Filozofowie umysłu zaczynają odgrywać istotną rolę w debacie na temat statusu moralnego zwierząt. Współczesne, obiecujące koncepcje świadomości każą uznać, że zwierzęta nie są zdolne do cierpienia w ludzkim sensie, co budzi sprzeciw wielu badaczy troszczących się o los zwierząt. Ponadto, etycy uznający zdolność do cierpienia za podstawowe kryterium przyznawania statusu moralnego, są w kłopocie, gdyż wyniki nauk kognitywnych wydają się kłócić z ich intuicjami. Proponuję usunąć ten problem przez odrzucenie poglądu uznającego konieczny związek między posiadaniem statusu moralnego a zdolnością do (...) cierpienia. Przedstawiam również projekt, jak bronić zasadności przynajmniej niektórych intuicji opartych na empatii i korzystać z nich w debacie na temat statusu moralnego zwierząt. (shrink)

U antropocentričkim se pristupima čovjekovim potrebama i interesima u vegetativnoj prirodi pripisuje moralna vrijednost. Imaju li i druga živa bića interese koje bi čovjek u svom ophođenju s njima trebao uzimati u obzir? To se pitanje ovdje obrađuje raspravom o interesima , intrinzičkoj vrijednosti i o »moralnim pravima« biljaka kao mogućim nositeljima njihova moralnoga statusa. Analogno osjetilnoj sposobnosti životinja, pokušava se u sposobnosti biljke da uspijeva prepoznati onu sposobnost koja bi mogla utemeljiti njezin moralni status .Mogu li se ljudi (...) u svome djelovanju naspram biljaka ponašati pogrešno ili ispravno i jesu li posljedice toga odnosa etički relevantne, ne samo naočigled ljudskih interesa i potreba nego i biljaka samih, ovisi o moralnom statusu biljaka. Njihovo se moralno zahtijevanje naspram ljudi temelji u njihovu moralnom statusu.In den anthropozentrischen Positionen treten die Bedürfnisse und Interessen des Menschen an vegetativer Natur als tragende Elemente auf, denen ein moralischer Wert zugesprochen wird. Demzufolge wird gefragt, ob auch die nichtmenschlichen Lebewesen Interesse hätten, die vom Menschen in seinem Umgang mit ihnen berücksichtigt werden sollten? Dieser Frage wird hier nachgegangen, indem die Interessen , Eigenwerte , „moralische Rechte“ der Pflanzen als mögliche Träger ihres „moralischen Status“ hinterfragt werden. Es wird versucht in der Fähigkeit der Pflanze zu gedeihen – analog zu der Empfindungsfähigkeit bei den Tieren – jene Eigenschaft zu erkennen, die den „moralischen Status“ der Pflanzen begründen könnte .Ob sich Menschen in ihrem Handeln den Pflanzen gegenüber falsch oder richtig verhalten können, und ob die Folgen dieses Verhaltens nicht nur angesichts der menschlichen Interessen und Bedürfnisse, sondern wegen der Pflanzen selbst ethisch relevant sind, hängt davon ab, was für einen „moralischen Status“ Pflanzen haben. In this essay, I develop a moderate hierarchical position about the moral status of animals that is based on two factors: on the level of mental development of a being who is affected and on the significance of the interests that are affected. I argue that this view accommodates two different sets of moral intuitions. On one hand, it explains why, in general, humans have the special moral standing that is typically attributed to us. On the other hand, it (...) also allows us to accommodate much of our intuition about how animals ought to be treated. In addition, this view is supported also by plausible general theoretical considerations. Subsequently, I explore some implications of this view for some real-life examples of our interactions with animals, especially, for the practice of raising them for food using industrial methods. I argue that this practice is morally wrong and that the correct approach is to adopt a (nearly) plant-based lifestyle. (shrink)

