Il s’agissait de la construction d’un double édifice interdépendant : le droit et ses concepts en plein développement, d’un côté, et une langue s’enrichissant d’un vocabulaire de plus en plus (...) technique et spécialisé, de l’autre. L’utilisation continue du law french dans les rangs des juristes, combinée au déclin général de l’usage de l’anglo-normand dans le reste de la société, a contribué à la formation d’une langue qui n’a bientôt été plus compréhensible que pour les spécialistes de droit. L'axe principal de ce texte du philosophe polonais Emil Lask (1875-1915) est la critique de la philosophie de la valeur et la théorie de la connaissance. Son exposé est l'une des révisions du kantisme les plus radicales du début du XXe siècle.

OBJECTIVES: To investigate the need for hospital clinical ethics committees by studying the frequency with which ethical dilemmas arose, the perceived adequacy of the process of their resolution, and the teaching and training of staff in medical ethics. DESIGN: Interviews with individuals and three multidisciplinary teams; questionnaire to randomly selected individuals. SETTING: Two major London children's hospitals. RESULTS: Ethical dilemmas arose frequently but were resolved in a relatively unstructured fashion. Ethical concerns included: the validity of consent for investigations and treatment; (...) lack of children's involvement in consent; initiation of heroic or futile treatments; resource allocation. Staff expressed the need for a forum which would provide consultation on ethical issues, develop guidelines for good ethical practice, undertake teaching and training, and provide ethical reflection outside the acute clinical setting. CONCLUSION: Multidisciplinary, accountable and audited clinical ethics committees with predominantly advisory, practice development and educational roles could provide a valuable contribution to UK clinical practice and perhaps in other countries that have not developed hospital clinical ethics committees. Regular musical activity as a complex multimodal lifestyle activity is proposed to be protective against age-related cognitive decline and Alzheimer’s disease. This cross-sectional study investigated the association and interplay between musical instrument playing during life, multi-domain cognitive abilities and brain morphology in older adults from the DZNE-Longitudinal Cognitive Impairment and Dementia Study study. Participants reporting having played a musical instrument across three life periods were compared to controls without a history of musical instrument playing, well-matched for reserve proxies of education, (...) intelligence, socioeconomic status and physical activity. Participants with musical activity outperformed controls in global cognition, working memory, executive functions, language, and visuospatial abilities, with no effects seen for learning and memory. The musically active group had greater gray matter volume in the somatosensory area, but did not differ from controls in higher-order frontal, temporal, or hippocampal volumes. However, the association between gray matter volume in distributed frontal-to-temporal regions and cognitive abilities was enhanced in participants with musical activity compared to controls. We show that playing a musical instrument during life relates to better late-life cognitive abilities and greater brain capacities in OA. Musical activity may serve as a multimodal enrichment strategy that could help preserve cognitive and brain health in late life. Longitudinal and interventional studies are needed to support this notion. (shrink)

