Deliberative democracy’s approach with its emphasis on a multidimensional conception of freedom is very well suited to offer a sophisticated and critical account of freedom of speech in the democratic public sphere. Nevertheless, it has rarely engaged other competing free speech theories in order to offer a valuable social critique of other ways of thinking about freedom of expression. This article tries to fill this gap by critically engaging Robert Post’s theory of freedom of speech based on democratic self-government. On (...) Post’s account, the key to effective democratic self-government is political autonomy, which he reduces to negative liberty and formal equality. I argue that this reduction creates serious problems. A purely procedural account of democracy makes it difficult to politicize new issues in the public sphere and also makes a dominant discourse resistant to contestation. Further, given his theory, Post does not have enough normative resources to offer an account of public justification, which would expand effective political liberty. (shrink)

Etycy nie poświęcali dotąd wiele uwagi niepewności, koncentrując się często na skrajnie wyidealizowanych hipotetycznych sytuacjach, w których zarówno kwestie empiryczne (np. stan świata, spektrum możliwych decyzji oraz ich konsekwencje, związki przyczynowe między zdarzeniami), jak i normatywne (np. treść norm, skale wartości) były jasno określone i znane podmiotowi. W poniższym artykule – który jest rezultatem projektu dotyczącego różnych typów decyzji w sytuacjach niepewności związanej z postępem w naukach i technologiach biomedycznych – przedstawię analizę sytuacji niepewności normatywnej, czyli takich, w których podmiot (...) musi podjąć decyzję, nie mając pewności co do tego, jaka norma postępowania jest właściwa, np. dlatego, że ma sprzeczne intuicje normatywne na temat dopuszczalności danej decyzji. Stanowisko, które określa się niekiedy mianem komparatywizmu, głosi, że w tego typu sytuacjach należy uwzględniać nie tylko stopnie przekonań podmiotu w kwestii różnych norm, ale także to, na ile możliwe decyzje warte są podjęcia wedle tych norm. Przedstawię tu analizę kilku przypadków niepewności normatywnej, a także charakterystyczny argument przeciwko dotychczasowym wersjom komparatywizmu, wskazujący, że nie uwzględniają one różnych nastawień do ryzyka w sytuacjach niepewności normatywnej, choć dopuszczają jednocześnie różne nastawienia do ryzyka w sytuacjach niepewności empirycznej. Pokażę też, że zasada ostrożności dotycząca statusu moralnego w upraszczający sposób przedstawia sytuacje niepewności normatywnej. (shrink)

Theories of moral desert focus only on the personal culpability of the agent to determine the amount of blame and punishment the agent deserves. I defend an alternative account of desert, one that does not focus only facts about offenders and their offenses. In this revised framework, personal culpability can do no more than set upper and lower limits for deserved blame and punishment. For more precise judgments within that spectrum, additional factors must be considered, factors that are independent of (...) the agent and the offense. I refer to this as the ‘partial conception’ of desert because takes facts about victims—their behavior, desires, and attitudes—into account for desert judgments. On my view, then, agents who are equally culpable may deserve different amounts of blame or punishment, depending on these victim-related factors. (shrink)

To analyze potential negative consequences of adopting generative AI solutions in the digital afterlife industry (DAI), in this paper we present three speculative design scenarios for AI-enabled simulation of the deceased. We highlight the perspectives of the data donor, data recipient, and service interactant – terms we employ to denote those whose data is used to create ‘deadbots,’ those in possession of the donor’s data after their death, and those who are meant to interact with the end product. We draw (...) on the scenarios to map out several key ethical concerns posed by ‘re-creation services’ and to put forward recommendations on the ethical development of AI systems in this specific area of application. The recommendations, targeted at providers of AI-enabled re-creation services, include suggestions for developing sensitive procedures for retiring deadbots, ensuring meaningful transparency, restricting access to such services to adult users only, and adhering to the principle of mutual consent of both data donors and service interactants. While we suggest practical solutions to the socio-ethical challenges posed by the emergence of re-creation services, we also emphasize the importance of ongoing interdisciplinary research at the intersection of the ethics of AI and the ethics of the DAI. What is the concept of sexuality? And do we still need it today? In the article I discuss problems related to the socio-cultural construction of sexuality, normalization politics and sexual citizenship, sexual segregation and anti-sex paranoia. I show how the division into us (friends) and them (strangers), according to sexual scripts, takes away the right not only to be part of society, but above all to be yourself. I wonder if – following the words of M. Foucault – it is (...) not the time to look for a new solution, for example, to replace the concept of sexuality with the forms of pleasure. I illustrate my considerations with examples from the observation of the public sphere and the reaction of the normative public to non-normative objects appearing in their surroundings. Most of the examples concern contemporary Poland – both in political and socio-cultural contexts. (shrink)

