Este artículo identifica los principales antecedentes legislativos y jurisprudenciales de la evidencia digital en Colombia, con miras a detallar su tratamiento en el proceso judicial; así mismo, pretende evidenciar cómo opera la cláusula de exclusión, y de qué manera se protege el derecho a la intimidad, en la obtención de evidencia digital, desde distintos medios de almacenamiento. La metodología es cualitativa y se utilizó la técnica de la revisión documental y la entrevista a expertos, para mostrar una realidad respecto a (...) una problemática de valoración de las pruebas tecnológicas, en los casos de ilicitud, y brindar aportes para mejorar la comprensión y la dimensión de su práctica en el proceso judicial. La principal conclusión es que no se le puede negar eficacia y validez probatoria por estar en forma de bytes, siempre y cuando se pueda establecer la autenticidad del contenido y la correspondencia con el autor. It has been claimed that Massimi’s recent perspectival approach to science sits in tension with a realist stance. I shall argue that this tension can be defused in the quantum context by recasting Massimi’s perspectivalism within a phenomenological framework. I shall begin by indicating how the different but complementary forms of the former are manifested in the distinction between certain so-called ‘-epistemic’ and ‘-ontic’ understandings of quantum mechanics, namely QBism and Relational Quantum Mechanics, respectively. A brief consideration of Dieks’ perspectivism (...) will then lead to a consideration of the much-maligned and typically dismissed role of the observer in the measurement process. This opens the door to London and Bauer’s presentation of a form of ‘phenomenological quantum perspectivalism’ that brings together Massimi’s two forms and explicitly eschews the ‘naïve’ realism that creates the above tension. I shall conclude with some reflections on how intersubjectivity can still be established within this framework, focusing in particular on how Massimi’s idea of ‘interlacing’ scientific perspectives can be accommodated, using the example of a ‘new cosmopolitanism’ that gave rise to Bose-Einstein statistics. Quadruple Helix Collaborations (QHCs) is a cooperation model in which industry, government, academia, and the public interact to innovate. This paper analyses the impact of a training intervention to provide specific knowledge, skills, and attitudes to deal with barriers commonly found in the progress of QHCs. We designed, implemented, and evaluated three training programs in Austrian, Colombian, Danish, and Spanish institutions. We analysed trainees’ (n = 66) and trainers’ (n = 9) perceptions to identify the competencies acquired with the intervention (...) and the approach’s limitations. We used online questionnaires (35 trainees; 9 trainers), semi-structured interviews (10 trainees), and a focus group (6 trainers). Trainees answered positively regarding their self-perception about the impact of the course and highlighted the acquisition of inspiration for their practice (score 4.1 out of 5.0) and knowledge (3.7). In contrast, they perceived that a deeper interaction with other participants (2.7) was challenging. After the courses, 74% of respondents indicated that they know more about how QHCs work in practice, and 86% about collaboration or engagement methods. Moreover, participants plan to be more sensitive towards setting common goals (71%) and power imbalances (63%). Trainers’ perceptions align with those expressed by participants, except that they considered that the interaction amongst participants during the course was higher. Qualitative analysis of interviews with participants and the focus group with trainers provides more detail about the strengths and weaknesses of the intervention. Our study shows that the collaborative design and implementation of training impact the participant’s learning competencies, with potential implications in their medium- to long-term practice. This paper examines from a historical perspective Tarski's 1936 essay, "On the concept of logical consequence." I focus on two main aims. The primary aim is to show how Tarski's definition of logical consequence satisfies two desiderata he himself sets forth for it: (1) it must declare logically correct certain formalizations of the -rule and (2) it must allow for variation of the individual domain in the test for logical consequence. My arguments provide a refutation of some interpreters of Tarski, (...) and notably John Etchemendy, who have claimed that his definition does not satisfy those desiderata. A secondary aim of the paper is to offer some basic elements for an understanding of Tarski's definition in the historical logico-philosophical context in which it was proposed. Such historical understanding provides useful insights on Tarski's informal ideas on logical consequence and their internal cohesion. (shrink)

Diseases of complex origin have a component of quantitative genetics that contributes to their susceptibility and phenotypic variability. However, after several studies, a major part of the genetic component of complex phenotypes has still not been found, a situation known as “missing heritability.” Although there have been many hypotheses put forward to explain the reasons for the missing heritability, its definitive causes remain unknown. Complex diseases are caused by multiple intermediate phenotypes involved in their pathogenesis and, very often, each one (...) of these intermediate phenotypes also has a component of quantitative inheritance. Here we propose that at least part of the missing heritability can be explained by the genetic component of intermediate phenotypes that is not detectable at the level of the main complex trait. At the same time, the identification of the genetic component of intermediate phenotypes provides an opportunity to identify part of the missing heritability of complex diseases. (shrink)

