We study the situation when the automorphism group of a recursively saturated structure acts on an ℝ-tree. The cases of and models of Peano Arithmetic are central in the paper.

Orthodoxy has it that language evolution requires Gricean communicative intentions and therefore an understanding of nested metarepresentations. The problem with this orthodoxy is that it is hard to see how non-linguistic creatures could have such a sophisticated understanding of mentality. Some philosophers like Bar-On (The Journal of Philosophy 110 (6): 293-330, 2013a; Mind and Language 28 (3): 342-375, 2013b) have attempted to develop a non-Gricean account of language acquisition building on the information-rich and subtle communicative powers of expressive behaviours. This (...) paper argues that this approach shares a number of instructive similarities with the literature on the cognitive conception of language. It shows how expressive accounts (and others) can learn from insights in that tradition and identifies a problem with the role of intentional actions in expressive accounts that can be solved by understanding expressive behaviours more as cognitive rather than communicative tools. The aim of the paper is to show that there are actions which are non-intentional. An account is first given which links intentional and unintentional action to acting for a reason, or appropriate causation by an intention. Mannerisms and habitual actions are then presented as examples of behavior which are actions, but which are not done in the course of acting for a reason. This account has advantages over that of Hursthouse's "arational actions," which are allegedly (...) intentional actions done for no reason at all. Many philosophers categorise judgment as a type of action. On the face of it, this claim is at odds with the seeming fact that judging a certain proposition is not something you can do voluntarily. I argue that we can resolve this tension by recognising a category of non-voluntary action. An action can be non-voluntary without being involuntary. The notion of non-voluntary action is developed by appeal to the claim that judging has truth as a constitutive goal. This claim, when (...) combined with a conception of judging as a way of settling a question, explains both why judging is genuinely agential, and why it is nevertheless non-voluntary. (shrink)

Actions that do not have instrumental goals can communicate social goals that are not rituals. Many non-instrumental actions such as bowing or kissing communicate a commitment to or roles in dyadic relationships. What is unclear is when people understand such actions in terms of ritual and when they understand them in terms of relationships.

:Recent attempts to engage and develop modes of ethological practice that avoid deterministic and mechanistic accounts of animal action have often relied on affect as a way of articulating how animal bodies affect and are in turn affected by the animate and inanimate bodies around them. In this context affect has often functioned as an instigating site of change that opens up the experience of a particular animal to new possibilities for action and relation. This paper seeks to bring the (...) significant role that affect has played in opening up new directions in ethological theory and practice in contact with a discussion of two currents in affect theory – one shaped by the genealogy of philosophical thought that stretches from Spinoza, through Gilles Deleuze, to contemporary thinkers such as Brian Massumi, and the other emerging from the reception of the American psychologist and cybernetics thinker Silvan Tomkins, in the context of queer theory, through the work of Eve Sedgwick and Adam Frank. The locus of intersection for these different modes of theoretical practice is the site-specific case study of monk parakeets who have drawn on and incorporated the ornamental elaborations of human architecture into their own complex architectural nest constructions at Brooklyn's Green-Wood Cemetery. Recently there has been a surge of interest in the intersection between epistemology and action theory, especially in principles linking rationality in thought and rationality in action. Recently there has also been a surge of interest in the epistemic significance of perceived peer disagreement: what, epistemically speaking, is the rational response in light of disagreement with someone whom one regards as an epistemic peer? The objective of this paper is to explore these two issues—separately, but also in connection with one (...) another. I turn first to the idea that the normative standing of our actions depends on the normative standing of our beliefs. I endorse this idea. More precisely, I endorse a principle according to which sufficiently high credence in success conditions for a given goal-directed action is a necessary condition on rational execution of that action. I then turn to the debate concerning the epistemic significance of perceived peer disagreement. The basic issue is whether such disagreement is always epistemically significant in the sense of serving as a defeater of the initial credences of the disagreeing parties. Conformists argue that this is so while non-conformists deny it. I present a new argument against a brand of non-conformism that I call “strong non-conformism”. The key premise is the principle that sufficiently high credence in success conditions for a given goal-directed action is a necessary condition on rational execution of that action. I argue that, given this principle, strong non-conformism fails to yield the verdict that the epistemic requirement on rational action is violated in a case where, intuitively, it is violated. This is because strong non-conformism has it that disagreement with a perceived peer does not act as a defeater in the relevant case. Conformism fares better. (shrink)

