The authors identify several types of the new forms of protestmovement that are discusses within the problems of autonomy ofscientific system and the protection of the interests of scientists. They argue that the this type of communication shows how it is possible to combine both cognitive and normative attitude of science. The authors show the mechanisms of the reproduction of this communication and argue that it gradually turns into communicative macro system. The authors conclude that the protest movement in science (...) could be considered as a practical resolution of the Merton – Popper paradox, which presumes the incompatibility of both cognitive attitude (impartial observation) and normative dimension (value production) of science. The purpose of the study is to develop theoretical and organizational and methodological recommendations for improving state financial control. The article analyses the main performance indicators of the state financial control bodies, identifies the weaknesses of their activities, groups of problems and shortcomings of the current state financial control system. The scientific novelty consists in the development of a set of measures aimed at improving state financial control in the Russian Federation. Philosophy is an abstract theoretical discipline. However, a new trend that develops experimental methods in philosophical research has recently been gaining popularity extending to the fields of philosophical research that have not seen experimental methods earlier. This article addresses the question of whether it is possible to investigate philosophical questions with empirical methods. Two areas of research are considered – philosophy of language and semantics and epistemology. In these subfields of philosophy, the application of experimental methods has recently lead to (...) a noticeable progress. Empirical methods are justified in those disciplines in which arguments in favor of a particular theory are based on the study of our intuitions. Experiments only serve to obtain more objective representations of our intuitions, and philosophical argumentation is built further based on these intuitions. The authors argue that the use of experimental methods in semantics is compatible with anti-psychologism about meaning. The latter point is particularly controversial because linguistic intuitions or intuitions about the meaning have often been viewed as something that speakers have clear cognitive access to. However, when experimental research (even when it is a collection of controlled judgments) shows results that are different from what the field has been previously assuming, a revision is called for. The authors review several cases of such refutations calling for further revisions and argue that such experimental work helps arguments in philosophy of language and epistemology gain more sound ground with respect to the empirical data that they build on. In philosophy of language and theoretical linguistics, the cases explored in this article relate to the differences between languages with and without articles and to the predictions about the availability of certain interpretations of such expressions or lack thereof. It is further shown how a similar method of identifying the existent or non-existent interpretations was used in the studies of the meaning of “most”. In epistemology, the article discusses the results of some recent experimental work relating to the knowledge ascriptions. The speakers’ intuitions about the famous Barn-examples have recently been shown to diverge from what philosophers have claimed, building their far-reaching arguments on the data that was arguably incorrect. Taking the regime established by the Convention on Biological Diversity as a foundation, the purpose of this article is twofold. First, it examines how the international biodiversity regime integrates the private property paradigm into its toolbox for conservation and sustainability and then critically evaluates the shortcomings of the intellectual property mechanism. Second, it argues that the increasing ubiquity of open access emerging technologies should lead the international community to carefully assess the benefits for conservation research of reverting to a framework (...) that places biodiversity within the global commons. The impasse between global commons advocates and the intellectual property status quo obscures the underlying problematic of the “commodity fiction” of biodiversity and increasing use of digital sequence information likely exacerbates power asymmetries. One remedy explored here is an alternative to these two approaches that dislodges rather than discards the concept of private property. Drawing inspiration from Polanyi and building on May (2010), the article shows how a hybrid approach bridging a public and private conception of genetic resources and traditional knowledge could more effectively and equitably distribute benefits to countries and communities providing resources of value to industry. The availability of free health care to all citizens has been regarded as a great achievement of the Soviet society. In recent decades, however, decreased funding of the state-run health care system has led to a deterioration in the quality and quantity of available medical equipment and services. More than 50 percent of the Russian population is dissatisfied with the health care system and the attitudes