This article integrates previously missing components of government quality into the governance-piracy nexus in exploring governance mechanisms by which global obligations for the treatment of IPRs are effectively transmitted from international to the national level in the battle against piracy. It assesses the best governance tools in the fight against piracy and upholding of intellectual property rights (IPRs). The instrumentality of IPR laws (treaties) in tackling piracy through good governance mechanisms is also examined. Findings demonstrate that: (1) while all governance (...) tools under consideration significantly decrease the incidence of piracy, corruption-control is the most effective weapon; (2) but for voice and accountability, political stability and democracy, IPR laws (treaties) are instrumental in tackling piracy through government quality dynamics of rule of law, regulation quality, government effectiveness, corruption-control, and press freedom. Hence, the need for a policy approach most conducive to expanding development is to implement an integrated system of both IPRs and corollary good governance policies. Moreover, our findings support the relevance of good governance measures in developing countries wishing to complement their emerging IPR regimes. (shrink)

I explain the doctrine of divine simplicity, and reject what is now the standard way to explicate it in analytic philosophy. I show that divine simplicity imperils the claim that God is free, and argue against a popular proposal for dealing with the problem.

From the standpoint of belief in divine freedom , the medieval Aristotelian understanding of divine simplicity is deeply problematic. This is for two reasons. First, if the divine will and wisdom are identical, it would seem that God’s action must be wholly determined by His rational apprehension of the good. Second, if the divine will is identical with the divine essence, it would seem that for God to be able to do other than He does would mean that (...) the divine essence could be different. This paper focuses on two leading medieval Jewish Aristotelians, Maimonides and Gersonides, to ascertain their approach to these issues. (shrink)

Aquinas maintains that, although God created the universe, he could have created another or simply refrained from creating altogether. That Aquinas believesin divine free choice is uncontroversial. Yet doubts have been raised as to whether Thomas is entitled to this belief, given his claims concerning divine simplicity.According to simplicity, there is no potentiality in God, nor is there a distinction in God between God’s willing, His essence, and His necessary being. On the surface, it appears that these claims (...) leave no room for divine free choice. I argue that attempts by Aquinas and a pair of his contemporary defenders to reconcile God’s freedom with God’s simplicity fail to resolve the problem. Nevertheless, I maintain that Aquinas provides the key to a resolution in his claim that while creatures are really related to God, God is not really related to creatures. (shrink)

In recent years the doctrine of divine simplicity has become a topic of interest in the philosophical theological community. In particular, the modal collapse argument against divine simplicity has garnered various responses from proponents of divine simplicity. Some even claiming that the modal collapse argument is invalid. It is our contention that these responses have either misunderstood or misstated the argument, and have thus missed the force of the objection. Our main aim is to clarify what the (...) modal collapse argument in fact says, and explain why the recent responses do not succeed. In order to argue our case, we will proceed in several steps. First, we aim to systematically articulate the doctrine of divine simplicity. Second, articulate the Christian conviction that God is free to create any feasible world or no world at all. Third, argue that divine simplicity suffers a modal collapse and thus undermines God's freedom. Fourth, respond to potential objections to modal collapse. Fifth, we offer some concluding remarks. One of the primary concerns of the Consolatio is to draw out many of the paradoxical conclusions concerning the relation between creation and God that stem from the premises of classical creationist metaphysics, and attempt to solve them. Once one accepts that God does exist, is omnipotent, omniscient, and simple, it becomes viciously difficult to explain: (1) how anything contrary to God’s will—evil—can exist; (2) how any cause can act independently of God’s will—human freedom; and (3) how “independent causes” (...) can relate to God through their own agency—human prayer. This naturally begs the question: why should we accept the premises of classical creationist metaphysics? This paper addresses this question by analyzing and defending two of the central premises of Boethius’s version of classical creationist metaphysics as they are addressed in Consolatio III,10: (a) that God exists, and (b) that God is simple. In previous publications, I have historically traced the prevalence and the influence of an argument—an argument which Kant calls the Achilles, the most powerful, of all rationalist demonstrations in the history of ideas. This proof, which ultimately derives from Plato has been repeatedly used and has had a major influence in shaping philosophic discussions since the Hellenic Age. The form of the argument is fairly straightforward: the essential nature of the soul consists in its power of thinking; thought, being immaterial, (...) is unextended, i.e., simple, having no parts; and what is simple is indestructible; a unity; and an identity. I have attempted to map the incidence and force of this demonstration in the seventeenth and eighteenth centuries—from the Cambridge Platonists to Kant —a time when it becomes crucial in questions concerning the immortality of the soul; the “transcendental” condition necessary for the unity of consciousness ; the necessary and sufficient criteria for the establishment of personal or moral identity; and its use as a sometimes hidden or unconscious premise, but often explicit “principle,” of certain metaphysical and epistemological idealist doctrines. Thus, if thought and soul are essentially unextended, it at once becomes problematic how an immaterial soul can know a material, extended, “external” world. (shrink)

