Proceduralists hold that democracy has a non-instrumental value consisting in the ideal of equality incorporated by fair procedures. Yet, proceduralism does not imply that every outcome of a democratic procedure is fair per se. In the non-ideal setting of constitutional democracies, government and legislative decisions may result from factional conflicts, or depend on majoritarian dictatorships. In these circumstances, Supreme Courts provide a guardianship against contested outcomes by enacting mechanisms of checks and balances, constitutional interpretation and judicial review. Yet, in virtue (...) of this role, Supreme Courts exercise a form of epistocratic power, which rests at odds with the ideal of political equality. We analyse this dilemma and propose a solution, arguing that Supreme Courts do not run unrestrained decisions; rather their decisional power is bound to the protective function of fundamental rights, in which their constitutional mandate ultimately consists. According to a leading view, emotions such as admiration, contempt, pride, and shame are important vehicles of agential development. Through admiration and contempt, we establish models and countermodels against which to shape our character; through pride and shame, we get a sense of how we measure up to them. Critics of this view object that these emotions always deliver uncompromising evaluations: admiration casts people in a completely positive light, while contempt casts aspersion on them. Therefore, insofar as they lack the (...) capacity for nuance, these emotions are systematically unfitting and misleading. This paper discusses this objection as originally formulated by John Doris as well as Macalester Bell’s response. Drawing from research on emotional intentionality, it will be argued that Doris’ and Bell’s accounts are respectively misguided criticisms and inadequate defences of these emotions. Their mistake lies in an invalid transition from the claim that these emotions are intentionally directed towards persons to the claim that they deliver global evaluations of those towards whom they are directed. By rejecting this inference, it will be shown that these emotions can deliver nuanced and fitting evaluations in a way Doris’ objection overlooks and Bell’s response precludes us from articulating. This book by Roberto Esposito - a leading Italian political philosopher - is a highly original exploration of the relationship between human bodies and societies. The original function of law, even before it was codified, was to preserve peaceful cohabitation between people who were exposed to the risk of destructive conflict. Just as the human body's immune system protects the organism from deadly incursions by viruses and other threats, law also ensures the survival of the community in a life-threatening (...) situation. It protects and prolongs life. But the function of law as a form of immunization points to a more disturbing consideration. Like the individual body, the collective body can be immunized from the perceived danger only by allowing a little of what threatens it to enter its protective boundaries. This means that in order to escape the clutches of death, life is forced to incorporate within itself the lethal principle. Starting from this reflection on the nature of immunization, Esposito offers a wide-ranging analysis of contemporary biopolitics. Never more than at present has the demand for immunization come to characterize all aspects of our existence. The more we feel at risk of being infiltrated and infected by foreign elements, the more the life of the individual and society closes off within its protective boundaries, forcing us to choose between a self-destructive outcome and a more radical alternative based on a new conception of community. Nijhawan argues convincingly that predictive mechanisms are pervasive in the central nervous system (CNS). However, scientific understanding of visual prediction requires one to formulate empirically testable neurophysiological models. The author's suggestions in this direction are to be evaluated on the basis of more realistic experimental methodologies and more plausible assumptions on the hierarchical character of the human visual cortex.

