El ensayo siguiente consiste en una reinterpretación de la obra de Frantz Fanon a partir de la problemática biopolítica iniciada por Michel Foucault. Se analizan los procesos a través de los cuales las vidas de los colonizados se determinan como inhumanas, y se insertan dentro de un "lenguaje de pura violencia", es decir de una red de poderes violentos, soberanos y totalizantes. Fanón va a pensar una puesta en jaque de aquel estado de excepción permanente colonial a partir de la (...) violencia misma, ya que se tratara para él de transformar, sobre la práctica de las luchas, la violencia en ejercicio del descubrimiento de la verdad. In this essay we approach Franz Fanon's work from a biopolitical standpoint as initiated by Michel Foucault. We analyze the processes that lead to the notion of colonized people's life as less than human with a "language of pure violence", that is, within a network of violent powers at the same time sovereign and totalizing. Fanón intends to check that permanent "state of emergency" of the colonies by means of violence itself, since fighting can be transformed from violence alone to the fight for the discovery of truth. To be Black means to have ancestors whose humanity has been de-nied by slavery, colonialism, neo-colonialism, and segregation, as well as by many theories elaborated in order to justify and intensify these modes of domination. To be Black also means having to face the enduring legacies of these systems and theories, which predomi-nantly manifest through overexposure to violence and death. Today, premature death and habituation to loss remain constitutive fea-tures of Black experience. Dignity, often de????ined as the inherent value of (...) every single human being, has been a core concept in ethics since Kant, at least. But in both philosophy and modern politics, the claim of respect for the dignity of people has coexisted with deep antiblack-ness. However, apart from the Western understanding of dignity stands another tradition. The concept of dignity is pervasive in Black radicalism, Caribbean philosophy, and African thought since the 18th century. This article draws inspiration from the legacy of these thinkers to elaborate an ethics centred on the speci????icities of racial-ized life. (shrink)

La pensée « afropessimiste»s’inspire d’Hortense Spillers pour mesurer les conséquences de la soustraction des Noirs aux ordres de l’humanité et de la subjectivité politique, en une violence qui convertit les vies africaines en chair. Le poète et théoricien africain américain Fred Moten revisite aujourd’hui ces pensées en inventant (...) un « optimisme noir », qui entend faire valoir l’ambivalence et l’ambiguïté de la noirceur, soulignant ses potentialités particulières et désignant dans « la chair » une possibilité de formuler de nouvelles formes de vie. S’il mobilise plusieurs penseurs marxistes, Lénine est à la fois celui pour lequel il témoigne le plus d’intérêt et celui qu’il condamne le plus radicalement. Admiré pour sa notion de dictature du prolétariat, craint pour sa conception de l’ennemi, c’est finalement son internationalisme radical et sa potentielle adoption par les peuples colonisés qui constituent le scandale de la pensée de Lénine. Dans la continuité de leurs travaux communs des années 1980, Ernesto Laclau et Chantal Mouffe ont développé parallèlement une nouvelle théorie du populisme. Cet article la définit comme une double ontologie du politique, qui fait droit à la fois à l’inimitié, ou dimension dissociative, et à la délibération, ou dimension associative du politique. Pour distinguer leur approche des populismes de droite, Laclau et Mouffe recourent à un anti-essentialisme intransigeant qui écarte l’histoire des éléments décisifs pour la construction d’un sujet politique. (...) Ce faisant, ils assimilent les mouvements anticoloniaux et antiracistes conséquents au conservatisme ou à la réaction. Une insuffisante problématisation de la question raciale et du militantisme antiraciste, souvent invoqué mais jamais analysé par les auteurs, sont à la source de ces confusions. Cela exige une reformulation du populisme de gauche dont la question du pluralisme pourrait fournir le point de départ. (shrink)

S’inscrivant dans le champ des Black Male Studies, cet article montre comment les hommes non blancs sont souvent les grands oubliés des luttes abolitionnistes, et ce alors mêmes qu’ils représentent l’écrasante majorité des personnes incarcérées. Détaillant les raccourcis ou les omissions qui grèvent certains textes de la justice transformatrice, ce texte rappelle ainsi que l’abolition requiert un changement radical d’imaginaire, et qu’elle ne peut se faire sans se confronter à la misandrie raciale.