Crises of forced migration are, unfortunately, nothing new. At the time of the writing of this paper, at least two such crises were in full swing – mass movements from the Middle East and parts of Africa to the E.U., and major movements from Central America to the Southern U.S. border, including movements by large numbers of families and unaccompanied minors. These movements are complex, with multiple causes, and it is always risky to attempt to craft either general policy or (...) philosophical positions in response to salient crises. However, both of these instances do bring to the foreground important questions about the proper purpose and extent of refugee protection as a means of dealing with crises of forced migration. In particular, both of these instances force us to consider what role persecution on the basis of a protected ground – race, religion, nationality, membership in a particular social group, or political opinion – ought to play in granting refugee protection, and whether our response to those in danger should change if the agents of persecution are non-state actors. This paper is not primarily about the problems arising from Syria or Central America. In a way similar to how hard cases make bad law, I contend that a too central focus on salient crises tends to lead to bad theory and often to bad general policy. However, if I am successful in my goal of clarifying the place of persecution and non-state action in refugee protection, then we may in turn be better able to think clearly about our current crisis situations. -/- In this paper I will first draw on my previous work on the normative logic of the refugee convention to argue that, while persecution should play an important, and even central, role in our thinking about refugees, this importance is shallow and pragmatic rather than deep and fundamental. Next, I will show how this conclusion supports the claim that harms amounting to persecution by non-state actors may ground an asylum claim, at least in some cases, both when the state is unwilling and when it is unable to protect its members. I consider two cases: first, instances where the authority and power of the state has been usurped by another power, and second, when the state has (implicitly or explicitly) delegated its power or authority to non-state actors. Herein is reproduced the text of the address of Jean-Marie Muller during the General Assembly of Iraqi groups dedicated to non-violence which took place in Erbil on 9 and 10 November 2009. Jean-Marie Muller defines six prospective forms of action for the non-violent movement in Iraq: training, information, sensitization, education, protest, and non-violent direct action.

According to influential view, using the criminal law against innocent actions or agents is wrong. In this paper, I consider four related arguments against this view: a debunking argument that suggests that the intuitive appeal of this view may be due to a conflation of different ideas; a counterexamples argument that points out that there are many cases in which using the criminal law against innocent actions ("non mala" actions that are not even "mala prohibita") or agents (...) is justified; a theoretical argument, according to which the force of the reasons for and against using the criminal law is a matter of degree and it is therefore implausible to hold that the latter always defeat the former; and an analogy argument, which holds that it is implausible to maintain that harming innocents is often justified in other contexts but (almost) never in the context of the criminal law. ABSTRACTIn this essay, I will argue for an understanding of justice that is grounded in our imperfect world by drawing upon the works of John Dewey and the Classical Daoist philosophers. It will require a reconstructed understanding of persons as a field/continuum of interrelations and an updated understanding of human action and agency. This understanding of justice takes the form of non-coercive action, interaction that respects the particularity of each lived situation. The practice culminates in an ability to respond to (...) the environment considered to be ziran or ‘self-so’ by the Daoist Philosophers. As described in the Dao De Jing, it is the cultivation of the ‘Three Jewels of the Dao’, the most central of them being compassion making, this practice of justice as non-coercive action also understandable as the practice of compassion as described by the Classical Daoist philosophers. Intuitively, the knowledge of one’s own intentional actions is different from the knowledge of actions of other sorts, including those of other people and unintentional actions of one's own. But how are we to understand this phenomenon? Does it pertain to all actions, under every description under which they are known? If so, then how is this possible? If not, then how should we think about cases that are exceptions to this principle? This paper is a (...) critical survey of recent attempts to answer these questions. I consider views under three headings: "special source" views, which hold that the knowledge of one's intentional actions has a non-perceptual source; "special domain" views, which hold that some but not all aspects of one's intentional actions are known in a special way; and "special character" views, which hold that the knowledge of intentional actions is special not because of where it comes from, but because of some other respect in which it is different in kind from the knowledge of other things. Soldiers hiding in enemy territory that are discovered by civilians face acute ethical problems as to what to do about them. The law of armed conflict forbids harming civilians, yet if they are released they may well betray the soldiers and alert enemy forces that will kill or capture the soldiers. This is not just a theoretical problem; there are recent documented accounts of British and American soldiers who have found themselves in such a position and who have died because (...) they released the civilians. This paper argues that the ethical imperative here is to save the lives of both the soldiers and the civilians and that this should be the guiding principle in such cases. To this end, where possible, non-lethal means of restraint should be used on civilians to incapacitate them while the soldiers escape. (shrink)