Many scholars have pursued philosophical inquiry through empirical research. These empirical projects have been shaped—to varying degrees and in different ways—by philosophical questions, traditions, frameworks and analytic approaches. This issue explores the methodological challenges and opportunities involved in these kinds of projects. In this essay, we briefly introduce the nine projects featured in this issue and then address two key questions: First, how do these diverse contributors understand their empirical research as a mode of philosophical inquiry? And, second, what is (...) the value in engaging in empirical research oneself, as opposed to drawing on the empirical work of others? As the essays in this issue demonstrate, there is no single answer to these questions. Our hope is that these guiding questions—and the diverse and divergent answers offered within this special issue—might demonstrate the live and pressing methodological questions involved in integrating empirical research and philosophical inquiry. Student-centered pedagogy has been embraced by many feminist practitioners and educational theorists as an antidote to more “traditional” or “masculinist” forms of classroom relations, epistemological constructs, and theories of self. I will show that the margin-center schema, student-centered pedagogy’s foundational metaphor, undermines feminist projects when applied to teacher-student relations. Although the margin-center schema has been a useful diagnostic tool in feminist theory, it operates prescriptively in student-centered pedagogy. Student-centered pedagogy designates teachers’ “proper place” at the margins of classroom life, a (...) place that echoes bygone visions of domestic femininity. This paper is simultaneously a critique of student-centered pedagogy and a recuperative project to dislodge the work of John Dewey from the teacher-centered/student-centered binary. (shrink)

ABSTRACT:This article examines the presuppositions and theoretical frameworks of the “new-wave” “Post-Westphalian” approach to international business ethics and compares it to the more philosophically oriented moral theory approach that has predominated in the field. I contrast one author’s Post-Westphalian political approach to the human rights responsibilities of transnational corporations (TNCs) with my own “Fair Share” theory of moral responsibility for human rights. I suggest how the debate about the meaning of corporate human rights “complicity” might be informed by the fair (...) share theory. While I point out that Post-Westphalians and moral philosophers may have fundamental disagreements about basic concepts such as legitimacy, justice, and democratic deliberation, I conclude that the Post-Westphalians have made a major contribution to the expansion of the field by presenting business ethicists with an opportunity to inform and guide debates about the potential future course of transnational governance. Inequality causes a variety of social ills, which give egalitarians reasons for concerns of justice. In particular, inequality is deemed to undermine people’s fundamental moral capacity of self-respect. In this paper, we explore the complex relationship between inequality and self-respect from a philosophical and an empirical angle, arguing that a theory of justice should take both into account. To this purpose, we first clarify the normative objection to inequality from the alleged erosion of self-respect. Then, we elaborate on empirical findings (...) showing the crucial role that ‘relative deprivation’ plays in the causal mechanism that connects inequalities to the erosion of self-respect. This paper is concerned with certain ontological issues in the foundations of geographic representation. It sets out what these basic issues are, describes the tools needed to deal with them, and draws some implications for a general theory of spatial representation. Our approach has ramifications in the domains of mereology, topology, and the theory of location, and the question of the interaction of these three domains within a unified spatial representation theory is addressed. In the final part we also consider (...) the idea of non-standard geographies, which may be associated with geography under a classical conception in the same sense in which non-standard logics are associated with classical logic. Whistleblowing is the act of disclosing information from a public or private organization in order to reveal cases of corruption that are of immediate or potential danger to the public. Blowing the whistle involves personal risk, especially when legal protection is absent, and charges of betrayal, which often come in the form of legal prosecution under treason laws. In this article we argue that whistleblowing is justified when disclosures are made with the proper intent and fulfill specific communicative constraints in (...) addressing issues of public interest. Three communicative constraints of informativeness, truthfulness and evidence are discussed in this regard. We develop a ‘harm test’ to assess the intent for disclosures, concluding that it is not sufficient for justification. Along with the proper intent, a