This paper is particularly concerned with shame, sometimes considered the ‘master emotion’, and its possible role in affecting the consent process, specifically where that shame relates to the issue of diminished health literacy. We suggest that the absence of exploration of affective issues in general during the consent process is problematic, as emotions commonly impact upon our decision-making process. Experiencing shame in the healthcare environment can have a significant influence on choices related to health and healthcare, and may lead to (...) discussions of possibilities and alternatives being closed off. In the case of impaired health literacy we suggest that it obstructs the narrowing of the epistemic gap between clinician and patient normally achieved through communication and information provision. Health literacy shame prevents acknowledgement of this barrier. The consequence is that it may render consent less effective than it otherwise might have been in protecting the person's autonomy. We propose that the absence of consideration of health literacy shame during the consent process diminishes the possibility of the patient exerting full control over their choices, and thus bodily integrity. I defend a moderate (neither extremely conservative nor extremely liberal) view about the contents of perception. I develop an account of perceptual kinds as perceptual similarity classes, which are convex regions in similarity space. Different perceivers will enjoy different perceptual kinds. I argue that for any property P, a perceptual state of O can represent something as P only if P is coextensive with some perceptual kind for O. 'Dog' and 'chair' will be perceptual kinds for most normal people, 'blackpool (...) warbler' for the expert birdwatcher but not for the rest of us, 'dangerous', 'familiar', or 'meaning that the cat is on the mat' for none of us. Psychologists have recently turned their attention to the nature of the recognition involved in judgment of familiarity. It has been suggested that, apart from judging a stimulus to be familiar when one is able to recall a context in which it was previously perceived, subjects are also able to judge that something is familiar merely on the basis of its faster perceptual processing.

In American legal journals over the last decade there were hundreds of pages of articles worrying over threats to justice and freedom arising from the power to withhold benefits. Government officials have tremendous discretion to offer or withhold foreign aid, ration-books, government contracts and jobs, welfare subsidies, public housing, tariff protection, academic grants, alien resident status, paroles, or exemption from conscription or combat, from arrest or prosecution or imprisonment. Right-wing economists have worried about welfare-state emphasis on administrative discretion rather than (...) the rule of law. And left-wing economists have worried about the rich man's power to intimidate the poor man by threatening to cut off his productive work. (shrink)

In the nearly 30 years since Premack and Woodruff famously asked, “Does the chimpanzee have a theory of mind?”, the question of exactly how much non-human primates understand about the mental lives of others has had an unusually dramatic history. As little as ten years ago it appeared that the answer would be a simple one, with early investigations of non-human primates’ mentalistic abilities yielding a steady stream of negative findings. Indeed, by the mid-1990s even very cautious researchers were ready (...) to flatly assert that Theory of Mind was a uniquely human capacity. Recently, however, an exciting new theoretical perspective on primate social cognition has arisen, and with it the distinct possibility that our evolutionary relatives may understand far more of the social world than we previously believed. In this paper we review new theory and evidence suggesting that non-human primates may indeed represent the mental states of others, at least within the domains for which their distinctive social ecology has prepared them. Having asserted that Premack and Woodruff's original question can be answered with a qualified yes, we then consider the new questions that arise in its place, particularly how and why our own Theory of Mind became more domain-general than that of other primates. Manipulation cases have figured prominently in philosophical debates about whether moral responsibility is in some sense deeply historical. Meanwhile, some philosophers have thought that folk thinking about manipulated agents may shed some light on the various argumentative burdens facing participants in that debate. This paper argues that folk thinking is, to some extent, historical. Across three experiments, a substantial number of participants did not attribute moral responsibility to agents with manipulation in their histories. The results of these experiments challenge previous (...) research indicating that folk thinking is not historicist. Furthermore, perceptions of reduced free will, but not of a change in personal identity of the agent, account for the attenuation of moral responsibility when the agent was manipulated. To the extent that folk thinking is relevant to philosophical debates about the nature of moral responsibility, the results helpfully illuminate the dialectical burdens facing competing conceptions of responsible agency. Pure quality of will theories claim that ‘the ultimate object’ of our responsibility responses (i.e., praise and blame) is the quality of our will. Any such theory is false—or so I argue. There is a second dimension of (moral) responsibility, independent of quality of will, that our responsibility responses track and take as their object—namely, how adroitly we are able to translate our will into action; I call this competence of will. I offer a conjectural explanation of the two dimensions (...) of (moral) responsibility: it matters to us that people actually perform adequately well because of how much it matters to us that we are able to live and work together successfully. In the fall of 2005, Mark C. Taylor, the controversial public intellectual and widely respected scholar, suddenly fell critically ill. For two days a team of forty doctors, many of whom thought he would not live, fought to save him. Taylor would eventually recover, but only to face a new threat: surgery for cancer. The Lutheran theologian and polemicist Matthias Flacius Illyricus (1520-75) organized an unprecedented collaborative project to write an encyclopedic Protestant church history, known as the Magdeburg Centuries (1559-74). At the planning stage in 1556, Flacius and his colleagues consulted with the Flemish jurist FranÁois Baudouin (1520-73). This article shows how, in this correspondence, ecclesiastical history became the workshop where legal and theological humanism met and interacted over issues of historical methodology. Interpretation, in the sense relevant to hermeneutics, is an attempt to make clear, to make sense of an object of study. This object must, therefore, be a text or a text-analogue, which in some way is confused, incomplete, cloudy, seemingly contradictory--in one way or another, unclear. The interpretation aims to bring to light an underlying coherence or sense.

In this article I respond to the constructive criticisms of my views in Markets with Limits that have been developed by Amy E. White, Roderick T. Long, and Julian Koplin. I also outline how Jason Brennan and Peter Jaworski have surreptitiously altered their position in the second edition of their book Markets Without Limits—alterations that they appear to have made in response to my criticisms. First, they have changed the view that they attribute to those they identify as anti-commodification theorists (...) in response to my claim that none of them hold the position that they attribute to them. Second, they have altered their definition of what constitutes a “semiotic” objection to markets. I argue that none of these changes successfully address my initial criticisms. By contrast, I believe that the revisions that I make to my views in response to the objections of White and Long address their concerns, and I concur with Koplin’s development of my views in the context of the use of AI. This 2003 book offers an interpretation of Heidegger's major work, Being and Time. Unlike those who view Heidegger as an idealist, Taylor Carman argues that Heidegger is best understood as a realist. Amongst the distinctive features of the book are an interpretation explicitly oriented within a Kantian framework and an analysis of Dasein in relation to recent theories of intentionality, notably those of Dennett and Searle. Rigorous, jargon-free and deftly argued this book will be necessary reading for all serious (...) students of Heidegger. (shrink)
