Peut-être est-on face à un défi aux postulats du libéralisme. Mais est-il vrai que le libéralisme s’opposait à l’intervention de l’État dans le domaine économique ? A principios del año 2005, Manuel Escamilla, por entonces editor de los ACFS, me sugirió que recopilara los trabajos publicados desde los comienzos de la revista. Se acercaba el Congreso Mundial de Filosofía del Derecho, que iba a celebrarse en Granada en mayo de 2005, y parecía una buena idea ofrecer un catálogo que incluyera noticia de todas las publicaciones contenidas en la revista desde su aparición, en 1961 hasta la fecha (por entonces, 2004)….

En 1806, es decir, hace m s de doscientos a¤os, naci¢ John Stuart Mill. Su padre, el fil¢sofo radical utilitarista James Mill, lo someti¢ a un programa educativo que hizo de ‚l una especie de ni¤o prodigio. Este ni¤o prodigio desarroll¢ una intensa labor intelectual, sin descuidar su actividad profesional privada, e incluso particip¢ en la vida pol¡tica de su tiempo. A pesar de la diversidad de temas que abord¢ y de los mbitos por los que se interes¢, John Stuart (...) Mill nos leg¢ un conjunto de escritos sobre la llamada democracia liberal, de los que tambi‚n la socialdemocracia sac¢ provecho. En esos escritos ya se apuntaban algunos de los problemas a los que seguimos enfrentados en la actualidad: la tensi¢n entre las masas y las elites, la perversi¢n del inter‚s general por la presencia de intereses siniestros, la desigualdad social que lleva a la marginaci¢n pol¡tica por raz¢n de sexo, clase, raza o procedencia, los sofismas del discurso pol¡tico que permiten la manipulaci¢n de la opini¢n p£blica, el tama¤o y la composici¢n de los grupos humanos de cara a su organizaci¢n pol¡tica, o la discusi¢n en torno a la pol¡tica econ¢mica m s adecuada a la democracia. De tales problemas tratan los textos reunidos en el presente libro, cuyo punto de partida lo constituye el an lisis cr¡tico de los textos de John Stuart Mill. Este ejercicio comparativo pretende poner de manifiesto, precisamente, qu‚ queda en la actualidad, o que se puede esperar que quede, de la democracia que ‚l preconizaba. (shrink)

En este texto se analiza el papel de los derechos humanos en la fase actual de globalización, en cuanto herramientas de la libertad política. Su globalización, hasta ahora pervertida por una selección parcial e interesada de lo globalizable -ante todo, el sistema de libre mercado- es imprescindible para el funcionamiento democrático de la nueva organización mundial. Pero para que los derechos humanos sean útiles a tal menester, será necesario en primer lugar, reflexionar sobre los servicios que han prestado al desarrollo (...) y ahora a la globalización del capitalismo. En segundo lugar, es preciso adecuar el discurso de los derechos a las necesidades de quienes padecen los desequilibrios que origina la globalización y convertirlo realmente en un discurso emancipador. Una imprescindible contextualización de los contenidos y condiciones de ejercicio de los derechos -para lo que son imprescindibles derechos sociales y a lo que aún ayuda los Estados-nación- es el corolario de esta reflexión que finaliza con un ejemplo de contextualización del discurso de los derechos a través de los derechos de los consumidores. Más allá de la legitimidad o ilegitimidad que para el gobierno de un Estado democrático puede comportar la cuestión de la democracia interna de sus partidos, en este artículo se demanda un control y una valoración autónoma del asunto porque, sencillamente, la organización y funcionamiento democráticos de los partidos es una herramienta pedagógica fundamental para que el ciudadano aprenda a vivir en democracia. Esta circunstancia exige la reactivación de sus derechos políticos en el seno de cualquiera de las comunidades de (...) las que forme parte, incluido un partido, lo cual lleva a un ejercicio de especificación o personalización de los mismos en la figura del afiliado. Dicha tarea, que acomete este artículo en relación con los partidos políticos españoles, permite ofrecer un criterio para valorar la cantidad de democracia interna de nuestros partidos, así como para revitalizarla. Introductory study to “Utilitarismo y Constitucionalismo: La Ocasión de 1812. (Eds. Manuel Escamilla Castillo y Josefa Dolores Ruiz Resa) Ed. Dykinson, Madrid, 2012.”.

ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer a (...) compositional derivation of their meaning. (shrink)

I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

Using a comprehensive sample of U.S. non-profit hospitals from 2011 to 2015, we examine the effects of state community benefits regulation on the amount of charity care provided by and the operational efficiency of U.S. non-profit hospitals. First, we document that, under such regulations, non-profit hospitals provide more charity care and less compensated care as a proportion of net revenue. We infer from these findings that CBR has the potential to increase both non-profit hospitals’ amount of charity care and their (...) efficiency of operations. Second, by examining variation in CBR types, we find no differences between having provision or having reporting requirements on the amount of charity care offered. Moreover, when we consider CBR with both provision and reporting requirements, the combination of these two requirements does not incrementally enhance charity care offerings, suggesting that the requirements may serve as substitutes with comparable effect. Lastly, we show that several state-level characteristics influence the relationship between CBR and charity care: CBRs in states with a higher gross domestic product and percentage of revenue received in taxes have incrementally lower associations with charity care, while hospitals in states where populations have, on average, higher household incomes have greater associations between CBR and charity care. Our findings highlight the effects that state-enacted regulation can have on socially beneficial behavior by non-profits. (shrink)

After viral entry into the cell, the nuclear envelope poses a major cellular barrier that needs to be overcome upon adaptation of highly pathogenic avian influenza viruses (HPAIV) to the new host. To ensure efficient viral transcription and replication in the nucleus of the host cell, the viral polymerase complex of avian influenza viruses needs to switch from recognition of avian to mammalian components of the nuclear import machinery. En este artículo analizaré algunos puntos de convergencia entre la filosofía transhumanista y la crítica filosófica contemporánea al antropocentrismo. Para ello distinguiré entre un tipo de programa normativo fuerte y uno débil en el transhumanismo. El argumento central reside en que la normatividad fuerte en el discurso transhumanista, al suponer que es posible seleccionar exclusivamente las características “propiamente humanas” para ser conservadas en el estadio post-humano, se basa en una concepción pre-darwiniana de la especie humana, lo cual posee implicancias tanto (...) epistemológicas como éticas. El artículo presenta los principales resultados de un estudio realizado entre 1998 y 2000 con hombres jóvenes de la Ciudad de Cali, Colombia, profundizando en sus prácticas de distinción en torno al cuerpo, la vestimenta, los espacios de sociabilidad, las mujeres como objetos de ostentación y sus dinámicas de prestigio. El estudio es desarrollado en base a observación participante y a la implementación de entrevistas con grupos de jóvenes entre 14 y 22 años, tanto de sectores medios bajos, como medios (...) altos, e indaga en sus opiniones sobre la moda, el prestigio, la distinción social y los comportamientos que otorgan o quitan el estatus. El presente artículo desarrolla una reflexión acerca de los ideales de belleza femenina promovidos por el mercado y los mass-media, dando cuenta de datos estadísticos e informes periodísticos de los trastornos que generan, en términos de mortalidad y morbilidad en la población femeninaLa primera parte del análisis responde, desde una perspectiva psicológica, a la pregunta ¿cómo se constituye como sujeto una mujer? La segunda parte aborda desde una perspectiva sociocultural la pregunta ¿cómo debe ser una mujer?, desde la premisa de (...) que las prácticas de educación y moldeamiento del cuerpo tienen sentido en la modernidad como una forma de control social. Finalmente se busca, desde una perspectiva política, señalar cómo el “boom” de la estética corporal es un mecanismo de dominación principalmente dirigido a la mujer, al cual las políticas públicas y la legislación no logran dar respuesta, manteniendo a éstas en un lugar pasivo como sujeto y actor político. In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. Currently, there are almost as many conceptions of emergence as authors who address the issue. Most literature on the matter focuses either on discussing, evaluating and comparing particular contributions or accounts of emergence, or on assessing a particular case study. Our aim in this paper is rather different. We here set out to introduce a distinction that has not been sufficiently taken into account in previous discussions on this topic: the distinction between inter-domain emergence—a relation between items belonging to different (...) ontic domains—and intra-domain emergence—a relation between items belonging to a same ontic domain. Our final purpose is not to assume and defend a definite stance on emergence, but to stress the relevance of such distinction when attempting to argue for or against emergence, in the first place. We will also address the connections between emergence so distinguished and more general philosophical perspectives, suggesting where would reductionists and pluralists stand with respect to intra- and inter-domain emergence. Objectives—To assess the relationship between the approval of trials by a research ethics committee and the fact that informed consent from participants was obtained, with the quality of study design and methods.Design—Systematic review using a standardised checklist.Main measures—Methodological and ethical issues of all trials published between 1993 and 1995 in the New England Journal of Medicine, the Lancet, the Journal of the American Medical Association and the British Medical Journal were studied. In addition, clinical trials conducted in Spain and published (...) by at least one Spanish author during the same period in any other journal were also included.Results—We studied the published articles of 767 trials and found the following indicators of lower methodological quality to be independent predictors for failure to disclose REC approval or ICP: absence of concealment of allocation, lack of justification for unblinded trials, not using a treatment for the patients in the control group, absent information on statistical methods, not including sample size estimation, not establishing the rules to stop the trial, and omitting the presentation of a baseline comparison of groupsConclusion—Trials of higher methodological and scientific quality were more likely to provide information about their ethical aspects. In biology and philosophy of biology, discussing the notion of interaction leads to an examination of interactionism, which is, broadly speaking, the view that rejects gene-centrism and gene determinism and instead emphasizes the fact that traits of organisms are always the result of genes and environments. It has long been asserted that the nature-nurture problem requires an interactionist solution of sorts, the so-called interactionist consensus. This consensus, however, has been deemed insufficient and challenged by several authors triggering an extension of (...) the debate among contestants and defenders. Unfortunately, part of the problem is that the views on causation that would ground claims about interactionism are not always made explicit in this debate, which renders those views somewhat complicated to assess. Moreover, it seems to be assumed that causal complexity excludes the possibility of characterizing, distinguishing, or comparing among causal contributions. By turning to a detailed survey of the origin of the debate and to some developments in the philosophy of causation, we will contend that this view is unwarranted, and that much of the debate around interactionism is based on the drawing of this conclusion. We also examine implications of this analysis for the project to develop a framework based on the notion of inter-identities. (shrink)