successful act of whistleblowing should provide information that serves the public interest. Taking cognizance of the varied conceptions of public interest, we present an account of public interest that fits the framework of whistleblowing disclosures. In particular, we argue that whistleblowing is justified inter alia when the information it conveys is of a presumptive interest for a public insofar as it reveals an instance of injustice or violation of a civil or political right done against and unbeknown to some members of a polity. A wide family of many-valued logics—for instance, those based on the weak Kleene algebra—includes a non-classical truth-value that is ‘contaminating’ in the sense that whenever the value is assigned to a formula φ⁠, any complex formula in which φ appears is assigned that value as well. In such systems, the contaminating value enjoys a wide range of interpretations, suggesting scenarios in which more than one of these interpretations are called for. This calls for an evaluation of systems with multiple contaminating (...) values. In this paper, we consider the countably infinite family of multiple-conclusion consequence relations in which classical logic is enriched with one or more contaminating values whose behavior is determined by a linear ordering between them. We consider some motivations and applications for such systems and provide general characterizations for all consequence relations in this family. Finally, we provide sequent calculi for a pair of four-valued logics including two linearly ordered contaminating values before defining two-sided sequent calculi corresponding to each of the infinite family of many-valued logics studied in this paper. In this methodological reflection, I describe the multidisciplinary hermeneutic process of philosophizing about teacher dissatisfaction. I discuss how philosophy serves as a starting point for interpretive work based on interviews with former teachers and readings of qualitative and quantitative research on teacher attrition and dissatisfaction. The result has been a project that enabled me to offer new descriptions of phenomena and to develop concepts that can be used to interpret the moral dimensions of teacher dissatisfaction. The fact that I return (...) to language and concepts as my research outcomes is why, despite my multidisciplinary approach, I continue to describe my work as philosophical. I suggest that philosophical enquiry pursued through empirical research has the potential to inform larger empirical studies, serve as a “sensitizing instrument” for empirical analysis, and to open discursive spaces where common understandings limit interpretive possibilities. Quais os limites da contribuição da hermenêutica de Hans-Georg Gadamer aos estudos arqueológicos? Tal questão, aparentemente marginal e de somenos, pois suscitada pela sua aplicabilidade em outra área de conhecimento, toca, segundo nos parece, as esferas fundamentais da realização da linguisticidade (textualidade, escrita, oralidade, corporeidade e arte) e conduz a uma reflexão sobre o estatuto do vestígio (ou rastro), tema que parece mostrar certos entraves em sua proposta filosófica. Uma análise sobre a abordagem gadameriana de vestígio mostra que tal conceito (...) é submetido à ordem da textualidade, o que implica que a produtividade de sentido advinda da materialidade possua um caráter secundário. Em vista disso, o presente artigo aventa a hipótese de que a tese gadamariana sobre a linguisticidade não é imediatamente ajustável à arqueologia oriunda da cultura material e conclui sugerindo que o vestígio possui um caráter pré-reflexivo que ultrapassa os limites da textualidade. This article addresses some useful coordinates for the analysis of the relationship between philosophy and taxation. My argument aims to show the relevance of a philosophy of taxation and thus draw attention to civic education required to shape a democratic public reason, truthful, critical and attentive. I emphasize the character of “donation” that is the rule of law within a democratic constitutional regime, which depends on tax payments for the purposes proposed, and particularly those of a social distributive justice. I (...) distinguish between charity and justice and political obligation to maintain that by implementing an effective "rule of law" citizens “donate” ourselves mechanisms and procedures for advancing a system of justice as fairness. This grant does not pertain to the field of natural duties, charity or sacrifice of supererogatory acts, but is expressed in institutional programs whose implementation and maintenance required from us pay taxes, but always based on personal commitment. Thus, close to John Rawls I emphasize the value of freedom. (shrink)

