Der logische Status dessen, was in der Hegelschen Terminologie «Begriff» heisst, kann nur als seine eigene Genese zur Darstellung kommen. In ihm sind die Formen der Positivität, die durch die Subjekt-Objekt-Relation charakterisiert sind, als Momente enthalten. Die Einsicht in die einzelnen Formen der Positivität ermöglicht es, sich einen Begriff von der Sprachlichkeit des Selbstbewusstseins zu machen.

Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. (...) Die Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. Both Michael Oakeshott and Carl Schmitt were deeply preoccupied with what Oakeshott called ‘the experience of living in a modern European state’; both felt that the state's proper origins and trajectory had not been grasped, that proper statehood had profoundly been put into doubt in the twentieth century, and that state authority and legitimacy needed to be shored up in an age of ‘mass politics’. Not surprisingly, then, both developed their conception of political association with and sometimes against Hobbes. (...) Both profoundly disagreed with conventional readings of Hobbes as propounding a materialist or ‘scientistic’ philosophy. Most importantly, both consistently de‐emphasized, or entirely discounted, Hobbes's contractualism – they cut off any possible route from Hobbes's thought to liberal theories of explicit or tacit consent. Instead, both stressed a concern with the cultural preconditions of political order. Oakeshott's civil association turned out to be an idealized picture of modern European individualism as a unique civilizational achievement that sustained a very limited state whose authority could only be acknowledged, rather than contested. Schmitt, on the other hand, advocated a deeply authoritarian fusion of political and religious elements, a sort of neo‐Erastian dictatorship as the solution to the problem of political order. Idiosyncratic as these visions might appear, they in fact sum up two ways of thinking about political order still prevalent today: the notion that liberal democracy is only for the West; and the idea that, ultimately, political cohesion depends on a shared religious mentality. A popular principle about grounding, “Internality”, says that if A grounds B, then necessarily, if A and B obtain, then A grounds B. I argue that Internality is false. Its falsity reveals a distinctive, new kind of explanation, which I call “ennobling”. Its falsity also entails that every previously proposed theory of what grounds grounding facts is false. I construct a new theory.

Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

The Information Artifact Ontology (IAO) was created to serve as a domain‐neutral resource for the representation of types of information content entities (ICEs) such as documents, data‐bases, and digital im‐ages. We identify a series of problems with the current version of the IAO and suggest solutions designed to advance our understanding of the relations between ICEs and associated cognitive representations in the minds of human subjects. This requires embedding IAO in a larger framework of ontologies, including most importantly the Mental (...) Func‐tioning Ontology (MFO). It also requires a careful treatment of the aboutness relations between ICEs and associated cognitive representa‐tions and their targets in reality, which implies in turn a new treatment of the relation of truthmaking. The Cambridge History of Renaissance Philosophy, published in 1988, offers a balanced and comprehensive account of philosophical thought from the middle of the fourteenth century to the emergence of modern philosophy. This was the first volume in English to synthesise for a wider audience the substantial and sophisticated research now available. The volume is organised by branch of philosophy rather than by individual philosopher or school, and the intention has been to present the internal development of different aspects of the (...) subject in their own historical context. On peut inscrire les travaux de Engel dans le sillage rationaliste des Pères de la philosophie analytique, mais après le tournant naturaliste opéré par Quine. Ce sont les diverses bonnes raisons, exposées de manière non systématique par Engel, d’associer naturalisme et rationalisme que je souhaite présenter tout en cherchant à identifier la difficulté constitutive de ce programme qui ne reçoit pas de solution complète: la normativité épistémique ne semble ni éliminable, ni correctement intégrée à ce programme.

Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the (...) limits of knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)

