This book is the first to bring together an interdisciplinary collection of essays on surrogacy and egg donation from three socially, legally and culturally distinct countries - India, Israel and Germany. It presents contributions from experts in the field of social and cultural sciences, bioethics, law as well as psychology and provides critical-reflective comparative analysis of the socio-ethical factors shaping surrogacy and egg donation practices across these three countries. This book highlights the importance of a comparative perspective to ‘make sense’ (...) of controversies and transitions in this highly contested area of artificial reproductive technologies. BackgroundDuring a commercial surrogacy arrangement, the event of embryo transfer can be seen as the formal starting point of the arrangement. However, it is common for surrogates to undergo a failed attempt at pregnancy conception or missed conception after an embryo transfer. This paper attempts to argue that such failed attempts can be understood as a loss. It aims to reconstruct the experiences of loss and grief of the surrogates and the intended parents as a consequence of their collective failure (...) to conceive a surrogate pregnancy.MethodsDrawing on a qualitative study conducted over a period of eight months between 2014 and 2015 at two fertility clinics in Delhi and two in Kolkata, India, this paper examines the experiences of the surrogates and the intended parents when faced with missed conceptions or failed conceptions during a surrogacy arrangement.ResultsWe argue that while the surrogate grieves the non-arrival of a ‘good news’ as an uncertain loss, the intended parents experience yet another, failure in addition to the losses they might have incurred during their previous fertility treatments. The body of the surrogate becomes a site of ‘a lost opportunity’. The surrogate embodies a loss in her quest to achieve social mobility and the intended parents experience a disembodied pregnancy loss. This very emotional experience stands in stark contrast to the conceptualisation of such failed attempts as non-events within the discourse of the surrogacy industry. The experience of loss of the intended parents is recognised but their grief is given no space. We argue that such ambiguity around the nature of losses resulting out of a missed or failed conception during surrogacy is an outcome of lack of interpersonal relationship between the surrogate and the intended parents.ConclusionsSince commercial surrogacy is a relational process, the only way in which the experiences of losses and failures of the actors at the preconception stage can be better addressed is through developing close sharing and understanding between each other through an ethics of care. Therefore, to nurture caring relationships, surrogacy needs to be understood as a moral commitment by –the surrogates and intended parents. To enable such a commitment, there is a need to reconsider the pre-defined and legally regulated professional duty of the doctors, agents and agencies. It cannot be a one-sided commitment, but has to have elements of mutuality. (shrink)

In diesem Aufsatz eröffnen wir durch die Auseinandersetzung mit einem Dokumentarfilm ethische Fragen, die mit der transnationalen indischen Leihmutterschaft in Verbindung stehen. Über den filmisch präsentierten Alltag von Leihmüttern wird deutlich, dass der Diskurs über kommerzielle Leihmutterschaft einer sensiblen Kontextualisierung für den spezifischen indischen Kontext bedarf. Die Perspektive von Surabhi Sharma bereichert die Diskussion, da sie den Zusammenhang von (...) Leihmutterschaft und Arbeit fokussiert. This chapter gives a brief overview of the composition of the volume and explains why it is important to undertake a detailed scholarly analysis and comparison of the following ethico-legal regimes of surrogacy and egg donation: the permissive-unregulated but transitory regime of India; the permissive regime of Israel, although highly regulated by professional, medical and religious norms, and the extremely restrictive regime of Germany, being legally permeable for particular forms of cross-border reproductive practice despite the non-permissive national law. It uses (...) an interdisciplinary lens to examine how the ethical, social, legal and cultural issues are interwoven in each regime. Moreover, we highlight the importance of a comparative analysis to understand how local developments cannot be isolated from each other, but deeply influence each other through transnational markets, modern media and the transfer of knowledge, people and body parts. Background Conventional consent practices face ethical challenges in continuously evolving digital health environments due to their static, one-time nature. Dynamic consent offers a promising solution, providing adaptability and flexibility to address these ethical concerns. However, due to the immaturity of the concept and accompanying technology, dynamic consent has not yet been widely used in practice. This study aims to identify the facilitators of and barriers to adopting dynamic consent in real-world scenarios. Methods This scoping review, conducted in December 2022, adhered (...) to the PRISMA Extension for Scoping Reviews guidelines, focusing on dynamic consent within the health domain. A comprehensive search across Web of Science, PubMed, and Scopus yielded 22 selected articles based on predefined inclusion and exclusion criteria. Results The facilitators for the adoption of dynamic consent in digital health ecosystems were the provision of multiple consent modalities, personalized alternatives, continuous communication, and the dissemination of up-to-date information. Nevertheless, several barriers, such as consent fatigue, the digital divide, complexities in system implementation, and privacy and security concerns, needed to be addressed. This study also investigated current technological advancements and suggested considerations for further research aimed at resolving the remaining challenges surrounding dynamic consent. Conclusions Dynamic consent emerges as an ethically advantageous method for digital health ecosystems, driven by its adaptability and support for continuous, two-way communication between data subjects and consumers. Ethical implementation in real-world settings requires the development of a robust technical framework capable of accommodating the diverse needs of stakeholders, thereby ensuring ethical integrity and data privacy in the evolving digital health landscape. The speeches delivered by Former U.S. President Donald Trump during his last presidential campaign (2015–2016) included hateful remarks against Muslims and immigrants. This study explored strategies of hate speech used in Trump’s political discourse against out-groups. The data consisted of a corpus of Trump’s speeches and interviews. Our analysis was based on Whillock’s [ 48 ] criteria of hate speech and Erjavec and Kovačič’s [ 13 ] strategies of hate speech. The results revealed that Trump employed re-articulation of meaning and (...) renaming by attributing any problem to immigrants and Muslims to express hatred against them, using direct hatred words. His overt use of hate speech strategies stemmed from his legitimate power and social authority as a successful businessman in his field. (shrink)