This paper defends the claim that pragmatic encroachment—the idea that knowledge is sensitive to the practical stakes of believing—can explain a distinctive kind of epistemic injustice: the injustice that occurs when prejudice causes someone to know less than they otherwise would. This encroachment injustice, as we call it, occurs when the threat of being met with prejudice raises the stakes for someone to rely on her belief when acting, by raising the level of evidential support required for knowledge. Purpose – The purpose of this paper is to investigate the internal structure of Gandhi's ethics as a way to determine opportunities for improving that system's ability to influence behavior. In this paper, the author aims to work under the idea that a system of ethics is a guide for social responsibility. -/- Design/methodology/approach – The data source is Gandhi's set of ethics as described by Naess. These simple (primarily quantitative) studies compare the concepts within the code of ethics, and (...) their relationships to one another. -/- Findings – Gandhi's ethics are robust at the 0.25 level (the scale is zero to one – zero is lowest). This is consistent with theories of the social sciences (that do not work well in practice). Gandhi's success might be ascribed to his leadership ability. -/- Research limitations/implications – Some suggest this approach is reductionist because of its superficial similarity to approaches of physical science. The implications for research are profound. First, this approach provides an objective method for comparing (and so, advancing) systems of ethics. Second, this paper suggests the opportunity to compare the internal structure of ethics with “external” aspects – the implementation of ethical systems. -/- Practical implications – By itself, Gandhi's system of ethics cannot be reliably applied in practice - it cannot be expected to change behavior more than any other system of ethics. This raises concerns about other ethical codes as well. The practical implications of the form of analysis presented in this paper are immense because it provides a way for practitioners to objectively compare two codes of ethics and determine which one will be more effective. -/- Originality/value – The approach documented in the paper has never been applied to the field of ethics. It is unique in that it addresses the “internal” structure of a system of ethics (compared to the “external”, or application, of ethical systems). (shrink)

Hannah Arendt connects the end of Modernity with a historical specific event: the ascent of Totalitarianisms. According to Arendt, that event would have supposed a cut in History and Tradition, a gap between a suddenly foreign past and an unforseeable future. In this article I restate Arendt’s solutions to the problem of how can be reminded and told what, after the break in History and Philosophical Tradition, it is not possible to understand trought the traditional categories of significance. In this study Steven Wall presents and defends a perfectionist account of political morality that takes issue with many currently fashionable liberal ideas but retains the strong liberal commitment to the ideal of personal autonomy. He begins by critically discussing the most influential version of anti-perfectionist liberalism, examining the main arguments that have been offered in its defence. La subtitulación cuenta con un gran potencial didáctico que facilita el diseño universal de aprendizaje. Mediante el análisis de percepciones con datos cuantitativos y cualitativos se persigue conocer tanto las ideas previas sobre los usos pedagógicos de la subtitulación como la percepción de los futuros profesores de idiomas de educación secundaria de su potencial como herramienta o recurso didáctico que favorezca la integración. Los resultados muestran que los docentes de lenguas de Educación Secundaria Obligatoria están familiarizados con la subtitulación como (...) consumidores, pero necesitan formación pedagógica para incluirla en su práctica docente y así, hacer la docencia más inclusiva. When creating theory to understand or implement change at the social and/or organizational level, it is generally accepted that part of the theory building process includes a process of abstraction. While the process of abstraction is well understood, it is not so well understood how abstractions “fit” together to enable the creation of better theory. Starting with a few simple ideas, this paper explores one way we work with abstractions. This exploration challenges the traditionally held importance of abstracting concepts from (...) experience. That traditional focus has been one-sided—pushing science toward the discovery of data without the balancing process that occurs with the integration of the data. Without such balance, the sciences have been pushed toward fragmentation. Instead, in the present paper, new emphasis is placed on the relationship between abstract concepts. Specifically, this paper suggests that a better theory is one that is constructed of concepts that exist on a similar level of abstraction. Suggestions are made for quantifying this claim and using the insights to enable scholars and practitioners to create more effective theory. (shrink)

