This paper aims to analyze the metaphorological project of Hans Blumenberg in relation to the philosophical developments of conceptual history in the mid-twentieth century. It is argued that Blumenberg, based on the study of metaphor, seeks to endow philosophy with a historical substrate that gives rise to the concept, forgotten by the inheritance of the cartesian philosophy. In this way, metaphors, but also myths and anecdotes, fulfill a pragmatic guiding function of thought and expe- rience, becoming indispensable for human life.

Some properties and an algorithm for solving systems of multivariate polynomial equations over finite fields are presented. It is then shown how formulas of propositional logics can be translated into polynomials over finite fields in such a way that several logic problems are expressed in terms of algebraic problems. Consequently, algebraic properties and algorithms can be used to solve the algebraically-represented logic problems. The methods described herein combine and generalise those of various previous works.

RESUMEN Se analiza si la versión de la justicia como equidad, presentada en El liberalismo político, es genuinamente una concepción política. Se examina el problema de la razonabilidad de las doctrinas comprehensivas, y se indaga luego si el argumento en dos etapas afecta la integridad estructural del liberalismo político. Se concluye que J. Rawls fracasa en su intento de justificar un liberalismo independiente de una doctrina comprehensiva de carácter liberal. ABSTRACT The article analyzes whether the conception of justice as fairness, (...) set forth by Rawls in Political Liberalism, is a genuine political conception. It first examines the issue of reasonableness of comprehensive doctrines and then goes on to inquire whether the two-step argument affects the structural integrity of political liberalism. Se propone una reflexión filosófica sobre el imperativo ético y político de pensar y reconstruir nuestro pasado a partir de la experiencia del sujeto latinoamericano oprimido y resistente. En este orden de ideas, el objetivo principal del artículo es emprender una búsqueda de aquellos lugares en los que habitan y se conservan en el tiempo las memorias de los latino-americanos antes y después del proceso de colonización o de “invasión” de la Modernidad europea. Esta indagación se inclina específicamente hacia esas (...) memorias “no oficiales”, construidas desde las comunidades en sus prácticas culturales, que mediante la rememoración y la tradición oral crearon vínculos de resistencia contra el olvido, al tiempo que preservaban aspectos fundamentales de sus tradiciones. Así, llamamos lugares a aquellos elementos que albergan fragmentos de lo pretérito invisibilizado por el discurso histórico oficial y que permiten establecer un vínculo trascendente entre pasado y presente, una recreación del pasado que surge a partir de la reconstrucción interpretativa de ruinas, rastros y vestigios de un tiempo que no ha dejado de ser y al que aún es posible acceder y conocer. Posteriormente, se destacan algunos episodios importantes de nuestra historia latinoamericana en los que esas memorias encuentran su lugar. (shrink)

The following article will examine three argumentative strategies to address a recent topic of debate in the philosophy of religion known as the “Gap Problem.” It aims to study the “Stage II” of cosmological arguments, where the goal is to establish the theistic properties or attributes that identify the first cause or necessary being with the concept of God. The unique contribution of this study lies in the formalized and systematic presentation of the various solutions proposed by authors in the (...) philosophical field, synthesizing their central ideas and presenting them in the form of arguments. I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. Considering the case of Juan de Vilanova y Piera, often celebrated as the first scientist to accept the prehistoric antiquity of palaeolithic paintings, we explore some of the problems related to the concept of ‘precursor’ in the field of the history of science. In the first section, we propose a brief history of this notion focusing on those authors who have reflected critically on the meaning of predecessors. In the second section, the example of Vilanova illustrates the ways in which (...) historians of science have created precursors. From the vantage of modern science, precursors have traditionally been defined as those who first indicated or announced ideas or theories later accepted by the scientific community. As a result, they have been represented as ‘heroes’ struggling hard to defeat the ignorance of their time. As the case of Juan de Vilanova illustrates, this traditional view is unsatisfactory in many ways. For this reason we consider in the third section a number of methodological strategies to promote a more adequate approach to pioneers. In particular, we suggest that the best way to surmount hagiographical approaches to past scientists is to put them in their own intellectual and historical contexts. (shrink)