Cílem článku je prozkoumat otázku po epistemickém statusu morálních intuic. Empirické výzkumy na poli morální psychologie ukazují, že intuice hojně využíváme při morálním hodnocení. Spoléháme se na ně však i jako morální filosofové při testování našich teorií – má-li některá normativní teorie proti-intuitivní důsledky, chápeme to jako její vadu a vice versa. V článku se snažím zodpovědět otázku, zda je taková praxe odvolávání se na morální intuice jako na evidenci ospravedlnitelná – je morální intuice spolehlivým epistemickým kanálem? Nejprve se budu (...) opírat o příbuznou debatu zaměřenou na epistemické intuice, představím tzv. restrikcionistickou výzvu a vysvětlím, z jakého důvodu se zaměřuji na morální intuice. V následující sekci předložím dle mého názoru nejsilnější linii útoku na epistemickou spolehlivost morálních intuic – argument z intuitivní nestability. Dříve jsme nevycházeli z úžasu nad zprávami o masivních rozdílech mezi námi Zápaďany a obyvateli exotických krajin, kterými nás ze svých terénních výzkumů zásobovali etnografové a antropologové. Dnes to jsou především morální psychologové a experimentální filosofové, kteří nás udivují ještě více odhalováním značné variability v intuicích – tentokrát však nejen mezi civilizovanými a domorodými lidmi, nýbrž i v srdci naší vlastní kultury. V další části tak předložím jednoduchou typologii intuitivní nestability a představím v současnosti již značně rozsáhlý soubor dat, který dokumentuje právě tuto neblahou vlastnost morálních intuic. Na jejich základě pak ve finální sekci dospěji k závěru, že morální intuice nejsou schopné dostát epistemickým nárokům, které klademe na jiné informační zdroje (např. smyslové vnímání), a jako takové nemohou sehrávat svou domnělou evidenční roli. V úplném závěru předložím předběžné poznámky týkající se možnosti využívat morálních intuic spíše jako zdroje motivace a za tím účelem navrhnu obrátit filosofickou praxi testování normativních teorií naruby. Wedle Stanowiska Komitetu Bioetyki przy Prezydium PAN nr 2/2012 z dnia 8. czerwca 2012 r. w sprawie preimplantacyjnej diagnostyki genetycznej (PDG) jednym z głównych problemów wiążących się z prawnym uregulowaniem PDG jest nierozstrzygalność sporu na temat statusu moralnego ludzkich zarodków. Stanowisko i zgłoszone do niego zdania odrębne stwierdzają, że ci, którzy uznają, że wczesne zarodki mają pełny status moralny, nie mogą się zgodzić na diagnostykę preimplantacyjną. W artykule pokazuję, że przyjęcie nawet skrajnie konserwatywnego poglądu na status wczesnych (...) embrionów ludzkich, czyli uznanie ich za byty mające pełny status moralny i pełne prawo do życia, nie wystarczy, by skutecznie argumentować przeciw dopuszczalności PDG w sytuacji, w której nie możemy zagwarantować przeżycia wszystkich embrionów. Przedstawiony tu argument opiera się na powszechnie akceptowanej obecnie w etyce medycznej zasadzie poszanowania autonomii oraz odwołuje się do sposobu podejmowania decyzji w sytuacji niepewności charakterystycznego dla klasycznie rozumianej teorii decyzji. Niektórzy twierdzą, że nawet jeśli ktoś nie wierzy, że embriony lub płody ludzkie mają jakiś szczególnie wyróżniony status moralny, to z ostrożności powinien traktować je tak, jak gdyby miały pełny status moralny. Pokażę, dlaczego takie rozumowanie jest niepoprawne.

Konserwatywni przeciwnicy prowadzenia badań naukowych na ludzkich embrionach argumentują, że od momentu poczęcia mają one status moralny równy statusowi ludzi dorosłych: zarodki mają takie samo prawo do życia jak dorośli. W artykule przedstawiam oryginalną argumentację za tym stanowiskiem, której źródła można znaleźć w XVII-wiecznej teologii moralnej i współczesnej teorii decyzji. Argumentacja ta nie odwołuje się do statusu ontologicznego embrionów, ale do pewnego typu rozumowania praktycznego na temat tego, co należy robić w rozmaitych sytuacjach niepewności. Na pierwszy rzut oka (...) wydaje się ona wzmacniać stanowisko konserwatywne, ponieważ nie zależy od kontrowersyjnych metafizycznych założeń na temat statusu zarodków czy kwestii ich potencjalności. W artykule pokażę jednak, że argumentacja ta obarczona jest poważnymi wadami, które sprawiają, że nie da się jej zastosować do uzasadnienia sprzeciwu wobec moralnej czy prawnej dopuszczalności np. badań na zarodkowych komórkach macierzystych. Celem artykułu jest scharakteryzowanie współczesnej publicznej debaty bioetycznej w Polsce na przykładzie dyskusji na temat kwestii reprodukcyjnych. Autorki podkreślają polaryzację i radykalizację przeciwstawnych stanowisk i pomijanie zagadnień istotnych dla dyskusji filozoficznych na ten temat. Debata społeczna ma charakter sporu światopoglądowego o charakterze pragmatycznym, a jej celem jest oddziaływanie na zmianę bądź ugruntowanie już przyjmowanych przekonań moralnych umożliwiające przyjęcie i akceptację społeczną proponowanego rozwiązania legislacyjnego. Do radykalizacji sporu przyczynia się silny wpływ instytucji Kościoła, rozwój ruchu społecznego na rzecz obrony praw kobiet (...) i praw reprodukcyjnych oraz brak należytej uwagi dla tej debaty i jej wszystkich uczestników ze strony władz publicznych. "Dignity as a Quality of Person: Types of Dignity – a Proposed Systematisation" This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of the expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the concept of dignity encompasses dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve (...) different concepts of dignity, and thus twelve types of dignity. Half of them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law, and this essay is devoted to this group of meanings. This group of meanings includes three concepts of dignity which encompass dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. Only the first of these three concepts of dignity is adequate to the interpretation of the preamble and art. 30 of the Polish Constitution. The second group of meanings, treating dignity as something with which the human being is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. The other half of the meanings take dignity as something that belongs to something. These meanings will be considered in the forthcoming essay Godność jako cecha podmiotów zbiorowych i godność jako cecha ugruntowana instytucjonalnie. Typy godności – propozycja systematyzacji [Dignity as an Attribute of Collective Entities and Dignity as an Institutionally Grounded Attribute: Types of Dignity – a Proposed Systematisation]. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “dignity” when designating something belonging to something can also designate (4) the dignity of social status based on belonging to a social group, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. STRESZCZENIE Opracowanie zmierza do identyfikacji różnych znaczeń wyrażenia (nazwy) „godność”, ze szczególnym uwzględnieniem znaczeń tego wyrażenia występującego w tekście Konstytucji RP. Znaczeniem nazwy „godność” jest pojęcie godności; z kolei pojęcie godności ujmuje samą godność danego typu. Wskazanych zostaje dwanaście różnych znaczeń wyrażenia „godność” – dwanaście różnych pojęć godności, zatem i dwanaście jej typów. Połowa z nich to znaczenia (pojęcia), które ujmują godność jako coś przynależnego człowiekowi jako podmiotowi i tym znaczeniom (i odpowiadającym im typom godności) poświęcone jest niniejsze opracowanie. W tej grupie znaczeń odróżnione zostają trzy pojęcia godności, które ujmują godność jako coś konstytutywnego dla bycia osobą – (1) przyrodzoną i niezbywalną godność osobową, (2) godność opartą na obserwowalnych i zmiennych cechach specyficznych dla istoty rozumnej i (3) godność opartą na historycznie ukształtowanym statusie społecznym przypisanym wszystkim ludziom. Jedynie pierwsze z tych pojęć jest adekwatne do interpretacji preambuły i art. 30 Konstytucji RP. W drugiej grupie znaczeń ujmujących godność jako coś przysługującego człowiekowi są pojęcia ujmujące godność jako cechę osoby – (4) godność osobistą (cześć i dobre imię), (5) godność osobowościową (poziom moralny) oraz (6) godność jako dyspozycja do stosownego sposobu bycia. Druga połowa znaczeń ujmuje godność jako coś przynależnego czemuś lub jako coś o charakterze konwencjonalnym, instytucjonalnym. Te znaczenia będą omawiane w kolejnym opracowaniu Godność jako cecha podmiotów zbiorowych lub cecha ugruntowana instytucjonalnie. Typy godności – Propozycja systematyzacji – Część 2. Konstytucja RP mówi o (1) godności Narodu, (2) godności urzędu lub funkcji, oraz o (3) godności publicznej (godnościach publicznych. Wyrażenie „godność” jako desygnujące coś przynależnego czemuś może także desygnować (4) godność statusu społecznego opartego na przynależności do jakiejś grupy społecznej, (5) godność zawodu oraz – co specyficzne dla języka polskiego – (6) godność jako nazwisko. Autor argumentuje, że niedopuszczalne jest przypisywanie wyrażeniu „dignity” występującym w danym przepisie prawnym, różnych pojęć godności. (shrink)

