This collection of essays examines the ways in which disputes and controversies about the application of scientific knowledge are resolved. Four concrete examples of public controversy are considered in detail: the efficacy of Laetrile, the classification of homosexuality as a disease, the setting of safety standards in the workplace, and the utility of nuclear energy as a source of power. The essays in this volume show that debates about these cases are not confined to matters of empirical fact. The first comprehensive analysis of the philosophical issues raised by the hijab controversy in France, this book also conducts a dialogue between contemporary Anglo-American and French political theory and defends a progressive republican solution to so-called multicultural conflicts in contemporary societies. It critically assesses the official republican philosophy of laïcité which purported to justify the 2004 ban on religious signs in schools. Laïcité is shown to encompass a comprehensive theory of republican citizenship, centered on three ideals: equality (secular neutrality of (...) the public sphere), liberty (individual autonomy and emancipation) and fraternity (civic loyalty to the community of citizens). Challenging official interpretations of laïcité, the book then puts forward a critical republicanism which does not support the hijab ban, yet upholds a revised interpretation of three central republican commitments: secularism, non-domination and civic solidarity. Thus, it articulates a version of secularism which squarely addresses the problem of status quo bias - the fact that Western societies are historically not neutral towards all religions. It also defends a vision of female emancipation which rejects the coercive paternalism inherent in the regulation of religious dress, yet does not leave individuals unaided in the face of religious and secular, patriarchal and ethnocentric domination. Finally, the book outlines a theory of immigrant integration which places the burden of civic integration on basic socio-political institutions, rather than on citizens themselves. Critical republicanism proposes an entirely new approach to the management of religious and cultural pluralism, centred on the pursuit of the progressive ideal of non-domination in existing, non-ideal societies. Although scientific practice sometimes encounters philosophical dif- ficulties, it cannot shoulder the burden of resolving them. This can lead to controversies. An unavoidable difficulty is rooted in the linguistic attitude, i.e., in the fact that to a considerable extent we express our thoughts in words. I will attempt to illuminate some important characteristics of linguistic expres- sion which lead to paradoxical situations, identifiable thanks to philosophy. In my argument, I will investigate how the notion of consciousness has altered over (...) the course of philosophical investigation and how it relates to recent scientific practice. In conclusion, I will focus on a few recent so-called radical positions in philosophy with regard to a framework within which consciousness and more generally mental phenomena can be regarded in a new light, as well as on the barriers we face when trying to unify scientific results. Discussion is widely held to be the pedagogical approach most appropriate to the exploration of controversial issues in the classroom, but surprisingly little attention has been given to the questions of why it is the preferred approach and how best to facilitate it. Here we address ourselves to both questions. We begin by clarifying the concept of discussion and justifying it as an approach to the teaching of controversial issues. We then report on a recent empirical study of the Perspectives (...) on Science AS-level course, focusing on what it revealed about aids and impediments to discussion of controversial ethical issues. How should we teach controversial issues? And which issues should we teach as controversies? In this paper, I argue that educators should heed what I call a ‘psychological condition’ in their practical efforts to address these questions. In defending this claim, I engage with the various decision criteria that have been advanced in the controversial issues literature: the epistemic criterion, behavioral criterion, political criterion and politically authentic criterion. My argument is that the supporters of these various criteria have focused (...) too closely on the socio-political and epistemic qualities of controversial issues in deriving their controversial issues pedagogies and have thereby overlooked the necessary subjective conditions for teaching controversial issues. If our pedagogical efforts to cultivate students’ reason by means of controversial issues are to be successful, then we must understand controversy as fundamentally a psychological phenomenon consisting in an intellectual tension in the minds of students. In the final pages, I conclude by recommending several forms of directive teaching that promise to be instrumental for creating such intellectual tension. (shrink)

When a new, brain-based definition of death was proposed fifty years ago, no one realized that the issue would remain unresolved for so long. Recently, six new controversies have added to the debate: whether there is a right to refuse apnea testing, which set of criteria should be chosen to measure the death of the brain, how the problem of erroneous testing should be handled, whether any of the current criteria sets accurately measures the death of the brain, whether (...) standard criteria include measurements of all brain functions, and how minorities who reject whole-brain-based definitions should be accommodated. These controversies leave little hope of consensus on how to define death for social and public policy purposes. Rather, there is persistent disagreement among proponents of three major groups of definitions of death: whole-brain, cardiocirculatory or somatic, and higher-brain. Given the persistence and reasonableness of each of these groups of definitions, public policy should permit individuals and their valid surrogates to choose among them. (shrink)

