This article seeks to reimagine the relationship between sustainability and financial performance in sustainable investing. Employing a utopian lens, I show how sustainability is constantly negotiated in a process of imagining and actualizing sustainable investing. For this purpose, I explore a fin-tech start-up’s endeavors to democratize sustainable investing through digitalization. Empirically, this article contributes a detailed account of the organizational process of––and the complexities involved in––establishing a sustainable investment organization, to this end focusing on the relationship between sustainability and financial (...) performance. The article further provides a novel theoretical perspective (utopianism) on sustainable investing, one offering a processual approach that uses both external and internal factors in its understanding of the practice. I conclude that a utopian mindset of possibility paves the way for an experimentational attitude and future-oriented thinking. Such a mindset could generate new approaches to the relationship between sustainability and financial performance, thus shining a light on the new and innovative solutions needed to establish financial markets oriented to the common good. Building on critical approaches that understand algorithms in terms of communication, culture and organization, this paper offers the supplementary conceptualization of algorithms as organizational figuration, defined as material and meaningful sociotechnical arrangements that develop in spatiotemporal processes and are shaped by multiple enactments of affordance–agency relations. We develop this conceptualization through a case study of a Danish fintech start-up that uses machine learning to create opportunities for sustainable pensions investments. By way of ethnographic and literary methodology, we provide an in-depth (...) analysis of the dynamic trajectory in and through which the organization gives shape to and takes shape from its key algorithmic tool, mapping the shifting sociotechnical arrangements of the start-up, from its initial search for a viable business model through the development of the algorithm to the public launch of its product. This chapter develops an alternative to the dominant articulation of human existence on the basis of classical phenomenology, arguing that Edmund Husserl's phenomenological inquiries into the structures of embodiment provide a very different and more fruitful starting point for the investigation of sexual difference than the ideas of social gender and biological sex. The ways of classifying sex and gender characteristics mark them out on several different conceptual bases, and thus their categories may not correspond or coincide. Moreover historical and (...) biological inquiries indicate that the dimorphic notion of sex is prescriptive and constructive. Finally the sex/gender paradigm is dominated by the explanatory framework of causes and effects. The phenomenological analysis shows that the causal-functional framework is inadequate for the investigation of the plurality of the bodily existence and sexual difference as a dimension of this existence. In the light of the explication of the concepts of sex and gender, and the phenomenological analysis of embodiment, the sex/gender paradigm cannot offer a basis for a comprehensive philosophy of sexual existence. Is it true that all conversational implicatures are cancellable? In some recent works (Weiner Analysis 66(2):127–130, 2004, followed by Blome-Tillmann Analysis 68(2):156–160, 2008 and, most recently, by Hazlett 2012), the property of cancellability that, according to Grice (1989), conversational implicatures must possess has been called into question. The aim of this article is to show that the cases on which Weiner builds his argument—the Train Case and the Sex Pistols Case— do not really suffice to endanger Grice’s Cancellability Hypothesis. What (...) Weiner has shown with his examples is that a conversational implicature cannot be cancelled if the speaker, whose utterance gives rise to the implicature, does not intend to cancel it. To implicate is an intentional speech act and, therefore, cancelling an implicature must also be intentional and must be performed by the same speaker whose utterance gives rise to the putative implicature. Dahlman analyzes the case with a version of Bayes’ rule that can handle dependencies. He claims that his method can help a fact finder avoid various kinds of bias in probabilistic reasoning, and he identifies occurrences of these biases in the analyzed decision. While a mathematical analysis may give a false impression of objectivity to fact finders, Dahlman claims as a benefit that it forces to make assumptions explicit, which can then be scrutinized.