W artykule wykażę, że szeroko rozpowszechnione poglądy na temat norm, które obowiązują żółnierzy na wojnie, pozostają w sprzeczności z moralnością ogólną. Etyka wojny dopuszcza działania, które w zwyczajnych sytuacjach nie tylko są uznawane za moralnie niedopuszczalne, ale wydają się czynami godnymi najwyższego moralnego potępienia. Zwracam uwagę na dwie wybrane rozbieżności między etyką ogólną a etyką wojny, tj. na problem związany z istnieniem asymetrii pomiędzy atakującymi i atakowanymi oraz na kwestię tego, kto jest właściwym celem moralnie usprawiedliwionego aktu przemocy. Odrzucając stanowiska (...) skrajne (realizm w stosunkach międzynarodowych i różne odmiany pacyfizmu), uznaję, że możliwe są dwa rozwiązania problemu tych rozbieśności: albo godzimy się na status quo, czyli mocną niezgodność etyki wojny z etyki ogólną, albo uznajemy, że należy znacząco przeformułować tradycyjną etykę wojny, a być może także obowiązujące normy prawa międzynarodowego. W tekście omawiam tę część internetowej dyskusji, przeprowadzonej w listopadzie 2012 r. na stronie Polskiego Towarzystwa Bioetycznego, która dotyczyła niepewności na temat moralnego statusu embrionów ludzkich. W trakcie dyskusji PTB na temat Stanowiska Komitetu Bioetyki przy Prezydium PAN w sprawie preimplantacyjnej diagnostyki genetycznej (PDG) pojawił się następujący argument: skoro spór o moralny status embrionu jest nierozstrzygalny, to powinniśmy opowiedzieć się przeciwko moralnej dopuszczalności wykonywania PDG na embrionach, a także przeciwko prawnej dopuszczalności tego rodzaju diagnostyki. W tekście omawiam tezy (...) Stanowiska i zdań odrębnych, które wywołały tę część dyskusji, a potem koncentruję się na następujących problemach: (I) dopuszczalność stosowania narzędzi teorii decyzji w debatach etycznych; (II) procedura podejmowania decyzji przez ciała doradcze w sytuacji niepewności moralnej; (III) znaczenie osiągnięć nauk biologicznych przy ustaleniu statusu moralnego embrionu; (IV) możliwość kompromisu w sytuacji pluralizmu wartości; (V) znaczenie statusu moralnego embrionów dla oceny moralnej i prawnej dopuszczalności PDG. Obszar etyki jest najczęściej ograniczany do człowieka i świata ludzkiego: tylko ludzie mogą działać moralnie lub niemoralnie, tylko ludzie mogą być z moralnego punktu widzenia godni pochwały lub nagany; tylko ludziom przypisuje się status podmiotów moralnego działania i podmiotów moralnych praw. W jakim stopniu ten antropocentryzm etyczny daje się utrzymać? Czy współczesna wiedza biologiczna, uwydatniająca ciągłość i stopniowalność cech właściwych dla istot żywych, nie podważa takiego mocnego rozgraniczenia i założenia o uprzywilejowanej pozycji człowieka? Czy nie powinniśmy wyjść poza gatunkowy (...) egoizm, a przynajmniej go ograniczyć? W niniejszym artykule rozważę argumenty na rzecz stanowiącej osobny paradygmat, wyjątkowej pozycji etycznej człowieka oraz zbadam argumenty na rzecz etycznego gradualizmu [czyli stopniowalnych różnic] między istotami ludzkimi a pozostałymi ssakami oraz między człowiekiem a przyrodą. W artykule szkicuję czynniki sprzyjające przemianie kompleksowego ujęcia relacji kobieta ciężarna – płód, w dualny model tego odniesienia. W pierwszym modelu kobieta i płód są traktowani przez lekarzy jak jeden pacjent, natomiast w drugim także fazom prenatalnym ludzkiego życia przyznaje się moralny status samodzielnego pacjenta. Dualne podejście ma negatywne następstwa dla kobiet brzemiennych, sygnalizowane w tekście w polemice z Susan Mattingly. W drugiej części pracy analizuję podjętą przez Franka Chervenaka i Laurence McCullougha, teoretyczną próbę uzasadnienia statusu płodu jako (...) pacjenta, przy jednoczesnym zachowaniu elementów kompleksowego modelu relacji kobieta ciężarna – płód. Analizy ukazują jej fiasko. (shrink)