Controversies in science are an essential feature of scientific practice: defined here as current problems that are unresolved because there are no accepted procedures by which they can be resolved or there are differing assumptions that affect the interpretation of evidence. Although there has been much attention in science education literature addressing socio-scientific and historical controversies in science, less has been paid to the teaching of contemporary scientific controversies. Using semi-structured qualitative interviews with 18 teachers at different (...) career stages in England, we investigated teachers’ social representations of scientific controversies using the discourse of the collective subject. We found a lack of controversy in teachers’ responses. Whilst scientific controversies were seen as an essential feature of how science works, they were not viewed as essential in science education and were represented as a distraction and dealt with informally, outside the planned curriculum and in response to students’ questions. Subject knowledge was considered a barrier. We argue that teaching about carefully selected scientific controversies has the potential to contribute to teachers’ and students’ understandings of science and the nature of science. There are perceived to be few opportunities for teachers to exercise this in the English context. We suggest how the collective subject discourses might be used to open up a discussion about teaching controversies in professional learning situations. Materials to stimulate discussion of scientific controversies could be useful in future curriculum development in science, but these would need to address the barriers of subject knowledge, access to literature and conflict with assessment-related priorities and a perceived need to advocate for trust in science. A controversy rages over the question of how should controversial topics be taught. Recent work has advanced the “epistemic criterion” as the resolution to this controversy. According to the epistemic criterion, a matter should be taught as controversial when contrary views can be entertained on the matter without the views being contrary to reason. When an issue is noncontroversial, according to the epistemic criterion, the correct position can be taught “directively,” with the teacher endorsing that position. When there is a (...) legitimate controversy, the view should be taught “nondirectively,” with the teacher remaining neutral. In response, Bryan Warnick and Spencer Smith argue that the proponents of the epistemic criterion fail to recognize the multidimensional nature of what it means to learn to be rational. Recognizing this complexity undermines the link between the epistemic status of the controversy and directiveness of one's teaching, suggesting more flexibility in how teachers approach controversial issues. It also implies the need for a new category of teaching, which Warnick and Smith call “soft-directive” teaching. (shrink)

The new Coronavirus, namely Sars-CoV-2, took the world by surprise and grew into a pandemic worldwide in a couple of months since the beginning of 2020. It managed to lockdown at home almost half of the world population under the threat of illness and sudden death. Due to the extreme medical advises of containing the spread and damages of this threat, mostly directed towards social distancing, public gatherings cancelation, and contact tracing, each State imposed such regulations to their people and (...) for all areas of social activity, including the religious ones. This articles analyses four topics: 1. Restrictions imposed by the State and reactions by religious organizations. The theological-ethical response focused on the fact that all religions what to save lives and defeat death. 2. The pandemic shows the sensitive relation between the State and religions and shows the differences in power relations in the different countries. The theological-ethical response calls for a partnership between the State and the religions in their territory. 3. The relation between science and religion is tested during the pandemic. Whereas the majority of believers adhere to scientific results, a good part refuses scientific knowledge. The theological-ethical response of the authors is that science and religion are complementary and not contradictory. 4. Pandemics as situations of high uncertainty are often accompanied by conspiracy theories that claim to know who is guilty for the disaster, who is the scapegoat, which has to be punished. The theological-ethical response gives theological reasons to say no to conspiracies and scapegoats and yes to take responsibility wherever we are in order to save lives. (shrink)

Virtue is among the most venerable concepts in philosophy, and has recently seen a major revival. However, new challenges to conceptions of virtue have also arisen. This paper explores some key discrepancies between two sets of normative requirements applicable to the research use of personal data and human biological materials: the data protection regime which follows the application of the European Union General Data Protection Regulation, and the Declaration of Helsinki, CIOMS guidelines and other research ethics regulations. One source of this controversy is that the GDPR requires consent to process personal data to be clear, concise, specific and granular, freely given and revocable and therefore has (...) challenged the concept of ‘broad consent’, which has been widely applied in the context of biobanking. Another source of controversy is the interplay between regulations of research ethics and protection of personal data related to the secondary use of personal data and biological materials. In this case, the GDPR ‘research condition’ provides an alternative to re-consent for the use of previously collected personal data and biological materials. Although the mentioned controversies have been raised in the legal literature, they have not been explicitly addressed from the research ethics perspective. Should consent be regarded as a priority legal basis for personal data processing in health data research? Can broad consent still be a suitable legal ground for biobanking? What should be the role of research ethics provisions that differ from the GDPR standards, and what should be the role and function of research ethics committees in the changing environment of health data research? These are the ongoing controversies to be explored in the paper. (shrink)