The Hooks et al. review of microbiota-gut-brain literature provides a constructive criticism of the general approaches encompassing MGB research. This commentary extends their review by: highlighting capabilities of advanced systems-biology “-omics” techniques for microbiome research and recommending that combining these high-resolution techniques with intervention-based experimental design may be the path forward for future MGB research.

Las posibilidades que ofrece el desarrollo de la inteligencia artificial y el manejo de macro datos son ingentes. Sus aplicaciones se extienden también al ámbito sanitario en el que resulta difícil separar la práctica médica y el proceso creciente de digitalización. Sin embargo, no todo es luz en este nuevo universo algorítmico. Existe también otro lado apenas perceptible, más opaco, pero impregnado de brumas provenientes de los intereses y expectativas económicos de las grandes empresas multinacionales. De ahí la necesidad de (...) incidir en la protección de los datos personales sanitarios, así como en la salvaguarda de la privacidad del paciente; teniendo presente que la defensa de los derechos fundamentales constituye un instrumento inequívoco de limitación del poder, en este caso, tecnocientífico. Introducción: El consentimiento informado es un procedimiento que brinda oportunidad a los pacientes de disponer de información y participar en la toma de decisiones médicas. Sin embargo, existe el criterio de que el nivel de entendimiento de la información aportada por los facultativos al paciente, sus familiares o ambos, es bajo y además, muchos médicos lo consideran como una herramienta de trabajo secundaria o que no es necesario realizarla con inmediatez. Objetivo: Evaluar la percepción y experiencia del personal sanitario de (...) la unidad de terapia polivalente del Hospital Docente Clínico Quirúrgico "Joaquín Albarrán" acerca del consentimiento informado. Método: Estudio descriptivo realizado en la unidad de terapia polivalente del Hospital "Joaquín Albarrán" de enero a marzo del 2013. Se aplicó una encuesta a 67 trabajadores que accedieron voluntariamente a responderla. Resultados: El 60 % de los encuestados tenía menos de dos años de trabajo en la unidad y solo el 45 %, conocimientos básicos de ética médica. Únicamente el 50 % de los interrogados consideró que este procedimiento puede mejorar la relación médico-paciente. Conclusiones: Es necesario incrementar el conocimiento sobre la utilidad del consentimiento informado entre los trabajadores de la unidad para aprovechar al máximo sus beneficios. Introduction: Informed consent is a procedure that offers full opportunity for patients to have access to information and participate in medical decision-makings. However, it is believed that the information given by the doctors are not fully understood by the patients, their families or both, and besides that many doctors consider it as a second tool or something that doesn't have to be done right away. Objective: Evaluate the perception and experience of the health staff of the polyvalent unit of the surgical clinical teaching hospital Joaquin Albarrán about informed consent. Method: Descriptive study carried out in the polyvalent unit of Joaquin Albarrán Hospital from January to march 2013. A survey was given to 67 workers who voluntarily agreed to answer it. Results: The 60% of the participants had been working in the unit for less than 2 years and only 45% of them had basic knowledge of medical ethics. Only 50% of the participants considered that this procedure could help to improve doctor-patient relationship. Conclusions: It is necessary to increase the knowledge of the usefulness of the informed consent among the workers of the unit to have full profit from it. (shrink)

