Discretion in the Automated Administrative State.Sancho McCann - 2023 - Canadian Journal of Law and Jurisprudence 36 (1):171-194.
Automated decision-making takes up an increasingly significant place in the administrative state. This article presents a conception of discretion that is helpful for evaluating the proper place of algorithms in public decision-making. I argue that the algorithm itself is not a site of discretion. The threat is that automated decision-making alters the relationships between traditional actors in a way that can cut down discretion and human commitment. Algorithmic decision-makers can serve to fetter the discretion that the legislature and the populace (...)

Folk theories of algorithmic recommendations on Spotify: Enacting data assemblages in the global South.Mónica Sancho, Ricardo Solís, Andrés Segura-Castillo & Ignacio Siles - 2020 - Big Data and Society 7 (1).
This paper examines folk theories of algorithmic recommendations on Spotify in order to make visible the cultural specificities of data assemblages in the global South. The study was conducted in Costa Rica and draws on triangulated data from 30 interviews, 4 focus groups with 22 users, and the study of “rich pictures” made by individuals to graphically represent their understanding of algorithmic recommendations. We found two main folk theories: one that personifies Spotify and another one that envisions it as a (...)

Animal breeding in the age of biotechnology: the investigative pathway behind the cloning of Dolly the sheep.Miguel García-Sancho - 2015 - History and Philosophy of the Life Sciences 37 (3):282-304.
This paper addresses the 1996 cloning of Dolly the sheep, locating it within a long-standing tradition of animal breeding research in Edinburgh. Far from being an end in itself, the cell-nuclear transfer experiment from which Dolly was born should be seen as a step in an investigative pathway that sought the production of medically relevant transgenic animals. By historicising Dolly, I illustrate how the birth of this sheep captures a dramatic redefinition of the life sciences, when in the 1970s and (...)

    Popper's Experiment Revisited.Sancho Pedro - 2002 - Foundations of Physics 32 (5):789-805.
Recently, there has been increasing theoretical and experimental interest in Popper's gedanken experiment. We calculate in this paper, using the path integral approach, the diffraction patterns predicted by quantum mechanics for this arrangement. The calculations confirm the narrowing of the width of the pattern in absence of the slit obtained experimentally by Kim and Shih (Y. Kim and Y. Shih, Found. Phys. 29, 1849 (1999)).

Ratiovitalistic hermeneutics and sport in the perspective of Ortega y Gasset.Jesús Conill Sancho - 2016 - Sport, Ethics and Philosophy 10 (4):416-429.
This work aims to show, in the first place, that the ratiovitalism of Jose Ortega y Gasset is one of the possible lines of the hermeneutic transformation process of contemporary thinking. Nietzsche’s hermeneutical mark on the development of Ortega’s thinking is clear in some very relevant aspects, such as the importance of the body and the innovative notion of life, both of which are decisive issues to understand sport. Secondly, an attempt is made to tap into the rich reflections of (...)

A New Insight into Sanger’s Development of Sequencing: From Proteins to DNA, 1943–1977.Miguel García-Sancho - 2010 - Journal of the History of Biology 43 (2):265-323.
Fred Sanger, the inventor of the first protein, RNA and DNA sequencing methods, has traditionally been seen as a technical scientist, engaged in laboratory bench work and not interested at all in intellectual debates in biology. In his autobiography and commentaries by fellow researchers, he is portrayed as having a trajectory exclusively dependent on technological progress. The scarce historical scholarship on Sanger partially challenges these accounts by highlighting the importance of professional contacts, institutional and disciplinary moves in his career, spanning (...)

Virtue ethics has often been regarded as complementary or laissez-faire ethics in solving business problems. This paper seeks conceptual and methodological improvements by developing a virtue character scale that will enable assessment of the link between organizational level virtue and organizational performance, financial or non-financial. Based upon three theoretical assumptions, multiple studies were conducted; the content analysis of 158 Fortune Global 500 firms ethical values and a survey of 2548 customers and employees. Six dimensions of organizational virtue (Integrity, Empathy, Warmth, (...)

On 26 June 2000, during the presentation of the Human Genome Project's first draft, Bill Clinton, then President of the United States, claimed that "today we are learning the language in which God created life".1 Behind his remarks lay a story of more than half a century involving the understanding of DNA as information. This paper analyses that story, discussing the origins of the informational view of our genes during the early 1950s, how such a view affected the research on (...)