A análise inicia com um exame da salvaguarda do ser a partir do Informe Natorp para, em seguida, apontar continuidades, quebras e reformulações em relação ao tratamento do tema da guarda em obras da década de 1930. Organisations are increasingly transforming themselves to remain profitable and obtain sustainable competitive advantages. Business processes are as important as technology in promoting organisational transformation. Organisational transformation ultimately entails combining existing business components, whether or not with the same use and design, with new ones to generate novel products and services. For example, one particular type of organisation transformation is digital transformation. This notion, which covers even the subjective aspects of organisational transformation, is currently under intensive discussion and suffers from the (...) semantics terms fluctuation related to the notion of ‘organisational transformation’. We argue that this topic could strongly benefit from an ontological analysis and conceptual clarification of these notions. This paper contributes with an attempt in this direction by proposing a Core Ontology of Organisational Transformation (COOT). This ontology comprises concepts and relations central to creating a reference model representing the organisational transformation paradigm. COOT was applied in a real-world case study on a car rental company. (shrink)

This study documents how people who inject drugs in rural Puerto Rico perceive payments for participating in HIV epidemiological studies. In-depth interviews were conducted among a subset of active PWID older than 18 years of age who had been previously enrolled in a much larger study. Findings suggest that financial compensation was the main motivation for initially enrolling in the parent study. Then, as trust in the researchers developed, participants came to perceive compensation as part of a reciprocal exchange in (...) which they assisted researchers by providing a trustful account of their experiences and researchers reciprocated with financial support. Não é pensando que criamos mundos. É compreendendo o mundo que aprendemos a pensar. Cosmovisão é um termo que deve significar um conjunto de fundamentos dos quais emerge uma compreensão sistêmica do Universo, seus componentes como a vida, o mundo em que vivemos, a natureza, o fenômeno humano e suas relações. Trata-se, portanto, de um campo da filosofia analítica alimentado pelas ciências, cujo objetivo é esse conhecimento agregado e epistemologicamente sustentável sobre tudo o que somos e contemos, que nos cerca (...) e que nos relaciona de alguma forma. É algo tão antigo quanto o pensamento humano e, além de utilizar elementos da cosmologia científica, engloba tudo na filosofia e na ciência que se refere ao universo e à vida. Uma cosmovisão não é um conjunto de ideias, hipóteses e suposições, mas um sistema baseado em observação, análise, evidência e demonstração. Nenhuma cosmovisão pretende definir, estabelecer, propor, mas apenas compreender, analisar e interpretar. Cada um de nós constrói e transporta sua cosmovisão ao longo da vida, sem estabelecer formas, como pano de fundo para nosso pensamento e comportamento. Linguisticamente, o termo “cosmovisão” derivaria do alemão, equivalente ao conceito de “ Weltanschauung”, usado por vários filósofos. No entanto, essa relação linguística não é aplicável porque contraria o que propomos como cosmovisão. Esta palavra alemã refere-se a uma visão pré-lógica ou proto-experimental da realidade, com um contexto intuitivo e longe de um conhecimento crítico ainda inexistente no momento da sua formulação. Sem dúvida, as cosmovisões , no sentido em que as entendemos, abrigam e utilizam esses elementos protoexperimentais ou pré-lógicos que incluem a história, o inconsciente coletivo e todos os arquétipos que carregamos. No entanto, no conceito que aqui aplicamos, a cosmovisão vai muito além desse conteúdo, primeiro por submetê-lo constantemente ao pensamento crítico presente e, finalmente, por tornar a experiência analítica (e não o próprio pensamento ou intuição) seu universo real. António Lopes expõe a amplitude deste conteúdo: -/- “Cosmovisões não são o produto do pensamento. Não nascem do simples desejo de saber. A apreensão da realidade é um momento importante em sua configuração, mas, no entanto, é apenas um. Vem da conduta vital, da experiência da vida, da estrutura de nossa totalidade psíquica. A elevação da vida à consciência no conhecimento da realidade, na valorização da vida e na realidade volitiva é o trabalho lento e árduo que a humanidade tem feito no desenvolvimento das concepções de vida. (W. Dilthey, 1992 [1911]: 120)” Neste trabalho, buscamos traçar uma cosmovisão baseada nas realidades que a ciência oferece hoje. Não nos propomos, em nenhum momento, a fazer ciência ou teorizar a filosofia, mas sempre buscaremos ser apoiados por elas ou, pelo menos, protegidos por elas das distorções cognitivas que costumamos carregar. Ce n'est pas en pensant que nous créons des mondes. C'est en comprenant le monde que nous apprenons à penser. La cosmovision est un terme qui devrait désigner un ensemble de fondements d'où émerge une compréhension systémique de l'Univers, de ses composantes comme la vie, le monde dans lequel nous vivons, la nature, le phénomène humain et leurs relations. C'est donc un champ de la philosophie analytique nourri par les sciences, dont l'objectif est cette connaissance agrégée et épistémologiquement soutenable de (...) tout ce que nous sommes et contenons, qui nous entoure, et qui nous concerne de quelques manières que