In the late 2010s, various international committees, expert groups, and national strategy boards have voiced the demand to ‘open’ the algorithmic black box, to audit, expound, and demystify artificial intelligence. The opening of the algorithmic black box, however, cannot be seen only as an engineering challenge. In this article, I argue that only the sort of transparency that arises from critique—a method of theoretical examination that, by revealing pre-existing power structures, aims to challenge them—can help us produce technological systems that (...) are less deceptive and more just. I relate the question of AI transparency to the broader challenge of responsible making, contending that future action must aim to systematically reconcile design—as a way of concealing—with critique—as a manner of revealing. The book _Metaphysics in Contemporary Physics_ offers various perspectives on the relation and mutual influence between modern physical theories and analytic metaphysics.

The aim of this paper is to examine the philosophical sources of some of the criticisms made in the second half of the 20th century to the practices and the main assumptions of historiography. In particular, the influence of the writings by Nietzsche dedicated to European Historicism on the renewed concept of history which is imposed in the twentieth century from the thought of Heidegger and Foucault. The divergent concepts of historical time and existential temporality, as well as those of (...) narrative unity and continuity of historical events, are the concepts that mainly fall under the critical scrutiny of these thinkers. Archaeological investigations that Foucault devotes to institutions and procedures of the European past are mentioned as examples of the critical review of traditional historiography. (shrink)

The aim of this paper is to refer basic philosophical approaches to the problem of musical meaning and, on the other hand, to describe some examples of the research on musical meaning found in the field of cognitive neuroscience. By looking at those two approaches together it can be seen that there is still no agreement on how musical meaning should be understood, often due to several methodological problems of which the most important seem to be the possibility of inter-theoretical (...) reduction and application of an accurate theory of explanation. I am suggesting that the application of some form of the mechanistic model of explanation might be found useful for clarifying reductionism-antireductionism dispute concerning musical meaning, and more importantly, for providing some answers for the debate in music-as-language controversy. Gideon Rosen described the difficulties faced by those who claim that statements about possible worlds cannot be literally true. According to his argument, if the truth of modal sentences could be explained by referring to the hypothesis of the plurality of possible worlds, which is a sort of fiction for modal irrealists, the position would have antinomic consequence. I argue that the advocate of broad modal fictionalism can avoid such a devastating conclusion. To that end, her position should be given (...) in meta-language describing the necessary and sufficient conditions of accepting modal sentences as true in terms of fiction of possible worlds. I show that there is a coherent way of reading ‘it is accepted as true’ that allows one to maintain that the disjunction of two mutually contradictory propositions can be accepted without accepting either of them. It is part of the phenomenology of perceptual experiences that objects seem to be presented to us. The first guide to objects is their perceptual presence. Further reflection shows that we take the objects of our perceptual experiences to be among the causes of our experiences. However, not all causes of the experience are also objects of the experience. This raises the question indicated in the title of this paper. We argue that taking phenomenal presence as the guide to the (...) objects of perception, we can see that at least in two sensory modalities, smell and touch, there is no uniform answer to this question. The objects of olfactory and tactile experiences can move along the causal chain. Accordingly, the content of olfactory and tactile experience may vary. (shrink)

Axiomatic proof/refutation systems for the paraconsistent modal logics: KN4 and KN4.D are presented. The completeness proofs boil down to showing that every sequent is either provable or refutable. By constructing finite tree-type countermodels from refutations, the refined characterizations of these logics by classes of finite tree-type frames are established. The axiom systems also provide decision procedures for these logics.

