A historical analysis of economic thought in Islamic tradition which interrogates contemporary Islamic economics as a hybrid system.

The paper explores the role and meaning of maṣlaḥa and its possible appropriation in the field of Islamic legal and economic thought, as laid down by various medieval and contemporary Muslim scholars. Questions that are pertinent to the research are the following: how has maṣlaḥa been incorporated in legal reasoning and what kind of meaning does it convey; what type of economic reading does it presuppose; do ethics, law, and scriptural sources play equally important role as reference in developing the (...) concept in economic terms, are some of the questions that this paper will try to provide answer to. Further, as there is a tendency to believe that Islamic economic thought cannot be equated only with legal and juridical underpinnings, it is pertinent to pose a question if economic ideas have flourished independently from its legal framework. Maṣlaḥa in its capacity has always remained part and parcel of Islamic legal theory, and has been rarely addressed within the frame of economic thought; therefore a new reading is required to deal with the position of economic teachings within Islamic tradition. The paper consists of three sections, whereby the contributions made by Muslim medieval scholars on Islamic economics will be presented. The first chapter provides a historical overview of Islamic law and the concept of maṣlaḥa in relation to the field of Islamic economics, including Abu Hamid al-Ghazali’s monumental Iḥya ‘ulūm al dīn, which presents a milestone in converging Sufi ethical teachings of Islam in accordance with the legal methodology of Islamic law. The second part aims to discern and examine the economic jurisprudence and economic theory in Islam as it is understood by some of the mainstream theoreticians of Islamic studies, advocating the view that Islamic economics is inextricably related to the gist of Islamic legal reasoning. In this section the ideas of Muhammad Baqr al-Sadr will be presented as he proposes a new reading of Islamic economics as a doctrine and not a science. The third part questions Islamic legal establishment and its normativity, the claim that legal norms have always been part of the Islamic economic reasoning. This claim rests upon the idea that Islamic legal patterns were also socially constructed, including some aspects of Islamic economic reasoning. Concluding remarks will draw upon the idea that despite the fact that Islamic legal and economic literature are based upon the religious scriptures of Islam, the Qur’an and Tradition, it is more appropriate to claim that they rest upon the ethical cosmology that surpasses purely theological concerns. This study aims to describe and compare nurses' willingness to provide care for patients with HIV/AIDS and factors associated with this in three countries. An international cross-sectional survey was conducted among nurses working in medical, surgical and gynaecology units in Finland (n =427), Estonia (n =221) and Lithuania ( n =185) in early 2006. The response rates were 75% (n = 322) in Finland, 54% (n =119) in Estonia and 86% (n = 160) in Lithuania. A modified version of a (...) scale developed in 1994 by Dubbert et al. was applied. Our findings showed a general willingness of the nurse participants to provide care for patients with HIV/AIDS. However, this willingness varied both among and within countries and was also related to specific nursing interventions. The results underline the importance of providing education on ethical issues related to HIV/AIDS care in Europe and tailoring the content of this education to meet nurses' national educational needs. Slavery is as old as human history and is a product of established cultures. To gain profit from captives resulted in slave trade and exploit them as labor force. Although ancient Turks took advantage of slaves, the conditions of Turkish nomadic steppe culture did not allow slavery become institutionalised. During Islamization of Turks, Turkistan witnessed one of the most successful periods of the slave trade because of raids against non-Muslim Turks by Samanids and Muslim Turks. Muslim travellers of X and (...) XI th century emphasize frequently the importance of the Turkish slave trade and its network. Turkish jawari (singular: jariya, an Arabic word, means concubine, female slave and housemaid) were the most demanded in Muslim countries in Turkestan and Near East due to their beauty, which the Muslim travelers mention quite frequently. Their beauty was reflected in epics like the stories of Dede Korkut and Shahnama as well. Turks used a few Turkish and Chinese origin words to mean jariya. Mahmud al-Kaşgari recorded the terms related to jariya in his book, Divan al-Lugat al-Turk. The meaning of some of these words have changed over time but the women referred to by these terms were generally housemaids in family life. All kind of jariya had opportunities such as marriage, being treated like a member of the family and being emancipated. My aim in this study is to address perception and interpretation of jariya and certain practices related to them in Turkish folk culture in the period of Islamization. (shrink)

