In this work, Professors Rosenfeld and Mancini have brought together an impressive group of authors to provide a comprehensive analysis on the greater demand for religions exemptions to government mandates. Traditional religious conscientious objection cases, such as refusal to salute the flag or to serve in the military during war, had a diffused effect throughout society. In sharp contrast, these authors argue that today's most notorious objections impinge on the rights of others, targeting practices like abortion, LGTBQ adoption, and same-sex (...) marriage. The dramatic expansion of conscientious objection claims have revolutionized the battle between religious traditionalists and secular civil libertarians, raising novel political, legal, constitutional and philosophical challenges. Highlighting the intersection between conscientious objections, religious liberty, and the equality of women and sexual minorities, this volume showcases this political debate and the principal jurisprudence from different parts of the world and emphasizes the little known international social movements that compete globally to alter the debate's terms. We shall draw an affirmative answer to the question posed in the title. The key point will be a quantum description of physical reality. Once fixed at ontic level two basic elements, namely the laws of physics and the matter, we argue that the underlying physical reality emerges from the interconnection between these two elements. We consider any physical process, including measurement, modeled by unitary evolution. In this context, we will deduce quantum random- ness as a consequence of inclusion of (...) the observer into the quantum system. The global picture of the universe is in a sense deterministic, but from our own local perspective (as part of the system) we perceive quantum mechanical randomness. Then, the notion of "information" turns out to be a derivative concept. (shrink)

By using a tomographic approach to quantum states, we rise the problem of nonlocality within a single particle (single degree of freedom). We propose a possible way to look for such e®ects on a qubit. Although a conclusive answer is far from being reached, we provide some re°ections on the foundational ground.

It is usually believed that a picture of Quantum Mechanics in terms of true probabilities cannot be given due to the uncertainty relations. Here we discuss a tomographic approach to quantum states that leads to a probability representation of quantum states. This can be regarded as a classical-like formulation of quantum mechanics which avoids the counterintuitive concepts of wave function and density operator. The relevant concepts of quantum mechanics are then reconsidered and the epistemological implications of such approach discussed.

Sleep is a major concern, especially in people with Down Syndrome. Beyond Obstructive Sleep Apnea, a number of other sleep difficulties have been reported in children with DS, such as delayed sleep onset, night-time awakenings, and early morning awakenings. The detrimental effect of sleep difficulties seems to contribute to and exacerbate the cognitive and behavioral outcomes of DS. Although the screening for sleep disorders is recommended early in age in DS, only a few studies have evaluated the sleep profile in (...) preschool-age children with DS. The aim of the current study was to assess the association between sleep disturbances and behavioral problems in a group of preschool-age children with DS, by means of a feasible and easy-to-administer parent-report questionnaires. Seventy-one preschool-age children with DS, ranging in age from 3 to 5.11 years, were included in this retrospective study. Sleep disturbances were evaluated by means of the Sleep Disturbance Scale for Children, while emotional and behavioral problems by means of the Child Behavior Checklist. Sleep breathing disorders were the most frequent sleep difficulties reported by parents. Moreover, children with clinical scores in total sleep problems exhibited elevation of psychopathological symptoms, namely Total problems, Affective problems, Anxiety problems, Pervasive Developmental Problems, and Attention Deficit/Hyperactivity Problems. The identification of the broader connection between sleep difficulties and emotional and behavioral problems in preschool-age children with DS leads to important considerations for intervention. The dynamical equations of quantum mechanics are rewritten in the form of dynamical equations for the measurable, positive marginal distribution of the shifted, rotated, and squeezed quadrature introduced in the so-called “symplectic tomography”. Then the possibility of a purely classical description of a quantum system as well as a reinterpretation of the quantum measurement theory is discussed and a comparison with the well-known quasi-probabilities approach is given. Furthermore, an analysis of the properties of this marginal distribution, which contains all the (...) quantum information, is performed in the framework of classical probability theory. Finally, examples of the harmonic oscillator's states dynamics are treated. (shrink)