One can often hear that intuitions are standardly “appealed to”, “relied on”, “accounted for”, or “used as evidence” in ethics. How should we interpret these claims? I argue that the typical understanding is what Bernard Molyneux calls “descriptive evidentialism”: the idea that intuition-states are treated as evidence of their propositional contents in the context of justification. I then argue that descriptive evidentialism is false- on any account of what intuitions are. That said, I admit that ethicists frequently rely on intuitions (...) to clarify, persuade, discover, or to support things other than the intuitions’ contents. The contents of intuitions are also commonly used as starting premises of philosophical arguments. However claims about these practices need to be sharply distinguished from the prevalent dogma. abstract G. A. Cohen argues that egalitarians should compensate for expensive tastes or for the fact that they are expensive. Ronald Dworkin, by contrast, regards most expensive tastes as unworthy of compensation — only if a person disidentifies with his own such tastes (i.e. wishes he did not have them) is compensation appropriate. Dworkinians appeal, inter alia, to the so‐called ‘first‐person’ or ‘continuity’ test. According to the continuity test, an appropriate standard of interpersonal comparison reflects people's own assessment of their (...) relative standing: Person A can only legitimately demand compensation from person B if he regards himself as worse off, all things considered, than B. The typical bearer of expensive tastes does not regard herself as being worse off than others with less expensive tastes. Hence, in the typical case, pace Cohen, compensation for expensive tastes is inappropriate. The article scrutinizes this rationale for not compensating for expensive tastes. Especially, we try to bolster the continuity test by relating it to Dworkin's distinction between integrated and detached values, pointing out that an argument for the continuity test can be built on the assumption that equality has integrated value. In brief, the point is that a metric of equality should be assessed, partly, in virtue of its consequences for related ideals. One of these is the kind of justificatory community promoted by the continuity test. We defend this view against an objection to the effect that equality is a detached value. We conclude that the continuity test constitutes a strong foothold for the resourcist egalitarian reluctance to compensate people for their expensive tastes. (shrink)

In this paper we investigate Boolean connexive logics in a language with modal operators: □, ◊. In such logics, negation, conjunction, and disjunction behave in a classical, Boolean way. Only implication is non-classical. We construct these logics by mixing relating semantics with possible worlds. This way, we obtain connexive counterparts of basic normal modal logics. However, most of their traditional axioms formulated in terms of modalities and implication do not hold anymore without additional constraints, since our implication is weaker than (...) the material one. In the final section, we present a tableau approach to the discussed modal logics. (shrink)

In order to understand how the environment influences business owner/managers’ attitudes towards tax morale, we build a theoretical model based on a neo-institutionalist framework. Our model combines three complementary perspectives on institutions—normative, cultural–cognitive and regulatory–instrumental. This enables a broader understanding of factors that influence business owner–managers’ attitudes towards tax evasion. We test the resulting hypotheses using regression analysis on survey data on business owner/managers in Latvia—a transition country, which has undergone massive institutional changes since it was part of the Soviet (...) Union over 25 years ago. We find that legitimacy of the tax authorities and the government, feeling of belonging to the nation and perceptions of the risk and severity of punishment are all associated with higher tax morale for business owners and managers. In the second half of the nineteenth century, France was the main site of the controversy around the so-called eoliths, supposedly human-made tools of Tertiary Europe. In contrast to the more common situation where scientists have to make sure that an object stabilized in a laboratory is not an artifact of the lab but a natural object, in the eoliths debates the opposite was the case. The eolith proponents tried to render plausible the object's artificial, that is human, origin. In (...) their case, the objects would only be of scientific interest if they were artifacts not geofacts (naturally flaked stones). The paper ties in with existing literature on the French eoliths movement and investigates the successive eoliths debates in Britain. In Bruno Latour's terms, eoliths as archaeological evidence for Tertiary Man in Europe could gain in reality through a successful enlisting of the collaboration of human and non-human actors such as scientists, theories, publications, taxonomies, technologies, institutions, etc. Indeed, networks were established among scientists, preferably of powerful institutions, the 'tools' were integrated or denied a place in existing taxonomies of prehistoric artifacts, experiments were carried out to demonstrate their chance or designed origin, and their convergence or incompatibility with a certain theoretical framework was discussed. Arguments often revolved around questions of negative evidence, since both proponents and opponents of eoliths as tools were aware of the fact that the eoliths' strongest tie to reality would be evidence of the toolmakers themselves. Several known hominid fossils, among them those of doubtful age, were thus proposed as Tertiary shapers of the 'tools'. These hypothetical 'Englishmen' and their supposed artifacts were enmeshed in particular theories of human evolution, marked as they were by the racism and nationalism widespread at the time. (shrink)
