Understanding the nusus and the interpretation of their texts has been at the center of the activities of many schools and ulama in fiqh studies, and as a result, each school of usool has sought to find a method suitable for their own understanding in order to understand and interpret the nusus in a sahih way. For this purpose, fiqh schools have developed some unique methods. It can be said that the main differences among the hukms that fiqh schools rely (...) on are generally due to these methodological differences. One of the efforts to understand and interpret through the linguistic structures and patterns of the nusus is tawīl. For this reason, it is necessary to know conceptions of tawīl in order to accurately determine the hukm giving methods of fiqh schools. In this context, the thought of Zâhiri Ṭawīl, which is based on the zâhiri meaning of the words in the language and aims to solve the meaning pattern of the nusus within the framework of the rules of the language, is important. To this end, the tawīl understanding of Ibn Hazm (d. 543/1148), one of the leading ulama of Zâhiri thought, has an important position in the determination of their understanding of fiqh and usool. For this purpose, by searching the works of Ibn Hazm, how his understanding of tawīl, which he used as a method, is reflected in his fiqh thought, will be examined through his fiqhi inferences. The Qur’an used their language when addressing the societies. The Qur'an especially, on the one hand, has used the language they use to convey its messages to its interlocutors in a correct and understandable way, on the other hand, it has used a unique style without departing from the natural structure of the language in unseen matters due to the nature of religious language. Therefore, it is necessary to take into account the words of the texts in order to understand and interpret the language used. The word tawīl was used by the ilm circles in the first period to mean the same as the word tafsir and in naming the works written as the Qur’an tafsir, the word tawīl was preferred instead of tafsir. Mâturîdî, the writer of the first dirayah tafsir, which points to the distinction between tafsir and tawīl, defines the word tafsir as 'to express exactly what is the meaning and purpose of the Qur'an, which is the divine word' and states that tafsir can be done only by the the Ṣaḥābah who knows Quran and Sunnah well. According to one of the many theses about the origin of language, it is God given. In other words, language has been taught to man by a supreme power (Allah). Ibn Hazm also defends this view. According to Ibn Hazm, the basic elements / elements of the language were taught by Allah to Adam (a.s), and then people developed this language in proportion to their needs. Therefore, the indications of the words depend on the declarations of God and linguistic experience. As a matter of fact, Allah has attributed new meanings to words such as salat, allegiance, hajj and similar words used for other meanings in the custom of language, and the new meanings attributed to them are accepted as the truth for the meanings of these words. Usûlists who adopted the method of fuqaha in usool, in the methods of istinbat of hukm out of sharii dalils, have generally made the taqseem of the words in terms of the meaning they were given to as âm, khâs, mushtarak and muavval while their taqsseem in terms of the words’ being used or not in the sense they were given was haqiqat, majaz, sarih and kinayah. Compared to other schools, the issue of tawīl has a different meaning according to the Zâhirî usûlists and faqih who base on the zâhiri khitab. Since the zâhir of the nusus is primary and essential, there should be a certain usool, principle and rule to give up the zâhir of the nusus and to switch to another possible meaning. Ibn Hazm states that there are different opinions among the usûlists about whether the imperative form is indicant of hukm. He also says that according to some Hanafi, Malikî and Shafii usûlists, as long as there is no evidence showing that it is wujub, tahrim, nedb, ibahâ and karahah, then the imperative form cannot be views as indicating a hukm. Research is an integral part of evidence-based practice in the emergency department and critical care unit that improves patient management. It is important to understand the need and major obstacles for conducting research in emergency settings. Herein, we review the literature for the obligations, ethics and major implications of emergency research and the associated limiting factors influencing research activities in critical care and emergency settings. We reviewed research engines such as PubMed, MEDLINE, and EMBASE for the last two decades using (...) the key words “emergency department”, “critical care”, “research”, “consent”, and “ethics” as the search terms. Research within emergency settings is slow or non-existent due to time and financial constraints as well as the lack of a research tradition. There are several barriers to conducting research studies in