Traditionally it has been thought that scientific controversies can always be resolved on the basis of empirical data. Recently, however, social constructionists have claimed that the outcome of scientific debates is strongly influenced by non-evidential factors such as the rhetorical prowess and professional clout of the participants. One potentially extremely fruitful use of the tools of corpus analysis in the philosophy of science is to help us understand disputed terrains within the sciences that we study. For philosophers of biology, for instance, few controversies are as heated as those over the concepts we use in taxonomy to classify the living world, with the definition of ‘species’ perhaps most fundamental among them. As many understandings of biodiversity, in turn, involve counting the number of species present in a (...) given area, these taxonomic concepts thus become crucially implicated in our efforts in conservation biology and our response to climate change. In this chapter, we present a corpus of taxonomic journal papers, and illustrate how it might be used to make progress in the history and philosophy of taxonomy. What parts of the biological world do taxonomists most often study? Are these areas of focus related to other methodological commitments, or perhaps to their underlying conceptual disagreement? Are species that are more important to conservation, or economic concerns, or more important to local cultures, more or less likely to be the target of biological study? Corpus-based methods, we argue, are uniquely powerful for approaching questions such as these, and we hope that the case we present can serve as a fruitful example for others considering their implementation. Controversial cases in medical ethics are, by their very nature, divisive. There are disagreements that revolve around questions of fact or of value. Ethical debate may help in resolving those disagreements. However, sometimes in such cases, there are opposing reasonable views arising from deep-seated differences in ethical values. It is unclear that agreement and consensus will ever be possible. In this paper, we discuss the recent controversial case of Vincent Lambert, a French man, diagnosed with a vegetative state, for whom (...) there were multiple court hearings over a number of years. Both family and health professionals were divided about whether artificial nutrition and hydration should be withdrawn and Lambert allowed to die. We apply a ‘dissensus’ approach to his case and argue that the ethical issue most in need of scrutiny is different from the one that was the focus of attention. (shrink)

Controversies, i.e., multiple theory confrontations, may have a strong impact on the development of science. By an analysis of the so-called resonance controversy in chemistry the view that controversies and their resolution differ considerably from the process of theory succession is defended. It is argued that controversies are symptomatic of foundational problems, produce theory-scattering or domain-splitting, and induce ontological shifts. An explication is given of the role of existence claims and the applicability of Ockham's Razor in the (...) resolution of controversies. The requirement of a realistic interpretation of theories at all times, as defended by some philosophers, is criticised. (shrink)

It is argued that the emergence of controversial views in discussions of theoretical medicine and bioethics is best explained by the assumption of moral realism within those discursive practices. Neither of the main alternatives of realism in contemporary meta-ethics — moral expressivism and anti-realism — can account for the rise of controversies in the bioethical debate. This argument draws from the contemporary expressivist or anti-representationalist pragmatism as advanced by Richard Rorty and Huw Price, as well as the pragmatist scientific (...) realism and fallibilism of the founder of pragmatism, Charles S. Peirce. In accordance with the fallibilist view, it is proposed that presenting controversial positions may serve epistemic purposes within bioethical debates, providing opportunities for inquiry by pointing towards problems to be solved and arguments and evidence for and against to be put forward. This paper discusses a way of introducing a scientific controversy, which emphasizes objective aspects of such issues as multiple theoretical interpretation of phenomena, choosing a theory, insistence on the chosen theory, and others. The goal is to give students a better insight into the workings of science and provide guidelines for building theories in their own research.