BackgroundThis article aims to contribute to a better conceptualization of pain and suffering by providing non-essential and non-naturalistic definitions of both phenomena. Contributions of classical evidence-based medicine, the humanistic turn in medicine, as well as the phenomenology and narrative theories of suffering and pain, together with certain conceptions of the person beyond them are critically discussed with such purpose.MethodsA philosophical methodology is used, based on the review of existent literature on the topic and the argumentation in favor of what are (...) found as better definitions of suffering and pain.ResultsPain can be described in neurological terms but cognitive awareness, interpretation, behavioral dispositions, as well as cultural and educational factors have a decisive influence on pain perception. Suffering is proposed to be defined as an unpleasant or even anguishing experience, severely affecting a person at a psychophysical and existential level. Pain and suffering are considered unpleasant. However, the provided definitions neither include the idea that pain and suffering can attack and even destroy the self nor the idea that they can constructively expand the self; both perspectives can b e equally useful for managing pain and suffering, but they are not defining features of the same. Including the existential dimension in the definition of suffering highlights the relevance of suffering in life and its effect on one’s own attachment to the world. An understanding of pain and suffering life experiences is proposed, meaning that they are considered aspects of a person’s life, and the self is the ever-changing sum of these experiences.ConclusionsThe provided definitions will be useful to the identification of pain and suffering, to the discussion of how to relieve them, and to a better understanding of how they are expressed and experienced. They lay the groundwork for further research in all these areas, with the twofold aim of a) avoiding epistemological mistakes and moral injustices, and b) highlighting the limitations of medicine in the treatment of suffering and pain. A provocative argument that environmental thinking would be better off if it dropped the concept of “nature” altogether and spoke instead of the built environment. -/- Environmentalism, in theory and practice, is concerned with protecting nature. But if we have now reached “the end of nature,” as Bill McKibben and other environmental thinkers have declared, what is there left to protect? In Thinking like a Mall, Steven Vogel argues that environmental thinking would be better off if it dropped the (...) concept of “nature” altogether and spoke instead of the “environment”—that is, the world that actually surrounds us, which is always a built world, the only one that we inhabit. We need to think not so much like a mountain (as Aldo Leopold urged) as like a mall. Shopping malls, too, are part of the environment and deserve as much serious consideration from environmental thinkers as do mountains. -/- Vogel argues provocatively that environmental philosophy, in its ethics, should no longer draw a distinction between the natural and the artificial and, in its politics, should abandon the idea that something beyond human practices (such as “nature”) can serve as a standard determining what those practices ought to be. The appeal to nature distinct from the built environment, he contends, may be not merely unhelpful to environmental thinking but in itself harmful to that thinking. The question for environmental philosophy is not “how can we save nature?” but rather “what environment should we inhabit, and what practices should we engage in to help build it?”. (shrink)

The purpose of this paper is to examine some passages of Tarski‘s paper ’On the concept of logical consequence’ and to show that some recent readings of those passages are wrong. John Etchemendy has claimed that in those passages Tarski gave an argument purporting to show that the notion of logical consequence defined by him (as opposed to some pretheoretic notion of logical consequence) possesses certain modal properties. Etchemendy further claims that the argument he attributes to Tarski is fallacious. Some (...) of Etchemendy’s critics have granted him that Tarski did give an argument purporting to show that the defined notion possesses certain modal properties ; but they have claimed that Tarski’s argument was not a fallacious one. I will show that both Etchemendy and his critics are wrong; in the relevant passages, Tarski did not offer (nor did he intend to offer) an argument that the defined notion of logical consequence possesses any modal properties. Mis experiencias en las prácticas del método de control mental han sido bien positivas. Yo las voy a sintetizar en dos partes bien diferenciadas, que yo denominaría zonas de luz y zonas de sombra. Comencemos por las zonas de luz o aspecto positivo del método. Yo las sintetizaría en tres notas, que para mí fueron quizá las más llamativas. En primer lugar una sistematización de las técnicas de relax. Todo el mundo en la vida va aprendiendo las actitudes que te (...) proporcionan descanso y distensión en la sobrecarga de fatiga. En este sentido, no se puede decir que esto sea exclusivo del control mental. Recuerdo que al seguir las técnicas de control mental, llegaba a situaciones anímicas a las que yo había llegado por otras experiencias personales. El director del método me aceptó que esto era posible, pero que puesto que habíamos venido a seguir este método, convenía practicarlo con fidelidad. Efectivamente, lo seguí fielmente y me encontré con los mismos efectos que por otras técnicas había conseguido. (shrink)

