Corporate social responsibility (CSR) and its action-oriented offspring Corporate Citizenship (CC) currently trigger an intensifying debate on ethics, role and behavior of companies within civil society. For companies, CSR raises the question of what may be the "good reason(s)" for acting responsible towards its members, customers or society. In order to answer this question, we face the debate on CSR and its strategic engagement drivers on the levels of corporate culture, social innovation, and civil society. In this article, we provide (...) a conceptual framework based on the analytic distinction of legitimation and sensemaking. The conceptual framework developed in this article can serve as a basis to develop a company's CSR strategy. Aristotle's Categories can easily seem to be a statement of a naïve, pre-philosophical ontology, centered around ordinary items. Wolfgang-Rainer Mann argues that the treatise, in fact, presents a revolutionary metaphysical picture, one Aristotle arrives at by (implicitly) criticizing Plato and Plato's strange counterparts, the "Late-Learners" of the Sophist. As Mann shows, the Categories reflects Aristotle's discovery that ordinary items are things (objects with properties). Put most starkly, Mann contends that there were no things before Aristotle. The author's argument consists (...) of two main elements. First, a careful investigation of Plato which aims to make sense of the odd-sounding suggestion that things do not show up as things in his ontology. Secondly, an exposition of the theoretical apparatus Aristotle introduces in the Categories--an exposition which shows how Plato's and the Late-Learners' metaphysical pictures cannot help but seem inadequate in light of that apparatus. In doing so, Mann reveals that Aristotle's conception of things--now so engrained in Western thought as to seem a natural expression of common sense--was really a hard-won philosophical achievement. The main interest of the doctrine of duties in the 18th century aims at the systematic differentiation of two classes of duties known as perfect and imperfect duties, as negative and positive duties, as duties of abstinence and duties of performance, as duties of debtiness and duties of conscience and benevolence. This paper follows the history of this differentiation and classification of the duties from Grotius, Pufendorf, Leibnitz, Thomasius, Mendelssohn and the early Kantians to Kant, especially to the Kant of (...) the "Doctrine of Virtue" , which takes up the distintive marks and distinguishing features of Kant's predecessors and integrates them into a consistent system of duties. Its fundamental distinction between two spheres of norms and classes of duties having their foundation in the difference of a negative determinate principle of actions and an affirmative indeterminate principle of ends is significant for the present ethical discussions as well. Die Philosophie der Wahrnehmung der letzten Jahrzehnte ist stark geprägt von der Begrifflichkeitsdebatte. Dabei ist allerdings eine dialektische Pattstellung zu erkennen: während die Begrifflichkeitsthese für gewöhnlich mit der epistemischen Rolle er Wahrnehmung begründet wird, verweisen Argumente für die Nichtbegrifflichkeitsthese zumeist auf die qualitative Reichhaltigkeit und die erlebnismäßig gegebenen, also phänomenologischen Aspekte der Wahrnehmung. Um diese Pattstellung zu überwinden, skizziere ich in diesem Beitrag Überlegungen für ein Argument für die Begrifflichkeitsthese, das wesentliche auf den phänomenologischen Aspekten der Wahrnehmung beruht.