In a recent issue of this journal, Vandermassen suggested that feminists should include sexual selection theory and evolutionary psychology in a unifying theory of human nature. In response, this article aims to offer some insight into the development of sexual selection theory, to caution against Vandermassen's unreserved assimilation and to promote the opposite ongoing integration — an inclusion of gender perspectives into evolutionary biology. In society today, opinions about maintaining traditional sex roles are often put forward on the basis of (...) what is natural and how animals behave. However, the natural sciences have proved to be pervaded by gendered values and interests; Darwin's theory of sexual selection has been criticized for being male biased, and partly due to the unwillingness of Darwin's scientific contemporaries to accept female choice, research has been overwhelmingly focused on males. More recently, theory has become less gender biased and research has come to include a large variety of issues not present in the first version of the theory. However, there is a need to increase the awareness of gender bias in order to develop a gender-neutral evolutionary biology. (shrink)

Lawami' al-Nazar fi Tahqiq Ma'ani al-Mukhtasar is Aḥmad b. Ya'qub al-Wallali's (d. 1128/1716) commentary on al-Sanusi's (d. 895/1490) compendium of logic, al-Mukhtasar. Al-Wallali was the first commentator on al-Sanusi's compendium after the author's autocommentary. In this publication, Ibrahim Safri offers a critical edition of this work, together with a study of the author's life and oeuvre. Safri also tries to show the indirect influence of Avicennism on logic in the Maghribi tradition in the seventeenth and eighteenth centuries. Biology is instrumental in establishing and perpetuating societal norms of gender and sexuality, owing to its afforded authoritative role in formulating beliefs about what is “natural”. However, philosophers, historians, and sociologists of science have shown how conceptions of gender and sexuality pervade the supposedly objective knowledge produced by the natural sciences. For example, in describing animal relationships, biologists sometimes use the metaphor of marriage, which brings with it conceptions of both cuckoldry and male ownership of female partners. These conceptions have (...) often led researchers to overlook female behavior and adaptations, such as female initiation of mating. Such social norms and ideologies influence both theories and research in biology. Social norms of gender and sexuality also influence school cultures. Although awareness of gender issues has had a major impact in Sweden during recent years, the interventions conducted have been based on a heteronormative understanding of sex; this has rendered sexual norms a non-prioritized issue and thereby rendered non-heterosexuals invisible in teaching and textbooks. Since this research was published in 2007 and 2009, norm critical pedagogics have been included in the Swedish National Agency for Education’s guidelines for teaching. This inclusion represents one way to tackle the recurring problem of heterosexuality being described as a naturalized “normal” behavior and homosexuals, bisexuals and transsexuals being described from a heteronormative perspective. In this paper, I employ gender and queer perspectives to scrutinize how animal sexual behavior is described and explained in Swedish biology textbooks. The analysis is based in gender and queer theory, feminist science studies, and evolutionary biology. The article begins with an outline a discussion of my theoretical framework, relating gender and queer perspectives on evolutionary biology to a discussion of queer methodology. I then scrutinize some empirical examples drawn from five contemporary biology textbooks used in secondary schools (by students aged 16-18 years old). Finally, I discuss the implications of the textbooks’ representations of animal sexual behavior, the problems of and need for a “textbook-version”, and providing examples of what an inclusive approach to biology education might look like. This article highlights the significance of the “Za shuo” 雜說 (Miscellaneous discourses) series for the study of Han Yu’s 韓愈 (768–824) political ideology, which proposes a three-tier system of governance that is made up of the emperor, the feudal lords, and the bureaucrats. The emperor is the pinnacle of the system; he collaborates with his ministers to devise state policies in the inner palace. The feudal lords protect the emperor in the regional areas. The bureaucrats form the machinery of the (...) government and implement its policies. Challenging current scholarship, which treats each of Han Yu’s essays independently, the article proposes a new interpretation of them as a whole It argues that the three essays “Long shuo” 龍說 (Discourse on the dragon), “Yi shuo” 醫說 (Discourse on physicians), and “Ma shuo” 馬說 (Discourse on horses) form an organic unit that provides internally consistent counsel to the ruler for his governance, and that a fourth essay, “Ti Cui Shanjun zhuan” 題崔山君傳 (Foreword to the biography of Cui Shanjun), is likely an interpolation. Through unearthing the true meaning of this series, the article also narrows down its time of composition, which has traditionally been left unspecified. This article also reveals Han Yu’s attitude toward the revived concern over the enfeoffment of princes in medieval China and toward his political ideology, which is not purely Confucian. The article thus is a contribution to the study of both political history and literary creation in the mid-Tang era. (shrink)