Tematem wiodącym jest kwestia prawa do życia. Punkt wyjścia stanowi art. 3. Powszechnej Deklaracji Praw Człowieka, który przypisuje to prawo wszystkim ludziom. Problem zaczyna się jednak, kiedy trzeba uściślić, czy w tekście Deklaracji chodzi o pojęcie "istoty ludzkiej", którego desygnatem jest istota ludzka w sensie czysto biologicznym, czy też chodzi raczej o pojęcie "osoby", a więc termin odnoszący się do sfery moralności. Współczesna definicja "osoby ludzkiej", jakiej używa bioetyka wywodzi się z filozofii nowożytnej: ta zaś za cechę konstytutywną ludzi uznaje (...) świadomość. Rozumowanie w tych kategoriach nieuchronnie oznacza kłopoty ze zdefiniowaniem moralnego statusu, a co za tym idzie, pozwala na zgłaszanie wątpliwości co do prawa do życia w przypadku embrionów i osób nieuleczalnie chorych, w stosunku do których rozważana bywa możliwość zastosowania eutanazji. Zagadnienie, które jest dyskutowane w niniejszym artykule, w kontekście prawa do życia dotyczy aborcji, a więc odnosi się do pierwszej z grup istot ludzkich, których osobowy status bywa podważony. Tytułowa dla artykułu moralna niepewność nie dotyczy częstokroć w kontekście dyskusji nad dopuszczalnością aborcji normy "nie zabijaj". Zwolennicy aborcji nie przeczą, że zabijanie ludzkich osób jest złem, wątpią jednak w możliwość uznania prenatalnych faz rozwojowych człowieka za fazy, w których mamy do czynienia z pełnoprawną ludzką osobą. Wątpliwość ta ma charakter moralny, a nie jedynie teoretyczny, decydując o aborcji nie ryzykujemy zatem błędnego sądu o charakterze teoretycznym, lecz spełnienie moralnie niesłusznego czynu. Jakkolwiek niepewność i ryzyko są nieodłącznymi elementami ludzkiego działania, to w przypadku gdy przedmiotem ryzyka jest moralnie doniosłe dobro, a takim jest ludzkie życie, stawiamy ryzyku granice: nie ryzykujemy życia drugich. W tradycyjnej teologii moralnej przywoływano tutaj zasadę tutioryzmu, nakazującą w przypadkach wątpliwych zawsze zachować odnośne prawo, czyli w dyskutowanym tu przypadku normę "nie zabijaj". Podobna intuicja towarzyszy współczesnemu kanadyjskiemu filozofowi, T. Lockhartowi. Autor zastrzega, że nie chce rozstrzygać, czy ludzki płód już jest, czy też jeszcze nie jest osobą wraz z przysługującym jej prawem do życia, przyjmuje jednak zasady działania w sytuacji niepewności, z których wynika, że niezależnie od przyjmowanych przez nas tutaj przekonań. wyborem racjonalnym jest zaniechanie aborcji. In this paper, we consider the notion of a moral model, trying to point out the important definitions of this status, as well as certain dilemmas that exist in terms of value determination in relation to this phenomenon. In the introductory part, the complexity of the sphere of moral action is considered, as well as the criteria that are relevant for determining the status of a moral role model. We tried to conduct our analysis of this notion in (...) the context of considering several areas of sociability (politics, religion, patriotism) within which the notion of moral model has its significant place. In this paper, I propose the concept of the “animated persona,” a soundless voice that says, “I am here” and appears on the surface of someone or something. This concept can bring clarity to the experience of perceiving a kind of personhood on a corpse, a wooden mask, or even a tree. In the first half of this paper, I will examine some Japanese literature and a work of Viktor Frankl’s that discuss these phenomena. In the second half, I will (...) analyze the concept of animated persona from five perspectives: (1) a compelling power, (2) surface-ness, (3) religious experience, (4) universality, and (5) the meaning of “I.” Lastly, I will discuss the relationship among the three layers of biological object, animated persona, and self-conscious being. My aim is to shed new light on the meaning of the encounter between the living and the dead. (shrink)

