In recent years, a growing body of work has emerged in legal theory that focuses on the relationship between law and virtue. Part of this virtue jurisprudence literature deals with the role of virtue in adjudication and judicial decision-making, with leading authors claiming that virtue plays a central explanatory and normative role. This article engages with this literature on virtue in adjudication, and connects it with a contemporary phenomenon that poses a risk for courts and judges, namely the politicisation of (...) judiciaries. In particular, the question emerges whether virtue jurisprudence is able to provide practical guidance to judges and courts in order to help them avert such politicisation. I sketch the outlines of two contrasting answers to this question, by exploring two alternative approaches to understanding the politicisation of judiciaries from within a broadly virtue-ethical framework. On the first approach, it appears that judges may help prevent politicisation, by becoming more attentive to the tragic character of particular cases and by deciding as civic friends. However, on the other approach, which builds on Alasdair MacIntyre’s critique of modern moral discourse, politicisation appears to be intractable, and the practical recommendations following from the first perspective may even aggravate it. Each day, a countless number of items is sold through online auction sites such as eBay and Ricardo. Though abuse is being reported more and more, transactions seem to be relatively hassle free. A possible explanation for this phenomenon is that the sites’ reputation mechanisms prevent opportunistic behavior. To analyze this issue, we first summarize and extend the mechanisms that affect the probability of sale of an item and its price. We then try to replicate the results as found in (...) four recent papers on online auctions. Our analyses reveal that (1) it makes sense to differentiate between ‘power sellers’ and the less regular users, (2) there are variables that have an effect on sales that are often not controlled for, (3) one should carefully consider how reputation is operationalized, ( 4) neglecting heteroscedastidty in the data can have serious consequences, and (5) there is some support indicating that effects differ across auction sites. Este artículo tiene como objetivo clarificar algunas nociones fundamentales de la reconstrucción del cristianismo de Søren Kierkegaard . En primer lugar, se hará una distinción entre creencia histórica y fe cristiana, que sirve de base para entender la relación existencial que el individuo puede desarrollar con la enseñanza de Cristo. Seguidamente, se hará alusión al concepto de espíritu que propone el pensador danés, demarcando con esto los estadios kierkegaardianos de la existencia. En las últimas dos décadas, la relación directa o indirecta de Kierkegaard con la nueva fenomenologíase ha vuelto un tópico de creciente interés. Haciendo eco de este ánimo, en este artículo pretendo leerdos niveles del pensamiento de Kierkegaard a partir de las directrices generales de la nuevafenomenología. El primer estadio refiere al carácter descentrado del sujeto kierkegaardiano frente aDios, modulación que se entrelaza con una inversión de la intencionalidad husserliana. Por otro lado,el segundo escalón apunta a la intersubjetividad, en tanto (...) el reconocimiento de y la responsabilidadhacia los otros. In this paper, I aim to show the evolution of Kierkegaard’s views on the state scattered in his Papers. To do this, I will carry out an analysis divided into chronological periods, and I will characterize each period in terms of its main features. The goal is to give a comprehensive account of Kierkegaard as a champion of the monarchical and authoritative state, who loses his patience and attacks the established order only when he thinks that Christianity’s truth is at (...) the greatest risk. This interpretation contrasts both with a mere despotic Kierkegaard and with a more liberal one. (shrink)

