Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones by (...) Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. There is ample research on how metaphors of life vary both cross-culturally and within culture, with age emerging as possibly the most significant variable with regard to the latter dimension. However, no representative research has yet been carried on whether variation can also occur across time. Our paper attempts to fill this gap in the literature by exploring whether a major crisis, such as the COVID-19 pandemic, can induce variation in how life is metaphorically conceptualized throughout society. By drawing on (...) the results of a nationwide, representative survey on the metaphorical preferences for life among Hungarian adults carried out during the second wave of the COVID-19 pandemic, we hypothesized that the pandemic would induce a revolutionary change (in the sense of the change being swift, as opposed to gradual) in how Hungarian adults metaphorically conceptualize life, as compared to the metaphorical preferences of the pre-COVID-19 era. We expected this variation to manifest itself in the emergence of novel metaphorical source domains and a realignment in metaphorical preferences. Our results, however, indicate that novel conceptualizations emerged only as one-off metaphors; Hungarians mostly rely on a stock collection of life metaphors even in times of crises, with changes happening mostly in the form of shifts in metaphorical preferences. Our study also found that the choice of preference of the source domains showed less alterations among older adults – implying that the older we get, the more resistant to change our metaphorical conceptualizations become, even under extreme conditions such as COVID-19. Every day, people make decisions about who owns what. What cognitive processes produce this? The target article emphasises the role of biologically evolved intuitions about competition and cooperation. We elaborate the role of cultural evolutionary processes for solving coordination problems. A model based fully on biological evolution misses important insights for explaining the arbitrariness and historical contingency in ownership beliefs.

This article examines whether the voting age should be lowered to 16. The dominant view in the literature is that 16-year-olds in the United Kingdom are not politically mature enough to vote since they lack political knowledge, political interest and stable political preferences. I reject this conclusion and instead argue that the voting age should be lowered to 16. First, I look at Chan and Clayton’s empirical claims and show that these features of 16- and 17-year-olds are in fact created (...) by exclusionary social practices and therefore that these features cannot be used to justify their exclusion from the vote. Second, I evaluate preliminary evidence from Austria which suggests that 16- and 17-year-olds, when actually given the vote, are politically mature. Third, I show that, on a balance of harms, considering that some 16- and 17-year-olds are mature, we still should lower the voting age even if some 16- and 17-year-olds are not politically mature. This paper arose out of the 2017 international conference on AI and law doctoral consortium. There were five students who presented their Ph.D. work, and each of them has contributed a section to this paper. The paper offers a view of what topics are currently engaging students, and shows the diversity of their interests and influences.

An online survey of 654 Australians found that the NP seniors is associated with positive personal characteristics of health and well-being such as ‘like to travel’, ‘lead an involved and active life’, ‘are vibrant and full of purpose’. Older people is also associated with positive characteristics, but somewhat less so than seniors and more socially oriented. Older people are seen to ‘benefit the workforce through their experience’, ‘have wisdom and can always be turned to for advice’, ‘play an important role (...) in their extended family’s life’. By contrast, the characteristics of those typically referred to by the elderly are negative in that the referents are incompetent or impose a burden on society, cf. ‘are frail and fall more often’, ‘are often victims of mental and physical abuse’, ‘are unable to look after themselves and depend on others for help’. The referents of old people and oldies have no particular set of characteristics assigned to them; perhaps that is why they only figure in the one characteristic ‘are tight-fisted with money’ that itself is not strongly associated with any one of the five NPs. Social media is an endless source of texts and images about almost everything. Accordingly, the number of analyses based on this source increases daily. Among the numerous methods social media can be analysed by, our attention focusses on discourse analysis. DA is a complex approach which makes it possible to capture not only the linguistic characteristics of given texts, but also their socially constructive and socially constructed features. Therefore, we carried out a systematic examination of the articles at one of (...) the largest academic databases, EBSCO available in 2019 which used DA in social media research. Our investigation studies not only the geographical distribution of this corpus, but the different self-proclaimed DA approaches. Furthermore, we developed a three-level scale in order to capture the methodological complexity of the collected articles. At one end of the scale there are those research papers where discourse appears only as a label for the textual material gathered, without further indication of any DA theories or methodologies. The other end, however, refers to those research projects which applied DA both in their theoretical and methodological frameworks, providing complex discourse analytical investigations of social media texts. This way we were able to demonstrate the wide array of DA perspectives employed in social media research. (shrink)