The author starts by noting a discourse that is widespread but more or less diffuse in the media and certain contemporary political and intellectual quarters, and which has to do with ‘the permanence of the religious’: according to an idea now current, the religious might be resistant to the process of secularization of civil society, because of its psychological and existential implications, or if seen as a universal, irreducible component of human culture. The author analyses the different aspects of this (...) discourse, puts them into perspective in order to draw out their intellectual and political elements and attempts to reconstruct their historical and cultural origins and show how the refusal to historicize ‘religion’ is expressed today through various types of scientific argument coming out of the human and social sciences (arguments which appeal, for example, to the Latin concept of ‘civilization’, or the Germanic one of ( ‘Kultur’). This article analyses how the philosopher Piero Martinetti conceptualizes the survival of a person’s soul after death. Martinetti’s stance is strongly influenced by the philosophy of Plotinus. Martinetti shows that the relation between singularity and multiplicity is expressed in human beings as two different and complimentary perspectives: a fundamental identity in the atemporal dimension of the intelligible life of the spirit and a dynamic tension in the empiric order of the spatio-temporal becoming. Both dimensions express themselves in a finalistic way, (...) attracted from the One who operates in them as a force of harmonization and concentration. The One as Omnitudo realitatis is the cornerstone of Martinetti’s position in regards to the survival of the individual soul after death: a concentration that happens mysteriously, because it transcends the ability of the human mind to understand it – yet, it certainly happens. ≪One thing only we know: what is worth living will live.≫. The article show that the purpose of the final elaboration of Merleau-Ponty is thus to find a new idea of philosophy in which both Hegelian and Husserlian phenomenology can converge. But this tension in no way constitutes an element of rupture in the theoretical continuity of the Merleau-Pontian philosophy.

O artigo versa sobre duas passagens cruciais em que toma forma o tema da comunicação entre vida humana e vida não humana: o século XVI, com Michel de Montaigne (1533-1592) e Giordano Bruno (1548-1600), e o século XVIII, com Jean-Jacques Rous-seau (1712-1778), o qual se inspira directamente nos Essais. O artigo mostra até que ponto a ética de Montaigne se concentra sobre a escuta da natureza imanente a cada indivíduo, comportando em si a ideia da solidariedade que une todos os (...) seres vivos, reconhecendo na comunicação entre a subjectividade humana e a natureza animal a primeira modalidade de identificação com a vida débil, oprimida e sofredora, a qual é condição de explicação de uma ideia de justiça "natural e universal". A piedade constitui já uma disposição para a alteridade que brota do sentimento de identificação com a vida, na sua contingência e capacidade de sofrer. O artigo mostra também até que ponto a reflexão moral de Bruno chega a uma conclusão similar, na medida em que se afasta de uma antropologia que se recusa a conceber o ser humano como centro privilegiado de sentido no universo, antes colocando o homem e o animal numa relação de reciprocidade e de copertença. Será precisamente na medida em que retoma esta elaboração antidualista que Rousseau transformará a piedade no principal eixo da moral. /// The article focuses on the two crucial moments in which the theme of communication between human life and non-human life takes form: the XVI century, with Michel de Montaigne (1533-1592) and Giordano Bruno (1548-1600), and the XVIII century, with Jean-Jacques Rousseau (1712-1778), who directly takes inspiration from the Essais. The article shows how the ethics of Montaigne is centred upon the auscultation of the nature immanent to each individual, and at the same time embraces the idea of the solidarity which connects all living beings, acknowledging in the communication between human subjectivity and the animal nature the first modality of an identification with forms of life which are weak, oppressed and suffering, as condition of explanation for an idea of justice that is both natural and universal Piety constitutes thus a disposition for the alterity which grows from the feeling of identification with life in its contingency and capacity for suffering. The article also shows to what extent Bruno's moral reflexion comes to a similar conclusion, to the extent that it distances itself from an anthropology that refuses to take the human being as a privileged centre of meaning in the universe, placing rather the human being and the animal in a relation of reciprocity and mutual belonging. It shall precisely be to the degree that he takes up this antidualistic formulation that Rousseau will transform piety into the main axis of the moral life. (shrink)