The goal of this paper is to explore the presuppositionality of factive verbs, with special emphasis on the verbs know and regret. The hypothesis put forward here is that the factivity related to know and the factivity related to regret are two different phenomena, as the former is a semantic implication that is licensed by the conventional meaning of know, while the latter is a purely pragmatic phenomenon that arises conversationally. More specifically, it is argued that know is factive in (...) the sense that it both entails and presupposes p, while regret is factive in the sense that it only presupposes p. In a recent article, Hazlett, 497–522, 2010) shows with authentic examples how know is used non-factively in ordinary language, and he observes in these examples, as he says, “a threat to Factivity.” I argue that non-factive uses of factive verbs, such as know and regret, far from being a threat to factivity, show that, on the one hand, know is ambiguous between a factive and a non-factive sense; on the other hand, in the case of regret, the presupposition of factivity has to be intended as a merely pragmatic implication which can be suspended by the speaker herself. Arguments on legal evidence rely on generalizations, that link a certain circumstance to a certain hypothesis and warrants the claim that the circumstance makes the hypothesis more probable. Some generalizations are acceptable and others are unacceptable. A generalization can be unacceptable on at least four different grounds. A false generalization is unacceptable because membership in the reference class does not increase the probability of the hypothesis. A non-robust generalization is unacceptable because it uses a reference class that is too heterogeneous. (...) A biastriggering generalization is unacceptable because decision makers are inclined to overestimate the evidentiary value of membership in the reference class. The standard of proof in criminal trials should require that the evidence presented by the prosecution is robust. This requirement of robustness says that it must be unlikely that additional information would change the probability that the defendant is guilty. Robustness is difficult for a judge to estimate, as it requires the judge to assess the possible effect of information that the he or she does not have. This article is concerned with expert witnesses and proposes a method for reviewing (...) the robustness of expert testimony. According to the proposed method, the robustness of expert testimony is estimated with regard to competence, motivation, external strength, internal strength and relevance. The danger of trusting non-robust expert testimony is illustrated with an analysis of the Thomas Quick Case, a Swedish legal scandal where a patient at a mental institution was wrongfully convicted for eight murders. Large portions of mathematics such as algebra and geometry can be formalized using first-order axiomatizations. In many cases it is even possible to use a very well-behaved class of first-order axioms, namely, what are called coherent or geometric implications. Such class of axioms can be translated to inference rules that can be added to a sequent calculus while preserving its structural properties. In this work, this fundamental result is extended to their infinitary generalizations as extensions of sequent calculi for both (...) classical and intuitionistic infinitary logic. Is morality intuitive or deliberative? The distinction can obscure the role of folk moral theories in moral judgment; judgments may arise 'intuitively' yet result from abstract theoretical and philosophical commitments that participate in 'deliberative' reasoning.