While philosophers have been debating for decades on whether different entities—including severely disabled human beings, embryos, animals, objects of nature, and even works of art—can legitimately be considered as having moral status, this question has gained a new dimension in the wake of artificial intelligence (AI). One of the more imminent concerns in the context of AI is that of the moral rights and status of social robots, such as robotic caregivers and artificial companions, that are built to (...) interact with human beings. In recent years, some approaches to moral consideration have been proposed that would include social robots as proper objects of moral concern, even though it seems unlikely that these machines are conscious beings. In the present paper, I argue against these approaches by advocating the “consciousness criterion,” which proposes phenomenal consciousness as a necessary condition for accrediting moral status. First, I explain why it is generally supposed that consciousness underlies the morally relevant properties (such as sentience) and then, I respond to some of the common objections against this view. Then, I examine three inclusive alternative approaches to moral consideration that could accommodate social robots and point out why they are ultimately implausible. Finally, I conclude that social robots should not be regarded as proper objects of moral concern unless and until they become capable of having conscious experience. While that does not entail that they should be excluded from our moral reasoning and decision-making altogether, it does suggest that humans do not owe direct moral duties to them. (shrink)

This paper critically assesses John Danaher’s ‘ethical behaviourism’, a theory on how the moral status of robots should be determined. The basic idea of this theory is that a robot’s moral status is determined decisively on the basis of its observable behaviour. If it behaves sufficiently similar to some entity that has moral status, such as a human or an animal, then we should ascribe the same moral status to the robot as we do to this (...) human or animal. The paper argues against ethical behaviourism by making four main points. First, it is argued that the strongest version of ethical behaviourism understands the theory as relying on inferences to the best explanation when inferring moral status. Second, as a consequence, ethical behaviourism cannot stick with merely looking at the robot’s behaviour, while remaining neutral with regard to the difficult question of which property grounds moral status. Third, not only behavioural evidence ought to play a role in inferring a robot’s moral status, but knowledge of the design process of the robot and of its designer’s intention ought to be taken into account as well. Fourth, knowledge of a robot’s ontology and how that relates to human biology often is epistemically relevant for inferring moral status as well. The paper closes with some concluding observations. Using evidence from experimental psychology, some social psychologists, moral philosophers and organizational scholars claim that character traits do not exist and, hence, that the philosophical tradition of virtue ethics is empirically inadequate and should dispose of the notion of character to accommodate the empirical evidence. In this paper, I systematically address the debate between dispositionalists and situationists about the existence, status and properties of character traits and their manifestations in human behavior, with the ultimate goal of responding to the (...) question whether virtue ethicists need to abandon the very enterprise of building a character-based moral theory in business ethics and organizational behavior. The creation of chimeras by introducing human stem cells into nonhu- man animals has provoked intense concerns. Addressing objections that appeal to human dignity, I focus in this essay on stem cell research intended to generate human neurons in Great Apes and rodents. After considering samples of dignity- based objections from the literature, I examine the underlying assumption that nonhuman animals have lower moral status than personsFwith particular attention to what it means to speak of higher and lower moral (...) statusFbefore evaluating the chimera research in question. I argue that (1) such experiments involving Great Apes should be prohibited out of respect for the research subjects and (2) such experiments involving rodents may or may not be permissible, depending on how we answer unresolved questions regarding rodents’ moral status. Standard liberal theories of justice rest on the assumption that only those beings that hold the capacity for moral personality have moral status and therefore are right-holders. As many pointed out, this has the disturbing implication of excluding a wide range of entities from the scope of justice. Call this the under-inclusiveness objection. This paper provides a response to the under-inclusiveness objection and illustrates its implications for liberal theories of justice. In particular, the paper defends two claims: first, it (...) argues that both the CMP and the potential capacity for moral personality are bases of moral status. This pluralist account of the basis of moral status can broaden the scope of justice and provide a solid philosophical justification for the common-sense intuition that almost all human beings have a moral status that is different and superior to that of nonhuman animals. Nicholas Agar, Jeff McMahan and Allen Buchanan have all expressed concerns about enhancing humans far outside the species-typical range. They argue radically enhanced beings will be entitled to greater and more beneficial treatment through an enhanced moral status, or a stronger claim to basic rights. I challenge these claims by first arguing that emerging technologies will likely give the enhanced direct control over their mental states. The lack of control we currently exhibit over our mental lives greatly contributes to (...) our sense of vulnerability. I then argue moral status should be viewed in terms of vulnerability. The enhanced will slowly gain the ability to command their mental states, reducing their vulnerability. These radically enhanced beings will have greater capacities, and possibly an inner life more valuable than our own. They will also be less vulnerable, and as a result, their moral status will be subordinate to our own. (shrink)

