The theory of document acts is an extension of the more traditional theory of speech acts advanced by Austin and Searle. It is designed to do justice to the ways in which documents can be used to bring about a variety of effects in virtue of the fact that, where speech is evanescent, documents are continuant entities. This means that documents can be preserved in such a way that they can be inspected and modified at successive points in time and (...) grouped together into enduring document complexes. We outline some components of a theory of document acts, and show how it can throw light on certain problems in Searle’s ontology of social reality. (shrink)

There are two important ways in which, when dealing with documents, we go beyond the boundaries of linear text. First, by incorporating diagrams into documents, and second, by creating complexes of intermeshed documents which may be extended in space and evolve and grow through time. The thesis of this paper is that such aggregations of documents are today indispensable to practically all complex human achievements from law and finance to orchestral performance and organized warfare. Documents provide for what we can (...) think of as a division of intellectual, instructional, and deontic labour, allowing plans, orders, and obligations to be enmeshed together in a way that often involves the use of diagrammatic elements, as for example in a musical score. Offering a comprehensive account of the documents in the corpora of the orators and in the manuscript tradition, Canevaro summarizes previous scholarship and delineates a new methodology for analyzing the documents.

This documents the exhibition and the artistic positions, describes the process of the project, and offers analysis of the cooperation experiment from the perspectives of the participating company, the consultants involved, and scholars of organisational science. BackgroundDelirium is highly prevalent in the general hospital patient population, characterized by acute onset, fluctuating levels of consciousness, and global impairment of cognitive functioning. Mental capacity, its assessment and subsequent consent are therefore prominent within this cohort, yet under-explored.AimThis study of patients with delirium sought to determine the processes by which consent to medical treatment was attempted, how capacity was assessed, and any subsequent actions thereafter.MethodA retrospective documentation review of patients identified as having a delirium for the twelve months February (...) 2013 to January 2014 was undertaken. Inclusion and exclusion criteria were used; demographic and descriptive data collected. A total of n=1153 patients were identified with n=310 meeting inclusion criteria.ResultA random sample of one hundred patients were subsequently reviewed. One third of patients had documentation relating to consent, while four patients had documentation relating to capacity. Median delirium duration was three days, with treatment refusal occurring in twenty-two patients and “duty of care” being used as an apparent beneficent related treatment framework in twelve patients.ConclusionsWhile impaired decision-making was indicated, the review was unable to indicate what patient characteristics flag the need for capacity assessment. Documentation relating to consent processes appeared deficient for this cohort. (shrink)

Memory, as is well known, makes up a large part of our identity (even though the criterion of this “identity” is controversial). Documents – understood as inscriptions – make up our external memory in a peculiar way: they constitute both a stable anchor and a reference-point for our personal transformations over time. There is, however, also an internal memory, residing in our brain. This is based in part on external documentation; but it is of course not exclusively tied thereto. Rather (...) it evolves dynamically over time, in part reflecting ethical debates which we carry on within ourselves and which is influenced also by emotional factors, for example as we try to erase memories that are unpleasant. If, for example, the internal memory of some offense against our person is erased, then the motivation to testify against those who offended against us no longer exists or is greatly reduced, and this is so even though the documents that record the offense remain. Our motivations here depend on the emotional factor in our memories; once this has been lost, even though the autobiographical, episodic memory still remains, then the value-significance of the event fades from our view, and with it the impulse to act. Emotions are in large part responsible for creating a bond with documents; they make it possible for our internal and external memories to have significance. There must be some degree of emotional resonance in inscriptions relating to events in the past, which arises out of our own experience of these events and from our memory of these experiences, for these inscriptions to have significance in our lives. Documents are thus fundamental. But for ourselves and for our social lives, they must be supplemented by internal memories. (shrink)

This is a translation and critical edition of two documents on the Kapp Putsch and the origins of the united-front policy in the German Communist Party. The documents were written by the kpd leader Paul Levi and their titles and dates are, respectively: ‘Letter to the Central Committee of the Communist Party of Germany’ and ‘Open Letter of the Zentrale of the United Communist Party of Germany’. They are a documentary appendix to our essay ‘Paul Levi and the Origins of (...) the United-Front Policy in the Communist International’, published in this issue of Historical Materialism. (shrink)

Our culture is dominated by digital documents in ways that are easy to overlook. These documents have changed our worldviews about science and have raised our expectations of them as tools for knowledge justification. This article explores the complexities surrounding the digital document by revisiting Michael Polanyi’s theory of tacit knowledge—the idea that “we can know more than we can tell.” The theory presents to us a dilemma: if we can know more than we can tell, then this means that (...) the communication of science via the document as a primary form of telling will always be incomplete. This dilemma presents significant challenges to the open science movement. (shrink)

A group of Sogdian documents from the area of Khotan was recently acquired by Renmin University of China, Beijing. Four economic documents were edited in JAOS 130/4 ; the present article, comprising the edition of one complete letter and several fragments of letters, completes the publication of this collection, which adds to a growing body of evidence for the presence of Sogdian-speakers on the trade routes to the south of the Taklamakan desert.