Roman Ingarden, one of Husserl's closest students and friends, ranks among the most eminent of the first generation of phenomenologists. His magisterial <I>Controversy over the Existence of the World, written during the years of World War II in occupied Poland, consists of a fundamental defense of realism in phenomenology. Volume I, which receives here its first complete and critical translation into English, initiates the grand project of refuting transcendental idealism, and begins by setting the foundations for an elaborate and precise (...) ontological system. This is Ingarden's greatest accomplishment, who is rather known as a theoretician of literature than an ontologist outside of Poland. The most important achievement of Ingarden's ontology is an analysis of the modes of being of various types of objects - things, processes, events, purely intentional objects and ideas. The three-volume <I>Controversy is perhaps the last great systematic work in the history of philosophy, and undoubtedly one of the most important works in 20th century philosophical literature. This study attempts to advance knowledge in the area of controversial advertising by examining the antecedents and consequences of controversial advert perceptions in the context of social media, and particularly social networking sites. Specifically, we explore how ethical judgement and religious commitment shape controversial advert perceptions leading to attitudes towards the advert, brand attitudes and purchase intentions. Our results indicate that when a SNS advert is judged to be ethically acceptable, the level of perceived advert controversy is lower. However, the (...) impact of ethical judgement on controversial advert perceptions becomes significant and positive when intrapersonal commitment and interpersonal religious commitment are introduced as moderators. This result implies that the level of religious commitment changes the ethical judgement–controversial advert perceptions relationship. The results also highlight that controversial advert perceptions negatively influence attitude towards the advert. The study contributes to the limited knowledge on controversial advertising on SNS, yielding significant and relevant implications for academics and advertisers alike, in their effort to improve advertising effectiveness without offending or alienating target audiences. Controversies are pervasive in the history of science. History is thus here also at odds with science's images. According to both traditional and contemporary views of science, there are no scientific controversies sui generis. In traditional images of science controversies are external to science proper; in some contemporary views nothing about controversies in science specifically distinguishes them from controversies in other domains. According to one traditional image, science progresses from common ground to conclusions according to (...) secure procedures such that there is no place for disagreement nor, therefore, for controversy. According to another traditional image of science, there are no such secure procedures. On the contrary: one does and even should jump to conclusions. Whereas here subsequent criticism is called for, it seems that controversy is not. This image is built on the assumption that refutations are clear cut, so that producing a valid refutation does not require a lengthy exchange of arguments. (shrink)

The controversies over genetically modified crops in India involve what Gieryn refers to as ‘boundary work’ in the ongoing competition for credibility and trustworthiness among claimsmakers with opposing points of view. Discourse about GM crops involves extensive drawing of boundaries by actors including policymakers, technocrats, NGOs, scientists, industrialists, and farmers. The issues raised range from governmental processes to moral and ethical implications, from environmental consequences to integration into the global economy. Those involved in these discussions frequently invoke the idealized (...) notions of farmers and farming in order to situate themselves within the boundary of a particular social category which may lend credibility to their claims. While Gieryn has focused primarily on scientists’ attempts to construct a boundary between science and non-science in order to establish themselves as experts, strengthen the credibility of their claims and avoid political interference in their intellectual activities, this article focuses on a different way in which knowledgeable and influential actors lay claim to trustworthiness by drawing a different kind of social boundary around themselves. This article will especially focus on the ways in which the category of farmers is used in the GM crop controversies by actors who are in a position to influence public policies regarding GM crops, especially in their efforts to justify their policy prescriptions. The thesis here is that GM crop controversies in India reflect elite actors’ attempts to compete for a shared social identity with farmers, thus constructing a context for the particular public policy prescriptions they support. The thesis is supported by a lexical item frequency analysis of discussion related to genetically modified cotton in India which demonstrates that boundary work using social identity of farmers plays a significant role in shaping the discourse surrounding the adoption and governance of GM crops. The basic philosophical controversy regarding ordinary objects is: Do tables and chairs, sticks and stones, exist? This paper aims to do two things: first, to explain why how this can be a controversy at all, and second, to explain why this controversy has arisen so late in the history of philosophy. Section 1 begins by discussing why the 'obvious' sensory evidence in favor of ordinary objects is not taken to be decisive. It goes on to review the standard arguments against (...) the existence of ordinary objects – including those based on problems with causal redundancy, parsimony, co-location, sorites arguments, and the special composition question. This chapter reviews fundamental ethical controversy surrounding the ongoing effort to revise the Uniform Determination of Death Act in the United States. Instead of focusing on the process of the revision itself, the chapter explores the underlying ethical debate over brain death that has been ongoing for many decades and finally culminated in this revision. Three issues are focused: the requirement for consent and personal exemptions before applying brain death for the diagnosis of death; redefining the areas of the brain (...) that have ceased to function in the definition of brain death; and codifying the American Academy of Neurology as the authority to issue the standards of the diagnosis of brain death. The chapter concludes that allowing the personal choice of death determination gives a pragmatic compromise to the disputed definition and practice of diagnosing brain death. So long as all risks and imperfections of the diagnosis are accepted through the consenting process, there is nothing ethically objectionable to continuing the current practice of diagnosing brain death as a successful tool to facilitate heart-beating organ donation without violating the dead-donor rule. By contrast, precluding personal choice and imposing legal restrictions to consent and exemptions would further erode public trust. (shrink)

