Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

However, in their eagerness to convince us of (...) the smallness of the sacrifices, I think the authors use some unfortunate rhetorical devices and move much too quickly over some necessary distinctions.The rhetorical display is unfortunate if the article is intended to be a fair and rational development of an argument--e.g., those who hold a position in opposition to the authors do not argue they "inveigh." The section on the political area of the controversy seems particularly dismissive of other's positions.However, I will focus on just two areas where I think a more nuanced consideration would make the question of the moral legitimacy of the "small sacrifices" of embryos less obvious than the authors' rhetoric would suggest.First, they claim that opponents of such research assume some sort of "super status" for an embryo. The rights generally conceded to born human beings may not be as "weak" as they characterize. But even considering only the "negative right against unwarranted violence," I think the authors misdescribe the situation. Contrary to their assertion, I do not know when "adults and even children are... forced to give life... in the defense or at least interest of the community's highest ideals and most pressing interests" (p. 153). Could they be speaking of capital punishment, justified in the name of protecting the community? But then why mention children?It is true that not everyone can be guaranteed every means to preserving and enhancing life. But this limitation on positive rights is not a "forced giving." Adults may be compelled to risk life--e.g. in a draft for the sake of a war. But, again, the more or less justifiable imposition of a risk is not the same as selecting out one particular individual or class to be directly killed. Neither adults nor born children are compelled to be killed for the sake of organ "donation," even if a greater number might be saved. If one grants equivalent status to the embryo (as the authors seem to do here for the sake of argument), opponents do not have to claim a "super status" for embryos, just the ordinary human right not to be killed even for "compassionate" motives.A second area where I think the authors move too quickly is in their impoverished definition of the essential humanity of the early embryo as exhaustively represented by the physical structure of its DNA. The authors seem to recognize [End Page 103] that, ordinarily, there is more to personhood than sheer physical structure. For example, they mention memories and habits (p. 154). They could also speak of relationships, attitudes, and the like. Since an early embryo has no such components of personality as we experience it, the authors hold that its identity could only be contained in its DNA. Since this DNA is preserved, even spread far and wide, by the use of stem cells, it almost seems as if we are doing the early embryo a favor by breaking it up.However, just because the embryo does not have any conscious memories or other attributes of character or personality, that does not mean its identity is constituted only by its physical structure described statically. The early embryo is not just a bundle of discrete structures, and its DNA is not just an inert lump made up of certain smaller lumps. Both the embryo and its DNA are active. Thus the identity of even an early embryo includes both its current processes and the innate potential for further activity and development. We are sympathic with LeDoux’s primary goal here ─ to get a solid scientific grip on what has been dubbed one of the most elusive, important questions in scientific discourse, to identify the underlying biomolecular processes that give rise to consciousness. However, we have issues with the way he goes about it and have tried to present them in a constructive manner. Our commentary is built around our theory of the origins of minds, dubbed the Cellular Basis of Consciousness (CBC), (...) and the empirical research that supports it. The CBC is based on the proposition that life and sentience are co-terminous, that life without subjectivity, feeling, without valenced perception, without the capacity to learn and lay down memories would have been an evolutionary dead-end. It could not have survived in the hostile, chaotic world in flux that dominated our planet four billion years ago. The biological sciences operate on the principle that all species, extant and extinct, evolved from the first prokaryotes. But what is meant by the term panentheism, and how does it work so as to avoid becoming still another form of pantheism or cosmic monism? Joseph Margolis, known for his considerable contributions to the philosophy of art and aesthetics, pragmatism, and American philosophy, has focused primarily on the troublesome concepts of culture, history, language, agency, art, interpretation, and the human person or self. For Margolis, the signal problem has always been the same: how can we distinguish between physical nature and human culture? How do these realms relate? _The Cultural Space of the Arts and the Infelicities of Reductionism_ identifies a conceptual tendency that can (...) be drawn from the work of the twentieth century's best-known analytic philosophers of art: Arthur Danto, Richard Wollheim, Kendall Walton, Nelson Goodman, Monroe Beardsley, Noël Carroll, and Jerrold Levinson, among others. This trend threatens to impoverish our grasp and appreciation of the arts by failing to do justice to the culturally informed nature of the arts themselves. In Joseph Butler, we have an account of human beings as moral beings that is, as this essay demonstrates, being supported by the recently emerging findings of the neurosciences. This applies particularly to Butler's portrayal of our empathic emotions. Butler discovered their moral significance for motivating and guiding moral decisions and actions before the neurosciences did. Butler has, in essence, added a sixth sense to our five senses: this is the moral sense by means of which we perceive what (...) we ought or ought not do. The moral sense yields relatively reliable moral perceptions when we love our neighbors as ourselves, and when our love for ourselves is genuine. Accurate moral perceptions will be thwarted by self-deceit—that is, by a self-partiality devoid of neighbor love, a condition that thwarts genuine self-love. Arthur Fine has recently argued that standard realist and anti-realist interpretations of science should be replaced by "natural ontological attitude" (NOA). I ask whether Fine's own justification for NOA can meet the standards of argument that underlie his criticisms of realism and anti-realism. Fine vacillates between two different ways of advocating NOA. The more minimalist defense ("why not try NOA?") begs the question against both realists and antirealists. A stronger program, based on Fine's arguments for a "no-theory" of truth, (...) has promise, but the arguments must be developed in a stronger, more general form if they are to justify NOA. (shrink)