Cet article introduit l’hypothèse de l’oppression nécropolitique des sans-abris. Nous partons d’une analyse métaphorologique de propos tenus par les sans-abris sur leurs conditions d’existence, souvent décrites comme impliquant l’expérience vécue paradoxale d’une indifférenciation tendancielle entre la vie et la mort. Nous essayons de conceptualiser le contenu de ces descriptions en faisant appel au concept de nécropolitique développé par Norman Ajari dans le contexte des études critiques de la race. La nécropolitique sera comprise ici comme un idéal-type de gouvernance (...) de la vie ne se réduisant ni à la biopolitique, ni à la thanatopolitique, mais visant plutôt à brouiller les frontières qui séparent la mort de la vie. La nécropolitique est ce qui rend la vie quotidienne des sans-abris proprement invivable, aboutissant à cette vie vécue sous forme-de-mort dont font état les témoignages de certaines personnes sans-abri.This article introduces the hypothesis of the necropolitical oppression of the homeless. We begin with a metaphorological analysis of the discourses held by certain homeless persons regarding their conditions of existence, often described as involving the paradoxical experience of a tendential undifferentiation of life and death. We then build on the concept of necropolitics elaborated by Norman Ajari in the context of critical race theory. Necropolitics will be understood here as an ideal-type of the governance of life reducible neither to biopolitics nor to thanatopolitics. Instead, the rationality of necropolitics as a form of oppression consists in constantly blurring the frontiers of life and death. In the case of the homeless, necropolitics is rendering their everyday life literally unlivable, an experience reflected in the analyzed testimonies of homeless persons. (shrink)

Healthcare (including public health) is special because it protects normal functioning, which in turn protects the range of opportunities open to individuals. I extend this account in two ways. First, since the distribution of goods other than healthcare affect population health and its distribution, I claim that Rawls's principles of justice describe a fair distribution of the social determinants of health, giving a partial account of when health inequalities are unjust. Second, I supplement a principled account of justice for health (...) and healthcare with an account of fair process for setting limits or rationing care. This account is provided by three conditions that comprise "accountability for reasonableness.". (shrink)

In this article I use Kantian moral philosophy to develop a concept of meaningful work. Specifically, a Kantian would argue that work is meaningful if (1) it is freely entered into, (2) it allows the worker to exercise her autonomy and independence, (3) it enables the worker to develop her rational capacities, (4) it provides a wage sufficient for physical welfare, (5) it supports the moral development of employees and (6) it is not paternalistic. I then provide examples of contemporary (...) management practices that provide meaningful work in this sense. (shrink)

The rapidly increasing numbers of elderly people in our society have raised some important moral questions: How should we distribute social resources among different age groups? What does justice require from both the young and the old? In this book, Norman Daniels offers the first systematic philosophical discussion of these urgent questions, advocating what he calls a "lifespan" approach to the problem: Since, as they age, people pass through a variety of institutions, the challenge of caring for the elderly (...) becomes the prudent allocation of public resources among the various stages of people's lives. Using this philosophical approach, Daniels addresses specific public policy issues such as the allocation of medical funds, the adequacy of long-term care, current Medicare cost-containment measures, and the equitable distribution of income support over the lifespan and between generations. Applied a theory of information integration to decision making with probabilistic events. 10 undergraduates judged the subjective worth of duplex bets that included independent gain and lose components. The worth of each component was assumed to be the product of a subjective weight that reflected the probability of winning or losing, and the subjective worth of the money to be won or lost. The total worth of the bet was the sum of the worths of the 2 components. Thus, each (...) judgment required multiplying and adding operations. The multiplying model worked quite well in 4 experimental conditions. The adding model showed more serious discrepancies, though these were small in magnitude. The theory of functional measurement was applied to scale the subjective values of the probability and money stimuli. Subjective and objective values were nonlinearly related both for probability and for money. (shrink)

