuable contribution to HCI as it points out that we are increasingly experiencing the world with, through, and by information technologies and that most of these technologies tend to be designed to provide commodities that effortlessly grant our wishes without demanding anything in return, such as patience, skills, or effort. This paper argues that Borgmann’s work is relevant and makes a valuable contribution to HCI in at least two ways: first, as a different way of seeing that raises important social, cultural, ethical, and moral issues from which contemporary HCI cannot escape; and second, as providing guidance as to how specific values might be incorporated into the design of interactive systems that foster engagement with reality. Initially seen as a simple master mariner (...) or at most as a technical device, a way to get a tale told, with the work of Albert Guérard he began to receive his due, becoming lionized as the true subject at least of Heart of Darkness, and of more than technical interest in the other stories. 1 In recent years, however, his reputation has slumped hard as his racism and sexism have come to the fore. In this article, I attempt no full-scale rehabilitation but simply point out that, despite his failings, Marlow possesses a virtue worth remarking and that his failings involve a failure to extend that virtue far enough.I call that virtue attentiveness, and more specifically, attentiveness to the other. It has been neglected, at least by philosophers, although as a virtue it is utterly obvious. This is not surprising. The moral life is generally the sphere of the obvious and progress here often consists merely in noting what has been overlooked. The presence or absence of this virtue is revealed less by what the agent feels or doesn't feel or does or doesn't do than by her stance or orientation toward others. And as orientations are slippery things to describe (and this one more than most) there is an advantage in looking at literary characters: they show palpably the virtue (or corresponding vice) at issue. My focus in this [End Page 318] article is the forms that Marlow's tales (particularly Lord Jim and Heart of Darkness) show attentiveness to the other can take—and fail to take—in a human life. II Let's begin with Marlow's sexism, and specifically as manifested in his lie to Kurtz's Intended. She asks for Kurtz's final words, and Marlow replies not "The horror! The horror!" but "The last words he pronounced was—your name" (HD, p. 161). 2 Marlow says that the truth "would have been too dark, too dark altogether" (p. 162). But what doesn't Marlow want the Intended to know? That her beloved went mad in the jungle, became evil? And why shouldn't she know this? Because it would bring her pain? But Marlow insists that the Intended has "a mature capacity" for suffering (p. 157; a capacity to handle it, presumably, not a proneness to it). Anyway, Marlow's lie will perpetuate suffering, her mourning for her image of Kurtz: smash her idol and she might be able to get on with her life. In any event, the issue of suffering does not explain why the truth is "too dark."Marlow does not class the Intended as "one of us" (LJ, p. 43). This is the phrase he, like Conrad, uses to characterize Jim in Lord Jim. It is usually taken to refer to national or racial identity or perhaps to membership in the merchant service. However, the phrase also has a biblical resonance. Genesis 3:22 says, "Behold, the man has become like one of us, knowing good and evil." The philosophies of Søren Kierkegaard and Albert Camus have typically been considered as inverted images of each other. Kierkegaard turns to faith in God as a path of redemption from meaninglessness while Camus rejects faith as a form of intellectual suicide and cowardice. I argue that an analysis of key terms of contest—faith and lucidity, revolt and suicide, Abraham and Sisyphus, despair and its overcoming—serves to blur the lines of contrast, making Kierkegaard and Camus much closer in their views (...) of what sort of life we should live in face of the forsakenness of our condition than they seem at first glance. Aristotelian commenters have long noted an apparent contradiction between what Aristotle says in Posterior Analytics I.2 and Physics I.1 about how we obtain first principles of a science. At Posterior 71b35–72a6, Aristotle states that what is most universal (καθόλου) is better-known by nature and initially less-known to us, while the particular (καθ’ ἕκαστον) is initially better-known to us, but less-known by nature. At Physics 184a21-30, however, Aristotle states that we move from what is better-known to us, which is universal (καθόλου), (...) to what is better-known absolutely, which is particular (καθ’ ἕκαστον). This paper turns to two of Aristotle’s most notable medieval commentators—Albertus Magnus and Thomas Aquinas—to resolve this apparent contradiction. The key to Thomas and Albert’s solutions, we will argue, is a twofold distinction between a sense-perceptive and scientific universal, and the particulars as sensed individuals and as differentiating attributes. Our Synthetic treatment of these distinctions contributes to the ongoing scholarly effort to understand the Stagyrite’s complex theory of knowledge. (shrink)