A serious yet unstudied consequence of the Christian-Muslim conflict in medieval Spain was the capture and enslavement of soldiers and civilians. Men, women, and children who were seized on raids, taken in battle, or pirated off ships were regarded by their captors as booty, to be used as slaves or to be sold for profit. Since warfare in twelfth-century Spain pitted Christians against Muslims, the usual prohibitions against enslavement of coreligionists clearly did not apply. For Muslims and Christians alike, capture (...) meant a life of slavery. Christian chronicles of this era are replete with stories of captives taken off to be sold in the slave markets of al-Andalus in southern Spain or, even worse, in those of North Africa. Some of these slaves, however, were able to regain their freedom through redemption — that is, to purchase their liberty by paying a ransom. Since the ransom price frequently exceeded what could be gained in the slave auctions, redemption became an attractive option to both captor and captive. (shrink)

The Abrahamic tradition that the Arabs value most was ḥajj. The ḥajj, which means to visit Kaʿba was the greatest means of getting closer to Allāh. The Kaʿba was the house of Allāh. And the visitors of the Kaʿba were Allāh’s guests. For this reason, the Arabs used to great respect to the visitors and they never used to attack a man in the ḥarem (the area around the Kaʿba). The same respect included visitors’ travels to the Kaʿba. There were (...) two Abrahamic traditions that ensured the safety of visitors and sacrifices: Ḥaram months and qalāid. Ḥaram months were Dhū l-Qaʿdah, Dhū l-Ḥijjah, Muḥarram and Rajab. And the Arabs did not used to attack anyone in those months. For visits outside the ḥaram months, the visitors used to use the qalāid as a primitive visa. Qalāid is the plural of the word qilāda, meaning necklace. The Arab, who saw the qilādas, used to understand that the person who wore the qilāda wanted to go to the Kaʿba or had returned home from the Kaʿba. Qilādas used to be knitted from wool ropes and they used to be hung on animals’ neck or humps. Sometimes horseshoes used to hang on these qilādas. On the way back from Kaʿba, the barks of the ḥarem trees used to hang on the qilādas instead of the horseshoes. The Qurʾān orders Muslims not to disrespect the qilādas. This order also reveals that the Qurʾān recognizes the qilāda tradition. Allāh’s Apostle (sallallaahu ‘alayhi wa sallam) and Ṣaḥāba are also known to continue this tradition.Summary: Ḥajj was the most important worship of the Arabs in the pre-Islamic period. Human and commodity mobility in the ḥajj had an important place in the life of the Meccans who lived in land unfit for agriculture. This fact is expressed as follows in Abraham’s (Ibrāhīm al-Khalīl) prayer: “Our Lord! Lo! I have settled some of my posterity in an uncultivable valley near unto Thy holy House, our Lord! That they may establish proper worship; so incline some hearts of men that they may yearn toward them, and provide Thou them with fruits in order that they may be thankful.” (Ibrahim 14:37) The Arabs who lived in various parts of the Arabian Peninsula used to come to Mecca during the ḥajj season and present their sacrifices. They also used to buy their needs from nearby markets. These markets were also places where traders had the opportunity to sell their products.Because the Arabian Peninsula is unfavorable in terms of climate and soil, many Arab tribes used to raid and attack other tribes to sustain their existence. It is even known that some Arabs proud of their raids. The attacks only used to stop in the ḥaram months (Dhū l-Qaʿdah, Dhū l-Ḥijjah, Muḥarram and Rajab). Because of the prohibition of fighting in the ḥaram months, the visitors used to visit the Kaʿba with confidence. Thanks to this truce, the trade goods carried by visitors used to reach to Mecca with confidence.It was possible that the visits outside of the ḥaram months were safe. However, it was necessary to follow some traditions in order to achieve this confidence. Visitors to the Kaʿba used to use some signs that they were visitors to the Kaʿba. One of these signs was qilāda (necklace) hanging on the neck or hump of the animal. The person wearing qilāda was Allāh’s guest, and his sacrifice was the property of Allāh. For this reason, no Arab would to dare to attack these visitors and property. Because of the Arab reverence for the Kaʿba, visitors wearing qilādas used to come to the Kaʿba and present their sacrifices throughout the year. The sacrifices had an important place in the livelihood of the poor.Qilādas were mostly used for visits outside the ḥaram months. The qilādas used to hang on the necks of the animals shipped to the Kaʿba as sacrifice. However, it is also known that qilādas are sometimes hung on hump. People who did not deliver sacrifices (animals) to the Kaʿba used to hang the qilāda his neck to show that he was a visitor to the Kaʿba. Similarly, it is known that people who sacrificed their animals on the Kaʿba hang the qilāda their neck on the way back. The qilādas fitted on the way to the Kaʿba were made of ropes spun from wool or hair. Sometimes horseshoes used to hang on these qilādas. Ḥarem plants (grass, tree bark) used to use in the qilādas on the way back.The Qurʾān orders Muslims not to disrespect the qilādas. This order also reveals that the Qurʾān recognizes the qilāda tradition. The word qalāid is mentioned twice in the Qurʾān: “O ye who believe violate not the sanctity of the symbols of Allāh, nor of the sacred month, nor of the animals brought for sacrifice, nor the qalāid, nor the people resorting to the sacred house, seeking of the Bounty and good pleasure of their Lord.” (Al Māʼidah 5:2), “Allāh made the Kaʿba, the sacred house, an asylum of security of men as also the sacred months, the animals for offerings, and the qalāid.” (Al Māʼidah 5:97) Considering the practices of the qilāda, it is understood that qilādas are a kind of visa. It is understood that all practices related to the visit to the Kaʿba, especially the ḥajj, have an aim to satisfy the material-spiritual needs of those who come there for the purpose of visiting and trading, as well as those who reside in the Kaʿba. Therefore, it will not be far away to say that qilādas can be used today for the same purpose. For example, labels, banderols, visas and passports can be used instead of ropes, horseshoes and plants. On the other hand, the meaning of the āyāt (verse) in which the word qalāid is mentioned is not limited to the Arabs. The same āyāt declare that qilādas are a development (qiyām) instrument for people. Therefore, the qilāda has a meaning potential beyond the 7th century and the inhabitants of this century. (shrink)