A philosopher may develop ideas on his or her own or follow them in the works of others. Different kinds of documentary threads will develop. Historians of a subject may follow either kind. In the period of _Toward “Principia Mathematica”, 1905–08_, Russell engaged with developments in the writings of Poincaré, Haldane, Schiller and Berry, among others. What follows are remarks on supplementary documents (one being on-line) for a fuller study of logical and philosophical threads in the period.

As is well known, speech acts such as acts of promising can have ontological consequences. For example an act of promising can give rise to a mutually correlated claim and obligation. Increasingly, speech acts in the narrow sense are being augmented by the use of documents of multiple different sorts. In this paper we analyze the results of this augmenta-tion from the ontological point of view, considering especially the domains of law and com-merce. We show how document acts are not (...) isolated phenomena, but rather form large and complex systems with other entities, including occurrent entities such as acts of signing and inspecting, as well as speech acts for example of instructing people to sign or complete a doc-ument. The paper concludes with a consideration of some of the special problems associated with the use of digital documents, for example as concerns issues of security and provenance. (shrink)

In societies with a non-elementary degree of complexity, we find institutions, social roles, promises, marriages, corporations, enterprises, and the large variety of what we can label “social objects”. On the one hand, we commonly speak and think of such entities as if they existed on a par with entities such as tables and persons. On the other hand, there is a clear link between what people think and how people behave and the social domain. We argue that the widespread “reductionist” (...) approach in social ontology fails to account for both those aspects of social reality, and put forward a new approach. The main idea is that a particular kind of social objects, namely documents – and more generally records of social acts – are the ground of social reality. The fundamental difference from the reductionist approach is that the content of collective intentions will turn out to be not so important in accounting for the ontological variety of complex social realities such as ours. 청대 고증학은 고전과 경전의 복원(復原)을 통한 법고창신(法古創新) 온고지신(溫故知 新)의 방법론을 주창한 고전주의 학파이다. 하지만 18세기 고증학을 수용하였던 조선의 유학계는 협소한 자구(字句) 해석과 문자학적 훈고(訓誥)에 집중하는 고증학의 경전고변 이 학문적 실용성이 있는가에 대한 의문을 제기하며 또 하나의 지적유희에 젖어들어 훈고 적학 공리공론으로 고증학이 빠져들 것이라는 우려를 떨쳐내지 못하였다. 하지만 조선 중, 후기 유학자들이 고증학 전반에 대하여 비판적인 시각을 견지했던 것 은 아니다. 명청 교체기 초기 고증학의 명대 3대 유로(遺老)인 고염무, 황종희 왕부지 등 에 대해서 조선의 유학계에서는 매우 긍정적이고 우호적인 입장을 모여주는 (...) 것들이 자주 나타난다. 이들의 특징은 경세치용의 실용적 경세론을 주창하는 학자들이었다는 것이다. 명말청초 경세치용의 고증학은 근본적으로 공사 사를 대립적 개념으로 상정했던 송대 성리학과 달리, 공 사의 통일적 관계에 주목한다. 이와 같은 공과 사의 경계 허물기는 조 선 실학사상에서는 결코 피해 갈 수 없는 것이었다. 이에 대한 조심스러운 수용은 기호 남 인계 성호학파에서부터 제기되는 것으로 보인다. 또한 이것은 노론계 북학파에서는 사욕과 탐욕을 위한 근대 자본주의 욕망구조의 승인 이 아닌 국가공동체의 공익을 위한, 즉 공적 영역에서의 사리(私利)의 수용으로 나타난다. 또한 재화와 욕망의 공적 수용이라는 측면에서 유교주의적 경세론에서 벗어나지 않으며 이용후생학파의 이론적 토대가 되기도 한다. 이외에도 황종희의 사회개혁론은 정약용과 최한기 등 당시 조선실학자들에게 막대한 사회사상적 영향을 주었으며 조선 후기 실학사상의 민권 민본주의의 근간을 제공한 것이 다 이렇게 명말청초 초기 계몽파 고증학의. 경세치용적 개혁사상은 조선 실학사상의 사회 변혁 사상의 근간이 되었음은 분명하다. In this paper, we present a method for introducing law students to the writing of legal documents. The method uses a machine-readable representation of the legal knowledge to support document assembly and to help the students to understand how the assembly is performed. The knowledge base consists of enacted legislation, document templates, and assembly instructions. We propose a system called LEDAS (LEgal Document Assembly System) for the interactive assembly of legal documents. It guides users through the assembly process and provides (...) explanations of the interconnection between input data and claims stated in the document. The system acts as a platform for practicing drafting skills and has great potential as an education tool. It allows teachers to configure the system for the assembly of some particular type of legal document and then enables students to draft the documents by investigating which information is relevant for these documents and how the input data shape the final document. The generated legal document is complemented by a graphical representation of legal arguments expressed in the document. The system is based on existing legal standards to facilitate its introduction in the legal domain. Applicability of the system in the education of future lawyers is positively evaluated by the group of law students and their TA. (shrink)