En este artículo se analiza la interpretación geopolítica y analógica que Enrique Dussel realizó de los conceptos levinasianos de “Alteridad” y “Otro” para mostrar su equivocidad en el ámbito de lo político.

The ethic of care has often been opposed to the ethic of justice as offering a different and even a contradictory approach to moral problems. This article argues that, from the perspective of the discourse ethic, both approaches are complementary in a very fundamental sense, since each one applies to one of two stages of moral reasoning that are as different as they are interconnected. It argues, in particular, that while justice is concerned with the justification and elaboration of norms, (...) care is concerned with finding a solution for specific moral situations. The article then places considerations of care at the centre of ideal discourse and subordinates the importance of rational understanding and moral justification to intuitive communication. (shrink)

El jesuita Francisco Suárez como eminente teólogo, filósofo y jurista de su época juega un papel relevante como precedente en la construcción de las categorías del pensamiento moderno. Una de estas categorías, no contemporánea del doctor eximio, es la de los derechos humanos. Son muchos los autores que anticipan alguno de sus elementos fundamentales ya en el pensamiento en torno al Derecho que desarrolla Francisco Suárez en sus principales tratados de filosofía jurídica y política como el De Legibus y la (...) Defensio fidei. En este trabajo trataremos de conectar la virtualidad del planteamiento suarista en el ámbito de los derechos humanos, explorando en su obra estos antecedentes y la dirección en la que los mismos se dirigen, así como las posibilidades de dialogo que abre en torno a la construcción de la concepción de los derechos humanos en el contexto actual. Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. La perspectiva evolutiva de Michael Ruse sobre la moral se caracteriza por combinar dos aspectos aparentemente contradictorios: por un lado, un escepticismo metaético y, por otro lado, una defensa de la ética normativa. Siguiendo la distinción de Daniel Dennett entre explicaciones con ‘ganchos celestiales’, que apelan a entidades sobrenaturales, y con ‘grúas’, que se adecúan a la teoría de la evolución por selección natural, la propuesta de Ruse busca llevar la comprensión de la ética y de la metaética en clave (...) de ‘grúa’ hasta sus últimas consecuencias. Ahora bien, la propuesta ruseana parece llegar a una aporía. Esto porque si bien en su propuesta se plantea una defensa de la ética normativa, Ruse le adjudica un rol destacado a las ‘disposiciones mentales innatas’ (vinculadas con piezas de psicología como las intuiciones o emociones morales), quedando todavía, aparentemente, un cabo suelto de su filosofía: cómo capturar, sin diluir, o sin reducir al mínimo, la normatividad de dicha ética (que el autor llama a veces ‘sustantiva’ en contraste con la metaética). En este artículo nos proponemos conservar la comprensión de la moral en clave de ‘grúa’ propuesta por Ruse pero, al mismo tiempo, recuperar una noción de razonamiento moral con mayor injerencia en la normatividad ética. Para ello, recurriremos al concepto de ‘metacognición’ que, una vez definido, nos permitirá poner en evidencia de qué manera el conocimiento de los procesos y productos cognitivos propios puede jugar un papel en el razonamiento moral destinado a inhibir disposiciones tendencialmente egoístas.
