Legal Judgment Prediction (LJP) is an essential component of legal assistant systems, which aims to automatically predict judgment results from a given criminal fact description. As a vital subtask of LJP, researchers have paid little attention to the numerical LJP, i.e., the prediction of imprisonment and penalty. Existing methods ignore numerical information in the criminal facts, making their performances far from satisfactory. For instance, the amount of theft varies, as do the prison terms and penalties. The major challenge is how (...) the model can obtain the ability of numerical comparison and magnitude perception, e.g., 400 < 500 < 800, 500 is closer to 400 than to 800. To this end, we propose a judicial knowledge-enhanced magnitude-aware reasoning architecture, called NumLJP, for the numerical LJP task. Specifically, we first implement a contrastive learning-based judicial knowledge selector to distinguish confusing criminal cases efficiently. Unlike previous approaches that employ the law article as external knowledge, judicial knowledge is a quantitative guideline in real scenarios. It contains many numerals (called anchors) that can construct a reference frame. Then we design a masked numeral prediction task to help the model remember these anchors to acquire legal numerical commonsense from the selected judicial knowledge. We construct a scale-based numerical graph using the anchors and numerals in facts to perform magnitude-aware numerical reasoning. Finally, the representations of fact description, judicial knowledge, and numerals are fused to make decisions. We conduct extensive experiments on three real-world datasets and select several competitive baselines. The results demonstrate that the macro-F1 of NumLJP improves by at least 9.53% and 11.57% on the prediction of penalty and imprisonment, respectively. (shrink)