emergency situations such as who, what, when, and how to obtain patient consent. The emergency environment is highly pressurized, emotional, and overburdened. The time taken for research is a particular risk that could delay the desired immediate interventions. Ethical issues abound, particularly relating to informed consent. Research in emergency settings is still in its infancy. Thus, there is a strong need for extensive research in the emergency setting through community awareness, resource management, ethics, collaborations, capacity building, and the development of a research interest for the improvement of patient care and outcomes. We need to establish a well-structured plan to assess and track the decision-making capacity, consider a multistep enrolment and consent strategy, and develop an integrated approach for recruitment into studies. Bu makalede Giritli Sırrı Paşa’nın (1844-1895) Şerhu’l-Akāid Tercümesi analiz edilmektedir. Makalede öncelikle Sırrı Paşa’nın entelektüel arka planı ve diğer eserlerine değinilerek tercüme tarihsel bağlamına yerleştirmeye çalışıldı. Özellikle mütercimin kelâm tasavvurunu yansıtan mukaddime kısmına dikkat çekildi. Mâtürîdî kelâmına dair klasik bir metnin on dokuzuncu yüzyıl Osmanlı okuyucusu için Şerhu’l-Akāid’in diğer şerh ve haşiyelerindeki farklı yorumları içerecek şekilde tercümenin nasıl genişlediği gösterildi. Tercümede farklı görüşlerin bir araya toplanması, aynı mesele karşısında farklı yaklaşımların birbirleriyle karşılaştırılabilmesini sağlamaktadır. Sırrı Paşa sadece metni tercüme edip diğer (...) yorumları nakletmekle kalmamış, kendi yorumlarını da ortaya koymuştur. Bu nedenle bu tercümeyi “yorumlu tercüme” olarak adlandırmaktayız. Örnek olarak bu çalışma Mâtürîdî ve Eşʿarî ekolleri arasındaki temel ihtilaflardan biri olarak görülen irâde-i cüzʾiyye kavramı üzerine odaklanmaktadır. Sırrı Paşa ve faydalandığı kaynaklardan Cevdet Paşa bu meselede Mâtürîdî görüşü benimsemişlerdir. (shrink)

En un tiempo de profundas transformaciones, conflictos y resistencias, desde una aproximación filosófico-política, pondremos el foco en la emergencia de la Naturaleza como sujeto de derechos, de los pueblos indígenas y de las mujeres indígenas en los procesos de lucha, negociación y representación, como nuevos sujetos políticos en los distintos niveles de la esfera pública. Desde esta perspectiva, examinaremos la incorporación de la Naturaleza como sujeto de derechos en la Constitución de Ecuador en 2008 y las luchas y métodos del (...) Pueblo Originario Kichwa de Sarayaku (Ecuador), a nivel nacional e internacional, frente al extractivismo petrolífero, atendiendo al papel que desempeñan las mujeres, a su interpretación del Sumak Kawsay (Buen Vivir) y del Kawsak Sacha (Selva Viva), y a sus aportaciones para la resolución de los conflictos ecológicos y políticos. Además de dar a conocer y presentar Sarayaku como un caso ejemplar, se concluye afirmando que la irrupción de estos «nuevos sujetos» nos sitúan ante un nuevo y complejo escenario, interpelándonos desde el Sur Global. Bu çalışmada Çorlulu Ali Paşa ve Çorlulu Ali Paşa Külliyesi hakkında kısa bir bilgi verilerek Çorlulu Ali Paşa tarafından yaptırılan kütüphane, kütüphanenin tamiri, bu kütüphanede mevcut olan ilk kitapların isimleri ve hangi alanda oldukları ayrıntılı olarak açıklanmış ve 18. yüzyıl Osmanlı entelektüel dünyasında ne tür eserlerin okunduğuna dair ipuçları sununulmuştur. Çorlulu Ali Paşa tarafından Parmakkapı yakınında Simkeşhane’nin bulunduğu bölgeye 4 Muharrem 1121/16 Mart 1709 yılında inşası tamamlanan câmi‘-i şerîf, dârü’l-hadîs, hânkâh, imâret, kütüphane gibi bölümleri ihtiva eden bir külliye inşa edilmiştir (...) Çorlulu Ali Paşa Kütüphanesi farklı tarihlerde tamir edilmiştir. 1894’de meydana gelen büyük deprem neticesinde zarar görmesi nedeniyle tamirata ihtiyaç duyulmuştur 7 Cemaziyelevvel 1314/14 Ekim 1896 tarihli tezkire ile depremde hasara uğrayan medrese ve kütüphanenin tamir edilmesi belirtilmiştir. 1901 yılında ise tekrar kütüphanenin tamirine ihtiyaç duyulmuştur. Kütüphanenin kurulma tarihine yakın olması ve kütüphanedeki ilk kitaplar olabilmesi düşüncesiyle makalede temel alınan defter Başbakanlık Osmanlı Arşivi’nde, Başmuhasebe Muhalefat Halifeliği Kalemi Defterleri arasında yer almaktadır. Defter ebrulu, 15x39,5 ebadındadır ve sayfa usülüyle numaralandırılmıştır. Toplam sayfa sayısı 24, numaralı boş sayfalar 1-3, 17-24’dür. Defterde ilk kayıttan anlaşılacağı üzere 20 C 1136/16 Mart 1724 tarihinde Çorlulu Ali Paşa Kütüphanesi’nde bulunan kitapların listesi verilmiştir. Defterde kütüphanede yer alan kitaplar tefsir, hadis, fıkıh gibi alan başlıkları altında sıralanmış ve cilt sayıları verilmiştir. Bazı eserlerin yazarlarının yazılmasına karşılık bazı eserlerin yazarları verilmeyip sadece eser ismi belirtilmiştir. Bu makaledeki amaç 18. Yüzyılda Osmanlı kütüphanelerinin birinde ne tür kitapların bulunduğu ve Osmanlı aydın kesiminin hangi türden kitaplara yoğun ilgi duyduğunu anlayabilmektir. Eserin sonunda defterin transkripsiyonu verilmiş ve kütüphane içerisinde hangi türde eserin daha fazla olduğu, türü ve miktarı grafiklerle analiz edilmiştir. (shrink)