and moral standards of their health care providers. Se realizó un estudio de intervencisn educativa, con el objetivo de determinar el nivel de conocimientos acerca del VIH/sida en estudiantes de la ESBU "Marcos Rammrez Rodrmguez" en el permodo comprendido desde el 1ro de marzo al 30 de mayo del 2010. Se estudiaron 150 adolescentes, escogidos de un universo de 347, a travis de un muestreo por conglomerado bietapico. Inicialmente se aplics una encuesta previamente sometida al mitodo de expertos (Delphi) y evaluada de muy adecuada, donde se determins que (...) el 82 % tenman conocimientos generales inadecuados Despuis de la intervencisn educativa -evaluada de muy adecuada por el mitodo de expertos- el 98,7 % de los adolescentes alcanzaron un nivel de conocimientos adecuados. El analisis estadmstico utilizando la prueba de McNemar, evidencis la asociacisn estadmsticamente significativa (p=0.0000) entre el nivel de conocimiento que tenman los estudiantes antes y despuis de la intervencisn, lo que demostrs que el modelo educativo-participativo empleado aumenta el nivel de conocimientos en los adolescentes. A study of educational intervention was carried out in order to determine the level of knowledge about HIV/AIDS in students of Marcos Rammrez Rodrmguez ESBU in the period from March 1th to May 30th 2010. 150 Teenagers, selected from a universe of 347, were studied through a conglomerate two sampling. Initially, a survey previously submitted to method of expert (Delphi) was applied and properly assessed. It was determined that 82 % had inadequate general knowledge. After the educational intervention - assessed fairly by the method of expert - 98, 7% of teenagers achieved an adequate level of knowledge. Statistical analysis using the McNemar test, showed a statistically significant association (p = 0.0000) between the level of knowledge that students had before and after the intervention, which demonstrated that the educational participative model used increases the level of knowledge among adolescents. The article is devoted to social problems of modern science (as it were interpreted Max Weber) considered in the context of the system-communicative approach by N. Luhmann. In contrast to the modern work of art, the modern science, as M. Weber believes, is associated with the fundamental unattainability of “true being”, and, as a result, with the transitory character of any scientific achievement. The specialty of modern science, as Weber noted, is determinated, on the one hand by its self-understanding, due (...) to the “peculiarity of the current moment”, and, on the other, by its transformation into a kind of blind spot of scientific observation. As a result, Weber formulated the main problem of the meaning of modern science: he wondered why any scientist needs a science under (1) external alienation and (2) inaccessibility of a scientific object? Moreover, the category of truth not just acquires its special value, but also sets a special meaning to the purpose of scientific communication, that becomes an object but not a property of scientific search. The main content of the article is the study of the Weberian concepts of the external (science as a profession) and internal (science as vocation) social factors of modern science as they were interpreted by E. von Kahler, G. Rickert, M. Scheller, K. Loewit. The authors discuss their attempts to modernize the fundamental Weberian distinction of truth/value as a principle of inclusion in the scientific community, that was formulated as a response to the “Weber’s challenge”. The authors argue that von Kahler criticized the Weberian concept for the incompatibility of the spatial and temporal discreteness of science within the “organic understanding” of the unity of the world. At the same time Scheler and Rickert payed special attention to the problem of subject specification of science. K. Levit discussed the possibility of Weber’s substitution of objectivity as a key distinction of modern knowledge with some opposite attribute. In the final part, the authors summarize the inconsistency of predictions about the further internal differentiation of scientific disciplines and the rejection of research motive for “genuine being”. L’article réunit les premiers résultats d’une enquête en cours sur l’histoire des femmes et du genre au Brésil. Il est basé sur des interviews réalisées auprès d’historien-ne-s ayant une production reconnue dans ce champ, et sur l’étude de leurs itinéraires. Les entretiens, d’abord oraux, se sont poursuivis par courrier électronique. Ces derniers échanges étant à mi-chemin entre le dialogue oral et l’échange épistolaire, duquel ils se différencient par leur rapidité et par leur caractère informel. Les onze historien-ne-s interrogé-e-s appartiennent à (...) trois générations : les pionnières (3), qui ont commencé leurs travaux et leurs enseignements pendant la décennie 1970 ; celles qui ont été formées par celles-ci ou par leurs contemporains (4), et les plus jeunes (4), qui témoignent de certains développements actuels de l’histoire des femmes et du genre au Brésil. The article critically examines the project of Brian Epstein's social ontology. The authors propose to interpret a social fact as derived from the appropriate perspective of an observer carrying out a structural reconstruction of a social phenomenon and identify difficulties in the way of analyzing social facts as