Proponents of "Asian values" argue that it is a distinctive product of the Western experience and that Western powers shouldn't try to push human rights and democracy onto Asian states. Liberal democrats in the West typically counter by questioning the motives of Asian critics, arguing that Asian leaders are merely trying to rationalize human-rights violations and authoritarian rule. In this book--written as a dialogue between an American democrat named Demo and three East Asian critics-- (...) class='Hi'>Daniel A. Bell attempts to chart a middle ground between the extremes of the international debate on human rights and democracy.Bell criticizes the use of "Asian values" to justify oppression, but also draws on East Asian cultural traditions and contributions by contemporary intellectuals in East Asia to identify some powerful challenges to Western-style liberal democracy. In the first part of the book, Bell makes use of colorful stories and examples to show that there is a need to take into account East Asian perspectives on human rights and democracy. The second part--a fictitious dialogue between Demo and Asian senior statesman Lee Kuan Yew--examines the pros and cons of implementing Western-style democracy in Singapore. Is liberal democracy appropriate for East Asia? In this provocative book, Daniel Bell argues for morally legitimate alternatives to Western-style liberal democracy in the region. Beyond Liberal Democracy, which continues the author's influential earlier work, is divided into three parts that correspond to the three main hallmarks of liberal democracy--human rights, democracy, and capitalism. These features have been modified substantially during their transmission to East Asian societies that have been shaped by nonliberal practices and values. Bell points to the (...) dangers of implementing Western-style models and proposes alternative justifications and practices that may be more appropriate for East Asian societies. With over three billion people currently living below the poverty line, finding better ways to lift people out of poverty is a concern of scholars from a range of disciplines. Within Management Studies, the focus is on developing market-based solutions to poverty alleviation through Bottom/Base-of-the-Pyramid initiatives. To date, these have enjoyed limited success, sometimes even exacerbating the problems they attempt to solve. As a result, there is a growing academic and practitioner push for a third iteration—BoP 3.0—that moves closer to (...) a sustainable development model of poverty alleviation. Through a grounded theory study of 21 Philippines-based organizations implementing poverty alleviation initiatives at the community level, this paper seeks to add to the existing suite of tools and guidance in the BoP field. It does so by questioning how these organizations approach the development and implementation of market-based approaches to poverty alleviation. Our results suggest that these organizations adopt a more community-centric approach, focusing on the creation of a self-reliant community before all else. We find this to be the result of a deeper understanding of the drivers of poverty in the communities they work with. Through the extrapolation of key themes and issues in our data, we propose a new conceptual model for building BoP 3.0 initiatives. This model consists of three intertwined theoretical dimensions: understanding issues as matters of concern; identifying limitations; and navigating time. These elements are linked by three active phases that allowed the organizations to move from one dimension to the next: sensemaking; entrainment; and investment. (shrink)

Claims pertaining to understanding are made in a variety of contexts and ways. As a result, few in the philosophical literature have made an attempt to precisely characterize the state that is y understanding x. This paper builds an account that does just that. The account is motivated by two main observations. First, understanding x is somehow related to being able to manipulate x. Second, understanding is a mental phenomenon, and so what manipulations are required to be an understander must (...) only be mental manipulations. Combining these two insights, the paper builds an account (URM) of understanding as a certain representational capacity—specifically, understanding x involves possessing a representation of x that could be manipulated in useful ways. By tying understanding to representation, the account correctly identifies that understanding is a fundamentally cognitive achievement. However, by also demanding that which representations count as understanding-conferring be determined by their practical effects, URM captures the insight that understanding is vitally connected to practice. URM is fully general, and can apply equally well to understanding states of affairs, understanding events, and even understanding people and works of art. The ultimate test of URM is its applicability in actual scientific and philosophical discourse. To that end the paper discusses the importance of understanding in the philosophy of science, psychology, and computer science. (shrink)

Mechanistic explanation has an impressive track record of advancing our understanding of complex, hierarchically organized physical systems, particularly biological and neural systems. But not every complex system can be understood mechanistically. Psychological capacities are often understood by providing cognitive models of the systems that underlie them. I argue that these models, while superficially similar to mechanistic models, in fact have a substantially more complex relation to the real underlying system. They are typically constructed using a range of techniques for abstracting (...) the functional properties of the system, which may not coincide with its mechanistic organization. I describe these techniques and show that despite being non-mechanistic, these cognitive models can satisfy the normative constraints on good explanations. (shrink)

Responses to these criticisms have primarily come from philosophers who make use of the traditional, and problematic, concept of God. In this volume, Daniel A. Dombrowski defends the ontological argument against its contemporary critics, but he does so by using a neoclassical or process concept of God, thereby strengthening the case for a contemporary theistic metaphysics. Relying on (...) the thought of Charles Hartshorne, he builds on Hartshorne's crucial distinction between divine existence and divine actuality, which enables neoclassical defenders of the ontological argument to avoid the familiar criticism that the argument moves illegitimately from an abstract concept to concrete reality. In this article we focus on three key precepts shared by Confucianism and the African ethic of Ubuntu: the central value of community, the desirability of ethical partiality, and the idea that we tend to become morally better as we grow older. For each of these broad similarities, there are key differences underlying them, and we discuss those as well as speculate about the reasons for them. Our aim is not to take sides, but we do suggest ways that Ubuntu (...) and Confucianism might have something to learn from each other and perhaps come closer. We hope that our preliminary reflections can inspire further debate and thinking on a theme – dialogues between long-standing and large-scale non-Western traditions – that is bound to increase in importance as non-Western societies play a greater role in the global system and as the search continues for a 'global ethic'. For much of the twentieth century, Confucianism was condemned by Westerners and East Asians alike as antithetical to modernity. Internationally renowned philosophers, historians, and social scientists argue otherwise in Confucian Political Ethics. They show how classical Confucian theory--with its emphasis on family ties, self-improvement, education, and the social good--is highly relevant to the most pressing dilemmas confronting us today. What is understanding? My goal in this paper is to lay out a new approach to this question and clarify how that approach deals with certain issues. The claim is that understanding is a matter of compressing information about the understood so that it can be mentally useful. On this account, understanding amounts to having a representational kernel and the ability to use it to generate the information one needs regarding the target phenomenon. I argue that this ambitious new account (...) can accommodate much of the data that has motivated theories of understanding in philosophy of science, and can also be generally applicable in epistemology and daily life as well. In this paper, I argue that explanations just ARE those sorts of things that, under the right circumstances and in the right sort of way, bring about understanding. This raises the question of why such a seemingly simple account of explanation, if correct, would not have been identified and agreed upon decades ago. The answer is that only recently has it been made possible to analyze explanation in terms of understanding without the risk of collapsing both to merely phenomenological states. (...)
