This paper examines a fundamental problem in applied mathematics. How can one model the behavior of materials that display radically different, dominant behaviors at different length scales. Although we have good models for material behaviors at small and large scales, it is often hard to relate these scale-based models to one another. Macroscale models represent the integrated effects of very subtle factors that are practically invisible at the smallest, atomic, scales. For this reason it has been notoriously difficult to model (...) realistic materials with a simple bottom-up-from-the-atoms strategy. The widespread failure of that strategy forced physicists interested in overall macro-behavior of materials toward completely top-down modeling strategies familiar from traditional continuum mechanics. The problem of the ``tyranny of scales'' asks whether we can exploit our rather rich knowledge of intermediate micro- scale behaviors in a manner that would allow us to bridge between these two dominant methodologies. Macroscopic scale behaviors often fall into large common classes of behaviors such as the class of isotropic elastic solids, characterized by two phenomenological parameters---so-called elastic coefficients. Can we employ knowledge of lower scale behaviors to understand this universality---to determine the coefficients and to group the systems into classes exhibiting similar behavior? (shrink)

In his provocative new book, The Tyranny of the Ideal, Gerald Gaus lays out a vision for how we should theorize about justice in a diverse society. Gaus shows how free and equal people, faced with intractable struggles and irreconcilable conflicts, might share a common moral life shaped by a just framework. He argues that if we are to take diversity seriously and if moral inquiry is sincere about shaping the world, then the pursuit of idealized and perfect theories (...) of justice--essentially, the entire production of theories of justice that has dominated political philosophy for the past forty years--needs to change. Drawing on recent work in social science and philosophy, Gaus points to an important paradox: only those in a heterogeneous society--with its various religious, moral, and political perspectives--have a reasonable hope of understanding what an ideally just society would be like. However, due to its very nature, this world could never be collectively devoted to any single ideal. Gaus defends the moral constitution of this pluralistic, open society, where the very clash and disagreement of ideals spurs all to better understand what their personal ideals of justice happen to be. This paper makes an argument for the democratic value of distrust. It begins by analyzing distrust, since distrust is not merely the negation of trust. The account that it develops is based primarily on Martin Luther King Jr.’s work in Why We Can’t Wait. On this view, distrust is the confident belief that another individual or group of individuals or an institution will not act justly or as justice requires. It is a narrow normative account of distrust, since it concerns (...) a specific normative task. Distinctions between vertical and horizontal distrust, as well as trust and agnostic trust are also discussed. This paper argues that distrust’s democratic value lies in its ability to secure democracy by protecting political minorities from having their voices ignored. As such, distrust can be viewed as a kind of Madisonian “check and balance” that works to prevent tyranny. Distrust also works to secure democracy by forging new or alternative forms of democratic participation. The main example discussed in this paper is King’s involvement in the Birmingham Campaign during the Black Civil Rights movement in America. In this case, King and his supporters’ distrust of fellow White citizens and political institutions led to alternative forms of political expression such as non-violent protests, boycotts, and other forms of civil disobedience, all of which led to greater racial justice by working to alleviate White tyranny. The debate between legal constitutionalists and critics of constitutional rights and judicial review is an old and lively one. While the protection of minorities is a pivotal aspect of this debate, the protection of disenfranchised minorities has received little attention. Policy-focused discussion—of the merits of the Human Rights Act in Britain for example—often cites protection of non-citizen migrants, but the philosophical debate does not. Non-citizen residents or ‘denizens’ therefore provide an interesting test case for the theory of rights as trumps (...) on ordinary representative politics. Are they the ultimate success story of the human rights framework? Or was Michael Walzer correct to describe government of denizens by citizens as a modern form of ‘tyranny’? This paper argues that neither liberal rights theorists nor democratic republicans provide a coherent response to the existence of denizens. Liberal rights theorists overstate the extent to which a politically powerless status can secure individual rights, while democratic republicans idealise the political process and wrongly assume that all those affected by laws are eligible for political participation. The paper outlines an alternative model for assessing the accountability of states to their non-citizen population, informed by the republican ideal of non-domination. It identifies gaps in state accountability to denizens–such as where there is inadequate diplomatic protection—and argues that these gaps are particularly troubling if their exit costs of leaving the state are high. The war in Iraq has reignited the passionate humanitarian intervention debate. President George W. Bush surprised many observers in his second inaugural address when he promised to oppose tyranny and oppression, and this in a world not always willing or ready to join in that fight. Humanitarian intervention is again on the forefront of world politics.