Riassunto : Il presente articolo intende lumeggiare l’esito tanto fecondo quanto problematico a cui conduce l’originale opera laskiana di risemantizzazione del concetto di soggettività. Al centro di tale opera si staglia la progressiva elaborazione di ciò che il filosofo rubrica, al termine del suo Denkweg, sotto il titolo di soggetto ricettivo. Con tale concetto, a cui è intimamente legato quello di “dedizione”, Lask individua in una mera ricettività intuitiva il momento sorgivo e originario di ogni processo cognitivo; il solo (...) momento che rende possibile un accesso diretto all’oggetto trascendente. Ma come si realizza questo accesso? Qual è lo statuto di ciò che il filosofo nomina “dedizione”? L’insufficiente risposta a tali quesiti conduce il pensiero laskiano ad un esito aporetico, ossia alla riduzione della dedizione a momento ideale e alla conseguente riattivazione, in ambito conoscitivo, dell’inaggirabile distanza tra soggetto e oggetto. Ma, se in tale aporia è riconosciuto il limite del modello della conoscenza elaborato da Lask nel suo sistema maturo, non è comunque possibile occultare il decisivo contributo offerto dalla sua riflessione al problema gnoseologico: il superamento del coscienzialismo attraverso l’elaborazione di un soggetto concreto-ricettivo e, accanto a esso, di un peculiare realismo. Subjectivity and Receptiveness: This paper intends to illuminate the problematic outcome of Lask’s redefinition of the concept of subjectivity. The main result of this operation is the elaboration of the notion of receptive subject. With this concept, strictly linked to the notion of Hingabe, Lask identifies the original element of every cognitive process in simple intuitive receptivity. Intuitive receptivity alone provides direct access to the transcendent object. But how is this access possible? What is the relation between the receptive-intuitive element of knowledge and predicative activity? What is the status of Hingabe? The insufficient answers to these questions lead the Lask’s thought to an aporetic outcome, namely, the reduction of Hingabe to an exclusively abstract and ideal receptivity, and consequently to the reactivation, in the theory of knowledge, of the distance between subject and object. However, while this distance marks the limit of the model of knowledge developed by Lask, the main contribuition of his thought remains valid: the overcoming of trascendental subjectivism through the elaboration of a concrete-receptive subject and of an original form of realism. In this paper I focus on Lask’s theory of the form of judgement, in order to argue that: (i) Lask’s definition of form is referentialist, meaning that it involves a necessary reference to the relevant matter; (ii) the surface structure of judgement, which is described by grammar, does not necessarily identify with its deep structure, which is described by metagrammar; (iii) only metagrammar allows us to explain the representationality of judgement; (iv) the previous points agree with an extensionalist (...) definition of judgemental representation. Il rapporto tra Emil Lask e il neocriticismo costituisce un significativo problema storiografico e teoretico. L'analisi della recezione neokantiana , delle indagini storiografiche e dei saggi teorici indica la difficoltà di una mera riconduzione della filosofia laskiana alla scuola del Baden, difficoltà determinata dalla revoca dell'istanza normativa della soggettività trascendentale, dall'interpretazione "oggettivistica" delle forme logiche e dall'affermazione del carattere derivato e secondario del giudizio.

Neo-Kantianism is common conceived as a philosophy ‘from above’, excelling in speculative constructions – as opposed to the attitude of patient description which is exemplified by the phenomenological turn ‘to the things themselves’. When we study the work of Emil Lask in its relation to that of Husserl and the phenomenologists, however, and when we examine the influences moving in both directions, then we discover that this idea of a radical opposition is misconceived. Lask himself was influenced especially (...) by Husserl’s Logical Investigations, and Husserl, especially in his later writings, was in some respects closer to Kant than were the Neo-Kantians. The contrast between the two philosophers can be illustrated by looking at their view of the objects of judgment; for Lask, as for Kant, judgment can relate to the thing as such only in an indirect way. The world of judgment is a collection of ‘imitations holding a secondary position’. It is cut apart from the plain world of real things by what Lask calls a ‘chasm of artificiality and imagery’. For Husserl, in contrast, the object of judgment is a ‘Sachverhalt’ or state of affairs, something ontologically ‘positive’ in the sense that it is an entity in its own right and does not point beyond itself in the manner of a mere sign or proxy for something else. ‘Facticity’ is a concept that classical phenomenologists like Heidegger use to denote the radically contingent or underivably brute conditions of intelligibility. Yet Fichte coins the term, to which he gives the opposing use of denoting unacceptably brute conditions of intelligibility. For him, radical contingency is a problem to be solved by deriving such conditions from reason. Heidegger rejects Fichte's recoil from facticity with his hermeneutics of facticity, supplanting Fichte's metaphor of our always being in reason's hand with the metaphor of (...) our always having been thrown. How does Heidegger inherit and diametrically repurpose Fichte's neologism? Whence the reversed meaning of ‘facticity’ in post-Kantian thought? The answer is Lask's doctoral thesis, which exerts an acknowledged impact on Heidegger's habilitation thesis. Lask interprets ‘facticity’ as Fichte's term for the individuality problem, that is, the resistance of the material particularity of individuals to explanation by the categories genetically deduced from reason. On his interpretation, ‘facticity’ denotes radical contingency in the guise of haecceity, that is, the brute uniqueness of individuals. Lask credits Fichte with registering the problem of individuality, which highlights the world's irreducibly precategorial character. But how is ‘facticity’ transmitted from Lask to Heidegger, given their opposing interpretations of how Fichte understands its meaning? I argue that (1) Lask misreads Fichte as a proponent of facticity, that is, one whose accommodation of radical contingency deflates the Wissenschaftslehre's systematic ambitions, and (2) Lask's misreading, without deceiving Heidegger regarding the sincerity of Fichte's ambitions, encourages Heidegger's own hermeneutics of facticity.