Empirical research on human–robot interaction has demonstrated how humans tend to react to social robots with empathic responses and moral behavior. How should we ethically evaluate such responses to robots? Are people wrong to treat non-sentient artefacts as moral patients since this rests on anthropomorphism and ‘over-identification’ —or correct since spontaneous moral intuition and behavior toward nonhumans is indicative for moral patienthood, such that social robots become our ‘Others’?. In this research paper, I weave extant HRI studies that demonstrate empathic (...) responses toward robots with the recent debate on moral status for robots, on which the ethical evaluation of moral behavior toward them is dependent. Patienthood for robots has standardly been thought to obtain on some intrinsic ground, such as being sentient, conscious, or having interest. But since these attempts neglect moral experience and are curbed by epistemic difficulties, I take inspiration from Coeckelbergh and Gunkel’s ‘relational approach’ to explore an alternative way of accounting for robot patienthood based on extrinsic premises. Based on the ethics of Danish theologian K. E. Løgstrup I argue that empathic responses can be interpreted as sovereign expressions of life and that these expressions benefit human subjects—even if they emerge from social interaction afforded by robots we have anthropomorphized. I ultimately develop an argument in defense of treating robots as moral patients. (shrink)

ABSTRACT If we accept that the behaviour of humans and other animals is very substantially channelled by evolutionary constraints, it might appear that there can be no place for animals within the protection of a human system of morality. However, the nature of plausible evolutionary constraints on the cognition of social animals, including humans, suggests that this is not so. It is likely that the most important element in our morality is the capacity to imagine the feelings of other individuals, (...) and this capacity is so important for our ability to understand and predict their behaviour that it would be likely to be preserved by evolution even if moral behaviour had no survival value in its own right. We also use this kind of imaginative sympathy to understand and predict the behaviour of other animals, and it is this which provides the main reason for the inclusion of such animals within a human moral system. The primitive elements of morality have a survival value that is probably common to many other social species of animals. Since one of our reasons for putting a special value on human life is the human capacity for moral behaviour, we ought also to view members of these species as being of special significance. A four dimensional approach to Newtonian physics is used to distinguish between a number of different structures for Newtonian space-time and a number of different formulations of Newtonian gravitational theory. This in turn makes possible an in-depth study of the meaning and status of Newton's Law of Inertia and a detailed comparison of the Newtonian and Einsteinian versions of the Law of Inertia and the Newtonian and Einsteinian treatments of gravitational forces. Various claims about the status of Newton's (...) Law of Inertia are critically examined including these: the Law of Inertia is not an empirical law but a definition; it is not a law simpliciter but a family of schemata; it is a convention and gravitational forces exist only by convention; it is (or is not) redundant; the concepts it embodies can be dispensed with in favor of operationally defined entities; it is unique for a given theory. More generally, the paper demonstrates the importance of space-time structure for the philosophy of space and time and provides support for a realist interpretation of space-time theories. (shrink)

Many accounts of the morality of abortion assume that early fetuses must all have or lack moral status in virtue of developmental features that they share. Our actual attitudes toward early fetuses don’t reflect this all-or-nothing assumption: early fetuses can elicit feelings of joy, love, indifference, or distress. If we start with the assumption that our attitudes toward fetuses reflect a real difference in their moral status, then we need an account of fetal moral status that can (...) explain that difference. I argue that we can have or lack relational obligations to early fetuses in light of our own activities or choices, independent of the fetus’s own features or properties. Those relational obligations make the early fetus morally considerable to the persons who stand in a moral relation to it. Pregnant persons (and other participants in the procreative process) can come to have relational obligations to an early fetus just in virtue of their own decision to create a person, either by intentionally getting pregnant or by deciding to continue a pregnancy. That decision not only makes it appropriate for them to care about the fetus, but it also generates obligations to the fetus that they didn’t have before that decision. (shrink)

This study examines the varying roles of power, status, and national culture in unethical decision-making. Most research on unethical behavior in organizations is grounded in Western societies; empirical comparative studies of the antecedents of unethical behavior across nations are rare. The authors conduct this comparative study using scenario studies with four conditions in both China and Canada. The results demonstrate that power is positively related to unethical decision-making in both countries. Status has a positive effect on unethical decision-making (...) and facilitates the unethical decisions of Canadian participants who have high power but not Chinese participants who have high power. To explicate participants’ unethical decision-making rationales, the authors ask participants to justify their unethical decisions; the results reveal that Chinese participants are more likely to cite position differences, whereas Canadian participants are more likely to cite work effort and personal abilities. These findings expand theoretical research on the relationship between social hierarchy and unethical decision-making and provide practical insights on unethical behavior in organizations. (shrink)