If an asymmetry in time does not arise from the fundamental dynamical laws of physics, it may be found in special boundary conditions. The argument normally goes that since thermodynamic entropy in the past is lower than in the future according to the Second Law of Thermodynamics, then tracing this back to the time around the Big Bang means the universe must have started off in a state of very low thermodynamic entropy: the Thermodynamic Past Hypothesis. In this paper, we (...) consider another boundary condition that plays a similar role, but for the decoherent arrow of time, i.e. the quantum state of the universe is more mixed in the future than in the past. According to what we call the Entanglement Past Hypothesis, the initial quantum state of the universe had very low entanglement entropy. We clarify the content of the Entanglement Past Hypothesis, compare it with the Thermodynamic Past Hypothesis, and identify some challenges and open questions for future research. (shrink)

This study examines the frequency of consanguineous marriage and the coefficient of inbreeding in the United Arab Emirates. The study was conducted in Al Ain and Dubai cities between October 1994 and March 1995. A sample of 2033 married UAE females aged 15 years and over participated. The degree of consanguinity between each female and her spouse, and the degree of consanguinity between their parents were recorded. The rate of consanguinity in the present generation was high with a coefficient of (...) inbreeding of 0·0222. The commonest type of consanguineous marriage was between first cousins. Double first cousin marriages were common compared to other populations. The consanguinity rate in the UAE has increased from 39% to 50·5% in one generation. The level of consanguinity was higher in Al Ain than in Dubai. (shrink)