Most economists are committed to some version of egoism. After distinguishing among the various sorts of egoistic claims, l cite the empirical literature against psychological egoism and show that attempts to account for this data make these economists' previous empirical claims tautological. Moreover, the assumption of egoism has undesirable consequences, especially for students; if people believe that others behave egoistically, they are more likely to behave egoistically themselves. As an alternative to egoism I recommend the commitment model of Robert Frank. (...) The equivalent of egoism at the organizational level is that business firms seek (should seek) to maximize profits. I present arguments to show that a conscious attempt by managers to maximize profits is likely to fail. A committed altruism is more likely to raise profits. I suggest that a firm should take as its primary purpose providing meaningful work for employees. (shrink)

Agency theory involves what is known as the principal-agent problem, a topic widely discussed in economics, management, and business ethics today. It is a characteristic of nearly all modern business firms that the principals (the owners and shareholders) are not the same people as the agents (the managers who run the firms for the principals). This creates situations in which the goals of the principals may not be the same as the agents--the principals will want growth in profits and stock (...) price, while agents may want growth in salaries and positions in the hierarchy. Many societies, and nearly all wealthy, developed countries, provide universal access to a broad range of public health and personal medical services. Is such access to health care a requirement of social justice, or is it simply a matter of social policy that some countries adopt and others do not? If it is a requirement of social justice, we should be clear about what kinds of care we owe people and how we determine what care is owed if we cannot (...) possibly meet every health need, as arguably no society can. We should be clear about what constitutes appropriate access to that care, given that there are diverse barriers to access. We must also be able to say why we owe these things as a matter of justice, and, of course, different accounts of social justice will bake and serve this cake in different ways. (shrink)

How can health plans make fair determinations about when “experimental” (and costly) treatments such as high dose chemotherapy with autologous bone marrow transplantation should be covered despite lack of clear clinical consensus about their benefits? Different models for managing “last chance” therapies evolving in some health plans offer promising examples of how issues of fairness and legitimacy in decisionmaking can be addressed.

Arnauld's criticisms as "a model of confusion confounded.” In a review of Wilson's book, R. McRae refers to "the difficult and not too coherent subject of material falsity. '' J. Cottingham describes the Descartes-Arnauld debate on the material falsity of adventitious ideas as "an involved and rather inconclusive exchange " and claims that the example of the material falsity of such ideas espoused by Descartes in Meditation III is "needlessly complicated. " A. Kenny, in turn, notes that several things are (...) "confusing in Descartes' account of false ideas. " Later reference is made to the fact that "Descartes appears confused. [...] and that "Descartes, it seems, cannot give a consistent answer. '' As will become clear, I take issue with each of these assessments. When Descartes' position on material falsity is understood in the light of late Scholastic sources, especially Suarez, whence it draws its strength and inspiration, the alleged confusion and incoherency vanishes. .. There is a hoary tradition in moral philosophy that assumes we cannot determine which moral theory is acceptable or correct unless we have available a correct theory of human nature, or, in its more modern form, of the person. With such a theory of the person, however, we could at least narrow down the choice among competing ethical theories. A more recent tradition, at least in one of its standard interpretations, agrees it would be necessary to have a correct theory (...) of the person before we could determine an acceptable moral theory, but it denies there is a determinate nature of the person to be captured in such a theory. The plasticity of the person, according to this strand of Marxist theory, rules out the possibility of there being universal moral theory at all. In this paper, I would like to explore a view that treads an intermediate path. It agrees with the Marxist denial that there is a determinate nature of the person, a deep fact of the matter, that can be abstracted from the social matrix and made the subject of a theory of the person. And, it agrees with both traditions that moral theory depends on and embodies a theory of the person. But, by making the problem of arriving at an acceptable view of the person itself something that depends on overall theoretical considerations, including moral ones, the intermediary, view may be able to avoid the type of moral relativism associated with the Marxist view.