In the first decade of the 21st century, the legislative bodies of certain social democratic countries (e.g. Australia, New Zealand, Nepal, Germany) have made a change into the binary system of presenting sex or gender on official identification documents, by introducing a third possibility – that (...) of gender indeterminacy. Would it now be possible to issue an official Id without knowing the precise sex of the person? My questioning tackles this new practice, measuring it from the standpoint of social ontology. (Bark Lacerta, Universith di Bari, Pubblicazioni dell'lstituto di filosofia, 12, 1967. Pp. 313. no price.) The philosophers at the University of Padua during the late Middle Ages and Renaissance arc attracting much renewed interest. This study makes accessible again the logical philosophy of Girolamo Balduino, professor at Padua during the second quarter (...) of the sixteenth century. Like other thinkers of his period, 13alduino follows the logic of Aristotle, and looks for progress within the ancient and mediaeval tradition, not for radically new doctrines. He continues the traditional interpretation of Aristotle by Averroes, for whom logic is only an instrumental habitus, a tool or method of demonstration. About the final contribution of the school of Padua to the improvement of Aristotelian logic was the doctrine of regressive demonstration, where demonstration terminates in or discloses the definition. Zabarella's well-known teaching on this point seems to be derived entirely from Balduino. Contrary to the interpretation of Cassirer, followed by Randall, this regressive demonstration is not a universal method of inquiry and is not at all like, and not the historical source of, the new method of Galileo. Papuli's book is solidly based on the original Latin texts, in notes, which are of great value in view of the fact that Balduino's works have been out of print since 1573. Not all of Papuli's interpretations are beyond criticism (e.g., p. 296), but he has done a service in enabling us to reestablish contact with one of the last significant commentators on Aristotle's logic. Pp. 196+22 facsimile illustrations) Giulio Cesare Vanini (1585-1619) ranks with Giordano Bruno as a modern hero of freedom of philosophical expression. He was tortured and then burned at the stake in Toulouse at the age of thirty-four, because of the unorthodoxy of his views. For this reason, he has drawn more attention than is perhaps deserved on the basis of his rather mediocre writings, which are little more than a tissue of plagiarisms culled from Pomponazzi, Cardano, J. C. Scaliger, and others. In this volume, Emile Namer has collected the scattered documents dealing with Vanini's life and activities. This is a valuable service, for it should enable scholars to disentangle fact from fiction and reality from myth. There has been so much heated discussion regarding Vanini that it is now time that someone should attempt to establish the precise facts and to reevaluate Vanini's place in intellectual history. In the past, writings about him have been governed more often by emotion than by reason. Namer prints documents from Naples, London, Paris, Simancas, and Toulouse. Some of these have been printed before in various journal articles, but it is valuable to have them all together in a single volume. In addition, he prints relevant excerpts concerning--as one of them put it--le douzi~me apostre de Satan, including material from Mersenne, Garasse, and others. He also includes a series of facsimiles of sample pages from the documents which he prints. All in all Namer's work is competently 250 HISTORY OF PHILOSOPHY done, though perhaps a bit more annotation to put the documents in historical perspective would have been desirable. In any case this little volume must be one of the bases for any future serious biographical or interpretative studies dealing with Vanini. Moreover, it shouM also be useful for scholars dealing with more general questions of seventeenth-century intellectual, religious, and social history. Unfortunately, there is no index, nor bibliography of earlier