Kaum einem anderen Fach haftet der Ruf des Komplizierten und Formellastigen so stark an, wie der Physik. Doch sind viele der grundlegenden Konzepte und Prinzipien auch ohne tiefere mathematische Ausbildung verständlich. We argue that Wittgenstein’s philosophical perspective on Gödel’s most famous theorem is even more radical than has commonly been assumed. Wittgenstein shows in detail that there is no way that the Gödelian construct of a string of signs could be assigned a useful function within (ordinary) mathematics. — The focus is on Appendix III to Part I of Remarks on the Foundations of Mathematics. Hardback, €59.00.According to its author, this book aims at reconstructing key parts of Abelard's logic while denying him a role as a hero of connexive logic or more generally as one of history's greatest logicians. At the end of the preface, we are told that "Abaelard hat die Logik seiner Zeit (...) nicht revolutioniert; er hat keine Kalküle konstruiert; und er hat auch nicht die Logik seiner Zeit auf ein höheres Niveau gehoben" (xiv).The book is divided into twenty-three chapters with titles such as "'Destruierende' versus 'separierende' Negation," "Vollkommene und unvollkommne Folgerungen," and "'Leere' Begriffe." As the titles show, it ranges over a large field. The results of Lenzen's analyses of Abelard's argumentation are presented in modern logical notation. There are many fine analyses, and despite Lenzen's refusal to see Abelard as a genius, he, too, seems to have been quite impressed by the old logician. However, at the end of the day, I am not sure that I have become any wiser about Abelard's contribution to the history of logic.Lenzen is a newcomer to the study of twelfth-century logic, and the book is marked by this in several ways. Thus, he informs the reader that "Spätestens seit Prantls Publikation der 'Geschichte der Logik im Abendlande' steht fest, dass Abaelards Traktat 'De Sillogismis Ypoteticis' sich stark an das Werk 'De syllogismo hypothetico' von Boethius (470–524) anlehnt" (165). This is quite true, but anything else would have been very remarkable, so the reference to Prantl serves no purpose.Unsurprisingly, the main source texts used are Abelard's Dialectica and his Glosae super Peri hermeneias, a part of the series of commentaries on the Ars vetus that go under the common name of Logica ingredientibus. Lenzen displays a cavalier attitude to philology. He quotes the Dialectica from De Rijk's second edition (1970), but in the bibliography he mentions that there are two editions without stating explicitly which one he quotes. In the case of the Glosae, he uses the obsolete editio princeps by Bernhard Geyer from 1927, and he does not even mention its replacement, Klaus Jacobi and Christian Strub's much superior 2010 edition in the series Corpus Christianorum, Continuatio Mediaevalis. This is inexplicable, for in his preface Lenzen describes his book as the child of a research project he began several years after the publication of the new edition. Now, fortunately, the use of Geyer does not have disastrous consequences for Lenzen's interpretation of Abelard, but had he used Jacobi and Strub's edition, he would not have had to propose a textual emendation in one place (88n17), nor would he have needed to quote, in another place, a Latin text (which he does not translate) with a nonsensical significantem instead of figurative (94n1o).Lenzen sometimes proposes textual emendations, but not always in a perspicuous way, and they are not all felicitous. For example, a quotation of L. M. de Rijk's edition of Introductiones Montane Minores in Logica Modernorum (LM) II.2 (1967) contains the phrase aliquod opposit[or]um (127n2). An unsuspecting reader would think this means De Rijk had conjecturally emended oppositorum into oppositum, for this is what opposit[or]um would mean in LM II.2. In fact, De Rijk just prints oppositum, so Lenzen's opposit[or]um must mean that he wants to correct De Rijk's text by inserting 'or,' but he forgets to tell us that he does not [End Page 520] faithfully reproduce the text quoted and that his square brackets mean something different from what they do in De Rijk's edition. This issue aside, his conjecture is superfluous, as proven by a parallel passage in LM II.2: 118. Similarly, he quotes Abelard as saying "alterum istorum [est]: vel nox vel dies" (152). The "[est]" is Lenzen's own, again superfluous, contribution to the text. By contrast, elsewhere he proposes to insert a non at LM II.2: 64.2. Abstract:While the medical ethics literature has well explored the harm to patients, families, and the integrity of the profession in failing to disclose medical errors once they occur, less often addressed are the moral and professional obligations to take all available steps to prevent errors and harm in the first instance. As an expanding body of scholarship further elucidates the causes of medical error, including the considerable extent to which medical errors, particularly in diagnostics, may be attributable to cognitive sources, (...) insufficient progress in systematically evaluating and implementing suggested strategies for improving critical thinking skills and medical judgment is of mounting concern. Continued failure to address pervasive thinking errors in medical decisionmaking imperils patient safety and professionalism, as well as beneficence and nonmaleficence, fairness and justice. We maintain that self-reflective and metacognitive refinement of critical thinking should not be construed as optional but rather should be considered an integral part of medical education, a codified tenet of professionalism, and by extension, a moral and professional duty. There appears to be a tension between two commitments in liberalism. The first is that citizens, as rational agents possessing dignity, are owed a justification for principles of justice. The second is that members of society who do not meet the requirements of rational agency are owed justice. These notions conflict because the first commitment is often expressed through the device of the social contract, which seems to confine the scope of justice to rational agents. So, contractarianism seems to ignore (...) the justice claims of the severely cognitively impaired. To solve this problem, Martha Nussbaum proposes the capabilities approach. The justifiability condition, on this approach, is met by the idea of overlapping consensus. This essay argues that overlapping consensus cannot meet liberalism’s justifiability condition, nor is it more inclusive of the cognitively impaired. Therefore, we have reason to retain the contract device and look for another way to ensure that liberalism respects the justice claims of all. (shrink)

Existing justifications for exclusionary rules and stays of proceedings in response to pre-trial wrongdoing by police officers and prosecutors are often thought to be counter-productive or disproportionate in their consequences. This article begins to explore whether the concept of standing to blame can provide a fresh justification for such responses. It focuses on a vice related to standing—hypocrisy—and a related vice concerning inconsistent blame. It takes seriously the point that criminal justice agencies, although all part of the State, are in (...) real terms separated from each other, and analyses the so-called separation thesis (or theses). It concludes that hypocrisy and inconsistent blame arguments could plausibly justify exclusion and stays only in relation to lower-level offending, and even there only indirectly. This is in the sense that exclusion and stays are expressions of judicial frustration with other bodies for their failure to take pre-trial wrongdoing seriously. (shrink)

Die „Grundlage der gesamten Wissenschaftslehre“ bleibt für den, der Fichte im philosophiegeschichtlichen Zusammenhang sehen will, der wichtigste Text; dies gilt auch dann noch, wenn die Akademie-Ausgabe abgeschlossen sein wird. Der Jenaer Fichte hat nicht nur auf seine Zeitgenossen am stärksten gewirkt, er war auch seinerseits damals noch am offensten für Einflüsse. Der vorliegende Kommentar – der erste, der den gesamten deutschen Text behandelt – bietet keine Paraphrase, keine Übersetzung in eine zeitgemäßere Sprache, keine „Darstellung“, die Fichtes Disposition durch eine eigene (...) ersetzt und damit – gewollt oder ungewollt – in Konkurrenz zum Original tritt. Er will vielmehr den Leser auf seinem dornigen Pfad Satz für Satz begleiten und bei keiner Schwierigkeit im Stich lassen. Die konkrete Erforschung literarischer Bezüge und Abhängigkeiten zeigt, wie sehr der „Selbstdenker“ Fichte – unbeschadet seiner Eigenständigkeit – nicht nur in der Philosophie, sondern im ganzen Geistesleben der Epoche verwurzelt ist. Durch die ausgiebigen, mit sprachlichen Erläuterungen versehenen Zitate entlegener Quellen ist der Kommentar zugleich eine Art Lesebuch. (shrink)