In the spring of 1784 the Marquis of Puységur, a great landowner and colonel in an artillery regiment, was called to the bedside of Victor, the son of his steward, who was suffering from pneumonia. Puységur was a follower of the new holistic medicine taught in an atmosphere of intense enthusiasm and scandal by Franz-Anton Mesmer, an Austrian doctor who had been living in Paris for several years. As a disciple of Mesmer, he intended to direct his ‘vital fluid’ onto (...) the young patient, by means of ‘magnetic passes’, to provoke ‘spasms’ which would lead to a calm state and an improvement in health. But things did not go as anticipated. Instead of displaying the anticipated spasms, the young Victor sank into a strange state of unconsciousness which, at first sight, resembled a deep sleep. Then he revived once more and came to life with a new personality. Freed from his inhibitions, he no longer spoke his habitual dialect, but the French of aristocrats, and he had no hesitation in berating his school teacher, whose secret thoughts he appeared to be able to read. Finally, he forecast the stages by which he would be cured and the remedies which would be suitable for him. Puységur wrote down all these strange facts and the following year he published a report which caused a sensation. Soon, throughout France, somnambulists appeared and observations about their subjects gathered. From that time onwards, the incomprehensible facts apparently evident in ‘provoked’ or ‘artificial somnambulism’ and also in ‘magnetic sleep’ - such expressions were used by Puységur and his followers for the state that he had just discovered - were to give rise to huge controversy. The Marquis of Puységur triggered the development nineteenth century of a movement of reflections and practices which have generally been referred to by the expression ‘animal magnetism’, invented by Mesmer. On the eve of the Revolution and throughout the nineteenth century this movement held a real fascination for philosophers, writers, and scholars. But there has been a tendency to overlook this episode in European culture, which has ultimately become a “lost continent” in our own period. (shrink)

It refers to an apprehension of reality in a poetic and conceptual mode, a vision of the world (...) and humanity opposed to the mechanistic one that emerged from eighteenth century rationalism. Indeed Goethe is a milestone in the history of the themes inherited from ancient traditions and the Renaissance that have in common the project of integrating ‘the science of humankind, the science of nature and a study of the destiny of humanity through the adventure of existence’. En revendiquant le rôle méthodologique fondateur de la philosophie, dans ce célèbre Discours de 1894, très cité dans le cadre du « Débat sur l'historicisme », Windelband procède à une remise en perspective des théories de la connaissance en place à son époque. En polémiquant tout à la fois avec les philosophies positivistes et avec Dilthey, en critiquant notamment l'opposition établie par celui-ci entre Sciences de l'Esprit et Sciences de la Nature, Windelband défend ici l'idée que les sciences contemporaines demandent (...) à être différenciées non pas sur la base de leur objet spécifique (l'esprit ou la nature), mais de leur méthode d'approche des objets, méthode qui varie selon qu'elle soit généralisante (ou nomothétique) ou singularisante (ou idiographique). In his famous Address of 1894 — often cited within the contextual framework of the so-called « Debate on historicism » —, Windelband asserts the methodological and founding role of philosophy. He sets about putting into perspective the theories of knowledge that were current at the time. In arguing with both the positivistic philosophies and Dilthey, notably in criticizing the opposition brought about by the latter between « Sciences of the Mind » and « Sciences of Nature », Windelband champions here the idea that contemporary sciences have to be differentiated not on the basis of their specific object (mind, or nature), but on the basis of their method of approach of these objects — a method that varies, depending on whether it is totalizing (or nomothetic) or singularizing (or ideographic).