He was deeply rooted in—but not confined by—the humanist tradition of Montaigne and Pascal, and this provided him with insights into the wretchedness as well as the grandeur of the human condition and with a conscious (...) Socratic moral and intellectual drive toward self-examination as a prerequisite for any inquiry into human affairs. Indeed, the distinctivecharacter of Ben's scholarship lay in his integration of morality and intellect. These humanistic resources in combination with his outstanding intellectual endowment enabled Ben to reach great heights of scholarly endeavor.To mention just a few of his many enduring achievements: Ben's thesis, advanced as early as 1951 and based on a study of the inner history of the rise of the Chinese Communist movement from a comparative perspective, developed the idea that the trajectory of Marxism eastward to Russia and China was, in fact, "a steady process of decomposition." Furthermore, The World of Thought in Ancient China, Ben's prizewinning magnum opus, which treats the whole range of ancient Chinese thought from a world-historical perspective, has achieved a methodological, no less than a historiographical, breakthrough. Ben's discussion of the need to "descend from the level of total cultural orientations to the level of shared problématiques" advances boldly beyond Max Weber's ideal-typical analysis in comparative world history. Historiographically, Ben's study of the general orientations in ancient China and their dialectical relations with the problématiques manifested in different schools of thought is the most incisive and comprehensive treatment of ancient Chinese thought to date.These great achievements derived from his ability to combine deep insights into historical realities with a humane simplicity in holding onto what is central in life. Such a simplicity was manifest in his spontaneous humility, a quality that furnished him with the moral and intellectual resources by which to develop empathetic understanding of the various strands of thought in China as well as in the West. Ben's analyses of human problems from a world-historical perspective, while characteristically erudite, subtle, complex, and at times extraordinarily brilliant, were singularly free from any trace of the influence of intellectual fashions and from any sort of [End Page 187] posturing or self-exhibition. The present research attempts to understand the importance of altruistic and egoistic values in determining consumers’ motives and intention to purchase organic foods. Using the face-to-face survey approach, a total of 1,067 responses were collected from consumers in China. Data analysis was performed using a two-step structural equation modeling approach, i.e., measurement and structural models. The findings indicated that both values influence the intention to purchase organic foods through the mediation of motives. Specifically, the altruistic value influences the environmental concern, (...) and the egoistic value influences the health concern. Moreover, the perceived uncertainty negatively moderates a relationship between consumer HC and organic purchase intention while positively moderating a relationship between consumer EC and organic purchase intention. Schwartz' "China and Contemporary Millenarianism—Something New under the Sun"Lin Yu-shengIn the spring of 1998, my colleague Mike Clover, a historian of the ancient West and an admirer of Benjamin I. Schwartz' The World of Thought in Ancient China, invited Professor Schwartz to participate, with Heiko Oberman, J. C. Heesterman, and Catherine Coquery-Vidrovitch, among others, in a conference he had been organizing on "Eurasia and Africa (...) during the Last Thousand Years." The essay that follows—the last piece of scholarly writing by Ben Schwartz, finished thirty-seven days before his passing—was read by me on his behalf at the conference, held on October 11 and 12, 1999, in Madison.From my telephone conversations with Ben in the summer of 1999, I learned that while he intended to work on a paper for the conference to be titled "The Idea of Unilinear Evolution and the Destinies of China," his attention was very much drawn to the fact of the onset in America of unbridled consumerism and materialism, whose characteristic of feeding on themselves with ever increasing intensity and widespread impact seemed to indicate to him the rise of a profoundly disturbing new phenomenon in this world. When I visited with Ben and Bunny (Mrs. Schwartz) in Cambridge on October 2 and 3, Ben was in the midst of writing an essay on what he would call the "new technological-economic millenarianism" or "materialistic apocalypticism." He said that he preferred to have me read this essay, which he would finish before the conference, rather than the one he originally intended to write. Since the conference was meant to take note of the significance of the passage of time from a world-historical perspective, the reflections by a thinker as deeply serious and searching as Ben Schwartz at the juncture of the end of the second millennium and the beginning of the third on the implications of an entirely new worldwide phenomenon as he perceived it—though having little direct bearing on China's past—would of course be most welcome at the conference.Ben's health deteriorated almost immediately after he had completed the essay on Friday, October 8, and he died on November 14, 1999. We now know from hindsight that Ben had probably felt that he might soon leave us, but he summoned enough energy not to let this happen before his completion of the essay, partly due to his sense of responsibility to deliver what he had promised and partly, and more importantly, because of the imperative he felt to issue, in the spirit of the old prophets, as his parting words, a grave warning to his fellow human beings.The essay is discursive, with many important points implied through nuance rather than formally argued. We can hardly expect more, given the physical condition of its author at the time of its writing. The “wisdom of the crowd” phenomenon refers to the finding that the aggregate of a set of proposed solutions from a group of individuals performs better than the majority of individual solutions. Most often, wisdom of the crowd effects have been investigated for problems that require single numerical estimates. We investigate whether the effect can also be observed for problems where the answer requires the coordination of multiple pieces of information. We focus on combinatorial problems such as the planar Euclidean (...) traveling salesperson problem, minimum spanning tree problem, and a spanning tree memory task. We develop aggregation methods that combine common solution fragments into a global solution and demonstrate that these aggregate solutions outperform the majority of individual solutions. These case studies suggest that the wisdom of the crowd phenomenon might be broadly applicable to problem-solving and decision-making situations that go beyond the estimation of single numbers. In view of the fact that vigorously promoting recycling has become a viable means to promote sustainable development, it is important to better understand the impact of recycling efforts on subsequent resource saving behavior. This research empirically examines the effects of recycling efforts on subsequent resource saving by analyzing the survey data of 356 college students in China. The recycling efforts, environmental self-identity and feeling of pride were measured using existing scales while saving behaviors and recycling cost were measured by (...) developing new scales. Partial least squares structural equation modeling was performed to test the structural relationships among recycling efforts, environmental self-identity, feeling of pride, and saving behaviors. Further, the moderation role of recycling cost was tested. The results showed that saving behaviors could be classified into two types based on their costliness; recycling efforts have a positive effect on costless saving behaviors, while having a negative effect on costly saving behaviors; both the positive and negative effect of recycling efforts on resource saving is mediated by pride feeling and environmental self-identity; and recycling cost negatively moderates the effects of recycling efforts on pride feeling. This essay defends the moral permissibility, as a form of punishment, of banishment, namely the exclusion by a state of a citizen from its territory. I begin by outlining the prima facie case for banishment, consider for whom it may be appropriate, and acknowledge constraints on its permissibility. I then defend banishment against the main objections in the literature to banishment or the related measure of denationalization (stripping citizens of their citizenship): impermissible permanency; excessive severity; ineffectiveness; unfairness to those who (...) are punished and the creation of two classes of citizens; unfairness among states; and that banishment without denationalization is incompatible with the nature of citizenship. I adopt a ‘cantilever strategy’: if incarceration is permissible notwithstanding a certain objection, so is banishment. In concluding, I sympathetically discuss the view that, despite the moral permissibility of banishment, the power to banish should not be instituted because of the risk of abuse. (shrink)