While the concept of adaptive preferences is an important tool for criticizing injustice, it is often claimed that using the concept involves showing disrespect for persons judged to have adaptive preferences. In this paper, I propose an account of adaptive preferences that does the relevant political work while still showing persons two centrally important kinds of respect. My account is based in what I call an indirect substantive account of autonomy, which places substantive requirements on the options available to a (...)

    Kant’s Philosophy of Language of Philosophy: On Philosophical Terminology.Eric Sancho-Adamson - 2023 - Kant Yearbook 15 (1):153-173.
Among the passages which are suggestive of a philosophy of language in Kant’s writings are his remarks and arguments on appropriate terminology for philosophical concepts. I ask what it is for Kant that makes some words more suitable than others. I reconstruct the arguments from the Inquiry concerning the distinctness of the principles of natural theology and morality (1764) and the Critique of Pure Reason (1781/1787) that defend that there is no such thing as a proper, real definition for philosophical (...)

Considering the "current" as a living, effective and revitalizing presence, and the "tradition" as that which we historically remains, this article studies the presence of scholastic thought in contemporary philosophy, through the work of Ortega, Zubiri and Habermas. In this sense, from the admiration and esteem for the scholastic tradition, but far from identifying himself with it, José Ortega y Gasset pays special attention to the doctrine of transcendentals, and to the concepts of evidence, conscience and, very especially, actuality. Xavier (...)

The design is organized in four sections divided by twisted ribbons. The free spaces in the design are filled with eight-pointed stars. How do engineers respond to ethical dilemmas that occur in practice? How do they view their individual and collective responsibilities? How do they make decisions before all the facts are in? Using the space shuttle programme as the framework, this book examines the role of ethical decision making in the practice of engineering. In particular, the book considers the design and development of the main engines of the space shuttle as a paradigm for how individual engineers perceive, articulate, and resolve (...)

  33. Must Adaptive Preferences Be Prudentially Bad for Us.Rosa Terlazzo - 2017 - Journal of the American Philosophical Association 3 (4):412-429.
In this paper, I argue for the counter-intuitive conclusion that the same adaptive preference can be both prudentially good and prudentially bad for its holder: that is, it can be prudentially objectionable from one temporal perspective, but prudentially unobjectionable from another. Given the possibility of transformative experiences, there is an important sense in which even worrisome adaptive preferences can be prudentially good for us. That is, if transformative experiences lead us to develop adaptive preferences, then their objects can become prudentially (...)

It presents a content analysis of the 122 codes of conduct statements from Fortune Global 500 firms, drawn from four sectors and using correspondence analysis. American firms tend to emphasize courage, while European firms emphasize integrity and empathy, surprisingly with Asian firms being closer to European ones. Retailers and pharmaceutical firms emphasize empathy, while banks and petroleum emphasize courage. (...)

The significance of critical phenomenology for psychiatric praxis has yet to be expounded. In this paper, I argue that the adoption of a critical phenomenological stance can remedy localised instances of hermeneutical injustice, which may arise in the encounter between clinicians and patients with psychosis. In this context, what is communicated is often deemed to lack meaning or to be difficult to understand. While a degree of un-shareability is inherent to subjective life, I argue that issues of unintelligibility can be (...)

The brain is often taken to be a paradigmatic example of a signaling system with semantic and representational properties, in which neurons are senders and receivers of information carried in action potentials. A closer look at this picture shows that it is not as appealing as it might initially seem in explaining the function of the brain. Working from several sender-receiver models within the teleosemantic framework, I will first argue that two requirements must be met for a system to support (...)

In this article, I first propose four guidelines that follow from understanding the project of assigning victims duties to resist oppression as an ameliorative project. That is, if we understand the project to be motivated by the urgent aim of ending or mitigating the harm that oppression imposes on the oppressed, I argue that we should focus on developing and assigning duties that satisfy what I call the ability, weighting, fairness, and overdemandingness guidelines. Second, I develop the duty to be (...)

Are there representations in the brain? It depends on what you mean by representations, and it depends on what you want them to do for you—both in terms of the causal role they play in the system, and in terms of their explanatory value. But ideally, we would like an account of representation that allows us to assign a representational role and content to the appropriate mechanistic precursors of behavior that in fact play that role and conversely, search for the (...)

Philosophical proponents of predictive processing cast the novelty of predictive models of perception in terms of differences in the functional role and information content of neural signals. However, they fail to provide constraints on how the crucial semantic mapping from signals to their informational contents is determined. Beyond a novel interpretative gloss on neural signals, they have little new to say about the causal structure of the system, or even what statistical information is carried by the signals. That means that (...)