The research aims to identify the status of the application of electronic document management system in governmental institutions – the study was applied on the Palestinian Pension Agency. The population of this study is composed of all employees in the Palestinian Pension Agency. In order to achieve the objectives of the study, the researchers used the descriptive and analytical approach, through which try to describe the phenomenon of the subject of the study, analyze the data and the relationship between the (...) components and the views put around it. Census method was used due to the small size of the study population and ease of access to the target group. (108) questionnaires were distributed to all members of the study population, were (65) employees in the Gaza Strip and (43) employees in the West Bank. All questionnaires were recovered. The study found the following results: There were no statistically significant differences in the members of the population in response to differences in the study about the reality of the application of electronic document management system in governmental institutions - case study on the Palestinian Pension Authority due to the age. There are statistically significant differences in the study about the reality of the application of electronic document management system in governmental institutions - case study on the Palestinian Pension Authority due to Qualification variable for the benefit of members of the population study who are holding a Bachelor degree. There are statistically significant differences in the study about the reality of the application of electronic document management system in governmental institutions – case study on the Palestinian Pension Authority due to the variable number of years of experience for the benefit of members of the study population who have experience between 11-15 years. The study found a group of recommendations, including: the need to focus on the establishment of a general management of electronic documents in the organization structure that takes care of all the technical processes in it an contains scientifically qualified persons in the field of electronic document management. The need is for the attention in developing strategic plans, policies and mechanisms of action commensurate with the electronic document management system. (shrink)

Abstract - The aim of the study is to identify the degree of administrative transparency in the Palestinian higher educational institutions in the Gaza Strip. In the study, the researchers adopted a descriptive and analytical method. The research population consisted of administrative staff, whether academic or administrative, except for those in senior management or the university council. The study population reached 392 employees. A random sample was selected (197). The number of questionnaires recovered was (160) with a recovery rate of (...) (81.2%). The researchers used a questionnaire for the data collection and were treated using SPSS to obtain the results. The results show that there is no significant difference between male responses and female responses due to gender variable. The results also confirm that there is no significant difference between respondents' responses due to the age variable. The results also showed a significant difference between respondents' responses attributed to the university variable. There is a fundamental difference between respondents' responses attributed to the scientifically qualified variable. The results also confirmed a significant difference between respondents' responses attributed to the management level variable. The results also confirmed a significant difference between respondents' responses due to variable years of service. The research reached a number of recommendations, the most important of which is: The necessity of Palestinian universities to adhere to the application of transparency standards in all university activities. The need to benefit from regional and international experience in the application of transparency systems within universities and to examine the possibility of applying these systems in our universities. As well as the need to engage in the program of teaching transparency in universities, as it is confirmed that only five universities participated in this experiment. The importance of raising awareness among the employees of Palestinian universities to clarify the foundations of building transparency and its dimensions to represent the active supporter through workshops and seminars. The simple fact is every utterance has the potential to offend. The issue pursued in this paper is not whether a joke is ethically correct or ethically objectionable. Rather, the issue is, how is it possible that an utterly tasteless joke, a joke that many consider to be crude, rude, inappropriate, highly offensive and even harmful be considered to be funny? Even though I will argue that given the right context, the right audience, any joke can be considered funny, I (...) am not saying that they are acceptable, correct, or ethical. The issue here is an epistemic one and not normative. Depending upon who's telling the joke and the audience to whom it's told, ethnic and racial jokes can either prove to be delightful and delicious or dehumanizing and disgusting. Humanity is under siege with Covid-19. Whilst the crisis aggravates, the world is also grappling with yet another challenge - a global misinformation conundrum. This arises from the spread of contagious conspiracy theories that obfuscate understanding the pandemic at best. Incidentally, the conspiracy theories have gone as viral as Covid-19 itself, spreading just as swiftly digitally as the virus does physically. The outcome has been a spectrum of attitudinal patterns, ranging from cynicism and skepticism to outright denialism and fatalism. Using (...) a conversational analysis that is predicated on extant literature and personal insights, the paper examines the import of conspiracy theories as a major complication of the Covid- 19 challenge. The paper posits that the theories have produced narratives and attitudinal outcomes that not only misrepresent the pandemic but also complicate its mitigation. (shrink)