The present paper—taking the example of the English translation of the Hungarian Civil Code of 2013—aims to give an overview on the legal and terminology-related challenges and pitfalls that might occur during the process of translating a civil code with civil law traditions into the language of the common law world. An attempt is made to categorise terminology-related conceptual problems and elaborate how the different types of translation methods could be applied; moreover, how a kind of legal-linguistic checks-and-balances can be (...) achieved through the well-dosed combination, having also the ratio of similarities to differences of legal concepts behind the respective terms in mind. Legal translators must act beyond the role of a simple translator: they must be comparatists, being aware of the legal origin of the relevant concepts and using the methods of comparative private law and translation studies at the same time, since both law and language are system-bound and are heavily influenced by the cultural and social environment. The authors strive to identify the significance of those problems from the perspective of how language-related aspects can perform some fine-tuning on the comparative methodology and findings, whether they are barriers only or provide also an opportunity to verify or refute prima facie comparative results. Comparative law—no doubt—supports legal translation, but their relationship is reciprocal: legal-linguistic subjects and problems emerging in the course of legal translation supply valuable feedback and further sources of inspiration. À travers le cas de Júlia Rajk (1914-1981), veuve du puissant ministre de l’Intérieur Laslo Rajk exécuté en 1949 à l’issue du premier grand procès en Hongrie, l’article explore la complexité de la construction des subjectivités politiques des femmes sous le communisme. Il soutient l’idée que ce n’est pas la participation à l’organisation officielle des femmes mais l’opposition à cette dernière qui conduit à des formes genrées de résistance.

This article provides an overview of some of the key changes brought about by the groundbreaking Framework Agreement (known as the Ohrid Agreement) in Macedonia since its signing in 2001. A power-sharing arrangement, it saved Macedonia from the brink of civil war. This article describes how the Ohrid Agreement restored peace by addressing the constitutional status of minorities, their equitable representation in the public sector and issues connected with higher education in the 2002–2006 period. It further assesses the merits of (...) decentralization as a remedy for safeguarding a unitary state in a multi-ethnic environment. It consequently argues that the Ohrid Agreement and the ensuing reforms have been important steps in the right direction revitalizing Macedonia by empowering not only the sizeable Albanian population but other less numerous communities as well. However, daunting challenges remain ahead. The perception and language gap between the two main ethnic communities hinder efforts for a truly functioning multi-ethnic state. Moreover, the new government formed after the July 2006 general elections has stirred controversy and caused tensions affecting its Euro-Atlantic perspective. To what extent this will affect Macedonia’s multi-ethnic democracy remains to be seen. (shrink)

ABSTRACTThis article describes our experience using art and theatre to engage rural communities in western Cambodia to understand malaria and support malaria control and elimination. The project was a pilot science–arts initiative to supplement existing engagement activities conducted by local authorities. In 2016, the project was conducted in 20 villages, involved 300 community members and was attended by more than 8000 people. Key health messages were to use insecticide-treated bed-nets and repellents, febrile people should attend village malaria workers, and to (...) raise awareness about the risk of forest-acquired malaria. Building on the experience and lessons learnt in the year prior, the 2017 project which was conducted in 15 villages involved 600 community members and attracted more than 12,000 people. Placebo-controlled trials are controversial when individuals might be denied existing beneficial medical interventions. In the case of malaria, most patients die in rural villages without healthcare facilities. An artesunate suppository that can be given by minimally skilled persons might be of value when patients suddenly become too ill for oral treatment but are several hours from a facility that can give injectable treatment for severe disease. In such situations, by default, no treatment is (or can be) given until the patient (...) reaches a facility, making the placebo control design clinically relevant; alternative bioequivalence designs at the facility would misrepresent reality and risk incorrect conclusions. We describe the ethical issues underpinning a placebo-controlled trial in severe malaria. To protect patients and minimise risk, all patients were referred immediately to hospital so that each had a higher chance of prompt treatment through participation. There was no difference between artesunate and placebo in patients who reached clinic rapidly; among those who could not, a single artesunate suppository significantly reduced death or permanent disability, a finding of direct and indirect benefit to patients in participating villages and elsewhere. The formal analysis of normative systems has traditionally focused on their deontic dimension rather than on their potestative dimension; yet, a growing amount of works aims at shedding light on the notion of power, its norm changing potential and its general interactions with deontic concepts. The present article contributes to this line of inquiry by adopting the following perspective: a normative system can be metaphorically seen as an agent that allocates abilities (powers) in order to promote the fulfillment of certain (...) desires (deontic directives), and in doing so regulates its behavioural domain. Our analysis emphasizes the instrumental nature of power, while clarifying the distinction between ‘being allowed’ and ‘being enabled’ and unveiling new patterns of interaction between deontic and potestative concepts. Operationally, we formulate this framework in terms of conditional rules, and provide a corresponding logic programming (ASP) implementation. (shrink)