The article examines the inaugural encounter of the Greek theory of tyranny and the Roman institution of dictatorship. Although the twentieth century is credited for fusing the tyrant and the dictator into one figure/concept, I trace the origins of this conceptual synthesis in a much earlier historical period, that of the later Roman Republic and the early Principate, and in the writings of two Greek historians of Rome, Dionysius of Halicarnassus and Appian of Alexandria. In their histories, the traditional (...) interest in the relationship between the king and the tyrant is displaced by a new curiosity about the tyrant and the dictator. The two historians placed the two figures alongside one another and found them to be almost identical, blurring any previous empirical, analytical, or normative distinctions. In their Greco-Roman synthesis dictatorship is re-described as `temporary tyranny by consent' and the tyrant as a `permanent dictator.' Dictatorship, a venerated republican magistracy, the ultimate guardian of the Roman constitution, is for the first time radically reinterpreted and explicitly questioned. It meets its first critics. The practice of philanthropy, which releases private property for public purposes, represents in many ways the best angels of our nature. But this practice's noteworthy virtues often obscure the fact that philanthropy also represents the exercise of private power. -/- In The Tyranny of Generosity, Theodore Lechterman shows how this private power can threaten the foundations of a democratic society. The deployment of private wealth for public ends may rival the authority of communities to determine their own affairs. And, (...) in societies characterized by wide disparities in wealth, philanthropy often combines with background inequalities to make public decisions overwhelmingly sensitive to the preferences of the rich. Allowing private wealth to dictate social outcomes collides with core commitments of a democratic society, a society in which people are supposed to determine their common affairs together, on equal terms. -/- But why exactly is democracy valuable? How should these values be weighed against the liberty of donors and the many social benefits that philanthropy promises? Lechterman explores these questions by examining various topics in the practice of philanthropy: the respective roles of philanthropy and government, public subsidies for private giving, the use of donations for political speech, instruments of perpetual giving, the rise in giving by commercial corporations, and "effective altruism" as a guide for individual giving. These studies build to a surprising conclusion: realizing the democratic ideal may be impossible without philanthropy--but making philanthropy safe for democracy also requires fundamental changes to policy and practice. This paper imagines what the liberatory possibilities of (full) ectogenesis are, insofar as it separates woman from female reproductive function. Even before use with human infants, ectogenesis productively disrupts the biological paradigm underlying current gender categories and divisions of labour. I begin by presenting a theory of women’s oppression drawn from the radical feminisms of the 1960s, which sees oppression as deeply rooted in biology. On this view, oppressive social meanings are overlaid upon biology and body, as artefacts of culture (...) and history. I then argue that ectogenesis should be pursued to replace two modes of assisted gestation that can be seen as outgrowths of oppressive assumptions about women's function, ectogenesis should be pursued to replace two modes of assisted gestation. These are gestational surrogacy and uterine transplant, which arise partly from gendered, pronatalist, and geneticist norms. These practices are supported by assumptions about women’s identity and value. Pursuing technologies such as ectogenesis, which weaken the presumed link between biology and gender, is beneficial to (trans-inclusionary radical) feminist aims, as part of a broad project of challenging dominant power relations resting on and maintaining gender categories. By allowing the conceptual separation of female reproductive function from ‘woman’, ectogenesis raises questions about how we determine who counts in this gender identity, and also how we value those who claim the identity ‘woman’. I conclude that ectogenesis has the potential to challenge traditional patriarchal family structures, and thence all other male-dominated structures (of work, education, cultural production), allowing a reimagining of the family and society in more radical ways than we have yet achieved. Debates on the practical relevance of ideal theory revolve around Sen's metaphor of navigating a mountainous landscape. In *The Tyranny of the Ideal*, Gerald Gaus presents the most thorough articulation of this metaphor to date. His detailed exploration yields new insight on central issues in existing debates, as well as a fruitful medium for exploring important limitations on our ability to map the space of social possibilities. Yet Gaus's heavy reliance on the navigation metaphor obscures questions about the reasoning (...) by which ideal theories are justified. As a result, Gaus fails to notice the ways in which his theory of the Open Society resembles the ideal theories he aims to dismiss. Ironically, Gaus winds up neglecting the ways in which the Open Society might tyrannize our efforts to realize greater justice. Through a close reading of the “three heads of tyranny” in Politics 5.11 —those being the tyrant’s efforts to form subjects who have small thoughts are distrustful of one another, and are (...) incapable of action—I argue that central to Aristotle’s account of tyrannical domination is how tyrants cultivate the ethical vice of “small-souledness”, thus producing subjects with humbled desires for a proportionate distribution of political power. This article deepens our appreciation of the social and