This text explores the problem of transcendental stupidity in Sigmund Freud, Gilles Deleuze and Jacques Derrida’s works, seeking to combine it with (1) the paradoxical figure of Oedipus (the original complex) in psychoanalytical and philosophical tradition and (2) the symptomatic situation of some important animals (wolf and dog, symbols of wild and domestic life [i.e.: Freud’s Wolfs, Freud’s Chow-Chows]) in analyses and therapies. While examining the important role of imagination in making moral judgments, John Dewey and Moral Imagination focuses new attention on the relationship between American pragmatism and ethics. Steven Fesmire takes up threads of Dewey's thought that have been largely unexplored and elaborates pragmatism's distinctive contribution to understandings of moral experience, inquiry, and judgment. RESUMEN Se explora la relación entre las dimensiones proposicional y no proposicional de la creencia religiosa para mostrar que la última dirige el proceso de justificación y representa su límite. Se defiende que la no proposicional también tiene valor cognitivo, porque constituye una suerte de elección epistémica preteórica que no es exclusiva de la fe religiosa. Se explora la noción de ambigüedad religiosa, tanto a nivel intelectual como experiencial, y se sostiene que la relación entre la dimensión proposicional y la (...) no-proposicional de la fe está mediada por la función directiva de las presuposiciones metafísicas instauradas por la experiencia religiosa. ABSTRACT The article explores the relation between the propositional and non-propositional dimensions of religious belief in order to show that the latter guides the process of justification and represents its limit. It argues that the non-propositional dimension also has cognitive value because it constitutes a sort of pre-theoretical epistemic election that does not pertain exclusively to religious faith. The article also delves into the notion of religious ambiguity, both in its intellectual and experiential interpretations, and argues that the relationship between the propositional and the non-propositional dimensions of faith is mediated by the guiding role of the metaphysical presuppositions established by religious experience. Integrated approaches in the ethical decision-making (EDM) and practically wise decision-making literature are emerging as alternative perspectives to management theories that conceptualize decision-making in a rationalist and value-free manner. However, more dialogue between both perspectives and qualitative research that applies them is required. In addition, there is a need for empirical analysis on business engagement in the face of grand challenges in developing countries. This paper proposes an integrated practically wise EDM framework to study how Colombian councilors who, in 2013, (...) voted for or against the merger between the Colombian state-owned company UNE and the Swedish multinational Millicom interpret this decision and its public impact. Qualitative semi-structured interviews were conducted with a voluntary sample of 18 of 21 councilors. Supporters of the UNE-Millicom merger expressed open-mindedness, seeing the merger as a means to achieve justice. On the contrary, the merger’s opponents expressed circumspection, doubting that Millicom’s intentions really leaned toward justice. We conclude that practical wisdom—embodied by both supporters and detractors—fosters an understanding of EDM beyond what leaders should not do. It also includes a democratic and balanced deliberation on what leaders think they should do to promote the common good. (shrink)

In the summer of 1995, Santiago Castro-Gómez wrote a convincing text entitled Critique of Latin American Reason, and continued Roberto Salazar-Ramos’ work‒who also took part in The Group of Bogotá, responsible for institutionalizing the project of Latin American Philosophy in Colombia‒in order to show how the creation of “The Latin American” was possible through the operation of a series of discourses. Rather than an a priori, the category of “The Latin American” is defined by Castro-Gómez as the effect of a (...) series of discourses to which a specific cultural identity was provided. Consequently, the author uses the tradition of historicism to rethink the history of ideas, so that, instead of studying the reception of European ideas and measuring how close to that scaffolding was Latin American thought, its study should begin from the philosophical and scientific practices themselves as a “part of the critical exercise in Colombia”. It is precisely within this horizon opened by Castro-Gómez’s writings in which this essay is inserted. (shrink)

This paper offers a realist critique of socialresearch on health inequalities. A conspectus of thefield of health inequalities research identifies twomain research approaches: the positivist quantitativesurvey and the interpretivist qualitative `casestudy'. We argue that both approaches suffer fromserious philosophical limitations. We suggest that aturn to realism offers a productive `third way' bothfor the development of health inequality research inparticular and for the social scientific understandingof the complexities of the social world in general.

La noción de interpretación desarrollada en el racionalismo crítico de Karl R. Popper muestra atributos específicos que la distinguen de modo sustancial de la interpretación constitutiva de la experiencia que tanto N. R. Hanson como Th. Kuhn defienden en sus respectivas propuestas. Se muestra que la interpretación del modelo popperiano queda atrapada en una epistemología de corte empirista que la separa de modo radical de toda hermenéutica filosófica. The notion of interpretation developed in the critical rationalism of Karl R. Popper (...) displays specific attributes that substantially distinguish it from the constituent interpretation of experience defended in both N. R. Hanson and T. Kuhn proposals. The article shows that the interpretation of Popper's model is trapped in an empiricist epistemology that radically separates it from all hermeneutic philosophy. (shrink)