In the current efforts of harmonizing the standards and enforcement of IPRs protection worldwide, this paper explores software piracy trajectories and dynamics in Africa. Using a battery of estimation techniques that ignore as well as integrate short-run disturbances in time-dynamic fashion, we answer the big questions policy makers are most likely to ask before harmonizing IPRs regimes in the battle against software piracy. Three main findings are established. (1) African countries with low software piracy rates are catching-up their counterparts with (...) higher rates; implying despite existing divergent IPRs systems, convergence in piracy rate could be a genuine standard-setting platform. (2) Legal origins do not play a very significant role in the convergence process. (3) A genuine timeframe for standardizing IPRs laws in the fight against piracy is most likely between a horizon of 4–8 years. In other words, full (100 %) convergence within the specified horizon will mean the enforcements of IPRs regimes without distinction of nationality and locality. This study examines the efficiency of tools for fighting software piracy in the conditional distributions of software piracy. Our paper examines software piracy in 99 countries over the period 1994–2010, using contemporary and non-contemporary quantile regressions. The intuition for modelling distributions contingent on existing levels of software piracy is that the effectiveness of tools against piracy may consistently decrease or increase simultaneously with the increasing levels of software piracy. Hence, blanket policies against software piracy are unlikely to succeed unless they (...) are contingent on initial levels of software piracy and tailored differently across countries with low, medium and high levels of software piracy. Our findings indicate that GDP per capita, research and development expenditure, main intellectual property laws, multilateral treaties, bilateral treaties, World Intellectual Property Organisation treaties, money supply and respect for the rule of law have negative effects on software piracy. Equitably distributed wealth reduces software piracy, and the tendency not to indulge in software piracy because of equitably distributed wealth increases with the increasing software piracy levels. Hence, the negative degree of responsiveness of software piracy to changes in income levels is an increasing function of software piracy. Moreover, the relationships between policy instruments and software piracy display various patterns: U-shape, Kuznets-shape, S-shape and negative thresholds. A negative threshold represents negative estimates with the increasing negative magnitude throughout the conditional distributions of software piracy. God’s providence appears to threaten the existence of human freedom. This paper examines why Descartes considered this threat merelyapparent. Section one argues that Descartes did not reconcile providence and freedom by adopting a compatibilist conception of freedom. Sections two and three argue that for Descartes, God’s superior knowledge allows God to providentially arrange free choices without causally determining them. Descartes’ position thus strongly resembles the “middle knowledge” solution of the Jesuits. Section four examines the problematic relationship between (...) this solution and the creation of the eternal truths, arguing that Descartes’ position depends on his unique understanding of divine simplicity. In this paper we explore material simplicity, defined as the virtue disposing us to act appropriately within the sphere of our consumer decisions. Simplicity is a conscientious and restrained attitude toward material goods that typically includes (1) decreased consumption and (2) a more conscious consumption; hence (3) greater deliberation regarding our consumer decisions; (4) a more focused life in general; and (5) a greater and more nuanced appreciation for other things besides material goods, and also for (6) material (...) goods themselves. It is to be distinguished from simple-mindedness, a return to nature, or poverty. Simplicity overlaps with traditional virtues such as temperance, frugality, and wisdom, and sustains and enables traditional virtues such as justice and generosity. Simplicity is a virtue because it furthers human flourishing, both individual and social, and sustains nature’s ecological flourishing. For analytic purposes, we consider six areas in which simplicity can make important contributions: (1) basic individual flourishing, (2) basic societal flourishing, (3) individual freedom or autonomy, (4) the acquisition of knowledge, (5) living meaningfully, and (6) preserving and protecting nonhuman beings. The proven failure of materialism to secure subjective happiness or objective flourishing argues for the practice of voluntary simplicity and for the radical reform of modern consumer societies. Each of these values may be interpreted in different ways. Moreover, there may be conflict between the values in application to specific theories. In this short paper, Kuhn's idea of scientific values is extended to the value of academic freedom. The value of academic freedom may be interpreted in a number of (...) different ways. Westphal's new book is marked by clarity and simplicity of style, a rare quality in the often turgid Hegel discussion, whose obscurity often approaches that of the master's own writing. The result is a refreshing, interesting, informed, intelligent, often critical examination of a variety of themes in Hegel's theory by one of our best Hegel scholars.