literature on Vanini, and the Introduction is perhaps too brief to orient the reader who has little previous knowledge of Vanini. A philosophy of information is grounded in a philosophy of documentation. Nunberg’s conception of the phenomenon of information heralds a shift of attention away from the question “What is information?” toward a critical investigation of the sources and legitimation of the question itself. Analogies between Wittgenstein’s deconstruction of philosophical accounts of meaning and a corresponding deconstruction of philosophical accounts of information suggest that because the informativeness of a document depends on certain kinds of practices with it, and because information emerges (...) as an effect of such practices, documentary practices are ontologically primary to information. The informativeness of documents therefore refers us to the properties of documentary practices. These fall into four broad categories: their materiality; their institutional sites; the ways in which they are socially disciplined; and their historical contingency. Two examples from early modern science, which contrast the scholastic documentary practices of continental natural philosophers to those of their peers in Restoration England, illustrate the richness of the factors that must be taken into account to understand how documents become informing. Zusammenfassung: Fehlinterpretierte Dokumente und ignorierte physikalische Fakten: Die Geschichte von,Hitlers Atombombe‘ muss korrigiert werden. Warum haben die deutschen Physiker während des Zweiten Weltkriegs keine Atombombe entwickelt? Seit mehr als 25 Jahren sind sich die Historiker einig, dass die deutschen Physiker wussten, wie eine Atombombe gebaut werden muss, dass aber ein Programm wie das amerikanische Manhattan‐Projekt zu ihrer Realisierung in Deutschland, erst recht während des Krieges, unmöglich war. Eine genaue Analyse aller erhaltenen Original‐Dokumente über die Arbeit an der Atombombe während des,Dritten (...) Reichs‘ zeigt jedoch erhebliche Fehler der Autoren durch unvollständige Analyse der Dokumente, falsches Verständnis naturwissenschaftlicher Erläuterungen und Ignorieren physikalischer Fakten. Es wird nachgewiesen, dass die deutschen Physiker bis zum Ende des Krieges nicht bemerkt hatten, dass eine Atombombe nur mit schnellen Neutronen realisiert werden kann. Nur Heisenberg hatte das richtige Prinzip spät erkannt, es aber nicht eindeutig kommuniziert und auch in keiner Weise physikalisch vertieft. Die physikalisch korrekte Interpretation der Dokumente zeigt, dass die deutschen Physiker während des Krieges erfolglos versuchten, einen Reaktor zu entwickeln, der auch eine Voraussetzung für den Bau einer Plutonium‐Bombe gewesen wäre. Aber sie wussten nicht, wie eine Bombe realisiert werden kann, weil sie nie an einer realistischen Theorie der Atombombe gearbeitet hatten. Summary: Misinterpreted Documents and Ignored Physical Facts: The History of ‘Hitler's Atomic Bomb’ needs to be corrected. Why have the German physicists not developed an atomic bomb during World War II? For more than 25 years, the historians agree that they knew how to build the bomb, but that a bomb‐development programme of the size of the US‐Manhattan‐Project would not have been possible in wartime Germany. A detailed analysis of all preserved documents on the German atomic bomb research during the ‘Third Reich’, however, reveals considerable mistakes by the authors due to incomplete analysis of documents, misinterpretations of scientific explanations and ignoring of physical facts. It is shown that until the end of the war the German physicists did not know that an atomic bomb can only be made with fast neutrons, except Heisenberg, who, however, discovered it rather late, did not communicate it clearly and did not study any bomb physics. The physically correct interpretation of the documents reveals that the German physicists worked unsuccessfully on a reactor, which would have been a prerequisite for a plutonium bomb. But they did not know how to build a bomb because they never worked on a realistic bomb theory. (shrink)