Patients with Wilson’s disease suffer from prospective memory impairment, and some of patients develop cognitive impairment. However, very little is known about how brain structure and function changes effect PM in WD. Here, we employed multimodal neuroimaging data acquired from 22 WD patients and 26 healthy controls who underwent three-dimensional T1-weighted, diffusion tensor imaging, and resting state functional magnetic resonance imaging. We investigated gray matter volumes with voxel-based morphometry, DTI metrics using the fiber tractography method, and RS-fMRI using the seed-based (...) functional connectivity method. Compared with HC, WD patients showed GM volume reductions in the basal ganglia and occipital fusiform gyrus, as well as volume increase in the visual association cortex. Moreover, whiter matter tracks of WD were widely impaired in association and limbic fibers. WM tracks in association fibers are significant related to PM in WD patients. Relative to HC, WD patients showed that the visual association cortex functionally connects to the thalamus and hippocampus, which is associated with global cognitive function in patients with WD. Together, these findings suggested that PM impairment in WD may be modulated by aberrant WM in association fibers, and that GM volume changes in the association cortex has no direct effect on cognitive status, but indirectly affect global cognitive function by its aberrant functional connectivity in patients with WD. Our findings may provide a new window to further study how WD develops into cognitive impairment, and deepen our understanding of the cognitive status and neuropathology of WD. (shrink)

Although environmental issues have attracted public attention, there are still many people unwilling to make behavioral changes to solve the problem, which makes promoting pro-environmental behavior become an interesting research topic. This study discusses the influence of air quality on the pro-environmental behavior of Chinese residents from the perspective of spatial distance, providing a theoretical basis and practical application for improving pro-environmental behavior. Through three experiments, this study reveals that air pollution within the local spatial distance could make residents more (...) willing to conduct pro-environmental behavior. In addition, we also find that air pollution within local spatial distance would stimulate residents’ environmental affection and promote them to conduct pro-environmental behavior. That is, environmental affection plays a mediating role in the interactive effect of air quality and spatial distance on pro-environmental behavior. (shrink)

This study explores both the negotiating styles and moral reasoning processes of business people and governmental officials in Taiwan, so as to provide a footing for outsiders when negotiating with Taiwanese over environmental concerns. Findings imply that Taiwanese business people and governmental officials can and will reason both at the conventional level and at the postconventional level of moral judgment. But, results of this study also indicate that Taiwanese negotiating styles do not necessarily match their levels of moral reasoning. With (...) respect to pollution concerns, Taiwanese seem unwillingly to accept responsibility as autonomous individuals. Instead, responsibility is accepted when mandated by the law. (shrink)

For the sake of convenience of analysis, situations of moral actions are classified into four categories. It is shown that morality is flexible, especially in the positive sense, in that a virtuous action can be taken in various ways and/or to various degrees. For some situations it is inherently unclear what the moral requirement is, and whether it is a (...) maximum or a minimum. It is concluded that the schism of the principle of utility between the principle of the good and the principle of the right seems to be inevitable, and the interpretation of the ultimate criterion for maximal utility should be relaxed or interpreted separately and differently according to the situation of action. ObjectiveNumerous studies have demonstrated that religious belief is associated with prosocial behavior. However, how do they maintain cooperation in societies with a predominating atheist population, such as China? Different primings and a quasi-experiment are used to examine the link between communist authority and prosocial behaviors among college students in China.Materials and methodsIn Study 1, the subjects’ communist authority in the university lab was primed by a communist-authority video. In Study 2, we compared the priming effects of communist authority and religion (...) on prosocial intention. Study 3 investigated the priming effect of communist authority on prosocial behaviors by employing a scrambled sentence task in the university lab. A quasi-experiment was conducted in Study 4.ResultsResults showed that communist-authority, a reminder of secular authorities, increased prosociality among college students. And empathy moderated the relationship between secular authorities and prosociality in Study 3 and Study 4.DiscussionCommunist authority, a secular authority prime, has a positive effect on promoting prosocial behaviors. These results provided a feasible yet novel way to reveal the mechanism of the relationship between secular authorities and prosociality in China. (shrink)