I argue against the Standard View of ignorance, according to which ignorance is defined as equivalent to lack of knowledge, that cases of environmental epistemic luck, though entailing lack of knowledge, do not necessarily entail ignorance. In support of my argument, I contend that in cases of environmental luck an agent retains what I call epistemic access to the relevant fact by successfully exercising her epistemic agency and that ignorance and non-ignorance, contrary to what the Standard View predicts, are not (...) modal in the sense that knowledge is. After responding to objections, I conclude by sketching an alternative account of ignorance centered on the notions of epistemic access and epistemic agency. (shrink)

Arguments analogous to those found in the late medieval theory of the king’s two bodies, popularized by Ernst Kantorowicz, were resurrected in early nineteenth-century constitutional theories of the moderating powers of monarchy. Post-revolutionary French liberal thought, echoed by its Portuguese counterpart, rediscovered the virtues of the institution of royalty, notably the immaterial and immortal body of the king. This rediscovery was prompted by the uncertainties of different national political contexts which made many contemporaries believe it desirable to integrate restored monarchies (...) within modern constitutional models for state stability. This first occurred with the Bourbons’ return to post-Napoleonic France and the restoration of the monarchy in 1814, and then with the Braganza royal family’s return to Portugal in 1821 after thirteen years of rule from Brazil. Using arguments similar to those previously made in late medieval European political and legal thought, French and Portuguese liberals developed a theory of the king’s two powers, according to which the monarch at once exercised a moderating power, defined by the abstract institutional nature of the king’s person, and an executive power, embodied within his physical person. This conceptualization of royal duality was intended to make it possible to delegate executive power to ministers, leaving the king only the attributes of a largely symbolic power. Liberals thereby hoped to confine the monarch to his purely institutional body in a de-politicized constitutional role. (shrink)

The aim of this paper is to show that we are entitled to see in Schütz’s article “Equality and the Social Meaning Structure” the proposal for a formal analysis of group membership understood as a kind of We-experience irreducible to pure We-relationships. First I argue that such an account defines the experience of group membership as a “situation definition process”. Then I show the relevance of this approach for the description of membership experiences and current debates on Collective Intentionality. Finally, (...) I point to its unclarified conceptual presuppositions—such as the at­tribution of situations to groups—, and propose an interpretative solution by drawing on the notions of “social situation” and community of relevances from The Structures of the Life-World. In attempting to debunk moral realism through an appeal to evolutionary facts, debunkers face a series of problems, which we label the problems of scope, corrosiveness, and post‐hoc justification. To overcome these problems, debunkers must assume certain metaphysical or epistemological positions, or otherwise pre‐establish them. In doing so, they must assume or pre‐establish the very conclusion they seek in advancing the argument. Las aproximaciones teológicas a partir del pluralismo religioso y la doble creencia religiosa, podrán generar la comprensión de la afiliación religiosa en creencias religiosas propias para el contexto tomando como referencia la fe del pueblo discernida. Entre las críticas de los más férreos oponentes de la teoría kuhniana de la ciencia sobresale un reparo que fue planteado simultáneamente tanto por Popper, como por su discípulo Watkins. Ambos filósofos sostuvieron que, si nos comprometemos con la tesis que afirma que hay Ciencia Normal, tendríamos que aceptar la consecuencia absurda de que las teorías científicas degeneran en dogmas. En este trabajo mostraré que la tesis de Kuhn no tiene las implicaciones desastrosas atrás señaladas y que Popper -y Watkins- (...) ofrecen una imagen increíblemente distorsionada de la naturaleza misma de la Ciencia Normal y de los paradigmas, a tal punto que las razones en las cuales Popper basa la acusación de dogmatismo dependen de un argumento defectuoso. Para ello, voy a contrastar los patrones históricos que Kuhn identifica en los episodios de Ciencia Normal, con las características que le atribuyen sus críticos. Argumentaré, a partir de las contribuciones de Hooke a la mecánica clásica, que no es cierto que uno de los atributos que distingue a los “científicos normales” sea la adhesión doctrinaria, i.e., que el científico normal está obligado a suscribir una teoría por moda o por autoridad. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