Eye gaze is a ubiquitous cue in child–caregiver interactions, and infants are highly attentive to eye gaze from very early on. However, the question of why infants show gaze-sensitive behavior, and what role this sensitivity to gaze plays in their language development, is not yet well-understood. To gain a better understanding of the role of eye gaze in infants' language learning, we conducted a broad systematic review of the developmental literature for all studies that investigate the role of eye gaze (...) in infants' language development. Across 77 peer-reviewed articles containing data from typically developing human infants in the domain of language development, we identified two broad themes. The first tracked the effect of eye gaze on four developmental domains: vocabulary development, word–object mapping, object processing, and speech processing. Overall, there is considerable evidence that infants learn more about objects and are more likely to form word–object mappings in the presence of eye gaze cues, both of which are necessary for learning words. In addition, there is good evidence for longitudinal relationships between infants' gaze following abilities and later receptive and expressive vocabulary. However, many domains are understudied; further work is needed to decide whether gaze effects are specific to tasks, such as word–object mapping or whether they reflect a general learning enhancement mechanism. The second theme explored the reasons why eye gaze might be facilitative for learning, addressing the question of whether eye gaze is treated by infants as a specialized socio-cognitive cue. We concluded that the balance of evidence supports the idea that eye gaze facilitates infants' learning by enhancing their arousal, memory, and attentional capacities to a greater extent than other low-level attentional cues. However, as yet, there are too few studies that directly compare the effect of eye gaze cues and non-social, attentional cues for strong conclusions to be drawn. We also suggest that there might be a developmental effect, with eye gaze, over the course of the first 2 years of life, developing into a truly ostensive cue that enhances language learning across the board. The focus of this paper is a large painting in the Kunsthistorisches Museum in Vienna, often attributed to Anthony Van Dyck in collaboration with Frans Snijders, which illustrates a fish market with figures engaged in a purchase. Clearly not a simple ‘genre’ subject, the theme of this painting has hitherto proved a puzzle. That it turns out to be a classical story involving a mullet, the Emperor Tiberius and two rival ancient gourmets, confirms the idea, argued from other evidence, (...) that, though Van Dyck appears to have been involved in the execution of the painting, it was his master, Peter Paul Rubens, who was the inventor of the theme and the composition. The painting is thus another example of Rubens’s fruitful collaboration with his friend, the animal and still-life painter, Frans Snijders. Like the Discovery of Philopoemen and Pythagoras Advocating Vegetarianism, it combines a lavish display of foodstuff by Snijders with a novel, and ingeniously apt, classical theme. (shrink)

Von Zeit zu Zeit hat man Preisaufgaben uber die Frage gestellt, welche Fortschritte die Philosophie in einem bestimmten Zeitraume gemacht habe. Der Zeitabschnitt pflegte auf der einen Seite durch den Namen eines grosen Denkers, auf der andern durch die "Gegenwart"? abgegrenzt zu werden. Man schien also vorauszusetzen, das uber die philosophischen Fortschritte der Menschheit bis zu jenem Denker hin einigermasen Klarheit herrsche, das es aber von da ab zweifelhaft sei, welche neuen Errungenschaften die letzte Zeit hinzugefugt habe.

Wenn es eine Lehre gibt, welche neben der Raum-Zeittheorie der Inauguraldissertation von 1770 für die Genese der Kritik der reinen Vernunft von zentraler Bedeutung ist, dann ist es die von Kant in den frühen Anthropologievorlesungen der siebziger Jahre vorgetragene Theorie eines spontanen, freien und selbstbewußten Ich. Aus welchen systematischen Erwägungen heraus hat er diese Ich-Theorie entwickelt? Was hat ihn dazu veranlaßt, seine Philosophie auf einem spontanen, freien und selbstbewußten Ich zu gründen, welches als eine einfache, numerisch identische, immaterielle und freie (...) Substanz verstanden wird, von der wir eine anschauende Erkenntnis im inneren Sinn haben? Aufgrund welcher konzeptionellen Änderungen wird diese Theorie gegenüber seiner Dissertation überhaupt erst ein sinnvolles Unternehmen? Es wird im Rahmen einer detaillierten Rekonstruktion der Problemlage, mit der sich Kant zwischen 1770 und 1772 konfrontiert war, gezeigt, daß er wesentliche Anregungen durch seinen früheren Schüler Marcus Herz erhalten hat, der in seiner Schrift Betrachtungen aus der spekulativen Weltweisheit einige grundlegende Lehrstücke der Dissertation kritisiert und mit Moses Mendelssohn für die Notwendigkeit eines „ersten Subjekts" plädiert. Nicht Rousseau, sondern Herz und Mendelssohn haben also in ihrer direkt auf die Dissertation bezogenen Kritik Kant davon überzeugt, daß das epistemisch aufgewertete Ich als Grund einer neuen Theorie des Verhältnisses von Denken und Gedachtem fungieren muß, um die Einheit unserer Erfahrung erklären zu können. The new so-called pragmatic-epistemic approach to the methodology of explanation seems to dispense with the difference between traditional epistemic reasoning and genuine explanation. Causal explanations are excluded from the debate. Instead, the degree and value of subjective conviction seems to be the decisive factor for explanation. The paper criticizes this restrictive approach for methodological and terminological reasons without denying the importance of epistemic, pragmatic considerations. In addition, the respective traditional thesis on the logical-structural identity of prediction and explanation and the (...) new epistemic turn with respect to this thesis are criticized. The latter seems to lead to confrontations between every day and scientific explanations. The epistemic liberalisation of terminology and methodology certainly admits of new forms of systematization, e. g. potential prediction, but a general theory of systematization should not be too restrictive and should at the same time retain the classical distinction between epistemic and genuine lawful explanations.