In this study, the classification of Zaydī fuqahā’ that emerged in the mutaaḫḫirūn period of Zaydī fiqh and related terms are examined. The book named Bulūgh al-arab wa-kunūz al-dhahab fī-maʿrifat al-madhhab, which has great importance among the studies aiming to present the Zaydī fiqh accumulation as a uniform doctrinal structure was taken as a basis in the processing of the subject. After an introduction in which Zaydī fiqh studies are evaluated in their relationship with the subject, the issue is handled (...) under three main headings. In the first title, the author and his work are introduced, and in the second and third titles, the methods and terms used in the classification of the Zaydī fukahâ are examined. The author of the work is ʿAlī b. ʿAbd Allāh al-Shaharī (d. 1190/1776) who lived during the period of the Qāsimī dynasty (al-dawla al-Qāsimiyya) in Yemen. The most important feature of the work, which was prepared using many sources that were attributed importance among the Zaydī literature, is that it was the most comprehensive of all that had written on madhhab doctrine until then. The first part of the work explains that the right madhhab to be followed is Zaydiyya. In the second part, the classes of the Zaydī fuqahā’, which is the subject of our study, are explained. The fuqahā’ classes are primarily divided into two parts: al-salaf al-ṣāliḥīn and al-ḫalaf al-ṣāliḥīn. The first dates back to the beginning of the 3rd/10th century. This class is divided into two parts, as al-sābiqūn and al-mutaaḫḫirūn. The sābiqūn starts with ʿAlī b. Abī Ṭālib, his two sons al-Ḥasan and Ḥusayn and ends with the sons of twelve imams who are their descendants. Zayd b. ʿAlī (d. 122/740) is one of the twelve imams. The most important of the faqīhs in the part of mutaaḫḫirūn, which started with al-Qāsim b. Ibrāhīm al-Rassī (d. 246/860), are the six imams called ahl-al-nuṣūṣ or aʾimma al-nuṣūṣ. The reason why they are named as such is that their words were taken as a basis in determining the views of the sect on the field of uṣūl and furūʿ l-fiqh. al-Qāsim al-Rassī is at a point where all the knowledge of the Prophet's family and the principles agreed upon by sābiqūn, reach him through many channels. al-Hādī Yaḥyā b. al-Ḥusayn (d. 298/911), grandson of al-Qāsim, is the most important imam in terms of his position in the madhhab. The ḫalaf al-ṣāliḥīn is also divided into two parts as ahl l-taḥṣīl and ahl l-naẓar. The first part also referred to as muḥaṣṣilūn or aʾimma al-taḥṣīl, has no subcategories. The second part is divided into two sub-sections as ahl l-taqrīr and mudhākirūn. The muḥaṣṣilūn class starts with those who catch up with the last class of ahl al-nuṣūṣ and ends with ʿAbd Allāh b. Ḥamza (d. 614/1217), one of the three important imams. Two other important imams of muḥaṣṣilūn are Aḥmad b. al-Huṣayn (d. 411/1020) and his brother Yahyā b. al-Husayn (d. 424/1032). It is the fiqh activity of the jurists of this class, called taḥṣīl l-madhhab, that brought Zaydī fiqh, which was fiqh of imams (madhāhib l-aʾimma) in its first period, into a single madhhab and to its classical form in the last period. Mudhākirūn jurists lived at the same time as the ahl-t-taqrīr. This period is about 700 years from the beginning of the 6th/12th century, which is the last century of the muḥaṣṣilūn class, to the end of the 12th/18th century, when Shaharī lived. The roles of the ahl al-taqrīr in the madhhab mostly consist of reviewing the works of the ahl-l tahṣīl, approving the correct ones, and correcting the wrong ones. That's why they are so named. The author of Kitāb l-Azhār, Aḥmad b. Yaḥyā l-Murtaḍā (d. 840/1437), is one of the prominent jurists among the ahl l-taqrīr. The majority of Zaydi fuqahā’ belong to the muẕākirūn class. These are the lowest class of the ahl-al-naẓar. As an important result reached in the study, it is possible to express the following: There is a difference between some of the knowledge and opinions in modern Zaydī studies, which include the same subject as Shaharī's work, in terms of the classification of Zaydī fuqahā’ and the terms used. Therefore, the findings and conclusions based on this work should be confirmed by new studies on other Zaydī classics, and existing opinions on Zaydī jurisprudence should be reviewed. (shrink)

There are a lot of studies on Ahmed Cevdet Paşa who has been considered as statesman, politician, jurist, historian, sociologist and educationalist. At the same time Ahmet Cevdet Paşa’s studies on logic are critically important when we deal with the last period of the Ottoman Empire. His book which is called Miyar-ı Sedad had both influenced the development of instruction of logic education in madrasahs and created a turning point in the studies on modern logic. For this reason (...) we have discussed his opinions about logic and science in this study and we have also tried to show that how his opinions on these issues affecected the instruction and the other fields.