ce soit. C'est quelque chose d'aussi vieux que la pensée humaine et, en plus d'utiliser des éléments de la cosmologie scientifique, il englobe tout ce qui, dans la philosophie et la science, se réfère à l'univers et à la vie. Une cosmovision n'est pas un ensemble d'idées, d'hypothèses et de suppositions, mais un système établi sur l'observation, l'analyse, la preuve et la démonstration. Aucune cosmovision n'entend définir, établir ou proposer, mais seulement comprendre, analyser et interpréter. Chacun de nous construit et transporte sa cosmovision tout au long de sa vie, sans établir de forme, comme toile de fond de nos pensées et de nos comportements. Linguistiquement, le terme « cosmovision » dériverait de l'allemand, équivalent au concept de « Weltanschauung », tel qu'il a été utilisé par plusieurs philosophes. Cependant, cette relation linguistique n'est pas applicable, car elle contredit ce que nous proposons comme cosmovision. Ce mot allemand fait référence à une vision prélogique ou proto-expérimentale de la réalité, avec un contexte intuitif et loin des connaissances critiques encore inexistantes au moment de sa formulation. Sans aucun doute, les cosmovisions, au sens où nous les entendons, abritent et utilisent ces éléments proto-expérimentaux ou prélogiques qui incluent l'histoire, l'inconscient collectif et tous les archétypes que nous portons. Or, dans le concept que nous appliquons ici, la cosmovision va bien au-delà de ce contenu, d'abord en le soumettant constamment à la pensée critique actuelle et enfin en faisant de l'expérience analytique (et non de la pensée elle-même ou de l'intuition) son univers réel. António Lopes expose l'étendue de ce contenu : [ ] « Les cosmovisions ne sont pas le produit de la pensée. Ils ne naissent pas du simple désir de savoir. L'appréhension de la réalité est un moment important dans sa configuration, mais, néanmoins, ce n'en est qu'un. Elle vient de la conduite vitale, de l'expérience de la vie, de la structure de notre totalité psychique. Sie ist so alt wie das menschliche Denken und umfasst neben der Verwendung von Elementen der wissenschaftlichen Kosmologie alles in Philosophie und Wissenschaft, was sich auf das Universum und das Leben bezieht. Eine Kosmovision ist keine Sammlung von Ideen, Hypothesen und Annahmen, sondern ein System, das auf Beobachtung, Analyse, Beweisen und Demonstrationen basiert. Keine Kosmovision will definieren, etablieren oder vorschlagen, sondern nur verstehen, analysieren und interpretieren. Jeder von uns baut und transportiert sein ganzes Leben lang seine Kosmovision, ohne Formen zu etablieren, als Hintergrund für unser Denken und Handeln. Космовидение — это не набор идей, гипотез и предположений, а система, основанная на наблюдениях, анализе, доказательствах и демонстрациях. Космовидение не ставит своей целью определить, установить или предложить, а лишь понять, проанализировать и интерпретировать. Каждый из нас строит и переносит свое космовидение в течение жизни, не устанавливая форм, как фон для нашего мышления и поведения. С лингвистической точки зрения термин "космовидение" происходит от немецкого, эквивалентного понятию "Weltanschauung", используемому рядом философов. Однако эта лингвистическая связь неприменима, поскольку противоречит тому, что мы предлагаем в качестве космовидения. Это немецкое слово обозначает дологическое или протоэкспериментальное видение реальности, имеющее интуитивный контекст и далекое от критического знания, еще не существовавшего на момент его формулировки. Несомненно, космовидения в том смысле, как мы их понимаем, содержат и используют эти протоэкспериментальные или дологические элементы, включающие историю, коллективное бессознательное и все архетипы, которые мы носим в себе. Однако в той концепции, которую мы здесь применяем, космовидение выходит далеко за пределы этого содержания, во-первых, постоянно подчиняя его современному критическому мышлению и, наконец, делая аналитический опыт (а не саму мысль или интуицию) своей актуальной вселенной. Антониу Лопес раскрывает широту этого содержания: -/- "Космовидения не являются продуктом мысли. Они не возникают из простого желания знать. Постижение реальности - важный момент в ее конфигурации, но, тем не менее, только один. Оно исходит из жизненного поведения, из жизненного опыта, из структуры нашей психической совокупности. Возвышение жизни до сознания в познании реальности, в оценке жизни и в волевой реальности — это медленная и тяжелая работа, которую проделало человечество в развитии представлений о жизни". (В. What is the relationship between persons and things? And how does the body transform this relationship? In this essay, Doris Santoro examines the discourse of “fidelity of instruction” to show how it is doublespeak for teacher compliance that is incompatible with democracy and education. Analyzing the distorted use of the term “fidelity” by market-based reformers, Santoro illustrates how it can be used as a weapon against teacher intelligence and moral response. She argues that John Dewey's philosophy provides conceptual resources to reframe some teacher infidelity as intelligent response, the moral agency required for pedagogical responsibility.