In several recent papers, Arthur Fine has developed a far-reaching attack upon both the standard realist interpretations of science and their most prominent anti-realist alternatives (1986a, 1986b, 1986c). In their place, Fine proposes not another position on the realist/anti-realist axis, but an attitude toward science, the “natural ontological attitude” (NOA), which is supposed to remove any felt need for a philosophical interpretation of science.In this paper I will be concerned with Fine’s reasons for adopting NOA rather than his arguments (...) against realism and anti-realism. Unless these reasons are adequate, Fine’s papers are likely to set off a scramble for new and better arguments concerning realism, rather than the reorientation of the philosophy of science which his polemics are clearly intended to provoke. Thus for my purposes, we can presume that Fine’s criticisms of standard positions are generally sound. The question is whether Fine’s proposed alternative attitude can then satisfy the same argumentative standards. (shrink)

This paper points to a more viable theory of interpretation on the basis of opposing the missteps in Arthur Danto’s theory. By noting the incongruities in Danto’s theories of art and interpretation, a theory of interpretation emerges which unifies its varieties on the basis of the view of the human person as a culturally embodied and enlanguaged primate. A feature notably absent from Danto’s own account.

_What, After All, Is a Work of Art? _directs our attention toward historicity, the inherent historied nature of thinking, and the artifactual, culturally emergent nature of both art and human selves. While these are familiar themes in Margolis's well-known studies of art and culture, they are largely neglected in English-language aesthetics and even philosophy in general. Margolis brings these primary themes to bear on a number of strategically selected issues: the modernism/postmodernism dispute; the treatment of modernist and "post-historical" painting in (...) Clement Greenberg and Arthur Danto; the coherence of relativism in interpreting art and the relevance of cultural relativity; the difference between artworks and persons as culturally constituted entities in contrast to natural entities and with regard to the logic of interpretation; the import of film on the theory of the relationship between understanding ourselves and understanding art, with special attention to the views of Walter Benjamin; and the propriety of the analogy between artworks and selves, as cultural entities, by way of treating the arts as a form of human "utterance." Although the argument is largely focused on certain particularly strenuous puzzles in the philosophy of art, the validity of Margolis's claims are more far reaching. If, through incorporating the reality of physical and biological nature, the emergence of art and human selves cannot rest satisfactorily on exemplars selected from nature alone, then certain fashionable views of science, of canons of understanding, conceptual resources, logic, rationality, and the like may well have to yield ground to ampler models that have been largely marginalized or overridden. In particular, the admission of historicity, the nerve of Margolis's argument, invites a decisive conceptual reorientation. _What, After All, Is a Work of Art? _is based on a series of lectures Margolis delivered at various universities in Japan in the Spring of 1997, while serving as a fellow of the Japan Society for the Promotion of Science. Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A.N. Whitehead's famous dictum that the entire European philosophical tradition 'consists of a series of footnotes to Plato' could equally characterize Maimonides' place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations--Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman--have read and (...) provided footnotes to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. SummaryThe discovery of dark lines in the spectrum of the sun as well as in some fixed stars since 1802 by William Hyde Wollaston, Joseph Fraunhofer and Johann Lamont is a relatively isolated phenomenon in the history of astronomy of the first half of the 19th century. Wollaston's representation of the sun's spectrum of 1802 can be seen as a simplification and reduction of the phenomenon by way of a seemingly clear connection with contemporary knowledge. Fraunhofer's famous colour etching (...) of the dark lines, of about 1817, can be regarded as a meticulous and painstaking representation of the known facts, taken to a high aesthetic level.Lamont's spectra of the fixed stars from 1836 are the first sketches of all of these phenomena. He emphasized the ‘oddness’, that is, the chaotic variety of identifiable lines. What was common to all of these representations was the general belief that something new and unimaginable could now be established as a scientific subject. The observations of these lines were coincidental with the thinking in other fields, as for example, in Alexander Humboldt's understanding of nature, in Johann Wolfgang von Goethe's theory of light and his interest in pictorial representations of nature, and in the new concept of landscape of the romantic