structurally independent of causally determining factors. The article shows that the determination and foundation of social facts cannot be understood as asymmetric, substantiates the symmetrical nature of the relationship between the determinable complex (...) fact and the ontological foundations that determine them, and suggests that the judgments describing them are equivalent, and also proves the need to involve philosophical and scientific methodology, the resources of the philosophy of language and epistemology to address the issue of the validity of projects “ontological fixation”, which the authors of the article propose to consider as a scientific classification. Understanding the ontology of the social is possible only when going beyond its limits, and any classifications can be idiosyncrasies of individual classifiers or observers, scientifically unequal and requiring epistemological evaluation. The authors note that epistemology allows us to judge the necessity or, on the contrary, artificiality of classification, and the question of the ontological basis of a social fact should be solved by analogy. Accordingly, the search for such ontological foundations is not possible without prior resolution of the epistemological problem: which classifications (fixations) of “natural” or “social species” are structurally necessary (in the sense that their macro-properties properties stem from the internal structure), and which are arbitrarily constructed by the observer, based on his idiosyncrasy or local-historical, cultural or ideological position. This article is dedicated to the 30th anniversary of the publication of Niklas Luhmann’s book The Science of Society. The system-communicative approach to the analysis of science is reconstructed with a focus on the relation of science to its highly complex external world. The problem of complexity is posed as a key one and is considered in the context of the communicative “reduction of the complexity” of the external world, which science actualizes through its unique binary opposition (truth/falsehood distinction). The (...) complexity of the world that science is facing disintegrates into two large areas. On the one hand, science processes its own external world, i.e., nature, society, the human psyche, as its object and thus fulfills a unique function, the pursuance of research. Scientific communication in this case can be integrated in the form of transdisciplinary studies. On the other hand, science has to respond to the complexity of the internal (i.e., social) external world of the communicative system of science, namely, to interfaced communicative systems of the embracing system of world society (politics, economy, religion, education, law, etc.). In the latter case, science does not fulfill a function but delivers achievements on request to the above-mentioned communicative systems in exchange for resources for interdisciplinary studies, which are occasional and cannot serve for integrating scientific communication on a systematic basis. We will propose some corrections to this theory and apply it to the situation in Russian science. (shrink)

Este trabajo analiza los intentos llevados a cabo por Jeremy Bentham y John Stuart Mill para hacer converger algunos de los principales modelos de fundamentación moral: las éticas de la felicidad, como la aristotélica, o la propia ética utilitarista, las éticas del deber de raíz kantiana y las éticas de los derechos.Si conseguimos “reducir”, en primer lugar, las éticas de los derechos al modelo de la ética del deber, podremos simplificar mucho la cuestión y limitarnos a contrastar este (...) último modelo con las éticas de la felicidad, que a su vez deberían converger en la propia ética de la utilidad. No obstante, y aun reconociendo su gran interés, una convergencia completa entre modelos alternativos se revela como imposible. A pesar de los esfuerzos, sobre todo de John Stuart Mill, no es posible una unificación completa de los planteamientos utilitaristas con los de Aristóteles y Kant. La continuación de la empresa utilitarista de lucha por la unificación teórica en el ámbito del problema de la fundamentación moral encuentra un buen ejemplo actual en la obra de Esperanza Guisán. El texto analiza y sistematiza de un modo completo la doctrina quesustenta el deber de motivación de las sentencias judiciales en el Estadoconstitucional. Este deber se encuentra anclado al Estado de Derechoy a sus principios, valores y derechos recogidos por la Constitución,al sistema «político» de la Democracia y al sistema «jurídico» delEstado constitucional. El artículo presenta y discute, desde un armazón filosófico materialista y pluralista, nuevos conceptos de: moral, derecho, justicia, equidad, libertades, derechos jurídicos, derechos morales, deberes jurídicos y deberes morales. Se establecen una serie de relaciones relevantes entre dichas ideas a través de nociones filosóficas informadas científicamente. Luego, se construye una propuesta de justicia normativa como equidad con prescripciones morales simétricas basadas en las definiciones de las propiedades de dependencias y libertades sociales. Este trabajo titulado " El Deber de Adoptar y los Derechos de la niñez en Chile" será incluido en el Volumen 24. Número 86(2024) de Revista Iberoamericana en la sección Foro de Debate denominada “Infancias Latinoamericanas: desafíos para la garantía de derechos en la región".