To address the rising concern that algorithmic decision-making may reinforce discriminatory biases, researchers have proposed many notions of fairness and corresponding mathematical formalizations. Each of these notions is often presented as a one-size-fits-all, absolute condition; however, in reality, the practical and ethical trade-offs are unavoidable and more complex. We introduce a new approach that considers fairness—not as a binary, absolute mathematical condition—but rather, as a relational notion in comparison to alternative decisionmaking processes. Using US mortgage lending as an example use (...) case, we discuss the ethical foundations of each definition of fairness and demonstrate that our proposed methodology more closely captures the ethical trade-offs of the decision-maker, as well as forcing a more explicit representation of which values and objectives are prioritised. For many centuries, philosophers and scientists have pondered the origins and nature of human intuitions about the properties of points, lines, and figures on the Euclidean plane, with most hypothesizing that a system of Euclidean concepts either is innate or is assembled by general learning processes. Recent research from cognitive and developmental psychology, cognitive anthropology, animal cognition, and cognitive neuroscience suggests a different view. Knowledge of geometry may be founded on at least two distinct, evolutionarily ancient, core cognitive systems for (...) representing the shapes of large-scale, navigable surface layouts and of small-scale, movable forms and objects. Each of these systems applies to some but not all perceptible arrays and captures some but not all of the three fundamental Euclidean relationships of distance (or length), angle, and direction (or sense). Like natural number (Carey, 2009), Euclidean geometry may be constructed through the productive combination of representations from these core systems, through the use of uniquely human symbolic systems. There is growing concern that decision-making informed by machine learning (ML) algorithms may unfairly discriminate based on personal demographic attributes, such as race and gender. Scholars have responded by introducing numerous mathematical definitions of fairness to test the algorithm, many of which are in conflict with one another. However, these reductionist representations of fairness often bear little resemblance to real-life fairness considerations, which in practice are highly contextual. Moreover, fairness metrics tend to be implemented in narrow and targeted toolkits that (...) are difficult to integrate into an algorithm’s broader ethical assessment. In this paper, we derive lessons from ethical philosophy and welfare economics as they relate to the contextual factors relevant for fairness. In particular we highlight the debate around acceptability of particular inequalities and the inextricable links between fairness, welfare and autonomy. We propose Key Ethics Indicators (KEIs) as a way towards providing a more holistic understanding of whether or not an algorithm is aligned to the decision-maker’s ethical values. (shrink)

Ikhwān al-Ṣafāʼ's Rasāʼil; criticism and interpretation.

The 2017 Riyadh Summit is one of the events that various media outlets densely covered. Drawing upon Van Dijk [ 53 ] Ideological Square, this study aims at identifying the in-group and out-group in ten pro-government Arab newspapers and investigating the discursive sub-strategies that were utilized in the representation of “us” and “them.” The findings reveal that most of the Arab newspapers tended to utilize a bundle of negative other-representation discursive sub-strategies to establish a dichotomy between “us” and “them” and (...) thus, construct “us” either directly or indirectly. It was found that negative lexicalization, distancing, and vagueness were the most frequently employed discursive sub-strategies in negative other-representation, while national self-glorification was the most frequently used discursive sub-strategies in positive self-representation. The study concludes by recommending other researchers to explore the same topic but in broadcast media, taking into account the prosodic aspects as well as the discourse itself. (shrink)