Cette refondation s’appuie sur ses propres travaux empiriques, notamment sur le religieux, sur l’usage de méthodes plus pointillistes comme la photographie ou la description des détails, ainsi que sur des hypothèses relatives à la différence entre Sapiens et Néandertal. Les nouvelles propositions de travail qu’il avance empruntent souvent à la philosophie comme moyen d’une réflexion épistémologique, mais aussi parfois à la métaphysique. C’est pourquoi (...) je me propose de discuter en philosophe son ouvrage Contre le relationnisme. Lettre aux anthropologues. Il ne s’agit pas de réactiver la pratique philosophique de la science ultime couronnant les autres disciplines grâce à une réflexivité plus radicale, mais de suivre la démarche de Piette dans ses motivations profondes qui, comme il l’admet lui-même, l’oblige à passer par la philosophie. In dieser Arbeit wird ein erster Schritt unternommen, die traditionelle wissenschaftliche Konzeption der Psychologie im Diskurs des Radikalen Konstruktivismus zu betrachten und die Grundlegung einer neuen radikal konstruktivistischen Psychologie zu versuchen. Dabei stellen sich mehrere Aufgaben: - erstens muß ein geeigneter erkenntnistheoretischer Standpunkt für die Analyse, den Ver gleich bzw. dessen Diskurs gefunden werden, - zweitens muß in groben Umrissen eine Fragestellung für den Vergleich von traditionel lem und neuem Paradigma entworfen werden, - drittens ist es notwendig, das vorherrschende wissenschaftliche (...) Paradigma der Psycholo gie offenzulegen, schließlich ist - viertens das neue Paradigma des Radikalen Konstruktivismus, insofern es für eine wis senschaftliche Psychologie geeignet ist, darzustellen, und nicht - zuletzt muß auch der Nachweis angetreten werden, daß eine radikal konstruktivistische Psychologie überhaupt möglich ist. Diese fünf Problemkreise entsprechen im großen und ganzen dem Aufbau dieser Ar beit, wobei aufgrund der engen Verflechtung dieser Aufgaben zahlreiche Wechselbezie hungen und Querverbindungen bestehen, die eine bloß - für manche vielleicht wünschens werte - lineare Anordnung nicht immer zulassen. Es ist für den Diskurs des Radikalen Konstruktivismus geradezu kennzeichnend, daß in ihm ein Ende immer zugleich ein An fang ist bzw. vice versa, sodaß er sich grundsätzlich als niemals abschließbarer zirkulärer Prozeß darstellt, dessen erster Durchlauf in dieser Arbeit geleistet werden soll. According to orthodoxy, the most fundamental kind of causation involves one event causing another event. I argue against this event‐causal view. Instead, the most fundamental kind of causation is thing causation, which involves a thing causing a thing to do something. Event causation is reducible to thing causation, but thing causation is not reducible to event causation, because event causation cannot accommodate cases of fine‐grained causation. I defend my view from objections, including C. D. Broad's influential “timing” argument, and I (...) conclude with implications for agent‐causal theories of free will. (shrink)

Affective congruency effects in the evaluation task can be explained by either spreading of activation or response competition. Eliminating effects of response compatibility by using other tasks (semantic categorisation, naming task) typically also eliminates affective congruency effects. However, there is no need for processing the affective information of the stimuli in these tasks either, which could be necessary for an affectively mediated spreading of activation (Spruyt et al., 2007, 2009, 2012). We introduced a new task to further test this hypothesis. (...) The valent/neutral-categorisation task does not confound affective congruency with response compatibility, but still requires a processing of the stimuli's valence. No affective congruency effect was obtained with this task in two experiments, disfavouring a conditional spreading activation account. On the other hand, a significant priming effect was found for associated word pairs in Experiment 1, providing evidence for the sensitivity of the task to detect spreading activation processes. Health Level 7 (HL7) is an organization seeking to provide universal standards for the exchange of healthcare information. In a document entitled ‘HL7 Version 3 Standard: Data Types’, the HL7 organization advances descriptions of data types recom- mended for use as identifiers. We will argue that the descriptions supplied provide insufficient guidance as to what exactly the entities are which these data types uniquely identify. Are they real things, such as persons or pieces of equipment? Or are they representations of (...) such real things in information artifacts? We here outline the problems faced by HL7 in providing answers to such questions, problems which arise because of the lack of anything like a coherent ontology in the HL7 standard, and we make some recommendations for future improvements. Modal dispositionalists hold that dispositions provide the foundation of metaphysical necessity and possibility. According to the kind of modal dispositionalism that can be found in the present literature, a proposition p is possible just in case some things are disposed to be such that p. In the first part of this paper I show that combining this classic form of dispositionalism with the assumptions that the laws of nature are necessary and deterministic and that all dispositions are forward-looking in time (...) leads to the unattractive conclusion that every truth is necessary. I argue that the classic dispositionalist should be troubled by this result and in the second part of the paper I suggest a novel variant of dispositionalism that avoids it. This extended form of dispositionalism allows that some propositions are only indirectly underwritten by dispositions. (shrink)

Referent tracking (RT) is a new paradigm, based on unique identification, for representing and keeping track of particulars. It was first introduced to support the entry and retrieval of data in electronic health records (EHRs). Its purpose is to avoid the ambiguity that arises when statements in an EHR refer to disorders or other entities on the side of the patient exclusively by means of compound descriptions utilizing general terms such as ‘pimple on nose’ or ‘small left breast tumor’. In (...) this paper, we describe the theoretical foundations of this paradigm and show how it is being applied to the solution of analogous problems of ambiguous identification in the fields of digital rights management, corporate memories and decision algorithms. Definitive diagnosis of malaria requires the demonstration through laboratory tests of the presence within the patient of malaria parasites or their components. Since malaria parasites can be present even in the absence of malaria manifestations, and since symptoms of malaria can be manifested even in the absence of malaria parasites, malaria diagnosis raises important issues for the adequate understanding of disease, etiology and diagnosis. One approach to the resolution of these issues adopts a realist view, according to which the needed (...) clarifications will be derived from a careful representation of the entities on the side of the patient which form the ultimate truthmakers for clinical statements. We here address a challenge to this realist approach relating to the diagnosis of malaria, and show how this challenge can be resolved by appeal to Basic Formal Ontology (BFO) and to the Ontology for General Medical Science (OGMS) constructed in its terms.
