THE HUME LITERATURE FOR 1981 The Hume literature from 1925 to 1976 has been thoroughly covered in my book Fifty Years of Hume Scholarship : A Bibliographical Guide (Edinburgh University Press, 1978; jê9.50), which also lists the main earlier writings on Hume. Publications of the years 1977 to 1980 were listed in Hume Studies for the last four Novembers. What follows here will bring the record up to (...) the end of 1981. Students preparing to function within the engineering profession need to be introduced to the basic issues in engineering ethics. The notion of a defendant submitting a false guilty plea due to the penal incentive offered is not an uncommon phenomenon. While the practice has been legitimised based on the defendant’s voluntary informed consent, it has often been argued that the structure of the plea-bargaining practice is coercive. Such can be the case whenever the plea offer entails a significant sentence differential, discrepancy in the form of punishment (a non-custodial sentence relative to a custodial one), or when the alternative of (...) pleading guilty includes the risk of capital punishment. Having said that, plea-bargains have often been classified as a “non-coercive offer”, whether due to their advantageous mutual character according to a baseline conception of coercion or being an offer that one can overcome according to an irresistible psychological account. While many scholars have struggled with the ambiguous notion of “coercive offers,” the paper offers an alternative approach, arguing that it is the type of reasons to be considered within the offer that renders the bargain less than fully autonomous. It will be argued that the plea-bargain proposition infuses irrelevant (guilt-uncorrelated) penal considerations unrelated to the question of guilt. Such considerations are the wrong kind of reason for the guilty-plea decision, and due to the defendant’s dependency on the plea offer, they distort the defendant’s intentional character of her autonomous decision. It is part of the conception of the guilty plea. Though a defendant may autonomously intend to consider irrelevant penal considerations, such a decision cannot be genuinely considered a decision regarding the admission of guilt. (shrink)

Recent scholarship suggests that Descartes’s effort to establish a truth criterion is not viciously circular (notwithstanding its reputation)---a fact that invites closer scrutiny of his epistemological program. One of the least well understood features of the project is his deduction of a truth criterion from theistic premises, a demonstration Descartes says he provides in the Fourth Meditation: the alleged proof is not revealed by a casual reading, nor have commentators fared any better; in general, the relevance of the Fourth Meditation (...) has not been duly appreciated. This paper reconstructs the argument of the Fourth Meditation, detailing the steps in the demonstration of the criterion and clarifying its role in the larger program. Surprisingly, Descartes deduces a truth criterion more fundamental than clarity and distinctness; this more fundamental criterion helps explain what are otherwise cryptic (though central) epistemological moves in the Sixth Meditation. Assume this hypothetical situation: an American pharmaceutical company, Maxwell Fisch Pharmaceuticals, Inc., wishes to perform clinical trials involving a new antipsychotic medication, Klezac. Klezac is in its third phase of the clinical stage of the drug research process. Once the testing is complete, Maxwell plans to submit a New Drug Application, the official request to begin marketing Klezac, to the Food and Drug Administration. The new drug is expected to receive FDA approval in 2 or more years. The company decides (...) to shift its research and development activities to Z, a small, developing country. In doing so, Maxwell is following the course taken by numerous other drug companies who wish to take advantage of faster governmental approval in foreign sites and ensuing cheaper research costs. The experimental philosophy movement advocates the use of empirical methods in philosophy. The methods most often discussed and in fact employed in experimental philosophy are appropriated from the experimental paradigm in psychology. But there is a variety of other (at least partly) empirical methods from various disciplines that are and others that could be used in philosophy. The paper explores the application of corpus analysis to philosophical issues. Although the method is well established in linguistics, there are only a few (...) tentative attempts of philosophers to utilise it. Examples are introduced and the merit of corpus analysis is compared to that of using general internet search engines and questionnaires for similar purposes. (shrink)

The 2015 Disneyland outbreak of measles in the US unequivocally brought to light what had been brewing below the surface for a while: a slow but steady decline in vaccination rates resulting in a rising number of outbreaks. This can be traced back to an increasing public questioning of vaccines by an emerging anti-vaccination movement. This article argues that, in the face of diminishing vaccination rates, childhood vaccinations should not be seen as part of the domain of parental choice but, (...) instead, as a non-negotiable legal obligation. The first part of the article formulates and defends two arguments in favour of unqualified mandatory childhood vaccination laws. First, government should not permit parents to put their children at avoidable risk of death and suffering; second, government should guard the common good of herd immunity to protect vulnerable persons. The second part rejects legal and pragmatic objections against such mandatory vaccination laws. (shrink)

Contrary to received opinion among philosophers, psychologists, and neuroscientists, conscious duality as a principle of brain organization is neither incoherent nor demonstrably false. The present paper begins by reviewing the history of the theory and its anatomical basis and defending it against the claim that it rests upon an arbitrary decision as to what constitutes the biological substratum of mind or person.

Roland Reichenbach; On Irritation and Transformation: A–teleological Bildung and its Significance for the Democratic Form of Living, Journal of Philosophy of Ed.

Although postmodernist thought has become prominent in some educational circles, its influence on science education has until recently been rather minor. This paper examines the proposal of Michalinos Zembylas, published earlier in this journal, that Lyotardian postmodernism should be applied to science educational reform in order to achieve the much sought after positive transformation. As a preliminary to this examination several critical points are raised about Lyotard's philosophy of education and philosophy of science which serve to challenge and undermine Zembylas’ (...) project. Subsequently, the three main theses of Lyotard that Zembylas considers beneficial and wishes to transpose onto science classrooms and pedagogy are scrutinized and found to be more of a hindrance than a help to curriculum reformers. Among the more notorious of Cartesian doctrines is thebête machinedoctrine — the view that brute animals lack not only reason, but any form of consciousness. Recent English commentaries have served to obscure, rather than to clarify, the historical Descartes's views. Standard interpretations have it that insofar as Descartes intends to establish thebête machinedoctrine his arguments are palpably flawed. One camp of interpreters thus disputes that he even holds the doctrine. As I shall attempt to show, not only does Descartes affirm (...) the doctrine, his supporting arguments are not palpably flawed — even if they ultimately come up short. It will indeed emerge that, in making his case, Descartes employs interesting argumentative strategies that have not been duly appreciated. (shrink)

The employment application form is a major source of information about candidates for many companies. It is also a potential source of infringement by the company upon the privacy of the individual. Although September 1984 saw the passing into law of the Data Protection Act, the U.K. has not been in the forefront of civil rights where employees and personal information are concerned. During an extended interview with members of a personnel department of a major company, several issues relating to (...) privacy issues were revealed and these are discussed in the paper. Although these interviews were carried out before the new law came into effect, they do show that this and many similar organisations may experience problems over compliance. This is particularly likely in the computerisation of personnel records and employees' access to their personal information. (shrink)