“Embodiment of God” is understood by me as “the appearance of God,” and in terms of “divinity,” “holy,” and “Being.” Heidegger states in “Letter on Humanism”: “Only from the truth of Being can the essence of the holy be thought. Only from the essence of the holy is the essence of the divinity to be thought. Only in the light of the essence of divinity can it be thought or said what the word ‘God’ is to signify.”1 This statement basically (...) shows how the latter stage, namely “God” appears or is embodied in the world. It also manifests how Heidegger understands onto-theology. “Letter on Humanism” was written in 1946. Is such a relation between ontology and theology to be found in Heidegger’s early works? What of Heidegger’s position after 1946? How can we understand Heidegger’s position on God according to his works in general with regard to my formulation of it as the “embodiment of God”? (shrink)

This paper begins with a discussion of the thesis that politics is a kind of téchne, as Aristotle states. He defines téchne as being the opposite of túche. Hence, politics is neither an exact science nor an accidental opinion; it is, rather, a teachable art or skill. Based on this theme, the paper investigates how Hannah Arendt interprets political freedom in the public sphere as the will of the plural citizens, facing an uncertain future, attempting to still the disquiet of (...) the collective ego. A comparison between Arendt and Heidegger could be made if we further investigate Heidegger’s understanding of political freedom in the public sphere based on his comprehension of the will of Da-sein and the enowning of Being. The burgeoning of new technologies is increasingly affecting people’s lives. One new technology that is heatedly discussed is artificial intelligence in education. To allow students to understand the impact of emerging technologies on people’s future lives from a young age, some popular science activities are being progressively introduced into elementary school curricula. Popular science activities are informal education programs and practices of universal education. However, two issues need to be discussed in the implementation of these activities. First, because these informal (...) curricula are usually short in duration, the question of whether they only serve to generate motivation or actually enhance learning outcomes requires examination. Second, the role of teacher support in popular science activities and its impact on students’ learning results need to be further investigated. To this end, this study aims to explore the effectiveness of popular AI science activities in informal curricula on students’ AI achievement and the interrelationship between students’ learning outcomes in popular AI science activities with and without teacher support. A 6-h-long AI popular science activity was conducted with 22 fifth- and sixth-grade students in elementary school. This study was conducted using a one-group pretest and posttest design, and the data collection tools included AI achievement pre- and posttests and an artifact scoring rubric. The results showed that with regard to learning outcomes, popular science activities were helpful for cognitive enhancement of AI concepts, but more time was needed for skills to improve. Additionally, this study found that students’ learning performance was different with and without teacher support. Activities with teacher support can enhance students’ learning outcomes, but students become accustomed to relying on their teachers. In contrast, activities without teacher support seem to be more effective in fostering students’ independent computational thinking and problem-solving abilities. (shrink)

This paper examines the effect of the image of destinations on the wage income of resident households, and the corresponding income inequality, from a novel perspective. This work uses China’s excellent tourism city image program, which is an urban planning policy implemented by the central government across cities to enhance the image of the city destination in the minds of tourists, and then promote tourist motivation and local tourism development to assess the effect on household wage income and its distribution. Results show that the program significantly increases household wage income by increasing employment opportunities, promoting business and population agglomeration, and improving urban infrastructure. Previously, language teaching has been focused on the passive learning of the alphabet. In addition, the research on teaching listening and speaking skills was limited. Listening skill is the key to learning a language, and speaking is the first explicit behavior of language. In order to improve language skills which are emphasized in new curriculum guidelines, student-centered thematic language teaching is considered as valuable. Through this, the concepts of multiple intelligences and curriculum integration were re-emphasized. An experimental design was adopted (...) in the current study. This study was conducted with the participation of 224 students from the Department of Multimedia Design in universities in the south of Taiwan. The research data were collected between September 2021 and December 2021. The implementation process took 16 weeks of thematic language teaching. The research results revealed 1. significant positive effects of thematic language teaching on listening, 2. significant positive effects of thematic language teaching on speaking skill, and 3. significant negative effects of thematic language teaching on learning anxiety. According to the results, it is expected that this study can help multimedia design students improve their listening and speaking skills as well as core language skills. (shrink)