psychological registers of Aristotle’s theorization of domination and gives reasons for continuing to take Aristotle’s insights into tyranny seriously today. Within this paper I draw on short vignettes and quotes taken from a two-year ethnographic study of boxing to think through the continuing academic merit of the notion of the male preserve. This is an important task due to evidence of shifts in social patterns of gender that have developed since the idea was first proposed in the 1970s. In aligning theoretical contributions from Lefebvre and Butler to discussions of the male preserve, we are able to add nuance to our (...) understanding of how such social spaces are engrained with and produced by the lingering grasp of patriarchal narratives. In particular, by situating the male preserve within shifting social processes, whereby certain men’s power is increasingly undermined, I highlight the production of space within which narratives connecting men to violence, aggression, and physical power can be consumed, performed, and reified in a relatively unrestricted form. This specific case study contributes to gender theory as an illustration of a way in which we might explore and understand social enclaves where certain people are able to lay claim to space and power. As such, I argue that the notion of the male preserve is still a useful conceptual, theoretical, and political device, especially when considered as produced by the tyranny of gender power through the dramatic representation and reification of behaviors symbolically linked to patriarchal narrations of manhood. But take a longer view—look beyond and below politics—and it is the unchallenged triumph of liberalism and its philosophical assumptions that ought to command our attention. The triumph of liberalism means the tyranny of liberalism, explains James Kalb in this illuminating book, for liberalism is the extension into the sociopolitical realm of modern scientific thought and technological rationality. These modes of thinking are regarded by nearly everyone today as uniquely authoritative; those institutions and beliefs which do not conform are regarded at best as annoyances, and at worst as evil. Furthermore, Kalb shows how liberalism is an expression of the interests and outlook of commercial and managerial elites, who are suspicious of less rationalized and controllable forms of social organization like the family. Kalb does not merely rehearse a tale of woe, nor is he content simply to analyze the current situation. With reference to concrete issues such as the debate surrounding same-sex marriage, he outlines the kind of traditionalist response to liberalism that is likely to be most effective. He argues that traditional, decentralized, and nonliberal forms of social organization are ultimately impossible to eradicate, and he shows how more human forms of association than those favored by liberalism might once again be brought into being. In this paper, I consider Martin Luther’s treatment of the tower of Babel narrative in his late Lectures on Genesis in order to display the continuing fruitfulness of a close reading of his exposition of Scripture for the task of contemporary political theology. Luther addresses the themes of, politics, tyranny, totality, and language with a theological attunement instructive to those of us formed within the societies and politics of late-modernity. In addition to attending to Luther’s reading of Genesis 11 (...) for its critical usefulness in interrogating our understandings of the mechanisms of political formation, I also look to his reading of the Eucharist in light of the Christological doctrine of the communicatio idiomatum, and his exegesis of the account of the Syrophenician woman in the Gospels, to indicate constructive ways in which the idolatrous politics of Babel might be resisted and the politics of Pentecost embraced. In this book, David Deane proposes a renewal of Catholic moral theology by deconstructing dominant secular positions and restoring Catholic positions to their theological roots.

This article sets out to describe and solve two puzzles that emerge in segregated labour markets (e.g. the USA or Sweden). First, in many hiring contexts people profess to adhere to egalitarian norms, and specifically to a qualification norm according to which job qualification should be the basis of employment. Still there is evidence of frequent norm violations (discrimination). Surprisingly, the norm persists and people do not frequently protest against such norm violations. The second puzzle is that people are suspicious (...) of the hiring of minorities, perceiving such hirings as evidence that a ‘political correctness’ norm has replaced the qualification norm. The article proposes that both puzzles can be solved within a game-theoretical model of social norm-following, where implicit bias is introduced into an ‘employment game’. Within this model, implicit bias plays a double role. First, it interferes with employers' hiring decisions regarding ethnic majority and minority members, respectively. This is the standard way of understanding the effects of implicit bias. Second, implicit bias interferes with bystander evaluations of hired candidates' qualifications. This is a hitherto overlooked effect of implicit bias. The article concludes that once we understand the double role of implicit bias, the two puzzles are resolved. (shrink)