An increasing number of studies demonstrated the involvement of the cerebellum in sequence processing. The current preliminary study is the first to investigate the causal involvement of the cerebellum in sequence generation, using low-frequency repetitive transcranial magnetic stimulation. By targeting the posterior cerebellum, we hypothesized that the induced neuro-excitability modulation would lead to altered performance on a Picture and Story sequencing task, which involve the generation of the correct chronological order of various social and non-social stories depicted in cartoons or (...) sentences. Our results indicate that participants receiving LF-rTMS over the cerebellum, as compared to sham participants, showed a stronger learning effect from pre to post stimulation for both tasks and for all types of sequences. No differences between sequence types were observed. Our results suggest a positive effect of LF-rTMS on sequence generation. We conclude that the cerebellum is causally involved in the generation of sequences of social and nonsocial events. Our discussion focuses on recommendations for future studies. (shrink)

The hologenome concept of evolution is a hypothesis about the evolution of animals and plants. It asserts that the evolution of animals and plants was partially triggered by their interactions with their symbiotic microbiomes. In that vein, the hologenome concept posits that the holobiont (animal host + symbionts of the microbiome) is a unit of selection. -/- The hologenome concept has been severely criticized on the basis that selection on holobionts would only be possible if there were a tight transgenerational (...) host-genotype-to-symbiont-genotype connection. As our current evidence suggests that this is not the case for most of the symbiont species that compose the microbiome of animals and plants, the opportunity for holobiont selection is very low in relation to the opportunity for selection on each of the species that compose the host microbiome. Therefore, holobiont selection will always be disrupted ‘from below’, by selection on each of the species that compose the microbiome. -/- This thesis constitutes a conceptual effort to defend philosophically the hologenome concept. I argue that the criticism according to which holobiont selection requires tight transgenerational host-genotype-to-symbiont-genotype connection is grounded on a metaphysical view of the world according to which the biological hierarchy needs to be nested, such that each new level of selection includes every entity from below. Applied to hologenomes, it entails that the hologenome is a collection of genomes, and selection of hologenomes is assumed to entail cospeciation of the host with the species that constitute its microbiome. -/- Against that interpretation, I propose the ‘stability of traits’ account, according to which hologenome evolution is the result of the action of natural selection in a non-nested hierarchical world. In that vein, hologenome evolution does not entail cospeciation, and thus it does not require tight transgenerational host-genotype-to-symbiont-genotype connection. By embracing a multilevel selection perspective, I argue that hologenome evolution results from the simultaneous action of natural selection on each of the lineages that compose the microbiome, and on the assemblage composed by the host genome plus the functional traits of its microbiome. Hologenome selection occurs when the evolution of the traits of the microbiome result from their effects on the fitness of the host, and it can take the form of multilevel selection 1, or multilevel selection 2. In both cases, hologenome selection entails the evolution of microbiome traits, as well as evolution of the host genome, rather than cospeciation of lineages. (shrink)

The paper focuses on a recent challenge brought forward against the interventionist approach to the meaning of counterfactual conditionals. According to this objection, interventionism cannot account for the interpretation of right-nested counterfactuals, the problem being its strict interventionism. We will report on the results of an empirical study supporting the objection. Furthermore, we will extend the well-known logic of intervention with a new operator expressing an alternative notion of intervention that does away with strict interventionism. This new notion of intervention (...) operates on the valuation of the variables in a causal model, and not on their functional dependencies. (shrink)

Given some reasonable assumptions concerning the nature of mental causation, non-reductive physicalism faces the following dilemma. If mental events cause physical events, they merely overdetermine their effects (given the causal closure of the physical). If mental events cause only other mental events, they do not make the kind of difference we want them to. This dilemma can be avoided if we drop the dichotomy between physical and mental events. Mental events make a real difference if they cause actions. But (...) actions are neither mental nor physical events. They are realized by physical events, but they are not type-identical with them. This gives us non-reductive physicalism without downward causation. The tenability of this view has been questioned. Jaegwon Kim, in particular, has argued that non-reductive physicalism is committed to downward causation. Appealing to the nature of actions, I will argue that this commitment can be avoided. Drawing from Taoist philosophy of wuwei (non-action), the author provides a frame to review current school reform movement. Political philosophy of wuwei highlights non-interference or non-intervention governance. Laozi discusses his theory of governance that a sage leader should take and explicates the paradox of non-action: By (...) not doing, everything is done. The paradox of wuwei complicates dialogues in the field of curriculum theory by opening spaces for taking effortless actions in the midst of standardization and accountability reform movement. In our experiment, participants were handed rods that systematically increased or decreased in length on subsequent trials. Participants were asked to judge whether or not they thought they could reach for a distant object with the hand‐held rod. The results are in agreement with a dynamical model, extended from Tuller, Case, Ding, and Kelso (1994). The dynamical effects observed in this study suggest that predictive judgments (...) regarding the possibility or impossibility of a certain action can be understood in terms of dynamically evolving basins of attraction instead of as depending on representational structures. One popular criticism of affirmative action is that it discriminates against those who would otherwise have been offered jobs without it. This objection must rely on the non- consequentialist distinction between what we do and what we merely allow to claim that doing nothing merely allows people to be harmed by the discrimination of others, while preferential programs actively harm those left out. It fails since the present effects of past discrimination result from social arrangements which result from actions (...) of ours. We can be responsible for the effects of past discrimination, even without having discriminated, if we are responsible for that discrimination having those effects. (shrink)