SummaryIn 1968, a prospective study was started in collaboration with the Family Planning Association to try to provide a balanced view of the beneficial and harmful effects of different methods of contraception. This investigation is now in progress at seventeen clinics and over 17,000 women are under observation. At the time of recruitment, all these women were married white British subjects, aged 25–39 years, who voluntarily agreed to participate. Fifty-six per cent were using oral contraceptives, 25% were using a diaphragm (...) and 19% were using an intrauterine device. During follow-up each woman is questioned at return visits to the clinic and a record of pregnancies and their outcome, hospital referrals, changes in contraceptive methods and the results of cervical smears, is accumulated. Women who default are sent a postal questionnaire and, if this is not returned, are telephoned or visited in their homes to collect the necessary information.So far, data obtained during 56,000 woman-years of observation are available for analysis. Follow-up has been maintained with an annual lapse rate of about 0.3%due to withdrawal of co-operation or loss of contact; adherence to the method of contraception in use at recruitment has been reasonably good, and the reporting of pregnancies and hospital admissions appears to have been both reliable and unbiased.The present data include only 24 deaths, so the mortality associated with different contraceptive methods cannot yet be estimated. With regard to morbidity, however, our preliminary results closely resemble those obtained in the prospective study carried out by the Royal College of General Practitioners and in the principal retrospective studies carried out in Britain and the United States. Women who used oral contraceptives at the start of the study experienced adeficiencyof hospital referrals for cancer, benign lesions of the breast, menstrual disorders other than amenorrhoea, duodenal ulcer, and retention cysts of the ovary; they showed anexcessof referrals for cerebrovascular disease, cervical erosion, skin disorders, self-poisoning, migraine, venous thrombosis and embolism, hayfever, gallbladder disease, amenorrhoea, and sterility. Women who used a diaphragm showed adeficiencyof hospital referrals for carcinoma-in-situ and dysplastic lesions of the cervix uteri and accidental injury; and anexcessof referrals for haemorrhoids and cystitis. Women who used an IUD experienced anexcessof hospital referrals for anaemia, varicose veins and salpingitis. About half of these differences were predicted from other studies while some suggestive evidence already existed for a further five. Of the remaining six, some probably reflect the influence of selective factors or chance.Multiple pregnancies, stillbirths, malformations, the sex ratio and birthweight showed no consistent relationship to method of contraception. The outcome of unplanned pregnancies occurring in women using an IUD, however, was remarkably unfavourable both in terms of ectopic gestation and miscarriage.Clear evidence was found of impairment of fertility after discontinuation of oral contraceptives. Whether this is likely to lead to permanent sterility in some women is uncertain.The study has provided data on the efficacy of a wide variety of contraceptive methods. In general the failure rates are in keeping with those obtained in other large-scale studies, save that those for the diaphragm and the sheath are much lower than those usually quoted.The available evidence does not yet allow a final balance to be struck between the benefits and risks associated with the new methods of contraception that have become widely used during the last two decades. It seems clear, however, that there are no material risks associated with the use of the diaphragm apart from the risk of pregnancy and that there may be some unintended benefits. (shrink)

Do tej pory badacze dysponowali jedynie źródłami drukowanymi lub odpisami wykonanymi przez osoby trzecie. Rękopisy ujawnione w kolekcji Simona Gratza w zbiorach Historical Society of Pennsylvania składają się z dwóch części (czystopisu i brudnopisu), obejmując łącznie 5 stron wierszy podpisanych nazwiskiem Jakubowskiego. Omawiane rękopisy stanowią reprezentatywny przykład wszechstronnych umiejętności pisarskich i poetyckiej dykcji Jakubowskiego oraz pokazują jego osobowość twórczą w nowym (...) oświetleniu. Nie tylko przynoszą nową wiedzę o dorobku poety, jego zainteresowaniach lekturowych, wrażliwości i podjętym wysiłku adaptacji w USA, ale także umożliwiają usytuowanie znanych utworów w nowej perspektywie badawczej oraz odzyskanie utraconego sensu wierszy zagubionych lub przepisywanych obcą ręką. Powodem był m.in. fakt, że pierwszy akapit napisany został ręką Sydenhama, co skłoniło Dewhursta do przypuszczenia, że rola Locke’a sprowadzała się jedynie do pełnienia obowiązków sekretarza znanego angielskiego lekarza. El presente estudio busca describir fenomenológicamente la forma que exhibe la pena en el cuerpo, después de la pérdida de un ser querido. Para esto, se consideran las hipótesis de movimiento centrı́peto orientado a la autoafección, y movimiento centrı́fugo aludido a la ruptura de la intercorpereidad. Ambos movimientos, hacen referencia a la sensación ambigua que el cuerpo vive en la pena asociados a la presencia y ausencia del otro que ya no está, ya que el dolor provee un estado de (...) desincronización temporal que vuelve simultáneos el presente-pasado y presente-futuro. Esto trae como consecuencias, la contracción y extensión del cuerpo a partir de la maleabilidad de sus propios lı́mites. (shrink)

In the context of mainstream feminism, Eastern-European women, coming from a post-Communist context are overwhelmed. As they have been unable to access the newest developments of feminist thought, feminist theology, they cannot find their own place and voice. In order to overcome this state of mind, this article puts forward an approach and a strategy. Drawing from the main ideas of contemporary Romanian and Transylvanian feminists – Mihaela Mudure, Mihaela Miroiu, Réka Geambasu, Enikő Magyari-Vincze and others – the article (...) aims to start the quest for a fitting Eastern European-type of feminism. Post-Communist countries are the so-called ‘second world’. They need to find their own way, their own voice, similar to the ‘third world’, which has already started to do so. The knowledge and reception of the international feminist movement and its main oeuvre can help Central and Eastern European women theologians find those aspects that have supported others. Stating the specific situation of ‘second world’ women and seeking the theological aspects that describe their position and problems adequately, they can contribute to finding their one and only special voice.