The so-called Menschenpark-debate on genetic engineering—originating in 1999—turned out to be one of the most controversial and contentious debates in German philosophy. It is also regarded as the first manifestation of the struggle between Sloterdijk and Habermas. While Sloterdijk’s ideas had a significant impact on Habermas’s theory, Sloterdijk’s philosophy has been consistently ignored and dismissed until today due to two reasons. First, he was accused of advocating for fascist ideology. Second, philosophers from the same academic circles claimed that his method (...) does not meet academic standards. The debate therefore signifies a larger problem that concerns the methodological difference between analytic-Continental philosophies that work on a formal level and Continental philosophies that work with a tropological account experimenting with different non-formal philosophical expressions. I will carve out this distinction with respect to the Menschenpark-debate to argue that Sloterdijk is an integral part of our philosophical historical moment. (shrink)

Feminism was born in controversy and it continues to flourish in controversy. The distinguished contributors to this volume provide an array of perspectives on issues including: universal values, justice and care, a feminist philosophy of science, and the relationship of biology to social theory.

Continuous deep sedation at the end of life is a practice that has been the topic of considerable ethical debate, for example surrounding its perceived similarity or dissimilarity with physician-assisted dying. The practice is generally considered to be legal as a form of symptom control, although this is mostly only assumed. France has passed an amendment to the Public Health Act that would grant certain terminally ill patients an explicit right to continuous deep sedation until they pass away. Such a (...) framework would be unique in the world. In this paper we will highlight and reflect on four relevant aspects and shortcomings of the proposed bill. First, that the bill suggests that continuous deeps sedation should be considered as a sui generis practice. Second, that it requires that sedation should always be accompanied by the withholding of all artificial nutrition and hydration. In the most recently amended version of the legal proposal it is stated that life sustaining treatments are withheld unless the patient objects. Third, that the French bill would not require that the suffering for which continuous deep sedation is initiated is unbearable. Fourth, the question as to whether the proposal should be considered as a way to avoid having to decriminalise euthanasia and/or PAS or, on the contrary, as a veiled way to decriminalise these practices. The French proposal to amend the Public Health Act to include a right to continuous deep sedation for some patients is a unique opportunity to clarify the legality of continuous deep sedation as an end-of-life practice. Moreover, it would recognize that the practice of continuous deep sedation raises ethical and legal issues that are different from those raised by symptom control on the one hand and assisted dying on the other hand. The article discusses the following question: why has the traditional philosophy of science been reluctant to seriously deal with scientific controversies? An answer is offered and an alternative is suggested. This alternative gives a leading role to the study of controversies within the framework of the philosophy of science. This proposal is supported, firstly, by a brief review of the research methodology employed by Johannes Kepler and, secondly, by the study of the emergence of quantum mechanics by Mara (...) Beller. The defense of the study of controversies is based on the recognition of the other one as the founding point of scientific objectivity and in the proposal of a kind of triangulation. (shrink)

This paper studies the controversy on Fehr and Schmidt's model of inequity aversion. It borrows insights from disciplines such as philosophy and the sociology of science that have specialized in studying scientific controversies. Our goal is to contribute to the historical and methodological literature on behavioral economics, which happens to have neglected behavioral economists' research on social preferences. Our analysis of the controversy reveals some new insights about the relation of behavioral economics with other sub-fields in economics, as well (...) as with other disciplines. (shrink)

SummaryIn the 1940s a controversy developed between John H. Northrop (Nobel Laureate, 1946) and Max Delbrück (Nobel Laureate, 1969) on the formation of bacteriophage. From the historiography of molecular biology there emerges a picture of an obstinate Northrop who repudiated the ‘correct’ insights revealed by the experiments of Delbrück. The established reputation of Northrop confronts one with the question of why Delbrück's epoch-making experiments were not convincing for Northrop. It will be argued that this was a consequence of local incommensurability (...) between Northrop's physiological/chemical research style and Delbrück's bacteriological/genetic research style. The analysis of this controversy reveals the elements that made up these two research styles. (shrink)