Summary: Misinterpreted Documents and Ignored Physical Facts: The History of ‘Hitler's Atomic Bomb’ needs to be corrected. Why have the German physicists not developed an atomic bomb during World War II? For more than 25 years, the historians agree that they knew how to build the bomb, but that a bomb‐development programme of the size of the US‐Manhattan‐Project would not have been possible in wartime Germany. A detailed analysis of all preserved documents on the German atomic bomb research during the ‘Third Reich’, however, reveals considerable mistakes by the authors due to incomplete analysis of documents, misinterpretations of scientific explanations and ignoring of physical facts. It is shown that until the end of the war the German physicists did not know that an atomic bomb can only be made with fast neutrons, except Heisenberg, who, however, discovered it rather late, did not communicate it clearly and did not study any bomb physics. The physically correct interpretation of the documents reveals that the German physicists worked unsuccessfully on a reactor, which would have been a prerequisite for a plutonium bomb. But they did not know how to build a bomb because they never worked on a realistic bomb theory. (shrink)

In most general terms, my paper is about the mixture of agendas in the recording industry, where documentation, with its apparently educational implications, becomes difficult to distinguish from a range of distinct, even opposed, goals—which I group under the heading "fabrication." After a few historical remarks, I develop the concept of what I call works of phonography —that is, sound-constructs created by the use of recording machinery. I detail their ontological characteristics, as contrasted the features of ordinary musical works. WPs (...) are—I claim—replete. They are autographic. And they are phono-accessible—that is, accessible only through playbacks of authentic instances of their record artifacts, e.g., cassette tapes, CDs, etc. I then turn to Theodore Gracyk's recent study of rock music, arguing that his account is formally similar to my account of WPs. This raises the question of whether there be counter-examples to Gracyk's account—particularly of the sort that show his view to be too broad. I bring this to a focus finally by a comparison of rock recordings with jazz recordings—two classes that Gracyk tries to keep ontologically distinct. I argue that many classic jazz recordings are artifacts of the recording studio, no less than those Gracyk identifies as pure cases of rock music. In the same vein, I argue that, once recorded, the improvisational music of jazz is deformed—indeed, that it acquires features of WPs. This has the further implication that Gracyk cannot preserve his sharp distinction between rock and jazz records that he want's to maintain. (shrink)

This article explores what it calls the “documentarist” hypothesis: the belief that the subject matter of history, the past, is structurally absent and thus can be reached only by way of documents, testamentary traces of various sorts . The first part of the article works out the documentarist position through interpretations of creative works that embody it and of a variety of reflections on historiography—those of Michel de Certeau and Paul Ricoeur, as well as some “postmodern historiography.” It argues that (...) documentarism ultimately faces an insoluble problem: it presupposes the pastness of the past, yet it cannot give itself the latter by way of the documents to which it believes itself confined. Documentarism assumes as already at hand a historical-temporal horizon of past, present, and future, for which it itself cannot account. In the second part of the article, accordingly, I turn to the historiographical portion of Faulkner's The Bear to expose the operativity of this always already given temporality. Faulkner's tale gives us access to a more radical historicity than any upon which documentarists reckon; yet this historicity turns out to sit askew from the usual frameworks of history as we know them, especially those of periods and epochs. The tension in Faulkner's own work between periodizing and event-laden explanations, I conclude, points to questions that fall beyond history as currently conceived. (shrink)

This paper explores how organizational members use documents to share their knowledge within and across work settings. I suggest that organizational studies of distributed knowledge sharing and information systems would greatly benefit from the linguistic analysis of communicative practices. Specifically, the paper highlights the notion of indexical centering as formulated by the linguistic anthropologist William Hanks and demonstrates its analytical power in studying documenting as a communicative practice. Drawing on a 15-month, multi-sited ethnographic study in several pediatric healthcare settings, the (...) paper focuses on how two doctors compose and use two medical histories found in two distinct medical information systems. The analysis suggests that the doctors use documents to index the temporal, spatial, and participatory dimensions of their knowledge sharing. They do so by indexing, on the one hand, the participants, times and places for their communicative practices and, on the other hand, the participants, times and places of their general care practices. The indexical analysis allows us to perceive documents, as more than mere vessels for knowledge transfer among organizational members, but as an integrated part of how people structure their work practices and situate their knowledge sharing in complex distributed organizational settings. BackgroundNursing documentation as a pivotal part of nursing care has many implications for patient care in terms of safety and ethics.ObjectivesTo explore factors influencing nursing documentation from nurses’ perspectives in the Iranian nursing context.MethodsThis qualitative study was carried out using a qualitative content analysis of data collected from 2018 to 2019 in two urban areas of Iran. Semi-structured interviews (n = 15), observations, and reviews of patients’ medical files were used for data collection.Ethical considerationsThis study was conducted in accordance with (...) the ethical principles of research and regulations in terms of confidentiality of data, anonymity, and provision of informed consent.FindingsThe main theme of this study was “unsafe documentation.” Two categories, “types of errors in reporting” and “reasons of errors in reporting,” and 12 subcategories were developed indicating factors influencing nursing documentation in the Iranian nursing context.ConclusionIn general, individual, organizational, and national factors affected nursing documentation in Iran. In this respect, hiring more nurses, application of reforms in the healthcare management structure, devising appropriate regulations regarding division of labor, constant education of healthcare staff, establishment of clinical governance, improvement of interpersonal relationships, development of hardware and software techniques for documentation, and provision of support should be done to improve the quality of nursing documentation. The above-mentioned suggestions can help nurses with a safe, ethical, lawful, and reliable documentation in nursing practice. (shrink)

This paper introduces the concept of Virtual Documents and its prototypical realization in our TNTBase system, a versioned XML database. VDs integrate XQuery-based computational facilities into documents like JSP/PHP do for relational queries. We view the integration of computation in documents as an enabling technology and evaluate it on a handfull of real-world use cases.