painters. It is no exaggeration to say that his efforts as a philosopher and editor of Philosophy East and West helped lay the foundation for the flourishing discipline now called comparative philosophy. In this work, some of the more important philosophers engaged in this worldwide effort comment on particular aspects of Deutsch's philosophy. The results are an exceptional tribute to an exceptional philosopher. Deutsch's responses show an open and gracious intelligence at work, one that is constantly learning from the insights of others.Arthur Danto offers his understanding of the relation between mysticism and art in Deutsch's philosophy. Deutsch's response brings the reader back to the formative years at Columbia University and the still simmering debate over what constitutes a genuine work of art. Postmodern philosophers could learn from Deutsch's careful handling of historical sources even as he appropriates the moving center of Indian philosophy for his own philosophical projects.One of the most brilliant essays in this festschrift is contributed by Herbert Fingarette. By bringing together the art of "wei wuwei" and the act of suffering, understood as the process of letting be what is really happening, Fingarette restores to suffering its genuine spiritual core. To suffer is not just to suffer pain but rather to "Suffer the Way to be. Do not interfere. Be like water—passive, and yet in the end powerful" (p. 74). Deutsch is moved by this extraordinary essay to offer an exceptional restatement of the central doctrine of the Bhagavad Gītā and his own theory of free action and its relation to authentic art: "This power is compelling for others. It attracts, because it is evident; it calls because one recognizes its possibilities for oneself; it demands because it sets a standard by which one measures, as it were, one's own attainment as a person" (p. 193). In this new volume in the Oxford Psychology Series, the author presents a highly readable account of the cognitive unconscious, focusing in particular on the problem of implicit learning. Implicit learning is defined as the acquisition of knowledge that takes place independently of the conscious attempts to learn and largely in the absence of explicit knowledge about what was acquired. One of the core assumptions of this argument is that implicit learning is a fundamental, "root" process, one that lies at (...) the very heart of the adaptive behavioral repertoire of every complex organism. The author's goals are to outline the essential features of implicit learning that have emerged from the many studies that have been carried out in a variety of experimental laboratories over the past several decades; to present the various alternative perspectives on this issue that have been proposed by other researchers and to try to accommodate these views with his own; to structure the literature so that it can be seen in the context of standard heuristics of evolutionary biology; to present the material within a functionalist approach and to try to show why the experimental data should be seen as entailing particular epistemological perspectives; and to present implicit processing as encompassing a general and ubiquitous set of operations that have wide currency and several possible applications. Chapter 1 begins with the core problem under consideration in this book, a characterization of "implicit learning" as it has come to be used in the literature. Reber puts this seemingly specialized topic into a general framework and suggests a theoretical model based on standard heuristics of evolutionary biology. A comprehensive study on the various benefits and traits of living with a Biblical worldview.

Dimensions of character are often overlooked in professional practice at the expense of the development of technical competence and operational efficiency. Drawing on philosophical accounts of virtue ethics and positive psychology, the present work attempts to elevate the role of ‘good’ character in the professional domain. A ‘good’ professional is ideally one that exemplifies dimensions of character informed by sound judgement. A total of 2340 professionals, from five discrete professions, were profiled based on their valuation of qualities pertaining to character (...) and judgement. Profile differences were subsequently examined in the self-reported experience of professional purpose towards a wider societal ‘good’. Analysis of covariance, controlling for stage of career, revealed that professionals valuing character reported higher professional purpose than those overweighting the importance of judgement or valuing neither character nor judgement, F = 7.92, p <.001. No differences were found between the two groups valuing character, irrespective of whether judgement was valued simultaneously. This profiling analysis of entry-level and in-service professionals, based on their holistic character composition, paves the way for fresh philosophical discussion regarding what constitutes a ‘good’ professional and the interplay between character and judgement. The empirical findings may be of substantive value in helping to recognise how the dimensions of character and judgement may impact upon practitioners’ professional purpose. (shrink)