Contrary to many interpreters, I argue that Thomas Aquinas’s account of divine simplicity is compatible with the accounts of divine simplicity given by John Duns Scotus and Gregory Palamas. I synthesize their accounts of divine simplicity in a way that can answer the standard objections to the doctrine of divine simplicity more effectively than any of their individual accounts can. The three objections that I consider here are these: the doctrine of divine simplicity is inconsistent (...) with distinguishing divine attributes, with the doctrine of the Trinity, and with the doctrine of divine freedom. "How, if at all, is responsibility possible," and "What kind of beings must we be if we are ever to be responsible for the results of our wills?". This study is not intended to guarantee final answers to these questions. What Wolf's study attempts to offer is insight into and a new perspective on the problem of the relationship between responsibility and freedom; it accomplishes this. After introducing us to the dilemma of autonomy as an issue germane to the (...) problem, Wolf embarks upon an examination and criticism of two standard positions: The Real Self View and the Autonomy View. While both of these contain plausible arguments, Wolf's examination exposes their inadequacies. According to the Real Self View, the actions of an agent are free and responsible if those actions arise out of one's own valuation system and are governed by the desires of the real self. The major difficulty is that if the real self is "deeply responsible" so as to deserve praise or blame, it leaves unanswered an explanation of why the real self is "deeply responsible" at all. Hence, the Real Self View fails to provide a solution. The Autonomy View is more radical and less defensible than the Real Self View. An autonomous agent can make choices on no basis, and is no more bound by reason than desire. To want autonomy is not only to want the ability to make choices when no choices exist, but to desire to be able to make choices for no reason, even if a reason exists. Wolf targets the vulnerability of the position. Prescinding from a cognitive perspective of reason, Wolf describes reason as a "normative faculty," or "whatever faculties are thought to be most likely to lead to true beliefs and good values". Concrete examples provide Wolf with supportive evidence that no responsible agent would want the ability to act contrary to reason. Like the Real Self View, the Autonomy View is inadequate. Wolf procedes to formulate her own theory in which reason plays a pivotal role. Her view is marked by a refreshing simplicity that does not undermine its philosophical soundness or its persuasiveness. According to Wolf's view, or the Reason View, the condition for responsibility is the ability to act in accordance with right reasons, the true, and the good. Philosophically, the true and the good are concepts that invite endless inquiry and debate. Wolf wisely avoids the pitfalls of many inquisitors and assumes a common sense, matter of fact approach to what constitutes the true and the good. There is objectivity in the world sufficient to yield empirical beliefs. Responsible agents are able to discern the true from the false and form value judgments that serve as a basis for action. Absolute metaphysical independence is not integral to responsible action, since there is always the presence of physical and psychological factors. But these factors are not so great as to deter or hinder responsible action. Whether or not an agent ultimately chooses to do that which is objectively better than something else does not alter the fact that one has the ability to act responsibly. Using the fundamental rational powers of perception, imagination, reflection, training, and logical thinking, the agent can recognize and appreciate the true and the good and act in accordance with them. The Reason View presumes that those whose intellectual and emotional capabilities fall within the range of normality are able to perceive what is objectively valid and morally good. Responsible action extends beyond the bounds of the moral sphere. Included under the category of responsible action are aesthetic, as well as personal, goals, and whatever else may be seen as good for the agent. What reason values as good has objective validity, albeit not absolute validity. What is good for the agent can never be judged apart from a given, determinate environment or from the psychological disposition of the agent that has its own normative competence. In its judgments, reason accommodates itself to both factors, and the responsible agent comes to see and appreciate the True and the Good. Wolf does not absolutize her theory; she offers it as working moral certitude for responsible agents. Her claim is that if the Reason View is correct, "It is important to cultivate and promote an open and active mind and an attitude of alertness and sensitivity to the world," so that one can come to "appreciate the True and Good" and "direct one's actions, in light of them". One can find little to discredit in Wolf's arguments, and her approach to the problem of the relationship between responsibility and freedom provides a relief from the tedious and convoluted debates that often take place when this issue is the topic.--Kathleen R. The advent of formal definitions of the simplicity of a theory has important implications for model selection. But what is the best way to define simplicity? Forster and Sober ([1994]) advocate the use of Akaike's Information Criterion (AIC), a non-Bayesian formalisation of the notion of simplicity. This forms an important part of their wider attack on Bayesianism in the philosophy of science. We defend a Bayesian alternative: the simplicity of a theory is to be characterised in (...) terms of Wallace's Minimum Message Length (MML). We show that AIC is inadequate for many statistical problems where MML performs well. Whereas MML is always defined, AIC can be undefined. Whereas MML is not known ever to be statistically inconsistent, AIC can be. Even when defined and consistent, AIC performs worse than MML on small sample sizes. MML is statistically invariant under 1-to-1 re-parametrisation, thus avoiding a common criticism of Bayesian approaches. We also show that MML provides answers to many of Forster's objections to Bayesianism. Hence an important part of the attack on Bayesianism fails. (shrink)

