There is a national movement supporting the retention and use of bio-specimens from deceased individuals for the purpose of genetic testing. This manuscript discusses the significance of postmortem genetic testing in the context of death determination by medical examiners. We highlight distinctive concerns that are raised in the areas of consent, confidentiality, and return of results when genetic testing is performed as part of a public molecular autopsy. We believe our manuscript will contribute to the development of a robust ethical (...) and legal framework for genetic testing in this context. (shrink)

In the late Middle Ages the philosopher and mystic Meister Eckhart preached that to know the truth you must be the truth. But how to be the truth? Eckhart's answer comes in the form of an imperative: release yourself, let be. Only then will you be able to understand that the deepest meaning of being is releasement. Only then will you become who you truly are. This book interprets Eckhart's Latin and Middle High German writings under the banner of an (...) imperative of releasement, and then shows how the twentieth-century thinker Martin Heidegger creatively appropriates this idea at several stages of his career. Heidegger had a lifelong fascination with Eckhart, referring to him as "the old master of letters and life." Drawing on archival material and Heidegger's marginalia in his personal copies of Eckhart's writings, Moore argues that Eckhart was one of the most important figures in Heidegger's philosophy. This book also contains previously unpublished documents by Heidegger on Eckhart, as well as the first English translation of Nishitani Keiji's essay "Nietzsche's Zarathustra and Meister Eckhart," which he initially gave as a presentation in one of Heidegger's classes in 1938. Abstract:This paper is a further development of two previous pieces of work (Moore 2002, 2005) in which modern virtue ethics, and in particular MacIntyre’s (1985) related notions of “practice” and “institution,” have been explored in the context of business. It first introduces and defines the concept of corporate character and seeks to establish why it is important. It then reviews MacIntyre’s virtues-practice-institution schema and the implications of this at the level of the institution in question—the corporation—and argues that the (...) concept of corporate character follows from, but is a novel development of, MacIntyre’s schema. The paper contrasts corporate character and virtues with the more familiar concepts of corporate culture and values. The constitutive and substantive elements of corporate character, including the essential corporate virtues, are then drawn out and illustrated with reference to the cases explored in Koehn (1998). Nonreductive physicalism states that actions have sufficient physical causes and distinct mental causes. Nonreductive physicalism has recently faced the exclusion problem, according to which the single sufficient physical cause excludes the mental causes from causal efficacy. Autonomists respond by stating that while mental-to-physical causation fails, mental-to-mental causation persists. Several recent philosophers establish this autonomy result via similar models of causation :1031–1049, 2016; Zhong, J Philos 111:341–360, 2014). In this paper I argue that both of these autonomist models fail on account (...) of the problem of Edwards’s Dictum. However, I appeal to foundational principles of action theory to resuscitate mental-to-mental causation in a manner that is consistent with the models of causation endorsed by these autonomists. Libertarian free will is, roughly, the view that agents cause actions to occur or not occur: Maddy’s decision to get a beer causes her to get up off her comfortable couch to get a beer, though she almost chose not to get up. Libertarian free will notoriously faces the luck objection, according to which agential states do not determine whether an action occurs or not, so it is beyond the control of the agent, hence lucky, whether an action occurs or (...) not: Maddy’s reasons for getting beer in equipoise with her reasons to remain in her comfortable seat do not determine that she will get up or stay seated, so it seems beyond her control, hence lucky, that she gets up. In this paper I consider a sub-set of the luck objection called the Physical Indeterminism Luck Objection, according to which indeterministic physical processes cause actions to occur or not, and agent’s lack control over these indeterministic physical processes, so agent’s lack control over, hence it is lucky, whether action occurs or not. After motivating the physical indeterminism luck objection, I consider responses from three recent event-causal libertarian models, and conclude that they fail to overcome the problem, though one promising avenue is opened up. It is sometimes argued that while human gestures are produced ostensively and intentionally, great ape gestures are produced only intentionally. If true, this would make the psychological mechanisms underlying the different species’ communication fundamentally different, and ascriptions of meaning to chimpanzee gestures would be inappropriate. While the existence of different underlying mechanisms cannot be ruled out, in fact claims about difference are driven less by empirical data than by contested assumptions about the nature of ostensive communication. On some accounts, there (...) are no reasons to doubt that great ape gestural communication is ostensive. Many appraisal theories claim that appraisal causes emotion. Critics have rejected this claim because they believe (a) it is incompatible with the claim that appraisal is a part of emotion, (b) it is not empirically supported, (c) it is circular and hence nonempirical, and (d) there are alternative causes. I reply that (a) the causal claim is incompatible with the part claim on some but not all interpretations of the causal claim and the part claim, (b) the lack of empirical (...) support can be remedied, (c) there may even be ways to cope with the circularity problem, and (d) it is unclear to what extent the alternative causes differ from appraisal. This book discusses American pragmatism as it is found in the writings of its three major advocates: Charles S. Peirce, William James, and John Dewey. This book discusses each man's definition of pragmatism and shows how each of them applied it to one basic concept: Peirce to a theory of reality; James to a notion of truth; and Dewey to the concept of God.