Argument teachers and scholars have frequently invoked external justification-impressing one's viewpoint upon another-as the primary social function of argument. Pluralism and fundamental disagreement in contemporary democratic societies raise questions regarding the status of argument, including the functions argument should serve. In this essay, I suggest alternatives of agenda expansion, responsibility attribution, and identity formation as important functions of argument in diverse societies. Thesealternative functions are especially important under conditions of social inequality, since they allow less powerful individuals and groups (...) to confront more powerful actors in situations where decision making is not open to all. In their substantive introduction, the editors first revisit two classical sites of controversy which have offered frameworks for theorizing the interplay between materiality and sociality: reification and fetishism. Obviously, these critical vocabularies emerge as crucial sites of perplexity as soon as the ontological boundary between subjects and objects is rendered equally problematic and fluid as the epistemological boundary between the imaginary and the real. A thumbnail sketch of the history of the two discursive traditions provides an elaborate systematic framework for (...) introducing the individual articles. The first axis of debate is generated by conceptual residues of the traditional tug-of-war between idealism and materialism which continues to infiltrate recent redescriptions of the web of sociality/materiality. The concern here is how much autonomy and agency can be granted to material objects in view of their social inscription and symbolic construction, and how far conceptual experiments with the ontological symmetry between humans and nonhumans may take us and/or should be permitted to go. The second axis of debate concerns the fate of critical theory and of ethico-political sensibility in the face of heightened uncertainties about the distinction between what is real, what is constructed, and what is imaginary, and between what may count as a person and what as a thing. Workplace Incivility (WI) occurs worldwide and has negative consequences on individuals and organizations. Valid and comprehensive instruments have been used, specifically in English speaking countries, to measure such adverse process at work, but it is not available a validated instrument for research carried out in Spanish speaking countries. In this study we aim to test the psychometric properties of the Matthews and Ritter’s four-item Workplace Incivility Scale (2016) with Spanish workers (N= 407) from different sectors. Participants’ mean age was 38.73 (...) (SD= 10.45) years old and the percentage of female employees was 59.2%. Confirmatory factor analysis using AMOS 19.0 was carried out, presenting a good fit. The internal consistency, convergent and concurrent validity of the scale were examined. Results show good scale reliability and expected high correlations with social undermining. Moreover, the scale related to propensity to leave a job, job satisfaction, and psychological well-being in the expected way. After configural invariance across groups was established, testing for metric invariance and scalar invariance was performed. Considering Δχ² and ΔCFI tests for two nested models, the 4-item scale was invariant when the employment status is considered (permanent vs temporal, full-time vs part-time and supervisor vs non supervisors). Overall, our findings showed good psychometric properties of the shorter version of the Workplace Incivility Scale in Spain. Theoretical and practical implications of this study are discussed. Preferences play a role in well-being that is difficult to escape, but whatever authority one grants to preferences, their malleability seems to cause problems for any theory of well-being that employs them. Most importantly, preferences appear to display a status-quo bias: people come to prefer what they are likely rather than unlikely to get. I try to do two things here. The first is to provide a more precise characterization of the status-quo bias, how it functions, and how (...) it infects commonly accepted theories of well-being. The second is to give an alternative characterization of an agent's preferences that succeeds in avoiding the status-quo bias. (shrink)

Should artificial agents (such as robots) be granted moral status? This seems like an important question to resolve, given that we will encounter a growing number of increasingly sophisticated artificial agents in the not too distant future. However, many will think that before we can even start to tackle questions about the moral status of artificial agents, we first need to solve tricky issues in the philosophy of mind. After all, most orthodox views about moral status imply (...) that only entities with a mental life are eligible for moral status. But, whether an unfamiliar entity like an artificial agent has a mental life raises controversial questions in the philosophy of mind. Given this, one might hope that we can resolve questions about the moral status of robots via “minimalist” views that give sufficient conditions for granting moral status to an entity that we can know to be satisfied without knowing whether the entity in question has a mind. This paper argues that we should be pessimistic about the prospects of minimalist views avoiding controversial questions in the philosophy of mind, by arguing that minimalist sufficient conditions are only plausible if combined with assumptions in the philosophy of mind. Building on agency and resource-based view theories, this study investigates the level of environmental disclosure (ED) practices of family versus non-family firms and explores the moderating role of board gender diversity. We test our hypotheses on a 3-year (2018–2020) panel data sample comprising 324 observations of Italian small- and medium-sized enterprises traded on the Euronext Growth Milan. Findings show that, compared to non-family firms, companies with a family firm status are characterized by lower levels of ED. Gender diversity on (...) the board, however, moderates this relationship, reducing this gap, to the extent that the family firm status is associated with higher ED when the number of women directors is high enough to constitute a critical mass. We consequently contribute to the studies on family business, corporate governance, and corporate social responsibility. (shrink)

In this article, I discuss the concepts of social position and social status, the types of social position, as well as the determinedness of social statuses by the given positions in a new approach. In the first, introductory part of the article, I emphasize that the institutional sociological conception of social position in my approach is relatively closest to the structuralist position conception. In the second part, I introduce two different concepts, labelled social position and social status, and (...) briefly review the social determinedness of social status. In the third part, social positions are typified from the point of view of the two components of social position: on the one hand, from that of social power relations and on the other from that of interest relations. I point out that the different social positions promote the realization of interests to different degrees, that is, they make it possible to attain different social statuses. Procrastination describes a ubiquitous scenario in which individuals voluntarily postpone scheduled activities at the expense of adverse consequences. Steel pioneered a meta-analysis to explicitly reveal the nature of procrastination and sparked intensive research on its demographic characteristics. However, conflicting and heterogeneous findings reported in the existing literature make it difficult to draw reliable conclusions. In addition, there is still room to further investigate on more sociodemographic features that include socioeconomic status, cultural differences and procrastination education. To this end, we (...) performed quantitative sociodemographic meta-analyses to fill this gap. It was found that the general tendency and academic procrastination tendency of males were stronger than females. No significant effects of differences in socioeconomic status, multiculturalism, nationality, family size, and educational background were found to affect procrastination tendencies. Furthermore, it was noteworthy that the gender differences in procrastination tendencies were prominently moderated by measurements, which has a greater effect on the Aitken Procrastination Inventory than on the General Procrastination Scale. In conclusion, this study provides robust evidence that males tended to procrastinate more than females in general and academic profiles, and further indicates that procrastination tendencies do not vary based on sociodemographic situations, including socioeconomic status, multiculturalism, nationality, family size, and educational background. One of the dominant themes of the symposium from which this collection of articles arose was the ontological status of consent. Is consent a particular state of mind? Is it the signification of that state of mind via a conventionally recognized act? Or, is consent a normative concept that evaluates not only the presence of a state of mind or act, but also the appropriateness of that state of mind or act in the particular circumstances?