Derechos y deberes, por lo general, han sido considerados como opuestos complementarios. Sin embargo, la crucial dimensión del cuidado, que se encuentra entre ambos conceptos no suele ser tan tomada en cuenta. Si recordamos que el cuidar está relacionado con lo moral, entenderemos que se trata de algo que nos enfrenta con aquello que consideramos que posee un valor. A partir de los planteamientos de Kant, si el deber (Sollen) es la realización de una acción por respeto (Achtung) a (...) la ley, entonces el cuidar debería estar políticamente centrado en el cuidado de dichas leyes que protegen el derecho (Recht) de todos, como forma de abrir una vía hacia una convivencia más consciente entre nosotros. La infracción al deber objetivo de cuidado (IDOC) es una figura introducida en Ecuador en el 2014 con el COIP, con 4 requisitos concurrentes. Para las actuaciones de los Anestesiólogos es necesario evaluar conjuntamente: la ley y reglamento de la especialidad, las normas mínimas de seguridad de la CLASA y los documentos sobre “cirugía segura” de la OMS. Investigamos en este artículo si existe relación entre estas últimas normas y los requisitos mencionados. El objetivo es encontrar la antes mencionada (...) relación y revisar su realidad procesal. Para ello realizamos análisis documental mediante lógica jurídica. Como resultado obtuvimos una correspondencia entre estas normas y los elementos de la IDOC, así como una ausencia de su consideración dentro de las sentencias evaluadas. Se concluye que, si bien son legalmente exigibles, estas normas no son siempre analizadas cuando se juzga una supuesta IDOC, por lo que es necesaria su incorporación al ámbito judicial. (shrink)

In a very short article, James Sterba argues that there is a moral duty to sacrifice one’s life to save the lives of others. Sterba justifies this duty by drawing an analogy with a series of cases in which some degree of sacrifice would be commonly accepted for the benefit of third parties. In this paper, I argue that Sterba’s argument reaches the correct conclusion, but is invalid. In addition, I point out two different arguments to support the existence of (...) a duty to sacrifice one’s life to save the lives of others. (shrink)

Ahora bien, el orden moral supone la existencia de un valor moral absoluto que no puede ser otro que el amor que Dios se tiene a sí mismo. La ética balmesiana es una ética del amor: la corrección moral de los actos humanos viene definida por su fidelidad al amor y el cumplimiento del deber. En este escrito quiero mostrar que la relación entre la memoria y el deber moral de recordar implica la intermediación necesaria del interés y el análisis de las consecuencias que de allí se siguen, para una concepción más incluyente y pragmática de las relaciones entre ética y moral. Comienzo señalando, mediante ejemplos, que sí hay exigencias morales relacionadas con el deber de recordar. Luego, entro a considerar la naturaleza de estas exigencias morales y su vinculación con lo que (...) entendemos como interés, para finalmente establecer una caracterización fluida y no excluyente de las interacciones entre ética y moralidad. El punto de partida de estas reflexiones son las lecciones sobre La ética del recuerdo (2002) de Avishai Margalit. El problema que Margalit se plantea es el siguiente: ¿Existe una ética de la memoria? ¿Bajo que circunstancias podemos afirmar que estamos obligados a recordar personas y acontecimientos del pasado? ¿De qué tipo de obligación estamos hablando aquí? ¿Quiénes están sujetos a la obligación: los individuos o los colectivos sociales? Un "cuadrado de oposición" al estilo escolástico puede servir para exhibir las relaciones lógicas entre tales nociones morales u "operadores" como debe y puede. El sistema puede construirse sobre la base de un solo operador y luego otros pueden agregarse para indicar una correspondencia con otras expresiones del lenguaje ordinario. (...) Este artículo discute el problema del ser y el deber ser a la luz de la relación entre lógica deóntica y lógica de normas. Los autores se centran primeramente en las soluciones no-cognoscitivistas de Weinberger y von Wright. Luego de refutar a ambas concepciones por considerarlas fallidas, defienden una concepción no-lingüística de las normas. Según esta última, normar es una especie de acto, norma es el producto de ese acto, y enunciado normativo es la expresión de una norma. | (...)