Reconstruction is a central notion in Dewey’s account of inquiry and in his metaphilosophical commitments. In his work, Dewey made a call for reconstruction of philosophy, in the reconstruction of central notions of the discipline, like knowledge, logic, truth, the good, reason, and experience. Inquiry itself is reconstructive, according to Dewey, involving the transformation of an indeterminate situation into one which is determinate and understood. Dewey’s philosophical views should therefore be of interest to those taking part in the recent turn (...) towards revisionary philosophical methodologies, like conceptual engineering, explication, and amelioration. In light of the recent developments in revisionary methodologies, I aim to explore Dewey’s conception of concepts in relation to the conceptual engineering literature, suggesting that it provides a useful conception of concepts for conceptual engineering, and to suggest a Deweyan model of philosophical inquiry where concepts are the objects of inquiry. In both cases, I hope to show a productive interaction between Dewey’s ideas and contemporary discussions of conceptual engineering. (shrink)

Em contraste com essa crítica, o presente trabalho defende a tese de que o princípio não está suscetível a essa pretensa confusão, utilizando, para tanto, a distinção leibniziana entre “a consideração do modo de conceber” e a “consideração da coisa mesma”. This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control. There is perhaps no area of law that so effectively protects human health and thereby advances the right to the highest attainable standard of health, as tobacco control. Globally, tobacco is responsible for 1 in 10 adult deaths, and is on track to kill 10 million people per year, mostly in developing countries, representing a US$200 billion drain on the global economy. Yet experience in recent decades has shown that a range of tobacco control measures, such as comprehensive bans on (...) smoking in public places, tobacco taxes, and limits on tobacco advertising, can greatly reduce smoking prevalence. These measures have slowly curtailed the epidemic, despite strong opposition from various sectors led by the tobacco industry. It is fitting that tobacco control is the focus of a recent, widely ratified global treaty and of increasing national litigation, often directly linked to countries’ human rights commitments. This paper discusses the meaning of an image rarely used within the religious and philosophical corpus of ancient India in order to describe the ultimate nature of God and the human being: a wall or canvas (Sanskrit, bhitti). The usage of such a peculiar image belongs to Abhinavagupta, the great exegete of the Tantric tradition who lived in Kashmir between the tenth and eleventh centuries A.D. After presenting some antecedents, the paper focuses on key passages taken fromAbhinavagupta’s work and shows (...) how, far from being secondary, the image of a wall possesses a remarkable consistency and expressive power in accordance withAbhinavagupta’s doctrinal presuppositions, in particular his commitment to a dynamic and ultimately paradoxical view of the divine realm, the universe and salvation. IntroductionThe Managing Cancer and Living Meaningfully therapy for patients with advanced cancer was tested against a supportive psycho-oncological counseling intervention in a randomized controlled trial. We investigated whether CALM was delivered as intended ; whether CALM therapists with less experience in psycho-oncological care show higher adherence scores; and whether potential overlapping treatment elements between CALM and SPI can be identified.MethodsTwo trained and blinded raters assessed on 19 items four subscales of the Treatment Integrity Scale covering treatment domains of CALM. A (...) random sample of 150 audio recordings were rated on a three-point Likert scale with 1 = “adherent to some extent,” 2 = “adherent to a sufficient extent,” 3 = “very adherent.”ResultsAll 19 treatment elements were applied, but in various frequencies. CALM therapists most frequently explored symptoms and/or relationship to health care providers and allowed expression of sadness and anxiety about the progression of disease. The exploration of CALM treatment element SC_1 was most frequently implemented in a satisfactory or excellent manner, whereas the treatment element SMP_4: Therapist promotes acknowledgment that some life goals may no longer be achievable was not implemented in a satisfactory manner. In terms of treatment differentiation, no treatment elements could be identified which were applied significantly more often by CALM therapists than by SPI therapists.ConclusionResults verify the application of CALM treatment domains. However, CALM therapists’ adherence scores indicated manual deviations. Furthermore, raters were not able to significantly distinguish CALM from SPI, implying that overlapping treatment elements were delivered to patients. (shrink)