Many philosophers hypothesize that our concept of personal identity is partly constituted by the one-person-one-place rule, which states that a person can only be in one place at a time. This hypothesis has been assumed by the most influential contemporary work on personal identity. In this paper, we report a series of studies testing whether the hypothesis is true. In these studies, people consistently judged that the same person existed in two different places at the same time. This result undermines (...) some widely held philosophical assumptions, supports others, and fits well with recent discoveries on identity judgments about inanimate objects and non-human animals. According to Grice’s analysis, conversational implicatures are carried by the saying of what is said. In this paper, it is argued that, whenever a speaker implicates a content by flouting one or several maxims, her implicature is not only carried by the act of saying what is said and the way of saying it, but also by the act of non-saying what should have been said according to what would have been normal to say in that particular context. Implicatures that (...) arise without maxim violation are only built on the saying of what is said, while those that arise in violative contexts are carried by the saying of what is said in combination with the non-saying of what should have been said. This observation seems to justify two claims: that conversational implicatures have different epistemic requirements depending on whether they arise in violative or non-violative contexts; that implicatures arising in non-violative contexts are more strongly tied to their generating assertion than those arising with maxim violation. According to Svein Eng there are propositions concerning the law which are descriptive as well as normative, but cannot be separated into one descriptive and one normative proposition. Eng calls these propositions “fused” (“sammensmeltede”). In Eng's theory a proposition with “fused modality” is partly descriptive and partly normative, but cannot be classified as a separable combination of a claim about what the law “is” and a claim about what the law “ought to be.” In a “fused” proposition modality is a (...) question of “degree.” The purpose of this article is to show why Eng's theory should be rejected. The introduction of “fused modality” adds nothing of value to legal theory. Eng claims to have discovered a class of propositions not previously accounted for, but this is not the case. An argument that makes use of a generalization activates the prototype for the category used in the generalization. We conducted two experiments that investigated how the activation of the prototype affects the persuasiveness of the argument. The results of the experiments suggest that the features of the prototype overshadow and partly overwrite the actual facts of the case. The case is, to some extent, judged as if it had the features of the prototype instead of the features it actually has. (...) This prototype effect increases the persuasiveness of the argument in situations where the audience finds the judgment more warranted for the prototype than for the actual case, but decreases persuasiveness in situations where the audience finds the judgment less warranted for the prototype than for the actual case. We explore two special challenges indigenous peoples pose to the idea of sovereigns as trustees for humanity. The first challenge is rooted in a colonial history during which a trusteeship model of sovereignty served as an enabler of paternalistic colonial policies. The challenge is to show that the trusteeship model is not irreparably colonial in nature. The second challenge, which emerges from the first, is to specify the scope and nature of indigenous peoples’ sovereignty within the trusteeship model. Whereas the (...) interaction between states and foreign nationals is the locus of cosmopolitan law, the relationship between states and indigenous peoples is distinctive. In the ordinary cosmopolitan case, foreign nationals do not purport to possess legal authority. Indigenous peoples often do make such a claim, pitting their claim to authority against the state’s. We discuss how international law has attempted to come to grips with indigenous sovereignty by requiring states to include indigenous peoples in decision-making processes that affect their historical lands and rights. A crucial fault line in the jurisprudence, however, separates a duty to consult indigenous peoples from a duty to acquire their free, prior and informed consent. The latter but not the former recognizes that indigenous peoples possess a veto over state projects on their lands, in effect recognizing in them a limited co-legislative power. We focus on recent jurisprudence from the Inter-American Court of Human Rights, and consider whether either the duty to consult or FPIC are enough to dispel the shadow of the trusteeship model’s colonial past. We suggest that they are a move in the right direction, and that implicitly they represent international law’s recognition that states are no longer the sole bearers of sovereignty at international law. We investigate argumentation where an expression is substituted with a less precise expression. We propose that the effect that this deprecization has on the audience be called deprecization effect. When the audience agrees more with the less precise version of the argument, there is a positive deprecization effect. We conducted an experiment where the participants were presented with a court room scenario. The results of the experiment confirm the following hypothesis: If the participants find it hard to agree with the (...) precise version of the argument and accept the use of the imprecise term, they will agree more with the imprecise version of the argument. Furthermore, we show that a person who reacts in this way to deprecization commits the fallacy of equivocation. (shrink)

In a recent paper, Max Deutsch argues that there is no “qua problem” for purely causal theories of reference, according to which the extensions of some expressions are grounded in causal relations to members of their extensions during dubbing acts. The qua problem is the difficulty in specifying the facts in virtue of which the reference of “elephant” is grounded by causal contact with something _qua_ elephant and not _qua_ its other properties. If no such specification can be given, reference (...) remains unacceptably indeterminate. This has led many to abandon purely causal reference grounding. Deutsch’s argument for the dissolution of the problem goes as follows: we usually agree that an event can cause its effect _qua_ some of its properties and not _qua_ others. For example, a hot acidic solution causes a glass beaker to break due to its heat and not due to its acidity. Given this assumption, we can simply say that an event caused a dubbing act _qua_ the causally relevant property and not _qua_ the causally irrelevant properties, thus grounding the reference of the term; the qua problem has vanished. I will argue that causal mechanisms, and in particular the facts about causal relevance appealed to by Deutsch, are insufficient to dissolve the qua problem. It is not generally the case that a _unique_ property is causally relevant in purely physical cases of causation; but this is precisely what is required to avoid the referential indeterminacy highlighted by the qua problem. I will demonstrate that if we rely on causal relevance to dissolve the qua problem, there is no way to respect the uniqueness requirement: there are too many properties that are causally relevant to the occurrence of any single dubbing act, including the intentional states of the dubber. The debate on love's reasons ignores unrequited love, which—I argue—can be as genuine and as valuable as reciprocated love. I start by showing that the relationship view of love cannot account for either the reasons or the value of unrequited love. I then present the simple property view, an alternative to the relationship view that is beset with its own problems. In order to solve these problems, I present a more sophisticated version of the property view that integrates ideas from (...) different property theorists in the love literature. However, even this more sophisticated property view falls short in accounting for unrequited love's reasons. In response, I develop a new version of the property view that I call the experiential view. On this view, we love a person not only in virtue of properties shaped by and experienced in a reciprocal loving relationship, but also in virtue of perspectival properties, whose value can be properly assessed also outside of a reciprocal loving relationship. The experiential view is the only view that can account not only for reciprocated love's reasons, but also for unrequited love's reasons. (shrink)