This study investigated the link between meditation, self-reported mindfulness and cognitive flexibility as well as other attentional functions. It compared a group of meditators experienced in mindfulness meditation with a meditation-naïve control group on measures of Stroop interference and the “d2-concentration and endurance test”. Overall the results suggest that attentional performance and cognitive flexibility are positively related to meditation practice and levels of mindfulness. Meditators performed significantly better than non-meditators on all measures of attention. Furthermore, self-reported mindfulness was higher in (...) meditators than non-meditators and correlations with all attention measures were of moderate to high strength. This pattern of results suggests that mindfulness is intimately linked to improvements of attentional functions and cognitive flexibility. The relevance of these findings for mental balance and well-being are discussed. (shrink)

The aim of Dimitris Vardoulakis’s paper, ‘Toward a Critique of the Ineffectual: Heidegger’s Reading of Aristotle and the Construction of an Action without Ends’, is to provide the foundation for a critique of aimless action by tracing its genesis to Heidegger’s putative misinterpretation of Aristotelian phronēsis (practical wisdom) in the 1920s. Inasmuch as ‘the ineffectual’—the name Vardoulakis gives to action devoid of ends—plays a crucial role in post-Heideggerian continental philosophy, he thereby seeks to diagnose and to provide an aetiology of (...) an illness afflicting contemporary thought. In my response, I will first argue that, while Vardoulakis is right to identify an emphasis on the ineffectual in Heidegger, he is mistaken about its origin. Heidegger does not strip phronēsis of instrumentality, nor does he mistranslate Nichomachean Ethics 1139a31–32. Second, I trace an alternative source for the ineffectual, which is not simply a negative alternative to technological machination but stems from a positive experience of what Meister Eckhart, and Heidegger in his wake, called life without why. Finally, I look at a couple of texts, including one discussed by Vardoulakis, in which even the later Heidegger is not entirely dismissive of calculative instrumentality but instead assigns the latter to a secondary, restricted site of competence. It is a long time since I have admired a book as much as I admire this one. It is a long time since I have disagreed with a book as profoundly as I disagree with this one. I hope this combination of reactions on my part has more than whatever limited biographical interest it has. I hope it helps to signal the combination of excellence and provocation that mark Timothy Williamson's book, which is at once beautifully clear, forcefully argued, (...) continually insightful, and, in my view, deeply wrong.One thing that I admire about the book is Williamson's preparedness to reflect philosophically on the nature of philosophy, something that is surprisingly rare in a discipline that is marked by such a high degree of self-consciousness and in which there are so few scruples about reflecting on the nature of other disciplines. One thing that gives me pause is Williamson's lack of serious engagement with the history of philosophy. 1 I am convinced that the philosophy of philosophy will always be seriously handicapped if it is as dissociated from the history of philosophy as this. But I shall not dwell on that concern here, because Williamson is clear enough about where his interests lie and I would be in danger, if I did, of succumbing to that familiar absurdity of berating an author for not having written a numerically different book.What I will say is that Williamson's failure to engage seriously with the history of philosophy seems to me indicative of a scientism about philosophy which, despite how much he does to motivate his conception of the discipline, is manifest in how much …. We take welfarism in moral theory to be the claim that the well-being of individuals matters and is the only consideration that fundamentally matters, from a moral point of view. We argue that criticisms of welfarism due to G.E. Moore, Donald Regan, Charles Taylor and Amartya Sen all fail. The final section of our paper is a critical survey of the problems which remain for welfarists in moral theory.