A liberal may emphasize the need for a redistributive safety net and yet still promote meritocratic capitalism as utopian as we may ever achieve.1 Michael Young, who coined the term meritocracy in 1958, depicted an imaginary meritocratic society as a dystopia (116). In The Tyranny of Merit, Michael J. Sandel spends six out of seven chapters exemplifying the misery of not-being-a-winner in a meritocratic society.The Tyranny of Merit does a brilliant job at providing an “A-ha!” moment to anyone who has been compelled to accept, and to live with, the seemingly fair meritocratic rule of evaluating individuals, despite the frustrating awareness that something is not quite right. The author articulates exactly what’s wrong with meritocratic capitalism.The problem of meritocratic capitalism is, succinctly put, “merit drives out grace” (58). Meritocratic capitalism denigrates those who lack abilities or, worse, it humiliates those who hold jobs that are needed by the society but do not pay a lot (203). Meritocracy provides a justification for inequality that markets deliver by making people believe that their success is their own doing, not something they inherit (120, 125). However, distribution of income and wealth based on the natural distribution of talent and abilities on which the success depends is just as arbitrary as the distribution based on the [End Page 154] historical and social fortune such as class.2 This lack of gratitude and humility among those who are rewarded richly by the markets, Sandel points out, discourages the successful people from caring for the common good or those who are less fortunate than themselves (14, 59).Any mainstream introductory economics textbook would say that prices provide market participants with information about the scarcity of productive inputs and incentive to pursue their self-interests (utility and profits), resulting in markets’ delivering goods and services that best serve consumers’ needs and wants. These textbooks would also clarify that efficiency that markets deliver in allocating productive resources and goods does not imply that the outcomes are necessarily fair or equitable. What is not necessarily made explicitly clear, however, is that market prices do not represent moral values. Rawls, Hayek, and Friedman agreed with Knights in that a market price depends on supply and demand that depend on institutional settings such as property rights, taxation, and support for higher education; therefore, distributing according to the market outcome has “little or no ethical significance.”3 Sandel laments that, in reality, those who are marked by markets as lacking merits (via low pay) live with a sense of demoralizing, humiliating failure (185). The outcome is a lack of contributive justice; those who lack merits struggle to achieve the recognition and honor that they deserve for what they offer through their works (203).What is likely to be completely missing in introductory economics classes at universities is the emphasis on contributive justice. Contributive justice, in my view, is the most important concept introduced by The Tyranny of Merit. The author emphasizes that individuals should be given a chance “to win the social recognition and esteem that go with producing what others need and value” (206). The author challenges us to think again how we should value different types of occupations (191). Aren’t plumbers, social workers, and teachers just as important for society as bankers? Why should there be any prejudice against those who choose not to go to universities? (73). Economics should emphasize that we are not just consumers; we are (proudly?) producers as well. This essay argues, following an insight of Burckhardt, that the philosophy of history is a ‘centaur’, and that it has a tendency to hinder rather than to encourage the practice of history. It challenges many of the presuppositions of Bevir's study, demonstrating that The Logic of the History of Ideas is not, in any meaningful sense, an historically minded work. The ‘logic’ of the essay looks to the arts, especially literature and music, as providing genuinely illuminating parallels to the discipline (...) involved in the practice of intellectual history. History cannot be understood as a process of philosophical abstraction; pertinent examples are of its essence, and plurality is therefore central to its richly textured nature. It still has much to learn from the reflexive procedures of anthropology. By examining the idea of ‘tradition’ the essay demonstrates that ‘the past’ is never dead, and that the relationship between texts is a living process: the intellectual historian is him/herself an artist, and his/her task is no less demanding than that of the creative artist, and it is always humblingly provisional. The meaning of the word tyrannos in Greek tragedy is much debated. Some have assumed that the word is always a neutral term signifying ‘ruler’ alone. Others argue for competing ideologies regarding tyranny: the result of an evolution in thinking on autocracy. This article challenges both of these assumptions. The negative meaning of tyrannos is always latent in tragedy, even where the word is used objectively and not as a term of abuse. Tyrannos does not simply indicate a powerful (...) individual but implies absolute power, fortune and wealth. This absolute power leads to ruin and tyrannical vice. Tyrannos signifies not a bad or illegitimate ruler, but rather one with the potential to develop such characteristics. It is the tyrant who evolves, whereas Greek conceptions of tyranny remain largely unchanged from at least the time of Aeschylus to that of Aristotle. (shrink)

A decision by the Supreme Court of California in the case Conservatorship of Wendland, issued in August 2001, forces us once again to confront the all-too-common situation in which an individual has, on multiple occasions, expressed strongly held personal convictions about life-sustaining interventions but failed to incorporate those convictions into a formal advance directive. Many courts have recognized that lay citizens do not consistently resort to written legal formalities in their day-to-day lives, and reasonable accommodation must be made to this (...) fundamental fact about human nature. However, a small but apparently growing minority of courts adamantly insist on either formal written directives or prescience and prophetic precision on the part of the patient before a surrogate can direct the withdrawal of life-sustaining treatment.