Abstract. The analysis of legal statements that are made from an "internal point of view" must distinguish statements where legal obedience is accepted from statements where legal obedience is only assumed. Statements that are based on accepted obedience supply reasons for action, but statements where obedience is merely assumed can never provide reasons for action. It is argued in this paper that John Searle neglects this distinction. Searle claims that a statement from the internal point of view provides the speaker (...) with reasons for actions that are "self-sufficient" in the sense that they are independent of the speaker's beliefs and desires. This claim is mistaken. A statement that is based on assumed obedience is self-sufficient, but does not give reasons for action. A statement that is based on accepted obedience gives reasons for action, but these reasons are not self-sufficient. (shrink)

The most popular uniting theme in feminist peace literature grounds women's peace work in mothering. I argue if maternal arguments do not address the variety of relationships different races and classes of mothers have to institutional violence and/or the military, then the resulting peace politics can only draw incomplete conclusions about the relationships between maternal work/thinking and peace. To illustrate this I compare two models of mothering: Sara Ruddick's decription of "maternal practice" and Patricia Hill Collins's account of racial-ethnic (...) women's "motherwork.". (shrink)

Envy is almost universally condemned. But is its reputation warranted? Sara Protasi argues envy is multifaceted and sometimes even virtuous.

In this paper I present a novel taxonomy of envy, according to which there are four kinds of envy: emulative, inert, aggressive and spiteful envy. An inquiry into the varieties of envy is valuable not only to understand it as a psychological phenomenon, but also to shed light on the nature of its alleged viciousness. The first section introduces the intuition that there is more than one kind of envy, together with the anecdotal and linguistic evidence that supports it. The (...) second section proposes and explains in detail a definition of envy tout court. The third section presents a recurring distinction between behavioral tendencies of envy, which has been explained in two distinct ways, one mostly proposed by psychologists, the other discernible in the philosophical tradition. The fourth section argues that these models of explanation track two variables, whose interplay is responsible for the existence of the four envies. The fifth section illustrates four paradigmatic cases, and provides a detailed analysis of the phenomenology, motivational structure, and typical behavioral outputs of each. _The Promise of Happiness_ is a provocative cultural critique of the imperative to be happy. It asks what follows when we make our desires and even our own happiness conditional on the happiness of others: “I just want you to be happy”; “I’m happy if you’re happy.” Combining philosophy and feminist cultural studies, Sara Ahmed reveals the affective and moral work performed by the “happiness duty,” the expectation that we will be made happy by taking part in that which (...) is deemed good, and that by being happy ourselves, we will make others happy. Ahmed maintains that happiness is a promise that directs us toward certain life choices and away from others. Happiness is promised to those willing to live their lives in the right way. Ahmed draws on the intellectual history of happiness, from classical accounts of ethics as the good life, through seventeenth-century writings on affect and the passions, eighteenth-century debates on virtue and education, and nineteenth-century utilitarianism. She engages with feminist, antiracist, and queer critics who have shown how happiness is used to justify social oppression, and how challenging oppression causes unhappiness. Reading novels and films including_ Mrs. Dalloway_, _The Well of Loneliness_, _Bend It Like Beckham_, and _Children of Men_, Ahmed considers the plight of the figures who challenge and are challenged by the attribution of happiness to particular objects or social ideals: the feminist killjoy, the unhappy queer, the angry black woman, and the melancholic migrant.