There is a difference between having reasons for believing and believing for reasons. This difference is often fleshed out via an epistemic basing relation, where an epistemic basing relation obtains between beliefs and the actual reasons for which those beliefs are held. The precise nature of the basing relation is subject to much controversy, and one such underdeveloped issue is whether beliefs can be based on brain processing. In this paper I answer in the negative, providing reasons that the basing (...) relation must be a specific psychological level relation between mental states, rather than being a brain process. This thesis focuses on expressively rich languages that can formalise talk about probability. These languages have sentences that say something about probabilities of probabilities, but also sentences that say something about the probability of themselves. For example: (π): “The probability of the sentence labelled π is not greater than 1/2.” Such sentences lead to philosophical and technical challenges; but can be useful. For example they bear a close connection to situations where ones confidence in something can affect whether it is (...) the case or not. The motivating interpretation of probability as an agent's degrees of belief will be focused on throughout the thesis. -/- This thesis aims to answer two questions relevant to such frameworks, which correspond to the two parts of the thesis: “How can one develop a formal semantics for this framework?” and “What rational constraints are there on an agent once such expressive frameworks are considered?”. Considerations of accuracy – the epistemic good of having credences close to truth-values – have led to the justification of a host of epistemic norms. These arguments rely on specific ways of measuring accuracy. In particular, the accuracy measure should be strictly proper. However, the main argument for strict propriety supports only weak propriety. But strict propriety follows from weak propriety given strict truth directedness and additivity. So no further argument is necessary.

In the modern world, provincialism in reflective thinking is dangerous, possibly tragic. If philosophy is to fulfill one of its main functions—that of guiding the leaders of mankind toward a better world—its perspective must become worldwide and comprehensive in fact as well as in theory. This, the motivating theme of the Second East-West Philosophers' Conference held at the University of Hawaii in the summer of 1949, is likewise the theme of this volume, the complete report of that Conference. The goal (...) of the eminent philosophers participating was the discovery of avenues of progress toward a synthesis of Oriental and Occidental thought. They attempted to reach tentative conclusions in the fields of methodology, metaphysics, and ethical theory. Conference activities consisted of meetings, lectures, discussions, undergraduate courses, and graduate seminars. As far as possible, the proceedings were limited to the study of East-West philosophy; extensive attention was not given to the strictly religious aspects of any philosophical tradition. Participants in the Conference were convinced that philosophy is now entering upon a new stage of development which will be characterized by trans-cultural cooperation and world perspective. This development can be of tremendous significance in world thought and eventually in the lives and actions of the people of the world. Twenty-three of the formal papers presented at the Conference comprise the substance of this book; a significant proposal for synthesis is stated or implied in almost every one. We present a semantics for a language that includes sentences that can talk about their own probabilities. This semantics applies a fixed point construction to possible world style structures. One feature of the construction is that some sentences only have their probability given as a range of values. We develop a corresponding axiomatic theory and show by a canonical model construction that it is complete in the presence of the ω-rule. By considering this semantics we argue that principles such as (...) introspection, which lead to paradoxical contradictions if naively formulated, should be expressed by using a truth predicate to do the job of quotation and disquotation and observe that in the case of introspection the principle is then consistent. This essay is concerned with Bernard Williams’ contention in Ethics and the Limits of Philosophy that, in ethics, reflection can destroy knowledge. I attempt to defend this contention from the charge of incoherence. I do this by taking seriously the idea that ethical knowledge is knowledge from an ethical point of view. There nevertheless remains an issue about whether the contention is consistent with ideas elsewhere in Williams’ own work, in particular with what he says about knowledge in Descartes. In (...) an earlier essay I argued that it is not. In a subsequent essay I indicated that I had changed my mind and gave a more sympathetic account of Williams’ contention. In a series of writings, James Sterba introduces several novel arguments from evil against the existence of God (Sterba, 2019; Sterba Sophia 59, 501–512, 2020; Sterba International Journal for Philosophy of Religion 87, 203–208, 2020b; Sterba International Journal for Philosophy of Religion 87, 223–228, 2020c; Sterba Religions 12, 536, 2021). According to one of these arguments, the problem of natural evil, God must necessarily prevent the horrendous evil consequences of natural evil such as diseases and hurricanes; however, these horrendous evil (...) consequences of natural evils still occur, so God does not exist. In this paper, I reply to Sterba’s argument from natural evil by introducing a naturalistic theodicy, and then demonstrating how it overcomes Sterba’s problem of natural evil. This paper is divided into five sections. First, I unpack Sterba’s problem of natural evil into three parts (Section 1), namely, Sterba’s moral obligation claim about humans, Sterba’s moral obligation claim about non-human life, and Sterba’s arguments from analogy. I then introduce a general naturalistic theodicy to the problem of natural evil (Section 2): naturalists grant that natural forces (entropy, evolutionary pressures, tectonic plate movements, etc.) cause horrendous consequences of natural evil, yet still consider human life in the universe a good better than humans are entitled to, so, if God made this naturalistic universe, God made human life in the universe a good better than humans are entitled to. I then use this naturalistic theodicy to reply to Sterba’s moral obligation claim about humans (Section 3), before bolstering the case by appeal to Sterba’s moral obligation claims about non-human life (Section 4).