To say that God is sovereign over all things is to say that everything depends on God. To say that God exists a se is to say that Gods depends on nothing. This chapter examines and defends strong versions of five theses pertaining to God’s sovereignty and aseity: Everything that exists depends on God for its existence. Every situation that is the case depends on God for its being the case.God depends on nothing for his existence. God depends on nothing (...) for his being what he is.God is perfectly free. The implications of these theses for the doctrines of creation ex nihilo, continuous creation, and God’s eternality, freedom, and simplicity are discussed. I argue that although the theses portray a deity who is quite different from humans, they nevertheless are consistent with God’s being personal, that is, a being to whom beliefs, desires, intentions, and emotions are correctly ascribed. The revival of Leibniz studies in the past twenty-five years has cast important new light on both the context and content of Leibniz's philosophical thought. Where earlier English-language scholarship understood Leibniz's philosophy as issuing from his preoccupations with logic and language, recent work has recommended an account on which theological, ethical, and metaphysical themes figure centrally in Leibniz's thought throughout his career. The significance of these themes to the development of Leibniz's philosophy is the subject of increasing attention by philosophers (...) and historians. This collection of new essays by a distinguished group of scholars offers an up-to-date overview of the current state of Leibniz research. In focusing on nature and freedom, the volume revisits two key topics in Leibniz's thought, on which he engaged both contemporary and historical arguments. Important contributions to Leibniz scholarship in their own right, these articles collectively provide readers a framework in which to better situate Leibniz's distinctive philosophy of nature and the congenial home for a morally significant freedom that he took it to provide. The capability approach, which is closely connected to the works of Amartya Sen and Martha Nussbaum, is one possible theoretical framework that could be used to answer the question as to why poverty is a problem from a moral point of view. In this paper we will focus on the normative philosophical capability approach rather than the social scientific and descriptive perspective. We will show that the approach characterizes poverty mainly as a limitation of freedom and that it is (...) precisely this aspect, from its point of view, that makes poverty morally significant. This insight shifts the discussion away from questions regarding specific capabilities or lists of them-questions treated extensively in the literature-to the more general level of what constitutes the normative core of the capability approach. But as we will also discuss and argue, the role of freedom alone does not give us a complete picture of poverty but only presents us with one aspect relevant to evaluating it. A further aspect which we consider has not been adequately recognized and taken into account by most capability theorists is the experience of disrespect and humiliation, or to put it differently, a lack of recognition. Drawing from existentialism, feminism, the thought of Karl Marx and novelists like Dostoevsky, Richard Schmitt looks at modern capitalist societies to understand what it is that might be wrong for individuals. His concern focuses specifically on those who are alienated-- those persons who have difficulty finding meaning in their lives, who lack confidence in themselves and trust in others and, finally, who are constantly distracted by consumer society. In this paper I compare parametric and nonparametric regression models with the help of a simulated data set. Doing so, I have two main objectives. The first one is to differentiate five concepts of simplicity and assess their respective importance. The second one is to show that the scope of the existing philosophical literature on simplicity and model selection is too narrow because it does not take the nonparametric approach into account, S112–S123, 2002; Forster and Sober in The (...) British Journal for the Philosophy of Science 45, 1–35, 1994; Forster, 2001, in Philosophy of Science 74, 588–600, 2007; Hitchcock and Sober in The British Journal for the Philosophy of Science 55, 1–34, 2004; Mikkelson in Philosophy of Science 73, 440–447, 2006; Baker 2013). More precisely, I point out that a measure of simplicity in terms of the number of adjustable parameters is inadequate to characterise nonparametric models and to compare them with parametric models. This allows me to weed out false claims about what makes a model simpler than another. Furthermore, I show that the importance of simplicity in model selection cannot be captured by the notion of parametric simplicity. ‘Simplicity’ is an umbrella term. While parametric simplicity can be ignored, there are other notions of simplicity that need to be taken into consideration when we choose a model. Such notions are not discussed in the previously mentioned literature. The latter therefore portrays an incomplete picture of why simplicity matters when we choose a model. Overall I support a pluralist view according to which we cannot give a general and interesting justification for the importance of simplicity in science. (shrink)