Medical imaging is predominantly a visual field. In this context, prenatal ultrasound images assume intense social, ethical, and psychological significance by virtue of the subject they represent: the fetus. This feature, along with the sophistication introduced by three-dimensional ultrasound imaging that allows improved visualization of the fetus, has contributed to the common impression that prenatal ultrasound scans are like photographs of the fetus. In this article we discuss the consistency of such a comparison. First, we investigate the epistemic role of (...) both analogic and digital photographic images as visual information-providing representations holding a high degree of objectivity. Second, we examine the structure and process of production of ultrasound scans and argue that a comparison between two-dimensional ultrasound and photography is justified. This is in contrast to 3D ultrasound images that, due to the intensive mathematical processing involved in their production, present some structural issues that obfuscate their ontological and epistemic status. Research ethics is increasingly formally regulated, but little is known about how ethical considerations are reported in dissertations. The aim of this literature study was to describe the status and trends of ethical considerations in Swedish doctoral dissertations written by registered nurses. A total of 77 dissertations from 1987, 1997, and 2007 met the inclusion criteria and were analyzed by descriptive statistics. Ethical considerations were mostly overlooked in 1987, but almost ubiquitous by 2007. All dissertations in 2007, except one, (...) had a section on ethical considerations; however, these were short, lacking in references, and short on content. The most common topic was informed consent and approval from research ethics review boards, followed by confidentiality and ethical aspects of methodological issues. Our results imply that the quantity and quality of ethical considerations must be improved in order to assure ethical soundness for participants, patients, researchers, and society. (shrink)

In this paper I show that proofs by contradiction were a serious problem in seventeenth century mathematics and philosophy. Their status was put into question and positive mathematical developments emerged from such reflections. I analyse how mathematics, logic, and epistemology are intertwined in the issue at hand. The mathematical part describes Cavalieri's and Guldin's mathematical programmes of providing a development of parts of geometry free of proofs by contradiction. The logical part shows how the traditional Aristotelean doctrine that perfect (...) demonstrations are causal demonstrations influenced the reflection on proofs by contradiction. The main protagonist of this part is Wallis. Finally, I analyse some epistemological developments arising from the Cartesian tradition. In particular, I look at Arnauld's programme of providing an epistemologically motivated reformulation of Geometry free of proofs by contradiction. The conclusion explains in which sense these epistemological reflections can be compared with those informing contemporary intuitionism. (shrink)

"Certainty" occupies an important place in Wittgenstein’s epistemology: it does not belong to the category of knowledge but constitutes its foundation. In his view, knowledge boils down to language games, and language games are based on indubitable certainties. According to Wittgenstein, scepticism is meaningless, and if there is no certainty, then even doubt would be meaningless. Wittgesntein maintains that [relative] doubt and knowledge are epistemic categories, whereas absolute doubt and certainty are non-epistemic categories. Epistemic categories are meaningful and when expressed (...) by means of statements could be either true or false. In contrast, non-epistemic categories are meaningless and when expressed by means of statements the properties of truth and falsehood do not apply to them. The aim of the present paper is two fold: 1- Providing an explanation of the status of certainty in comparison to categories such as doubt and knowledge in Wittgenstein’s thought; 2- Providing a critical assessment of Wittgenstein's approach to certainty through the prism of critical rationalism. The main arguments of the paper are as follows: 1. Although Wittgenstein considers certainty to be meaningless and therefore not on a par with epistemological categories, he regards it as an objective concept that functions as the foundation upon which all human knowledge is based; 2. Wittgenstein's efforts to show the objectivity of certainty have not been entirely successful, partly due to his reliance on a defective notion of ‘objectivity’ and partly as a result of the prominence he assigns to the category of ‘meaning’ at the expense of the category of ‘truth’. The essence of deities has captured our imaginations for as long as we can remember. Does a God exist, or is the divine entity just a figment of our dreams, a projection? Is God what Aribiah Attoe calls a “regressively eternal and material entity” or what Gericke calls “a character of fiction with no counterpart outside the worlds of text and imagination”? This paper aims to wrestle with those questions from a theological perspective and to look at the ontological (...) class='Hi'>status of Yahweh and how that worldview lends itself to African Traditional Religions in conversation with Attoe's method of inquiry from the perspective of African Metaphysics. This paper aims to be a part of the larger project undertaken by the author, showing that philosophy can and should be an auxiliary discipline in Old Testament Studies as it has been seen, both fields have ways of similar arguing and coming to the same conclusions. We hypothesize that in modern societies the striving for high positions in the hierarchy of organizations is equivalent to the striving for status and power in historical and traditional societies. Analyzing a sample of 4,491 US men and 5,326 US women, we find that holding a supervisory position or being in charge of hiring and firing is positively associated with offspring count in men but not in women. The positive effect in men is attributable mainly to the higher proportion (...) of childlessness among men in non-supervisory positions and those without the power to hire and fire. This effect is in accordance with the positive relationship between other status indicators and reproductive success found in men from traditional, historical, and modern societies. In women, we further find a curvilinear relationship between income percentile and offspring number by analyzing US census data, indicating that women may strive for resources associated with advancement rather than for status per se.