According to qualified-agent virtue ethics, an action is right if and only if it is what a virtuous agent would characteristically do in the circumstances. I discuss two closely related objections to this view, both of which concern the actions of the non-virtuous. The first is that this criterion sometimes gives the wrong result, for in some cases a non-virtuous agent should not do what a virtuous person would characteristically do. A second objection is it altogether fails to apply (...) whenever the agent, through previous wrongdoing, finds herself in circumstances that a virtuous person cannot be in. I focus on Rosalind Hursthouse's account of right action, and argue that it can provide a satisfactory response to both these objections. I do so by drawing attention to the distinction between action guidance and action assessment, and arguing that while the above criterion is adequate as a means of action assessment, we should turn to the virtue- and vice-rules (v-rules) for action guidance. This study investigates the effects on organization’s financial performances of, first, the extent to which the organizations are involved in controversial business activities, and second, their level of social performance. These companies can be considered non-socially responsible given the harmful nature of the activities they are involved in. Managers of these companies may still have incentives to pursue socially responsible actions if they believe that engaging on those actions will help them to achieve legitimacy and improve investors’ perception (...) about them. We develop a comprehensive methodology to investigate these corporate social performance (CSP)-related effects in a complex but specific setting. To this end, we analyze a sample of 202 US firms for the period 2005–2008 using a novel method in this area: partial least squares. Our results indicate that, contrary to the general findings in prior literature, companies involved in controversial business activities which engage in CSP do not directly reduce the negative perception that stakeholders have about them. Instead, we found evidence of a positive mediation effect of CSP on financial market-based performance through innovation. (shrink)

The “diversity” framework the Supreme Court has imposed on affirmative action weakens its justice import in theory and practice. The increasing alignment of wealth with attendance at selective institutions betokens a diminishing quality of student at those institutions. So some of the perceived advantages of affirmative action rely on an increasingly false sense of the quality differences between more and less highly-ranked institutions. Aligning those rankings with the quality of student (and quality of instruction at the different kinds of institution) (...) would have the net effect of benefiting black and Latino students as a group. More generally, improving the quality of education and the standing of less selective higher education institutions is an urgent racial educational justice challenge of the current moment, from which affirmative action diverts attention. Purpose: The paper aims at examining whether George Herbert Mead's theory of language is an appropriate candidate for developing a non-dualistic conception of experience and empirical research. Problem: Josef Mitterer has limited his theory of a non-dualizing way of speaking to criticizing dualistic positions in philosophy and sciences but has not developed a non-dualistic conception of empirical research. To do this, the task is to forego the notion "description" as a remainder category of dualism to develop a new understanding of (...) language. Findings: Mead's communication and action theory contains a non-dualistic nucleus. His gesture theory of communication allows us to distinguish action and speech and connect them in a non-dualizing way. Further research should especially focus on the relation between immediate and reflective experience in Mead's work. (shrink)

We show that each non-compact Polish group admits a continuous action on a Polish space with non-smooth orbit equivalence relation. We actually construct a free such action. Thus for a Polish group compactness is equivalent to all continuous free actions of this group being smooth. This answers a question of Kechris. We also establish results relating local compactness of the group with its inability to induce orbit equivalence relations not reducible to countable Borel equivalence relations. Generalizing a result of (...) Hjorth, we prove that each non-locally compact, that is, infinite dimensional, separable Banach space has a continuous action on a Polish space with non-Borel orbit equivalence relation, thus showing that this property characterizes non-local compactness among Banach spaces. Do we have free will and moral responsibility? Is free will compatible with determinism? Scott Sehon argues that we can make progress on these questions by focusing on an underlying issue: the nature of action explanation. When a person acts, or does something on purpose, we explain the behavior by citing the agent's reasons. The dominant view in philosophy of mind has been to construe such explanations as a species of causal explanation. Sehon proposes and defends a non-causal account of (...) action and agency, according to which reason explanation of human behavior is teleological rather than causal, before applying the teleological account of action to free will and responsibility. He argues that the non-causal compatibilist account works well in practice: it is in accord with our clear intuitions about cases, and it both explains and provides guidance in the cases where our intuitions are murkier.
